Dear Mr. Herrmann:
The Southold Town Board of Trustees reviewed the site plan prepared by Joseph
Ingegno last revised December 13, 2001 and determined the proposed single-family
dwelling to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland
Code and Chapter 37 of the Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above, without a permit. It is your responsibility to ensure that
all necessary precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and
Coastal Erosion Hazard Area, which may result from your project. Such precautions
may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and the coastal erosion hazard area and your project or erecting a temporary
fence, barrier, or hay bale berm.
However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion
Hazard Area would require permits from this office.

Dear Ms. Standish:
A Letter of Non-Jurisdiction dated 17 July 1998 (copy enclosed) was issued by the Board of
Trustees for the proposed development of the captioned parcel, as all work was proposed to
occur more than 75 feet landward of the surface waters of the adjacent yacht basin.
As all work will in fact occur more than 100 feet from surface waters, as depicted on the
enclosed site plan prepared by Joseph Ingegno, L.S., last revised 13 December 2001, would you
kindly issue a current Letter of Non-Jurisdiction pursuant to §97-12(C) of the newly revised
Wetlands Law.

your proposal to construct a house and retaining wall to be out
of the Trustee Wetland jurisdiction under Chapter 97 of the Town
Code.
However, any activity within 75' of the Wetland line requires a
