A detailed description and plans of the applicants' activity are enclosed to assist in your review.
The decision whether to issue permits will be based on an evaluation of the probable impact,
includi-~ cumulative impacts, of the proposed acfivide~ on the public interest. That decision will reflect
the national concern for both protection and utilization of impo. rt..t resources. The benefits .which
reasonably may be expected to accrue from the proposals musz be balanced against their reasonably
foreseeuble detriments. All factors which may be relevant to the proposals ~ be consic[ered;inchidi~
the cumulative effects thereof.; among those are conservation, econom,es, aesth~[c~, g~
environmental concerns, wetlands, historical properties, fi~h' ~d wildlife value/, flcodplafd ~i~/es, ~
use, navigation, shoreline erosion and accretion, recreation, water supply and conservafidn~ water~luality,
energy needs, safety, food and fiber product/on, mineral needs, consideration of pwperty ownership and,
in general, the needs and welfare .of the people.
The Co~ps of Engineers is soliciting comments from the public; Federal, state, and local agencies
and officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of
these proposed activities. Any comments received will bo considered by the Corpi[ o]~ F.n~inecrs to
determine whether to issue, modify, condition'or deny Permits for these proposals. To mzke this
decision, comments are used to assess impacts on endangered specie~, historic properties, water quality,
general enviromnentsi effects, m~d the other public interest factors listed ~bove. Comments are uSed in
preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the
National Environmental Policy Act. Comments are also used to determine the need for a public hearing
and to determine the overall public interest of the proposed activities.

Any person may request, in writing, before this public notice expires, that a public hearing be
held to collect information necessary to consider these applications. Requests for public hearings shall
state, with particularity, the reasons why a public hearing should be held. It should be noted that
information submitted by mail is considered just as carefully in the permit decision process and bears the
same weight as that furnished at a public hearing.
Our preliminary determination is that the activities for which authorization are sought herein are
not likely to affect any Federally endangered or threatened species or their critical habitat. However,
pursuant to Section 7 of the Endangered Species Act (16 U.S.C. 1531), the District Engineer is consulting
with the appropriate Federal agencies to determine the presence of and potential impacts to listed species
in the project area or their critical habitat.
.... Based upon a review of the latest published version of the National Register of Historic Places,
- theri: are no known sites eligible for, or included in, the Register within the permit area. Presently
unknown archeological, sciemific, prehistorical, or historical data may be lost by work accomplished
under the required permit. ~
Pursuant to Section 307 (e) of the Coastal Zone Management Act of 1972 as amended [16 U.S.C.
.~5,6.'(e0]~ for activities under consideration that are located within the coastal zone of a state which has
a federally approved coastal zone management program, the applicants have certified in the permit
application that the activity complies with, and will be conducted in a manner that is consistent with, the
approved, state coastal zone management program. By this public notice, we are requesting the .state's
concurrence with, objection to, or waiver of the applicant's certification. No permit decision will be
made until one of these actions occur. For activities within the coastal zone of New York State, the
applicant's certification and accompanying information is available from the Consistency Coordinator,
New York State Department of State, Division of Coastal Resources and Wateffrom Revitalization,
Coastal Zone Munusement Program, 41 State Street, Albany, New York 12231, Telephone (518) 474-
6000. Comments regarding the applicants' certifications, and copies of any letters to this office
commenting upon this proposal, should be so addressed.

WORK DESCRIPTION
The applicants, Leslie Gazzola and Cheryl Hansen, have requested Department of the
Army authorization to dredge material with ten years maintenance from an unnamed canal off
Little Peconic Bay at the Town of Southold, Suffolk County New York, with subsequent upland
disposal.
Each applica~ pwposes to dredge with a clam shell bucket, a maximum of 100 cubic
yards per event from 10 foot by 70 foot and I0 foot by 145 foot areas, respectively, out. shore
of existing bulkheads, three times during the ten-year duration of a Department of the Army
permit, if issued. All dredged material would be trucked to a state-appwved upland site where
it would be suitably retained so as to prevent its reentry into any waterbody.
The stated purpose of this project is to provide a safe navigable dep ~tl~. for vessel mooting.

Town Board of Trustees on June 23, 1999:
RESOLVED, that the Southold Town Board of Trustees grant the
request for an Amendment to Permit #4960 for dredging and
removal of spoil. To recoup soil and restore to a depth of 4'
below MLW, not greater than 10' from bulkheads. Spoil to be
removed from boat basin to an average depth of 4' below MLW and
placed upland. Amount of spoil to be removed will be approx.
100 c.y. for each parcel. Located: 495 Elizabeth Lane,
Southold.

Dear Mr. Kowalski:
The following action was taken by the Board of Town Trustees
during its regular meeting held on February 24, 1999 regarding
the above matter:
WHEREAS, Permits & Drafting Unlimited on behalf of LESLIE GAZZOLA
applied to the $outhold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated January 5, 1999 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on February 24, 1999, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees grant a Wetland Permit to
replace 82.5 linear ft. of bulkhead inkind/inplace and 25"
higher than existing, widen existing slip by excavating 2.5'X
25' section and constructing new bulkhead at walls, backfill
bulkheads with 100 c.y. of excavated material and related
activites to complete with the condition that a 10' non-turf
buffer be placed behind the bulkhead.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.
