To~n Cle~ 6:00 PM A meeting of the Southold Town Conservation Advisory Council was held Tuesday, November 9, 2004 at Down's Farm Preserve. CHAIRMAN'S ANNOUNCEMENTS REPORTS APPROVAL OF MINUTES Moved by Don Wilder, seconded by Jack McGreevy, to Approve the Minutes of October 18, 2004. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of MARK GORDON to replace the existing deteriorated stairs and landings to beach with new stairs and landings. Located: 63165 County Rd. 48, Greenpor[. SCTM#40-1-14 The CAC recommends Approval of the application with the Condition the stairs and landings are replaced, in-kind. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of MARY DIGREGORIO to construct a 4'X 58' fixed timber dock, a 3'X 16' ramp, and 6'X 20' floating dock. Located: 100 Oak St., Cutchogue. SCTM#136-1-36 The CAC recommends Approval of the application with the Condition the catwalk is extended on the landward side, to grade level and to the masonry wall. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of MARK TESSER for the existing 5'X 22' fixed elevated catwalk, construct a fixed elevated catwalk extension 5'X 8', construct a fixed elevated walkway (including hinged ramp) 5'X 32', and construct a floating dock 6'X 20' secured by four (4) pilings. Located: 455 Lesters Rd., Mattituck. SCTM#114-7-1 The CAC recommends Approval of the application with the Condition that the docking facility and boat do not exceed 1/3 across the width of the creek, and no treated lumber is used. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to TABLE the Wetland Permit application of LI SOUND OYSTER, LLC C/0 TOM ANDERSON to expand an existing dock facility to be utilized for a commercial shell-fishing and aquaculture facility. The existing 4'X 130'+/- timber catwalk is proposed to be widened to 10' to accommodate a fork-lift or truck. The existing platform and 3'X 20' ramp are proposed to remain. (7) 6'X 20' floats are proposed and to be supported by (15) 8" dia. piles. The existing re-bar and garbage debris on the creek bottom is proposed to be removed and disposed of at an approved offsite location. On the north side of the property west of the existing house the applicant proposes to remove the remains of a dilapidated concrete wall, and proposes to remove existing wood landscape debris to an approved offsite location. A shed is proposed in the same location as the previous shed location, and proposed buffer area. South of the dock the buffer area is proposed to extend from the MHW to the concrete wall. North of the dock the buffer area is proposed to extend from the MHW to the back edge of the existing fence north to the property line. Located: 1240 Love Lane, Mattituck. SCTM#140-1-23.1 The CAC Tables the application because more information is needed in order to make a recommendation. The CAC questions the purpose of the proposed operations, and recommends all discharge pipes should be removed. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of LESLIE BARNEY & SEAN OLSEN to construct a fixed timber dock, consisting of a 4'X 12' inclined ramp; 4'X 18' fixed elevated catwalk; 3'X 14' hinged ramp; and 6'X 20' "T" - float, secured by (2) 6" dia. pilings. Located: 1075 Smith Drive North, Southold. SCTM#76-2-1 The CAC recommends Approval of the application with the Condition the beach area is re-planted with native species and that the docking facility and boat do not exceed more than 1/3 the width of the creek. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of PATRICE & JOHN KEITT to remove/replace (in-place) approx. 152 linear ft. of existing timber bulkhead with vinyl bulkhead; remove (2) existing timber retaining walls and construct (1) approx. 159 linear 4 ft. timber retaining wall; and backfill with approx. 125 cy. of clean sand fill to be trucked in from an upland source. Remove existing swimming pool, patio, decks, landings and stairs; and construct new swimming pool, terrace, deck, stone landscape wall, walks, landings, and stairs, including 4'X 15' platform/stairs to beach. Located: 280 Basin Rd., Southold. SCTM#81-1-19 The CAC recommends Approval of the application with the Condition the bluff is re- planted with native species and a 5' vegetated buffer is installed. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Nick Dickerson, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of RYCK KOKE to replace (within 18") approx. 185 linear ft. of existing timber bulkhead with vinyl bulkhead; install approx. 185 linear ft. of timber bulkhead on landward side of existing bulkhead; truck in approx. 40 cy. of clean sand fill from an upland source to be used as backfill. Remove and replace (in-kind) an existing 5'X 50' wood deck and 4'X 5' cantilevered platform (in same positions relative to new bulkhead). Located: 245 Kimberly Lane, Southold. SCTM#70-13-20.2 The CAC recommends Approval of the application with the Condition of a 20' non-turf buffer and no treated lumber is used on the bulkhead. Vote of Council: Ayes: All Motion Carried SANDRA SCHPOONT to reconstruct the existing beach access stairs; construct new 4'X 36' dock, 2.5'X 12' ramp, and 6'X 20' float to replace the former float and ramp. Located: 630 Ruch Lane, Southold. SCTM#52-2-26 APPLICATION WITHDRAWN Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of ALEX WlPF to construct a 10'X 38' extension to the existing dwelling and spread top soil on top of bank toward house, behind retaining wall. Located: 940 West Creek Ave., Cutchogue. SCTM#103-13-7 The CAC recommends Approval of the application with the Condition drywells are installed to contain the roof run-off and a retaining wall is maintained at the top of the bluff to stop run-off. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Nick Dickerson, it was RESOLVED to TABLE the Wetland Permit application of BARRY BALL & KIMBERLY VANZEE to remove debris, poison ivy, and invasive non-native species, and plant additional native species and groundcover, in the 50' wide buffer and along the driveway; repair the bride to island; renovate existing dock and boathouse; remove debris and poison ivy and invasive species from island at southern end of property and maintain by seeding with grass and mowing; re-gravel driveway south of house as needed; renovate the existing dock on the pond on the east side of the house, and trim the_phragmites along the western edge of the pond. Located: 525 Cedar Birch Lane, Orient. SCTM#15-8-26.8 The CAC Tables the application and recommends a detailed plan of all proposed activities. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of ELIZABETH LYONS to install a fence within 100' of the water constructed of 4"X 4" posts and I"X 6" boards. Located: 8680 Fifth St., New Suffolk. SCTM#117-10-12.2 The CAC recommends Approval of the application with the Condition the fence is extended to the top of the bluff only and all existing posts are removed from the beach. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of NANCY SUE MUELLER TRUST to add new steps and sitting area to replace old existing steps and sitting area to bay beach. Located: 2200 Park Ave., Mattituck. SCTM#123-8-10 The CAC recommends Disapproval of the application and recommends continued use of the common stairs and repair as necessary. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Nick Dickerson, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of THOMAS ANDERSON & THOMAS KEVlN ANDERSON for the existing deck. Located: 1240 Love Lane, Mattituck. SCTM#140-1-23.1 The CAC recommends Approval of the application with the Condition the concrete wall remains as a buffer. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of ANTHONY & BARBARA BONAGURA to construct first and second floor additions to the existing dwelling, cut back existing porch, construct new covered porch, new second-floor covered deck, new frame and brick garage, new covered carport, and to legalize the existing rear yard deck on grade. Located: 900 Holbrook Lane, Mattituck. SCTM#113-6-11 The CAC recommends Approval of the application with the Condition drywells are installed to contain the roof run-off and the installation of a storm-water run-off control system. Vote of Council: Ayes: All Motion Carried EDGAR SMITH for the existing dock on the seaward side of the concrete seawall; dock is 111 '-5" X 10' with an "L" section on the northerly side of the seaward end 20'-4" X 10'. At the seaward end of the dock structures consisting of pilings and horizontal timbers extend approx. 10' from the northerly side and approx. 20' from the southerly side. There are 3' wide steps to grade with an 8' run on the north side of the dock near the landward end. A three-pile dolphin is located off the northerly side of the dock and a 7'X 10' ramp to grade exists on the landward side of the seawall. The project also includes the repair of approx. 20' of the concrete seawall, inkind/inplace, on the northerly side of the dock. Located: 680 Bay Lane West, Orient. SCTM#24-2-10 The CAC notes that there are presently two docking facilities on the property. The council recommends removal of one dock and repair of the remaining dock in accordance with the Code. Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of FRANCES & JOHN DIVELLO to construct a fixed timber dock, consisting of a 4'X 126' fixed catwalk (to be elevated a min. of 3.5' above grade of marsh); a 3'X 18' ramp; and a 6'X 20' float secured by (2) 8" dia. pilings. Construct 4'X 9' platform/steps at landward end of catwalk. Located: 1705 Meday Ave., Mattituck. SCTM#113-9-8.1 Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of DAVID CORCORAN to remove and replace (in-place) approx. 83 linear ft. of existing timber bulkhead (forming boat slip) with vinyl bulkhead; maintenance dredge 30'X 30' area within boat slip to a max. depth of-4' ALW; spread approx. 45 of 85 cy. sand/silt spoil landward of bulkhead as backfill; and truck remaining spoil to an approved upland source. Remove and replace (inkind/inplace) 2.5'X 12' ramp and remove and replace (in-place) +/-7'X +/- 20' float with 6'X 20' float. Located.: 405 Fleetwood Rd., Cutchogue. SCTM#137-4-15 The CAC recommends Approval of the application with the Condition of a 20' non-turf buffer. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of SYDNEY & DEBORAH DUFTON, as contract vendees, to construct a single-family dwelling on a concrete foundation, associated sanitary system, driveway, roof drains, to truck approx. 290 cy. of clean sand to site for grading, and to establish a 25' wide undisturbed buffer. Located: 13555 New Suffolk Ave., Cutchogue. SCTM#116-2-23 The CAC recommends Approval of the application with the Condition of a 50' non- disturbance buffer. 8 Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of BELVEDERE PROPERTY MANAGEMENT, LLC to construct a 6'X 80' extension, with wavebreaks, onto an existing pier, to relocate three 3-pile dolphins, to relocate one ladder, and to install one new ladder. Located: Robins Island. SCTM#134-3-5 Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND PERMITS Moved by Don Wilder, seconded by Nick Dickerson, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the application of MGH ENTERPRISES, INC./DBA ORIENT BY THE SEA to Amend Permit #4188 to add 4' to the west side of the (kitchen) building. Located: 40200 Main Rd., Orient. SCTM#15-9-8 Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the application of THOMAS CAVANAGH to Amend Permit #5875 to allow a 6' boardwalk in the 10' non-turf buffer and the addition of an open gazebo structure adjacent to the non- turf buffer. Located: 600 Little Peconic Bay Rd., Cutchogue. SCTM#111-14-13 Vote of Council: Ayes: All Motion Carried GREGORY MAZZANOBILE to Amend Permit #5631 to eliminate the swimming pool and move the proposed sanitary system leaching pools 3' further from the wetlands line. Located: 1300 & 1460 Lake Dr., Southold. SCTM#59-1-21.6&21.7 POSTPONED TOM SCHLICHTER & FELICIA SCOCOT_ZA to Amend Permit #4986 to add an attached deck to the rear of the dwelling, 22' X 12'. Located: 400 Rene's Dr., Southold. SCTM#54-6-4.4 The CAC did not make an inspection, therefore no recommendation was made. Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the application of MARTIN KOSYMNKA to Amend Permit #3829 to modify the existing floating dock to make it wider and larger, so it would be more accessible. Located: 1985 Pine Tree Rd., Cutchogue. SCTM#98-1-11.1 Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Nick Dickerson, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the application of FRANK MARTORANA to Amend Permit #5456 to allow the construction of a house with a different footprint, and which would be constructed 10' further from the wetlands. Located: 3500 Deep Hole Dr., Mattituck. SCTM#115-17-9&10 Vote of Council: Ayes: All Motion Carried The next meeting of the Conservation Advisory Council has been scheduled for Tuesday, December 7, 2004 at 6:00 PM at Down's Farm Preserve.
