Dear Sir:
This permit, dated 10/17/02, specifies that the work must be completed with 90 days. As you will
recall, the project was the subject of a NYSDEC Notice of Violation and administrative delays
within that agency resulted in the letter from the DEC approving our proposed restoration plan
was not received until December 3, 2002. This, of course, is not a good time of the year to do the
planting required by the approved plan, and we ask that the completion date be changed to the
spring of 2003.

Dear Mr. Fitzgerald:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, October 16, 2002 regarding the above matter:
WHEREAS, Proper-T Permit Services on behalf of PETER BOGER applied to the Southold
Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code, the
Wetland Ordinance of the Town of Southold, application dated May 21, 2002, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
October 16, 2002, at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed xvill not affect the health,
safety and generalwelfare of the people of the totvn,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of PETER BOGER to remove
the rocks from in front of the bulkhead, relocate the rocks to the "eroded area" offthe north
bulkhead, and re-vegetate the disturbed areas, all as depicted on the approved plan last revised
October 18, 2002. All work must be completed ~vithin 90 days from the date the permit is
signed.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Inspections are required at a fee of $5.00 per inspection. (See attached schedule.)

24, 2002, the following recommendation was made:
Moved by Bob Ghosio, seconded by Melvyh Morris it was
RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of
the Wetland Permit Application of PETER BOGER for the existing concrete block
bulkhead 23'9" overall length, with small-stone armoring on seaward side; permit
existing small-stone return configuration at south end of bulkhead at grade, 9'+/- overall
length.
Located: Windy Point Lane, Southold. SCTM#87-4-4
The CAC recommends Disapproval of the application and 'recommends that the
applicant remove the concrete blocks and re-vegetate the area with indigenous
vegetation.

Dated December 13, 2002, extending the time to complete the work. Although it was
originally contemplated that this work would be completed in the spring, the poor
weather in May and June caused a delay in the planting schedule. The purpose of this
letter is to advise you that I plan on performing the necessary restoration work during the
period of July 23 to July 25, 2003. Please contact me if you wish to schedule either a
pre-construction and/or a post construction inspection. I can be reached during business
