In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : 1 . No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. The subject property is one of many waterfront homes in this neighborhood which are being renovated. The existing brick residence is to be renovated with a new addition on the landward side of the existing residence, a second floor will be added to the existing residence and an in- ground pool to replace the existing above ground pool and decking. The property has bulkhead at the top of the bluff and construction will be landward of the bulkhead. The bluff is heavily vegetated and stable . The proposed renovation to the house and pool, as well as the existing structures on the bluff, have been approved by the Town Trustees . The DEC has no jurisdiction above the 10 ' contour and a letter of non- jurisdiction is pending. 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing brick house is to be renovated, the house and above ground pool predates the bluff setback ordinance. The bulkhead protects the bluff and the existing structures are in need of renovation and upgrade to meet current code requirements . 3 . The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance. The existing structures 4110 4110 establish the setbacks, the pool will be replaced and the first floor of the house is retained with badly needed improvements . 4 . The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district . The owners wish to improve the existing conditions . The vegetation on the bluff is mature and stable . This region has experienced no erosion. Certain decks and wood platforms on the bluff have or will be removed. The Trustees have issued approval for the proposed improvements, no adverse effects or impacts on the environmental conditions of the property, neighborhood or district will result . 5 . The alleged difficulty was not self-created. The conditions of the property, topography and create the difficulty. The existing residence and pool are already on the property and predate the setback ordinance . 6 . The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant . Existing nonconforming decks which could cause environmental damage on the bluff are being removed, the pool which is landward of an existing bulkhead is to be replaced and the existing house renovated to meet current building codes . The renovations are modest given the size of the property and similar properties in this neighborhood.
