construct 4'x9' ramp, 4'x45' fixed catwalk and 4'x5' terminal stairs all supported by 4'~x4'}posts.
However, this permit does not constitute any other permits from other agencies.

Pursuant to Section 307 (c) of the Coastal Zone Management
Act of 1972 as amended (16 U.S.C. 1465 (c) (3) (A)), the applicant
has certified that the activity complies with and will be

coastal zone management program.

The captioned permit was issued on 19 July 2000 for the construction of a 4' x 56' catwalk with a
4' x 9' inclined ramp and 4' x 5' stairs at its landward and seaward ends, respectively. The New
York State Department of Environmental Conservation would only approve a shorter structure,
however, consisting of a 4' x 9' ramp; 4' x 45' fixed catwalk; and 4' x 5' terminal stairs, all
supported by 4" x 4" posts.
Therefore, please issue an amendment to the permit and issue a refund to Mr. Braun in the amount
of $80 ($612 (paid) - $492 - $40 amendmem fee), as the total area of the structure to be located
seaward of apparent high water will be 164 square feet, including a 4' x 36' section of the catwalk
(144 s.f.) and the 4' x 5' stairs (20 s.f.). Three copies ora revised plan are enclosed herewith.

Dear Mr. Krupski:
The captioned permit, issued 19 July 2000, authorized construction of a catwalk and house
addition on the water side of the existing dwelling. Mr. Braun, however, has decided to abandon
the addition proposed on the water side of the existing dwelling and has instead proposed to
construct an addition onto the road side of the existing garage. As this proposed addition is
located more than 100' from the tidal wetland boundary and thus out of the Trustees' jurisdiction
pursuant to Chapter 97 of the Southold Town Code, would you kindly issue a Letter of Non-
Jurisdiction based on the revised survey, (3) copies of which are enclosed herewith.

The following action was taken by the Board of Town Trustees
during a Regular Meeting, held on July 19, 2000, regarding the
above matter.
WHEREAS, EN-CONSULTANTS, INC. on behalf of MICHAEL BRAUN
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated June 29, 2000, and
WHEREAS, said application was
Conservation Advisory Council
recommendations, and
referred to the Southold Town
for their findings and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on July 19, 2000 at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approved application to
construct a 4'x56' fixed timber catwalk with a 4'x9' inclined
ramp and 4'x§~ stairs at the landward and seaward ends,
respectively. Construct a 10'x15' first story addition.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete pro~ect will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

CONSERVATION ADVISORY COUNCIL
At the meeting of the Southold Town Conservation Advisory Council held Tuesday, July 11,
2000, the following recommendation was made:
Moved by Richard Smith, seconded by Scott Hilary, it was
RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the
Wetland Permit Application of MICHAEL BRAUN 85-5-6 to construct a 4'X 68' fixed timber
catwalk with a 4'X 9' included ramp and 4'X 5' stairs at the landward and seaward ends,
respectively.
RESOLVED to recommend APPROVAL of the Wetland Permit Application to construct a
10'X 15' first-story addition.

The CAC recommends Disapproval of the catwalk because it is not justified for the proposed
need and it would inhibit public access to the wetland resources. The affect of accumulative like
structures in that area would have a negative impact.

The proposed addition represents a minor expansion of the existing
