PROPERTY FACTS/DESCRIPTION: The applicant's 14,996 sq. ft. parcel is shown as Lot 122 on the filed map of Cedar Beach Park (or 12,667 sq. ft. per surveyor tie line measurements at bulkhead) with 100 feet along West Lake Drive and 126.24 feet in depth along the easterly side line. The property is improved with a one-story frame house with garage, as shown on the July 6, 2004 site map prepared by Robert Charles Tast, R.A. BASIS OF APPLICATION: Building Department's July 22, 2004 Notice of Disapproval, citing Section 100-244, in its denial of a building permit to construct additions with alterations which will be less than the code-required 35 feet from the front yard line and exceeding the 20% code limitation of lot coverage. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on December 16, 2004 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: In the applicant's original application and survey map dated July 6, 2004, prepared by Robert Charles Tast, Architect, the front porch was requested with variable dimensions, 24.74 feet from the front lot line facing West Lake Drive, 12.9 ft. and 12.8 ft. side yards, and lot coverage at 22.3% of the 14,997 sq. ft. parcel size. AMENDED AREA VARIANCE RELIEF REQUESTED: During the December 16, 2004 public hearing, the applicant was requested, and agreed, to increase the front yard setback that would be more conforming to the code's front setback requirement of 35 feet, reducing the size of the porch from 8-11' depth variables x 58.30'+- lin ft., to 8' in depth x 58.30' lin ft., after removing a 3 ft. x 15.50 ft. section of the porch, resulting a 27' +- front setback, 12.9 feet from the west side line and 28.8+- feet to the east side line. (The applicant agreed to submit the Board's requested revisions for this reduction, to allow for an 8 ft. deep front porch, before obtaining a building permit.) This also reduced the lot coverage from 22.6% to 22.3%. Page 2—December 29, 2004 . • ZB Ref. 5627—Nancy Louise Carroll CTM Id: 90-1-21 REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant requests a proposed one-story covered porch along the entire front length of her home on West Lake Drive in Southold. The setback proposed is greater than at least one parcel, adjacent to the east, which contains a nonconforming front yard setback as close as 22.5 feet. The lot coverage request was reduced to 22.3% of the entire lot size (or 26.8% when measuring the lot size to a tie line at the bulkhead). 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's lot is a small lot (12,667 sq. ft. in area when measured to the existing bulkhead), and the applicant wishes to construct a single-story 8 ft. porch in front of the existing concrete entry/platform/brick walkway, which is presently 32+- feet from the front property line, requiring code relief. 3. The variance granted for the porch is not substantial. The existing front walkway with platform at the entrance is 32+- feet from the front property line, and the proposed 8 ft. porch will replace this area, resulting in a 27+- ft. front yard setback. The lot coverage increase would allow 2.3%, or 345 square feet, over the 20% code limitation of the 14,997 sq. ft. lot size, for 3,344.11 sq. ft. total (22.3%). 4. The difficulty has been self-created and is related to the need for a front porch, which cannot be planned to meet the setback requirement of the zoning code. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a front porch, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Dinizio, and duly carried, to DENY the variance shown on the July 6, 2004 architectural site plan prepared by Robert '' Page 3—December 29, 2004 , II ZB Ref. 5627— Nancy Louise Carroll CTM Id: 90-1-21 Charles Tast, R.A., and to GRANT alternative relief, for an one-story front porch not to exceed 8 ft. by 58.30 lin ft. at 27+-feet from the front lot line, with the condition that the applicant obtain a revised survey to confirm this alternative, for submission when applying for a building permit. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : 1 . No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. The variance is required to add a covered porch on the front of the renovated house . The surveyor has measured the front yard of the adjacent property (east) , it is only 22 . 5 feet from the road. The proposed setback is 24 . 74 to West Lake Drive . A dead end street contains only 7 homes . The lot coverage will be slightly exceeded, per the filed map the proposed lot coverage is 22 . 6% (to the bulkhead/tie line 26 . 8%) in order to construct the covered porch. The lot is only 100 feet in width and 127 to the bulkhead. The proposed covered porch will provide an architectural break for the front of the house and a small covered seating area for rocking chairs . The architect has designed the covered porch to provide better circulation for the house, the dining room and master bedroom will have french doors which open onto the covered porch. The house is designed to enjoy the waterfront location and open summer home feel . 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance. The front porch provides access with the french doors off of the front rooms . Elimination of the front porch will require elimination of the french doors (otherwise the grade of the property would have to be changed to meet the french doors with the grade) . S 410 3 . The waterfront homes along West Lake Drive are being renovate and substantially improved, the homes are designed to benefit from the waterfront views . The owner has planned significant improvements to the property, the proposed covered porch will not result in a substantial increase to lot coverage . 4 . The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district . The front porch is on the landward side of the house and no modifications will be required. 5 . The alleged difficulty was not self-created. This is an undersized waterfront lot which creates the difficulty. The owner wishes to design a house which is in keeping with the waterfront style. 6 . The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant . BASIS OF APPLICATION: Building Department's March 13, 2002 Notice of Disapproval, amended August 30, 2002 and January 13, 2003, citing Section 100f 239.48 regarding an application for a building permit to construct additions/alterations to the existing dwelling. The reasons stated in its denial are that the proposed addition/alteration are: (1) less than 75 feet from the bulkhead, after considering the existing deck addition is"as built'at+_42.8 feet; and (2)will have a lot coverage area greater than the 20%for building areas. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 20, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF.REQUESTED: Applicant wishes to construct a proposed second-story addition, proposed garage addition and proposed deck at the rear of the dwelling. The reasons stated in its denial are that the proposed addition/alteration are: (1) less than 75 feet from the bulkhead, after considering the existing deck addition is "as built" at +- 42.8 feet; and (2) will have a lot coverage area greater than the-20% for building areas. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 20, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF.REQUESTED: Applicant wishes to construct a proposed second-story addition, proposed garage addition and proposed deck at the rear of the dwelling. The setbacks are proposed at 36.6 feet from the front lot line, 12.9 feet on the west side and 12.8 feet from the east side line (total 25.7 ft. total side yards), and 42.8 feet from the bulkhead/rear lot line, as shown on the site plan prepared by Garrett A. Strang, Architect dated 1/13/01 • REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: Page 2—April 3, 2003 Appl. The neighborhood is developed with single-family dwellings on small, nonconforming lots. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to :pursue, other than an area variance. The applicant's lot is a small nonconforming lot, under 15,000 sq. ft.,and the applicant wishes to construct a two-story addition over the existing footprint and to add a garage and deck areas, all of which create the need for code relief. 3, The relief requested is substantial. The code requirement is 75 feet from the bulkhead, and this is-a request for a 32'2" reduction. The second variance is minimal, at only :8% of a reduction in the code. 4. The difficulty was self-created when the applicant purchased the existing house and becoming aware of the small lot size and tight setback tolerances. 5. No substantial evidence has been submitted to suggest that the two variances for the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grantof the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
