AU¢ l 9 2002 Gentlemen: I have enclosed the Letter Request For A Waiver, along with the Notice To Adjacent Property Owners with attached cerlJt'md mail receipts and retum receipts, and my check for the ·ing fee herein. Please be advised that my clients obtained an estimate to have the subject fence installed. The contractor was specifically in~ not to perform any work until any and all necessary permits were obtained. This is a second home for my clients, who then returned to their primary residence. Kathy Lofmse then co.~=~ted va~ous Southold Town agencies and determined that since this wes watenYont property, an application to your Board was required. My clients then autho(czed me to complete the application process to your Board for a waiver. Upon ratum to her Southotd home, Kathy Lofrese discovered that the contractor has ignored her instructions and had installed the fence without obtaining the necessary permits. When she contacted the cuntmctor, she wes advised that no permits were necessary. As you can see, my clients did not intend to have the fence installed without the nece~?_~__ry permits. The contractor ignored their specific instructions not to proceed without obtaining all required approvals. This is not a case of build now, and get the permit later. My clients apologize to this Board for the fence being installed prior to obtaining the necessary authorization, but hope under the circumstances that this board understands it was not their fault.
