PROPERTY FACTS/DESCRIPTION: The applicant's 13,532.16 sq. ft. lot has 100 ft. frontage along Gillette Drive and along East Gillette Drive, and a depth of 134.05 feet along the northerly property line. The lot is improved with a two-story frame dwelling situated 44.7 feet from the westerly front line facing Gillette Drive, and 59.9 feet from the front line along East Gillette Drive. BASIS OF APPLICATION: Building Department's February 19, 2004, Notice of Disapproval, citing Code Section 100-33 in its denial of a building permit application concerning a swimming pool proposed in a front yard location rather than a rear yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 20, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following fads to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to locate a new 18' x 36' in-ground swimming pool wide 9 ft. wide step area, proposed at least 20 feet from easterly front lot line and at least 23 feet from the north lot line and at least 20 feet from the south lot line, as shown on the 1-2- 2003 survey sketch prepared by Kenneth M. Woychuk, L.S. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because swimming pools are a customary use in this residential zone. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the property has two front yards and no rear yard under the zoning code definitions. 3. The variance granted herein is not substantial. The pool will be located behind the house and will be at setbacks greater than that required for accessory buildings or structures when located in a defined rear yard, and additional screening on the street side is a condition of this approval. 4. The difficulty was not self-created. 5. No evidence has been submitted during the hearing or in the written record to suggest that a variance in this community of single-family homes will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of this relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Chairwoman Oliva, and duly carried, to GRANT the variance as applied for, as shown on the 1-2-03 survey sketch prepared by Kenneth M. Woychuk, L.S. date stamped by ZBA 3/26/04, with the condition that the applicant plant and continuously maintain landscape trees along the east side of the property line running north and south outside of the safety fence. The landscape must fully shield the pool from the street at all times. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : 1 . No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. The property is unique in that it is only 30 ' by approximately 75 ' and located on Orient Harbor. The property is protected solely by Marine structures such as the bulkhead, gabions filled with sand and covered over by the proposed decking. In 1992 the house, bulkhead and deck were damaged in a storm. The house and deck predate zoning and all structures and the lot are nonconforming. The DEC issued a permit, after litigation, to a prior owner and permit transferred to my client (Inger Boyajian) . The Town Trustees issued the original permit to the prior owner in 1993 to reconstruct the existing house within the existing footprint (without expansion) , replace deck and add wave attenuating gabion revetment within the footprint . My client purchased the property and began to pursue transfer of the permits and extension of existing permits . Construction of the gabion, attenuation structures and bulkhead was needed to be done first to protect the ultimate renovations of the house. These structures do not require a building permit so one was not sought . Costello started in September 2003 . Costello could not place the DEC and Trustee required marine structures with the deck in place so the deck was removed with the intention of being replaced after the improvements were completed. The building department directed us to obtain a variance for replacement of the nonconforming deck because it was removed. The building department has issued a building permit for the renovation of the existing house and the 410 0 work has commenced in accordance with that permit (permit #30265Z) 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance. The house sits above the sand, gabion revetment and wave attenuation structures . The decking is intended to go on top of this marine infrastructure . The previous deck was at the level of the house and the house and deck will be located in accordance with FEMA regulations 11 feet above flood elevation. The house will have no usable outside living area if the deck is not replaced. Moreover, the project will not be in compliance with the Gabion and wave attenuation design approved by the DEC and Trustees . The gabion are filled with sand and then the top capped off with the decking. The house is unique in all respects and the structures are constructed almost to the property line . The house is adjacent to the road end. The road end washed out due to the lack of adjacent support provided by the owner' s bulkhead and inadequate road design adjacent to the water. The owner and Costello Contracting bolstered the road end, at great additional expense to the owner and at no cost to the Town in an effort to protect the property. The decking is a necessary part of the overall design. 3 . The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance. The decking was in place prior to the construction, the decking required replacement due to normal wear and tear from storm damage and part of the deck was lost when the bulkhead was destroyed during a storm. All these improvements were issued permits but normal delay between agencies required extension and renewal of permits . The deck could not be repaired until the gabion and wave attenuation structures were constructed in January 2004 . The applicant has gone through great expense, time and aggravation to start the renovation of the house, the decking is the finish work of the house and would present an extreme hardship if denied as propose. 4111 1111 4 . The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district . All of the structures which were required as a pre-condition of renovating the house are intended to mitigate the physical and environmental conditions . The house has been left unattended for years due to the permit processes which burdened this applicant . Now that all the permits and structural components are in place, the deck replacement becomes an issue . Common sense should be applied, when a DEC and Trustees plan incorporates in kind and in place replacement of the deck damaged by storms or other reasons (like support structures of gabion and attenuation structures) this matter should not require a variance. The improvements are in conformity with State and Local environmental review. 5 . The alleged difficulty was not self-created. The Gabion and Bulkhead are necessary to protect the house and the design requirements of regulatory agencies (DEC, and FEMA) Compliance with these regulations required the removal of decking- never intending to remove the decking permanently from the plan. The house is primarily a summer residence and decking is an integral part of the use of the property. There is no yard without the decking. Moreover, the bulkead was setback from it' s original position by 4 feet (landward) due to DEC regulations so the decking is 4 ' landward of the original deck. 6 . The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant . The decking provides access around the house . Without the decking the house sits 11 feet above flood elevation. On the basis that we truly would not like to have swimming pool in our front yard and also it is more a reality than not,that the pool would devalue our property. Not everyone would enjoy viewing a swimming pool site, chain link fence, and the activities around it through their living room and den windows. There are no other pools in the neighborhood on Gillette Drive or East Gillette like this. There is one on a single lot on the south end of East Gillette and there is a house on Midland Drive that has a pool in their back yard. Neither pool appears to have any aesthetic interference with their neighbors. It would seem that the Vitelli's pool could set a precedent for anyone in this area to build a pool in their front yard.
