SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' 10,066 sq. ft. parcel is shown as Lot #83 on the Map of Marion Manor, with 102+- feet along East Gillette Drive and 100 feet along Cleaves Point Road in East Marion. The property is improved with a 1-1/2 story, single-family dwelling. Gardiners Bay is located 165 feet to the south of this lot. BASIS OF APPLICATION: Building Department's August 20, 2004 Notice of Disapproval, citing Sections 100-33 and 100-244 in its denial of a building permit to construct a new dwelling with an increase in the degree of nonconformance, with setbacks at less than 35 feet from the front lot line, at less than 35 feet from the rear lot line, and with total lot coverage in excess of the code limitation of 20% of the lot area (10,066 sq. ft.). Also proposed is an accessory shed in an area other than the required rear yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 21, 2004 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct a new dwelling, most of which will be over the existing concrete foundation, plus 376 sq. ft. for the deck and 12'8" screened- in porch which extend 12' from the face of the house, shown on the 7/30/04 site plan prepared by Todd Walbourn, Architect and K. Furlong, Designer. The setbacks to the existing foundation are 34' 2" from the westerly front line along East Gillette Drive and 30+-feet between the deck and the front line along Cleaves Point Road; the remaining setbacks are 14' 6.6" to the north and 17'8" to the east, at its closest measurements, as shown on the April 23, 2004 survey prepared by Smith, Jung & Gillis. The average high roof is proposed at 29.28 feet from average grade level. The existing lot coverage is 2,058 sq. ft. or 20.4%. The applicant proposes 2,297 square feet, or 23% lot coverage. Page 2—November 4,2004 • • ZB Ref. 5614—Fred Yarosh and Shei Furlong CTM Id: 38-4-27 ADDITIONAL INFORMATION:AMENDED RELIEF: By letter dated October 18, 2004, the applicants retracted their request for new 11' x 9' accessory shed, reducing the lot coverage and removing the need for yard location variance. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicants' proposed reconstruction is substantially within the footprint of the existing single-family home. The lot fronts along two streets and is limited in size with a nonconforming area of 10,066 square feet. Several field visits were made to the site and the immediate neighborhood. The applicants request for a modest home for year-round use is reasonable and would not create an undesirable change in this residential community. This is a residential neighborhood consisting of construction which over the years had similar difficulties which resulted in relief from zoning code standards. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicants' request is limited based on the size of the lot and applicants' plan to use the existing foundation. 3. The variance granted herein is substantial. The reduction is at least 17 feet less than the code setback requirements from the northerly and easterly lot lines. The relief requested in relation to the proposed lot coverage is not substantial and amounts to an additional 187 sq. ft. of porch construction. 4. The difficulty was self-created and is related to the need to upgrade the existing dwelling over the existing footprint, with a plan that does not conform to the current Town Code requirements. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of substantial reconstruction of the existing dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. After reviewing Mr. Siderakis' letter we tried to reach him by phone in hopes of clarifying his objections to our application for multiple variances. We called him twice at his East Marion address and twice at his Sunnyside, Queens address. We left messages explaining that we were calling to clarify his concerns, and perhaps to meet in person. As of today we have not heard from him. In an attempt to identify what or which parts of our proposed construction he felt was "blocking his view of the bay", we visited the property on Sunday, October 17. We realized for the first time that he does have a small view of the water from the southeastern portion of his property. Until this time we did not know that he had any view of the water. In an effort to understand his request for"disapproval in its entirety" we staked-out our property lines, house boundaries, and the new shed location with the assistance of our architect. It was determined that the shed in its proposed location would block his view. We did not see that any other part of the construction that this variance application pertains to, would block his view. We have attached photographs here that illustrate his view through our property to the bay. It is not our intention to block Mr. Siderakis'view of the bay. We would therefore like to retract the proposed shed from this variance application. Since Mr. Siderakis did not specify what part of our variance application he objected to, our architect has prepared a drawing describing the sight lines to the bay from his property across our property. The architect's drawing is included here for your review. The new materials and construction quality will be of much greater quality than exists now. For example painted plywood 'T-111' siding that exists now will be replaced by natural stained cedar shiplap siding. The new, higher quality construction and materials will be more in keeping with the character of the neighborhood. 2) House: The new house is to be built on the existing foundation with the same footprint. The small .231 acre lot has three front yards and one rear yard, each requiring a 35 ft. setback, which is an unusual circumstance since most lots have one or two side yards with 10 ft. setback limits. Cedar Lane, which creates one of the "front yard" set-backs is closed and no longer active. Cleaves Point Road,which creates another of the"front yard"set- backs is open for half the length of the property and closed and no longer active for the second half of the property. The increase by 3% in lot coverage is created by two living area overhangs and part of the deck, which cantilever 2 ft., or less beyond the existing foundation wall. Please refer to photos for clarification on proposed overhangs. Shed: The new shed is located along Cedar Lane, which is a closed, no longer active, street that is overgrown with large trees and shrubs. In addition, locating sheds along Cedar Lane, as we propose, is common for homes located on East Gillette Drive. Please refer to photos. 3) The amount of relief requested is minimal because the house already exists on the same foundation and footprint. The location of the shed is in what is commonly understood as the "backyard" of properties on East Gillette Drive. 4) There will be no physical and environmental impact since the present house is already on its existing foundation and we propose minimal re-grading. The new slab-on-grade for the shed is less than 100 square feet and should not have any known impacts. 5) The variance is not self-created. After reviewing Mr. Siderakis'letter we tried to reach him by phone in hopes of clarifying his objections to our application for multiple;variances. We called him twice at his East Marion address and twice at his Sunnyside, Queens address. We left messages explaining that we were calling to clarify his concerns, and perhaps to meet in person. As of today we have not heard from him. In an attempt to identify what or which parts of our proposed construction he felt was "blocking his view of the bay", we visited the property on Sunday,October 17. We realized for the first time that he does have a small view of the water from the southeastern portion of his property. Until this time we did not know that he had any view of the water. In an effort to understand his request for"disapproval in its entirety"we staked-out our property lines, house boundaries, and the new shed location with the assistance of our architect. It was determined that the shed in its proposed location would block his view. We did not see that any other part of the construction that this variance application pertains to, would block his view. We have attached photographs here that illustrate his view through our property to the bay. It is not our intention to block Mr. Side kis'view of the bay. We would t -,refore like to retract the proposed shed from this variance applicati n. Since Mr. Siderakis did not specify what part of our variance application he objected to, our architect has prepared a drawing describing the sight lines to the bay from his property across our property. SEQRA DETERMINATION: The Zoning Board of Appeals has visit' d the property under • consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' 10,066 sq. ft. parcel is shown as Lot #83 on the Map of Marion Manor, with 102+-feet along East Gillette Drive and 100 feet along Cleaves Point Road in East Marion. The property is improved with a 1-Y2 story, single-family dwelling. Gardiners Bay is located 165 feet to the south of this lot: BASIS OF APPLICATION: Building Department's August 20, 2004 Notice of Disapproval, citing Sections 100-33 and 100-244 in its denial of a building permit to construct a new dwelling with an increase in the degree of nonconformance, with setbacks at less than 35 feet from the front lot line, at less than 35,feet from the rear lot line, and with total lot coverage in excess of the code-limitation of 20% of the lot area (10,066 sq. ft.). Also proposed is an accessory shed in an area other than the required rear yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 21, 2004 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct a new dwelling, most of which will be over the existing concrete foundation, plus 376 sq. ft. for the deck and 12'8" screened- in porch which extend 12' from the face of the house, shown on the 7/30/04 site plan prepared by Todd Walbourn, Architect and K. Furlong, Designer. The setbacks to the existing foundation are 34' 2" from the westerly front line along East Gillette Drive and 30+-feet between the deck and the front line along Cleaves Point Road; the remaining setbacks are 14' 6.6" to the north and 17'8" to the east, at its closest measurements, as shown on the April 23, 2004 survey prepared by Smith, Jung& Gillis. The average high roof is proposed at 29.28 feet from average grade level. The existing lot coverage is 2,058 sq. ft. or 20.4%. The applicant proposes 2,297 square feet, or 23% lot coverage. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties: The applicants' proposed reconstruction is 1 substantially within the footprint of the existing single-family home. The lot fronts along two streets . and is limited in size with a nonconforming area of 14,066 square feet. Several field visits were made to the site and the immediate neighborhood. The applicants request for a modest home for year-round use is reasonable and would not create;an undesirable change in this residential community. This is a residential neighborhood consisting of construction which over the years had similar difficulties which resulted in relief from zoning code standards. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicants' request is limited based on the size of the lot and applicants' plan to use the existing foundation. 3. The variance granted herein is substantial. The reduction is at least 17 feet less than the code setback requirements from the northerly and easterly lot lines. The relief requested in relation to the proposed lot coverage is not substantial and amounts to an additional 187 sq. ft. of porch construction. 4. The difficulty was self-created and is related to the need to upgrade the existing dwelling over the existing footprint, with a plan that does not conform to the current Town Code requirements. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6.
