The creation of such a lot is contrary to good subdivision layout principles and creates problems as far as access by emergency and service equipment is concerned. This lack of access could result in health,safety and welfare problems for the future residents of the landlocked lot,not to mention potential disputes over the use and maintenance of any right-of-way over an adjacent parcel that may be created for the purpose of access. Property Location: 1960 Gull Pond Lane, Greenport; CTM 35-3-12.9 (a/k/a CTM 12.6 and 12.7 total combined area: 81,913 sq. ft). SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's property consists of a total combined area of 81,913 sq. ft. with 272.50 ft. along the south side of Gull Pond Lane, Greenport. The property is improved only by two small sheds and a dock structure as shown on the November 18, 2004 survey, amended November 30, 2004 by Peconic Surveyors, P.C. BASIS OF APPLICATION: Building Department's December 8, 2004 Notice of Disapproval, citing Section 100-32 in its denial of an application to subdivide the property, with proposed Lots 1 and 2 containing less than the code required 80,000 sq. ft. in size, and containing less than 250 feet of depth in this Residential R80 Zone District. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 3, 2005 and March 31, 2005, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants are requesting area variances concerning two proposed nonconforming Lots, #1 of 40,913 sq. ft. and lot depth of 50 feet, and #2 of 41,000 sq. ft. and lot depth of 186. The property is also shown on the Subdivision Map of Leon Marcus with an approval date stamped August 4, 1986. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Most properties on Gull Pond are approximately one acre in size, and only those lots adjacent to the cemetery are over two acres. Also, land approximately 200 feet south of the applicant's property is zoned R40 Residential (minimum 40,000 sq. ft. required). 2. The building of two houses on property that is at least twice the area of the neighboring parcels cannot be achieved by any other method. 3. The relief granted is substantial, reducing the lot from two acres to one acre. Although neighbors have raised questions about environmental effects and traffic that would result from the building of an additional house, the marginal effect of building two houses rather than one will not be significant, given the number of improved smaller lots in the vicinity. 4. The difficulty has been self-created. It is a consequence of the owners' retaining the two-acre size of the existing lot at the time neighboring lots were divided. 5. No evidence has been submitted to suggest that a variance in this residential community, with adjacent R-40 and R-80 Zone Districts and similar sized improved and vacant parcels, will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Goehringer, and duly carried, to GRANT the variances as applied for, with lot sizes shown on the November 18, 2004 map, amended November 30, 2004 by John Metzger, L.S. (Peconic Surveyors, P.C.). This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Vote of the Board: Ayes: Members Oliva (Chairwoman), Goehringer, Dinizio, and Simon. Nay: Member Orlando (referring to intent of recent changes in the town subdivision code). A thorough review for the site,the surrounding area and the proposed action has been conducted, and the following is a summary of those findings. SITE HISTORY: In May 1984 a minor subdivision map for Leon Marcus was approved by the Town of Southold Planning Board. The map contained 18.5 acres and divided it into 4 building lots and one (1) 7.3-acre parcel for preservation. The four(4) building plots ranged in size from 3.879 acres to 1.4 acres. These parcels totaled 11.14 acres or 485,441 square feet. The subject site is included as part of the building lots. Most of the four(4)building lots were uplands. Field inspections have determined that there are approximately 8,300 square feet of wetlands on the building lots,mostly on Lots 3 &4 and on their west ends. The area of preservation is almost entirely freshwater wetlands. As stated, on May 21, 1984 the Southold Planning Board approved the land division that contains the subject site with five (5) conditions. These conditions were: 1. No further subdivision of Lots 3 and 4 in perpetuity (NOTE: These are the two larger lots and the ones containing the wetlands). 2. The building envelope will set back 100 feet from the shoreline on Lot 2 (NOTE: A substantial portion of Lot 2 is contained in the subject site). 3. Should the Nature Conservancy not accept the parcel, said owner will covenant and restrict the land never to be subdivided again nor built on in perpetuity (NOTE: Current tax rolls show the dedication parcel being owned by South Fork Land Foundation, Inc., 1 another preservation organization. The parcel is posted as being owned by The Peconic Land Trust). 4. Conditions 1 through 3 inclusive shall be filed as covenants and restrictions in the office of the County Clerk on or prior to granting approval of this subdivision. 5. The subdivision will be made subject to the applicant posting a bond with the Town in the approved amount of$9,130.00. Parcels 1 and 2,the two southern and smallest lots on the approved subdivision, both had frontage on Gull Pond. Lot 1 had its building envelope located on the western portion of the lot(west of the existing tennis court) and had approximately 105' of frontage on Gull Pond Inlet. Lot 2 had approximately 360' of frontage on Gull Pond Inlet. Lots 1 and 2 were 94,300 and 61,000 square feet in size, respectively. In 1986,there was a lot line modification with regard to Lots 1 &2. On Lot 1, all of the land and waterfront east of the tennis court was transferred to Lot 2. Lot 2 transferred a small portion of land north of the tennis court to Lot 1. The transfers resulted in Lot 1 being reduced in size to 73,387 square feet and it having no frontage on Gull Pond Inlet. Lot 2 received all the frontage on Gull Pond Inlet and its size was increased to 81',913 square feet. The lot line modification resulted in the current lot configuration of the subject site, which was previously the old Lot 2. EXISTING CONDITIONS&PROPOSED ACTION: At present,the subject site is vacant and does not have a residence on it, but it is improved with two sheds and two docks. The site is entirely cleared and maintained in lawn. There are no natural habitats on site, with the exception ofthe tidal wetlands along the eastern property/shoreline. There are several accessory structures on site. The building envelopes on the proposed plan provide a 100' setback from the mean high waterline for both lots. The building envelopes have an elevation of between 8 and 10'. The proposed lots,#1 (north) and#2 (south) are 40,913 and 41,000 square feet,respectively. The site is located within the "R-80" district. The Southold Town Code, Article III, Section 100-32, states: "No building or premises shall be used and no building or part thereof shall be erected or altered in the A-C, R-80, R-120, R-200 and R-400 Districts unless the same conforms to the Bulk Schedule and Parking Schedule incorporated into this chapter with the same force and effect as if such regulations were set forth herein full". The Bulk Schedule, contained within the Code,requires a minimum lot size of 80,000 square feet and a minimum lot depth of 250 feet. As shown on the proposed subdivision,proposed Lot#1 will become non-conforming,with a total lot size of 40,913 square feet and a lot depth of 50 feet at its smallest point. Proposed Lot#2 will also become non-conforming, with a total lot size of 41,000 square feet and a lot depth of 186 feet at its smallest point. The size of the two (2)proposed lots conform to the New York State Department of Environmental Conservation(NYSDEC)requirements for construction adjacent to tidal wetlands(minimum 40,000 square feet). The proposed setback of the building envelope exceeds their requirements for building and sanitary system construction(minimum 75 feet and 100 feet, respectively). Likewise,the Suffolk County Department of Health Services' (SCDHS) standards are also met with the proposed applications, specifically with regard to lot area and setbacks from wetlands and surface water (minimum 100 feet). Suffolk County Water Authority will service the site. Lot#2 will be accessed by a proposed 15-foot wide right-of-way across the building envelope of Lot#1. Given the configuration of the lots in relationship to Gull Pond Road this is the only alternative on accessing the proposed Lot#2. Even with the proposed right-of-way, sufficient area exists on the proposed Lot#1 to construct a house and sanitary system. Given the existing habitat on site,the elevations of the land,the proposed lot sizes and the proposed locations of the house and sanitary systems, no significant impacts are expected to the environment of the site or the surrounding area. SURROUNDING AREA: With regard to the character of the area, I have carried out field investigations and reviewed various maps and aerials. Attached at the end of this document are two (2)figures, "2000 Aerial&Tax Maps" and"Existing Land Use". The first figure,the recent aerial photograph, has the tax lots superimposed on it and illustrates the general character of the area. The second figure, "Existing Land Use", is a composite of the tax maps and existing zoning of the area from Route 25 on the north, Sandy Beach 3 Lane on the south,Manhasset Ave. on the west and Maple Lane on the east. The site is located approximately in the middle of this area. The"Existing Land Use" figure graphically illustrates the size of the individual parcels in the area. A vast majority of the parcels, as shown in light red, are smaller than the proposed parcels. Of the 208 parcels illustrated in the figure, 184, or 88.46%of the 208, are smaller than the proposed parcels. Most of these lots have been developed with single-family houses. The lots colored dark yellow represent lots that are about the same size as the proposed lots on the subject site. There are only four (4) of these within the area, or 1.92%;three (3) are developed and one is vacant. It should be noted that two (2) are immediately south and adjacent to the subject site. Larger lots are shown in pale yellow, of which there are eleven(11), or 5.29%of all the lots. Three of these larger lots were those created by the original 1984 and 1986 land divisions that included the subject parcel. Two (2)other"large lots" are south of the subject site and adjacent to other lots that are the approximate same size as the proposed lots. These two (2) "larger lots"are in fact about the same size as the proposed lots with regard to building envelope and in their original configuration. The reason that their size is so large is that their area includes portions of two (2) streets that have been abandoned and added to their square footage. The character of the area is that of a band of single-family housing and lots that extend south from Route 25, on both sides of Gull Pond Inlet,to Sandy Beach Road, as well as to Youngs Point. All of the lots, as well as the constructed homes on them, represent lots equal or smaller in size to the proposed lots. Most of the lots are significantly smaller than the proposed. The eight(8)parcels have been identified as public/quasi-public lands. These include lands owned by the Town, church, cemetery,homeowners association, and the South Fork Land Foundation Inc. All of these parcels are large in size and are considered in a final use. These parcels represent most of the area east of Manhasset Ave. and west of Gull Pond Lane, as well as some parcels along the bay frontage. As noted above,the character of the area is principally one of developed, small lots. However,there is a small area of lots that are about the same size as the proposed lots. These 1-acre lots are immediately adjacent to the subject site and join the two areas of smaller lots to the north and south. The proposed project is consistent with the current character of the area. In fact,the parcel, if left in its current configuration and size,would be the only lot of its size and, as such, would be out of character with the surrounding area. With regard to zoning, the site is zoned"R-80"which requires a minimum square footage of 80,000 square feet per lot. Since the proposal is for the creation of two lots just over 40,000 square feet, variances are necessary from Town Code. In 1983,the Town rezoned the site from"A-Residence"to "R-80". "A-Residence" allowed for the construction of single-family homes on 40,000 square foot lots. As noted above, in May 19$4 the minor subdivision map was approved for four(4) lots. From the revision dates on the map,the subdivision was apparently under consideration prior to the rezoning. It is likely that a greater number'of lots was 4 originally considered in previous layouts. It should be further noted that one of the two (2)lots created in the Marcus subdivision did not meet the bulk requirements of"R-80". The 1983 "R-80"rezoning took in all of the large lots east of Manhasset Avenue and west of Gull Pond Lane (see "Existing Land Use" figure). This area included the cemeteries, an irregularly shaped wetlands parcel, and the 18.5-acre parcel from which the subject site was subdivided. In addition,the three (3)lots immediately south of the subject site were also included in the rezoning. It is important to note that all three (3) of the lots did not conform to the"R-80" square footage requirement. In fact,they were all approximately the same size as-the-proposed lots on the subject site (the road was not yet abandoned),but they were included in the 1983 "R-80"rezonings. As such, the Town recognized the appropriateness of creating non-conforming lots by the rezoning of these parcels on its own motion. The Board of Zoning Appeals created these three (3) lots on February 27, 1975 as part of ppeal No. (y2i4 2008. At that time, the area was zoned"A-Residence". The parcels conformed to the square footage 01 • requirements of that district;however,relief was needed for lot width and access. At that time the surrounding area had already been developed, for the most part,as it appears today. In the Board's approval decision it was stated that: "The Board finds that these lots will be larger than many in the area. ...and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance." A copy of the minutes for the February 27, 1975 Appeal No. 2008 is provided for the record. The proposed action conforms in size and configuration to these lots immediately to the south. • r 4GP ' With regard to conformance to the"R-80"zoning,this subject land was originally part of a minor land division by Leon Marcus as discussed previously. The land division resulted in a configuration of what could be referred to as a cluster. Under NYS Town Law Section 278 (previously 281) allowance is made for municipalities to "cluster"the yield of a given piece of property on smaller lots for, among other reasons,preservation of environmentally sensitive lands. On this site a 7.3-acre parcel, or 34.46% of the entire subdivision, was dedicated for preservation purposes. This parcel is entirely freshwater wetlands. The present Town policies exclude wetlands from determining clustering yield;therefore,the area of dedication will not effect the number of lots, or yield, the 18.5-acre site would generate. Yield would be determined on the upland portion of the remaining 11.2 acres. In order to determine the potential yield field inspections, as well as map and aerial photo interpretation, were undertaken. It is estimated from field visits and review of topographic maps and aerials that approximately 8,300 square feet of the 11.2 remaining acres is considered wetlands. These wetlands are located to the rear, adjacent to the dedication parcel. Therefore, 479,572 square feet can be used in yield computations. It is assumed that since the parcel has access to three roads(Gull Pond Lane, Angler's Road, and Fiddler Lane) lots could be developed without the loss of land for the construction of interior roads. A straight math computation is therefore possible: 479,572 square feet divided by 80,000 square feet per potential lot equals a yield of 6 lots. Therefore,under State and Town law,the yield could be taken and moved around,placing the same number of lots on smaller parcels. Since the original land division only contained four(4) lots and the actual yield was for 6 lots,the proposed additional lot(which would bring the total up to five (5)lots) would be in conformity with the zoning density of the area. 5 - i Additionally, one can look at all the lands zoned"R-80" in the study area. There are two large parcels, the Sterling and St. Agnes cemeteries,that total approximately 35.9 acres,plus the church land and the irregularly shaped wetland parcel would add 7.0 acres for a total of 42.9 acres. All of this land, even though zoned"R-80", will never be developed. Therefore, the overall density of what could have been constructed in the area is significantly reduced or,to express it another way, of the 61.4 acres zoned"R- 80"in the area, only 5 houses will be built or 1 house per 534,916.8 square feet. CONCLUSION: In consideration of the above, the proposed action will not have an adverse effect or impact on the physical or environmental conditions in the district,neighborhood,or on the site. The site is presently in lawn and landscaping, no natural habitats exist. Setbacks of greater that 100 feet are proposed for the construction of homes and sanitary systems on the two (2) lots. These setbacks exceed the requirements of the NYSDEC and the SCDHS. The granting of the variance will not produce an undesirable change in the character of the neighborhood, nor will there be a detriment to nearby properties. The proposed lot sizes are equal to or greater than the majority of the lots in the area. The character of the area is that of small lots, in fact smaller than the proposed. The ZBA approved similar lot sizes and configurations immediately to the south of the subject site. Under the original minor subdivision that created the parcel a greater number of lots (an estimated two [2] more) could have been created under the existing zoning. Therefore,the proposed creation of one (1)new lot does not exceed the overall zoning density for the district, nor does it represent a change of zone. Also there was a Town Law regarding 2 acre zoning and we also paid a hefty Preservation Tax which indicated to me that Southold town was concerned about over building. So, now I don't understand why there is an appeal being considered when there was a law passed some time ago to prevent this from actually happening. This particular piece of property is one of the very last pristine water front properties on the north fork. To squeeze 2 houses on this parcel would be detrimental to the area. Not only would 2 houses be built, but also I am sure there would be another dock built. My major concern is simple –if we allow this to happen in this situation and say YES, how can we say NO to other appeals? Won't this set up prescience for all to follow? Where will it stop? Over-building has been going on for-sometime now on Long Island. We moved'here to get away from exactly that. We were so delighted to see Land Preservation on our block, a 2-acre parcel next door that could only have 1 house on it. I am asking you to personally inspect what is being proposed on my block and carefully consider all the implications of granting this subdivision. I would like to see . tr only one house be built on the said property and am hoping you can understand my concerns. I am sorry I could not attend this hearing but I have a job that I am responsible for. I am hoping the next meeting (if there is one) will be held at a more convenient time for the working fellows. Also, I wanted to mention that many of the people of Gull Pond and across the pond are away at this time and have NO idea what is being contemplated. My wife's name is Antoinette D Beck-Witt and is primary owner of 1710 Gull Pond Lane. We are both displaced South-Porkers. My Wife and I grew up in Southampton and Amagansett. We --have observed, first-hand, the changing face of the South Fork over the past 50 years. We respectfully put forth our comments on the proposed subdivision for 1960 Gull Pond Lane. Environmental concerns. A large portion of Gull Pond is bulk-headed, 1960 is not. This provides a beach access and shoreline for numerous birds, waterfowl,turtles,deer, fox and raccoons. To compromise this small oasis for life,in any way, would be funereal. Financially On the South Fork we have watched certain properties retain their values, while others fluctuate at the whim of the real estate market. 1960 is a beautiful piece of land with space and views of estate quality. We are certain 1960 will bring in a larger more stable net tax figure to the town for years to come, if left as is. Subdividing this parcel will cost the town income in the long run. Over-Develonnient Gull Pond is a development which was laid out intelligently. Every parcel is of good size and has its own dock. As ex-South-forkers, we were astounded to see actual planning put into a project. This attracted us to the area. The South Fork has turned into a hodge-podge of property lines and right of ways, drawn by individual's greed,with no concern for the end result.. Final thoughts Many East-Enders leave because of taxes, utility and insurance bills and the general cost of living. Some of us remain here, living on the edge,because right here is the most beautiful place on Earth. Unfortunately,due to the mass development of the South Fork, it has become an area we no longer wished to reside. The reasons we struggled to live there, were gone. Beck-Witt/ r, It is up to the Town Decide on the direction the North fork will take. The development that took place on the South Fork over the past 30 years has jumped the bays to the North Fork and will not take 30 yrs. to gain the same momentum. If the Town decides to subdivide 1960 into two buildable lots we will understand, regardless of the rhetoric, which direction the Town wants to go. We will file an application to subdivide 1900 into 4 lots,build Ivlcivlansions,make our money, move out of state to join our friends, endure their"I told you so's" , and look back in dismay as the last bit of the most beautiful place on Barth is destroyed.
