Property Location: 55135 Main Road, Southold; CTM 62-2-11.1. cox- /- H t t SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 219 acre site is improved with a firehouse with 40 ft. high tility pole with siren, a fire hydrant, roof access stairway, masonry garage, flagpole, and other improvements as shown on the site plan prepared by William F. Collins, A.I.A. dated 12/11/02, revised 6/25/03 (ref. survey prepared 11/18/02 by Barrett, Bonacci and VanWheele, P.C.). BASIS OF APPLICATION: Building Department's May 25, 2004, Notice of Disapproval, citing Code Section 100-1626.3 in its denial of a building permit application concerning a replacement of a wireless communications antenna and related equipment, for the reason that the proposed antenna (measured at 60 feet) projects higher than 20 feet above the average height of buildings, which is 23 feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on July 15, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to replace the existing 40 ft. high wooden pole with a new wireless telecommunications facility monopole at 60 ft. in height, on a 10' x 12' concrete pad, behind the firehouse along the northeast rear wall section. The property contains a firehouse and related equipment for emergency. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant is licensed by the FCC. The 60-ft. high tower will replace existing SFD 40-foot wooden pole. Applicants expert witness testified that 60' is the lowest possible height that will Page 2—August 2,2004 • • ZBA No.5547—Southold Fire District/Omnipoint CTM 62-2-11.1 enable Omnipoint to close the coverage gap. No testimony was presented to refute this statement. With regard to the design elements of the structure, the applicant's testimony confirmed that a "flagpole" design would reduce coverage, be twice as costly, and would prohibit the company from future heightening of the pole. A flagpole design was stated would require an additional 10' to 20' in height to ensure the same coverage as the pole design. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's expert witness, Nicholas Balzano, Radio Frequency Engineer, testified that there is a significant service gap in the Southold area, and that the height and location of the antenna is required to eliminate the gap. The gap affects coverage for the public, as well as police, fire, ambulance and emergency response personnel in Southold. 3. The variance granted herein is substantial. The height of the new tower would exceed the code limit by 17 ft. (23' existing tree line plus 20 ft. allowed above code = 43 feet), for a 60 ft. height. 4. The difficulty has been self-created, as a result of the applicant's desire and need to replace the existing structure at a height which exceeds the code limitation of 43 feet, in this Hamlet Business (HB) Zone District. 5. No evidence has been submitted to suggest that the requested variance in this community of commercial and residential uses will have an adverse impact on the physical or environmental conditions in the neighborhood. There was no opposition to the wireless telecommunications facility, either written or oral testimony, presented in this matter. The benefits to the community of improved service and ensuring public safety outweigh the affects of the variance. 6. Grant of this relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a 60' wireless telecommunications facility, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Tortora, seconded by Member Dinizio, and duly carried, to GRANT the variance as applied for, as shown on the site plan dated 12/11/02 (SP-1), updated 56/25/03, prepared by William F. Collins, A.I.A. Rosenberg, 82 N.Y.2d 364, held that a provider of wireless telecommunications services is considered a public utility for zoning purposes, and that the public utility exception to the test for unnecessary hardship, warranting the grant of a height variance applies. In its decision the Court stated, "It has long been held that a zoning board may not exclude a utility from a community where the utility has show a need for its facilities." In addition, the Court stated, "Where the intrusion or burden on the community is minimal, the showing required by the utility should be correspondingly reduced." In this case, the applicant, which is licensed by the Federal Communications Commission to provide service in Suffolk County, has a significant service gap in the Southold area and cannot provide reliable service to its customers as required. In order to eliminate its service gap, it must establish an antenna facility in a location and at a height determined by its engineers. The proposed facility would be located in the Hamlet Business District, and is proposed to be 60 feet in height. Accordingly it complies with Section 100-162, and would be a permitted use, but for its lack of compliance of Section 100-1626.3. X Nicholas Balzano, being duly sworn, deposes and says: (1) I am a Radio Frequency Engineering ("RF Engineer") consultant for Omnipoint Communications, Inc. ("Omnipoint"). As Omnipoint's RF Engineer, I am familiar with its existing and proposed facilities in and adjacent to the Town of Southold (the "Town"). (2) I respectfully submit this Affidavit in support of Omnipoint's application for an area variance for height and any other approvals that may be necessary for Omnipoint to construct a 60' wireless telecommunications facility on the premises situated at 55135 Main Road, Southold,NY (the "Site"). COVERAGE (3) There is a significant gap in coverage in Omnipoint's personal communications service ("PCS") system telephone coverage in and around the Town. A gap in coverage is evidenced by the inability to adequately transmit or receive calls, or by interrupted or disconnected calls. (4) This gap in coverage prevents Omnipoint from providing seamless PCS coverage and public or private users of its PCS, including police, fire, ambulance and emergency response personnel in the Town. (5) Since the PCS is used with increasing frequency to report crimes, accidents, fires, medical emergencies and other threats to persons, a gap in PCS coverage represents a demonstrable threat to public health, safety and welfare. (6) The gap in PCS within the Town is extensive and ongoing. I base this conclusion on personal knowledge gained through my use of tools, such as Odyssey, which RF Engineers employ to identify gaps in PCS coverage, and through actual drive tests which confirmed the Odyssey prediction. • (7) Odyssey software is a decision support tool for evaluating signal-related aspects of PCS system performance. Odyssey produces a map which indicates where coverage exists and where there is a gap in coverage. The Odyssey generated map for Omnipoint's existing•and proposed neighboring PCS sites shows a gap in PCS coverage in and around the Town that the Site will help to fill. (8) Upon identification of a gap,in coverage, the local topography and geography is examined as well as the location of existing and proposed Omnipoint sites. Based, on this information, a general location is selected which will support a site capable of remedying the gap in coverage in the coverage area. (9) Omnipoint's real estate group is then directed to review the local zoning ordinance and possible locations for its facilities which may remedy the gap in coverage. (10) Omnipoint's real estate group then contacts the owners of such locations to determine their potential interest in pursuing a lease or license for the installation of Omnipoint's facilities.on the property. Once the Real Estate Group identifies a specific location, the RF • Engineer uses Odyssey and actual drive tests to determine the minimum height at which antennas must be located in order to fill the existing gap in coverage. (11) The Site was selected using the methodology and techniques described above and I 7 ' have determined that this Site is necessary to fill Omnipoint's gap in coverage. I also conclude that the proposed height of 60' is the lowest possible height that will enable Omnipoint to fill the significant gap in coverage. This fact is proven by Map 1, which shows coverage from the Site at a height of 50'. As you can see, at that height, a coverage gap would remain along North Road, Youngs Avenue and Main Road. (12) The Applicant's existing and proposed facilities in and around the Town are indicated on each attached Map with number designations and described below. (14) The coverage projected by Odyssey for neighboring existing and proposed sites is shown on each of the attached Maps. A gap in coverage centered at Main Road & Youngs Avenue is depicted on Map A (15) The projected coverage for the neighboring existing and proposed sites, including the Site, is shown on the attached Map 2. As shown on Map 2, constructing Omnipoint's facilities at the Site at a height of 60' will eliminate the gap in coverage. However, as shown on Map 1, constructing Omnipoint's facilities at a 'height of 50' will not eliminate the gap in coverage. CONCLUSION (16) Omnipoint leased space on this Site because: (a) locating facilities thereon will assist Omnipoint in filling its existing gap in coverage and (b) locating facilities thereon will eliminate the need for Omnipoint to erect an obtrusive free standing structure in this area of the Town. (17) Based on the foregoing, it is my professional opinion, on behalf of Omnipoint, that:( a) there is an existing gap in PCS coverage in the Town; (b) the Site is an ideal location because its elevation and topography will permit reliable PCS coverage to be achieved within this section of the Town; ( c) the efficacy of the Site was confirmed by computer modeling; and (d) the Site is necessary to meet the current and expected future demands of Omnipoint's customers. For all of the foregoing reasons, the requested area variance Approval along with any other approvals that may be necessary for Omnipoint's installation of its facilities at the Site should be granted. C SUMMARY This report is the result of an extensive study of Electromagnetic Field Intensities (EMF - Power Densities) emitted by the proposed Omnipoint Communications, Inc. Antenna Installation (Site #LI-13- 412B-Southhold F.D.), to be mounted on a replacement Monopole, located at Section 62, Block 01, Lot 11.1, 55135 Main Road (Rt. 25), Southhold, New York. The study incorporated the most conservative considerations to determine practical combined cumulative worst case Power Densities (EMF) resulting from the proposed Omnipoint Communications, and existing Southhold Fire Department transmitting Antennas the Southhold community could theoretically encounter. • CONCLUSIONS The Power Densities emitted by the proposed Omnipoint Communications Antenna Installation base station are many orders of magnitude below the Health Standards adopted or proposed in the United States and any Health Standard used anywhere in the world. The issue of EMF compliance is pre-empted from the municipality regulatory powers beyond the applicants stating that it has examined the emissions in accordance with "OET Bulletin No. 65 - Edition 97- 01, August 1997" with analytical adjustments to equations per Richard Tell Associates and Ed Mantiply of the FCC Office of Engineering Technology and that the applicant is in compliance with the FCC/NCRP MPE of 1000 microwatts/cm. sq. General Public Standard. This Standard is recognized by the New York State Department of Health (NYSDOH). Section 704 of the Telecommunications Act of 1996 states that; " No State or local government or instrumentality thereof, may regulate the placement, construction and modification of personal wireless services facilities on the basis of environmental effects of radio frequencies emissions to the extent that such Facilities comply with the Commissions (FCC) Regulations concerning such emissions". This law directs the Federal Communications Commission (FCC) to offer assistance to state and local governments in wireless facilities issues. On August 1, 1996 the FCC adopted portions of the 1991 ANSI/IEEE, and NCRP Maximum permitted exposure (MPE) criteria. I D The results of this theoretical worst case safety analysis clearly indicate that the EMF emissions contributed by the proposed Omnipoint antenna installation will be far below EMF continuous Exposure levels as per ANSI/IEEE C95.1-1991/NCRP (49 CFR 1.1310), Federal Communications Commission (FCC) Continuous Exposure Standards, OSHA, and NYSDOH limits. The emissions broadcast from the Omnipoint Class C transmitters [GMSK (FM) Modulation], are in the non-ionizing 1930-1950 MHz frequency band. The EMF levels attributed to the emissions contributed by the PCS Broadcast Systems are well below EMF Standards which in the Scientific consensus based on overwhelming evidence, are well below threshold effects. The derived Standards have added safety limits to the threshold levels. When EMF levels encountered are at or below the Standard, no health effects occur, therefore no cumulative effect is possible regardless of exposure duration. This analysis and the results of this analysis assumes an antenna power output of two hundred fifty (250) Watts ERP per channel. The theoretical highest combined cumulative emissions from the proposed Omnipoint PCS and existing Fire r Department transmitting antennas the Southhold community could be exposed to at an elevation of 16 feet above ground, at any point in the Southhold community would be less than % of the applicable FCC MPE EMF General Public Standards. This combined cumulative percentage of EMF levels which could be emitted would be 4Q times below all applicable FCC MPE ,EMF General Public Standards. (See Table IIA-1) I (Note: All future co-locating carriers must complete an FCC Compliance analysis, including the proposed carrier Emissions as determined herein, providing cumulative EMF emissions impact.) The theoretical highest combined cumulative emissions i from the proposed Omnipoint PCS and existing Fire Department transmitting antennas individual on the peak of Firehouse roof could be exposed to at an elevation of 46 feet above ground, at any point on the existing Firehouse rooftop would be less than 42.% of the applicable FCC MPE EMF General Public Standards. This combined cumulative percentage of EMF levels which could be emitted would be 2.38 times below all applicable FCC MPE EMF General Public Standards. E This EMF level and all other levels presented in Table II-IIB are theoretical maximas that could occur only under worst case, assuming conditions such as in phase reflections occurring steady state, all transmitters operating simultaneously and continuously and excluding resistance or attenuating characteristics of construction material used in homes, schools and other similar structures. In reality, actual field measurements continually provides readings of power density levels far lower than the more conservative analytical levels indicated. The Telecommunications Act of 1996, is the applicable Federal Law with respect to consideration of environmental effects of RF emissions in the siting of PCS Radio facilities. It is the conclusion of this report, that the proposed Omnipoint application meets the Federal Communications Commission (FCC) present criteria and the FCC criteria as it is effected by the Telecommunications Act of 1996, with respect to environmental considerations of RF emissions. Further, Mobile PCS Radio Frequency Bands do not interfere with television reception, telephones or radio reception due to the wide separation of the Broadcast Bands as mandated and monitored by the FCC. (See Table I) ANALYSIS This critical analysis* incorporated Radio antenna emission characteristics and included the following assumptions which exceed realistic conditions of operations, but will yield worst case EMF - Power Densities ordinarily not realized and never exceeded. 1. All antennas are located at the lowest elevation indicated in the construction drawing to absorb errors in actual locations and to bring the antenna cluster closer to facilities and citizens than would normally be the case. 2. All antennas will be transmitting continuously, 24 hours a day. 3. All channels will be communicating simultaneously. 4. Power levels emitting from the antennas are increased by a factor of 4.0 to take into account possible in - phase reflections at any point in the Southhold community, which is rarely the case, and if so, are never continuous. 5. At all distances greater than 2000 feet, the Power Densities decrease by a factor of four (4) with every doubling of distance. 1d F The Wireless Antenna Installation in question is an assembly of low power antennas that emits radio energy at levels 100 to 1000 times below those of Commercial Broadcast Antennas. Given the distances between the antennas studied in this report and the community field points in question, as well as the overall community, the densities of the radio energy are extremely low. * Reference Basis for calculations: 1 - "Evaluating Compliance With FCC Guidelines for Human Exposure to Radiofrequency Electromagnetic Fields. Frequency Bands According to the FCC, microwave (MW) frequencies cover the approximate band from 900 MegaHertz (MHz) to 300 GigaHertz (GHz). One MegaHertz (MHz) is a million cycles and One GigaHertz (GHz) is a billion cycles per second. Table I lists several other communication and interrogation frequencies used in the United States. Clearly, a large fraction of commercial and private telecommunication involves MW Frequencies. One of the considerations is the maximum number of channels which could be transmitted by each of the proposed antennas in each sector. Further, in determining maximum public exposure to EMF emissions, potential close proximity of the antennas must be defined ("near field" region, or "far field" region). The following will examine procedures followed in accordance with FCC OET Bulletin 65- Edition 97-01, with analytical adjustments to equations per Richard Tell and Ed Mantiply of the FCC Office of Engineering Technology. To determine emissions of Omnnipoint PCS Antennas at any point in S o u t h h o l d: Far Field- Any point in the community: When power density predictions of field points in the community are calculated Far Field equations can be used. The elevation from the centerline of the proposed antennas to the base of the replacement monopole the transmitting antennas would be 57 feet and 50 feet. The closest an individual could approach the transmitting antennas would be 44 feet. This assumes a 6 foot tall person, with the distances being measured from the top of that individual's head standing directly below the replacement Monopole to the centerline of the lowest antenna panels described. b) The antenna clusters will consist of three (3) Sectors, using two (2) quadpol Directional type antennas (EMS DR65-19-02DPQ or equivalent), for proposed carrier Omnipoint in each sector for transmission and receive. The physical arrangement of these antennas is illustrated in drawings provided by Omnipoint. (Assumed 2 degree downtilt for all antennas in this analysis.) c) The maximum number of channels that will be assigned to the antenna array, for proposed carrier Omnipoint, in any direction, will not exceed twelve (12). The maximum power from the transmitting antennas in each sector, with all twelve (12) channels transmitting simultaneously, will not exceed 3000 Watts, ERP (@ 250 watts ERP/channel). The radio transmissions will be at frequencies between 1930 and 1950 Megahertz. d) The coverage pattern of the voice antennas will be in three (3) sectors and is considered to transmit circularly, 360 degrees. This will provide a worst case situation, resulting in the maximum possible power density. e) It was assumed that the elevation of the Southhold community within a radius of 2000 feet from the replacement Monopole perimeter is equal to the elevation at the base of the replacement Monopole, with exceptions as noted. f) All field points are at Radial distances indicated from the base of the replacement Monopole where the vertical line of the Transmitting antennas intersect. The agencies must consider whether their actions significantly affect the "the quality of the human environment". To implement this mandate, the Federal Communications Commission (FCC) adopted rules covering the NEPA in licensing and approving facilities and operations under its jurisdiction. Rules adopted were codified in the code of Federal Regulations, Part 1, Subpart I, of the FCC Rules and Regulations. Facilities or operations specified must provide information assessing the environmental effect of their proposal. In the case of RF radiation, the environmental effect would be the relative health risk to people living or working near or at the facility in question. The FCC was required by NEPA to make a determination as to whether the facilities or operations it approves may significantly affect the human environment with regard to RF emissions. As there was no federal standard for exposure to RF emissions, the FCC chose to rely upon a recognized non-government standard. The FCC selected the "American National Standard Safety Level With Respect to Human Exposure to Radio Frequency Electromagnetic Fields, "300 KiloHertz (kHz) to 100 GigaHertz (GHz)" prepared by the American National Standards Institute (ANSI) in 1982. The protection guides recommended by ANSI were the guidelines the FCC had identified for using in evaluating environmental significance with respect to Human Exposure to RF emissions. The FCC adopted rules which required preparation of environmental assessment if the particular facility or operation would cause exposure of workers or the general public to levels of radio frequency radiation in excess of the ANSI protection guides. .The rule was contained in 47 CFR 1.1307(d). That rule applied to facilities or operations licensed or authorized under the following parts of the Commission's Rules, 5,21 Subpart K), 25, 73, 74 (Subparts A, G, I, and L), and 80. The facilities and operations licensed or authorized under all other parts, subparts or sections of the Commissions Rules were categorically excluded from consideration. 0 In 1986 the National Council on Radiation Protection and Measurements, Sub-Committee SC-53, published recommended limits for occupational and public exposure (NCRP - "Biological effects and exposure criteria for radio frequency electromagnetic fields." NCRP Report No. 86, National Council on Radiation Protection and Measurements, Bethesda, Maryland). Sub-Committee SC-53 independently retained Radiation Frequency Protection Guidelines (RFPGs) similar to those of the 1982 ANSI Standard but with one notable exception: two tiers appear, one for occupational exposure and one for exposure of the general public. In 1993, the EPA, aware of the FCC's Notice of Proposed Rule Making (In the matter of Guidelines for Evaluating the Environmental Effects of Radio Frequency Radiation, August 13, 1993. III. Severability. If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid,the judgment shall not effect the validity of this law as a whole or any part there of other than the part so decided to be unconstitutional or invalid. The applicant has confirmed that 43 feet would be code-permitted after calculating the 23 ft. average height of the trees, and 20 feet allowed above this average. But I would like to voice my concern that the siren will be continued and mounted on the tower as well. It is my understanding that this siren was gifted to the district from the Shoreham power plant. It is my assumption then, that this siren was to be used once, in the event of a "three mile island"type of meltdown to alert those within hearing to flee or perish. Well, for the years that we have had this thing,we 10 employees at East End Insurance have endured several sirens per day. These events stop all work, cease phone calls and must be injurious to our health. I have no way of proving a causal relation,but I have lost hearing in my left ear suddenly,the side toward the fire house as I sit at my desk. I am also a Vietnam vet and just attributed the sudden loss to after affects from all the mortar and rocket attacks we had at that time. But who knows? I would invite any interested party to come to the office at noon to experience the pain of this siren. I think this would be an excellent time to consider the purpose of this siren and if there is any reason for it to be sounded at all; if there is a reason to sound it,how loud should it be? Even the MTA corrected the volume of the train horns at grade crossings,why can't we 1. decrease to volume, 2. aim it higher to project away from the neighbors and toward whoever is the intended receiver of this noise. 3. Discuss the logic and rationale for a noon siren, (if it is a test it could be 2 seconds long) and discuss the logic and rationale for the ambulance siren when all the volunteers have radio signals anyway. As a next-door neighbor of the Fire Department, I would like to express my concern regarding the loudness of the siren. Every Noon, when the siren sounds, it brings our office to a stop. If the windows are open, people rush to close them as the noise is truly hurtful. As emergencies are called in, again the siren goes off and we cringe until it has stopped. Oliva, Chairwoman_ Ref: Southold Fire District/Omnipoint #5547 As Manager of Colonial Village, I sent a letter to the Southold Town Board of Appeals on June 17,2004, attempting to seek ways of reducing the noise level from the fire siren(copy attached). In order to continue to pursue ways of balancing the needs of the fire department, the safety of vehicles approaching the firehouse during department activity, and the quality of life of the residents in the shadow of the siren; I contacted the NYS DOT Project Engineer for the reconstruction of Rt. 25 in Southold (DOT ref#259518)Joe Ludwig,concerning the installation of special stop lights to notify vehicles approaching the firehouse when fire department vehicles are exiting the firehouse. Special firehouse traffic signals are used in many locations and would appear to be more effective and appropriate for warning vehicles approaching the firehouse than a siren. Joe Ludwig informed me that there was no plan to install such a system. It would appear that this is the opportunity,before the Main Road is rebuilt and repaved,to consider such a system. The existing siren, initially designed for the Shoreham Nuclear power plant, produces sound levels that exceeds 120 dbls(115 being the OCHA limit). Although the siren is not strictly an Omnipoint issue,their request presents an opportunity to re-examine the impact of the dangerous and probably unnecessary noise produced by this high intensity siren. The Board should require that some attempt be made to reach a compromise between the needs for the Fire Department, and needs of the adjacent neighbors. Although there may not be any requirement for an impact study before installing such a high intensity siren in the back yard of a community of senior citizens, (our records don't have any indication of any review or discussion before the new siren was installed),I can assure the Board that, after 8 years of being exposed to the intense and ear shattering noise,most of our residents feel they were let down or forgotten by the Town. Attempts to voice concerns about the siren have been rebuffed by insinuating that our residents did not support the Fire Department. Nothing could be further from the truth. r' 3.
