Property Location: 705 Bridge Lane, Cutchogue: CTM 118-2-8. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 1.06-acre lot is improved with a two-story frame house with attached garage and separate swimming pool construction, as shown on the March 15, 2000 survey, updated May 11, 2004, by John C. Ehlers, L.S. BASIS OF APPLICATION: Building Department's January 26, 2004 Notice of Disapproval, citing Code Section 100-33C in its denial of a building permit application concerning applicant's proposal to demolish an existing building and to construct a new garage at less than 35 feet from the front lot line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on June 22, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a new accessory garage, 24' x 30' at 35 feet from front yard line at closest point instead of 50 feet, after removal of the entire 16.3 ft. x 18.4 ft. accessory building in the same yard area. The height of the proposed garage will be less than the code's 18 ft. maximum at mean height, and 21 feet or less, to the top of the ridge. A storage area is proposed above the first story of the garage as shown on the plan prepared 5/10/04 by Donald G. Feller, Architect. The location will meet the code requirement with a minimum 10 ft. setback from the southerly yard line. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant is proposing to replace a damaged one-story garage that was built many years ago, with a new garage with storage above. The •F?age 2-July 1,2004 • • ZBA No.5539-John Wolleben CTM 118-2-8 setback difference between the new garage and the old garage will be for a 35 ft. setback instead of the existing 40 ft. setback, without need for any other relief. The new garage will be partly screened from view with mature landscaping and trees. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The garage that exists will be removed entirely, and a new garage will be constructed in the same yard area. 3. The variance granted herein is substantial. The relief requested is a reduction of 15 feet for a 35 ft. minimum front yard setback, instead of the code requirement for a 50 ft. setback. 4. The difficulty was self-created when the new construction was planned in a nonconforming location. 5. No evidence has been submitted to suggest that a variance in this community of waterfront single-family residences with accessory buildings in the front yard area will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested variance is the minimum necessary and adequate to enable the applicants to enjoy the benefit of having a new garage while preserving and protecting the character of the neighborhood and the health, safety, and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Orlando, and duly carried, to GRANT the variance as applied for, as shown on the 5/10/04 plan prepared by Donald Feiler, Architect, and survey amended 6/22/04 by John C. Ehlers, L.S., SUBJECT TO THE FOLLOWING CONDITION: That the accessory building shall be for storage and garage use only; no sleeping or living quarters. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. MORICHES, NY 11940-1222 CommissondExpirese9,2007 John& Patricia Wolleben • 705 Bridge La., Cutchogue CM# 1000-118-2-8 REASON FOR APPEAL 1) An undesirable change will NOT be produced in the character of the neighborhood or a detriment to nearby properties, if granted BECAUSE: • Only approximately 360 sq.ft. of the proposed structure will require a variance. • The location of the proposed garage will not create any obstruction of views of neighbors, nor will it produce any other negative impact and is partially screened from view with mature landscaping and trees. 2) The benefit sought by the applicant CANNOT be achieved by some method, feasible for the applicant to pursue, other than the area variance BECAUSE: • The vicinity of the existing one story frame building is the optimum location for a garage. The existing building is non-conforming. The proposed structure will replace the existing building. 3) The amount of relief requested is not substantial BECAUSE • A variance of 15' is being requested. • The area subject to the variance is approximately 360 square feet. 4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district BECAUSE • Adequate setbacks are being maintained from the wetlands. • Minimal clearing will be required for placement of the garage in the proposed location. • Proposed lot coverage will be approximately 9.2%; 20% is permitted. 5) Has the alleged difficulty been self-created? ( ) Yes. ( X ) No. 6) The physical constraints of the property dictate the placement of the proposed garage. The location of the existing building is non-conforming and the proposed garage will replace the existing building. This is the minimum that is necessary and adequate, and at the same time preserve and protect the character of the neighborhood and the 4alth, safety and welfare of the community. // _ Lee E y,[ Catherine Mesiano, Inc., Agent for John&Patricia Wolleben Swom to before me this,('day of , 2004. 4IJJ W ' /ONotary NE W. No 4856 — JOHN WOLLEBEN. PARCEL 1000-118-2-8 STREET & LOCALITY: 750 Bridge Lane, Cutchogue Lot#121 Amended Map B of Section B, Nassau Point Club Properties DATE OF PUBLIC HEARING: September 14, 2000 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION. Applicant's property is located on the south side of Bridge Lane and the west side of Bayberry Road The survey map dated May 22, 2000 shows that this lot is 1 06 acres in size to a tie line along a lagoon The premises is improved with a single-family dwelling with garage addition, accessory building in the easterly front yard, and dock. The property is 214,68 ft. along Bayberry Road and 228 23 feet along Bridge Lane. BASIS OF APPEAL: Building Inspector's July 14, 2000 Action of Disapproval which reads that an accessory in-ground swimming pool is not permitted in the case of a waterfront lot when the front yard setback is less than fifty (50) feet from the front property line, pursuant to Article Ill, Section 100-33C. The swimming pool is proposed at thirty five (35) feet from the front property line AREA VARIANCE RELIEF REQUESTED BY APPLICANT: The request made by applicant is to locate an accessory swimming pool with a setback of thirty-five (35) feet from the front property line REASONS FOR BOARD ACTION (1) The granting of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because the accessory swimming pool will be located in the least environmentally sensitive part of this waterfront lot and will be, partially screened from view by mature trees and landscaping No evidence was presented to suggest that the relief hereby'granted will produce an undesirable change in the character of the neighborhood Many residences in the neighborhood enjoy in-ground swimming pools (2) The benefit sought by the applicant cannot be achieved by some method. feasible for applicant to pursue, other than an area vanance because the property is a waterfront lot subject to environmental restrictions which prohibit placement in this area Although the Town Code allows accessory structures to be located in the front yard in the case of waterfront lots, applicant's property contains two front yards; the proposed area facing Bridge Lane, and the front yard area facing Bayberry Lane, which is used as a driveway and parking area. There are no other locations on the property which would not require a vanance to construct a swimming pool (3) The requested area variance is not substantial a (. roti • ,.t- c,ma ' 4j,,rj .,, Dvt4 r' t ,1 ` r, _ + .,f 4,i:Y't 1,4 . . ri r F+ (4) There is no evidence that the grant of the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district: (5) The alleged difficulty has been self-created, in part, and relates enjoy a swimming pool, and is in part due to the physical constraintso to the applicant's desire to In considering this a f the lot adequate for thea application, the Board deems this action to be the minimum necessaryI. applicants to enjoy the benefit of a new in-ground swimmingi grant of this variance will preserve the character of the neighborhood sand welfare of the community, Pool, and that the and the health, safety, 1 RESOLUTION/ACTION: On motion by Member Tortora seconded byI Member Collins, it was RESOLVED, to GRANT the variance, as applied for, 1 VOTE OF THE BOARD: AYES: Members Goehringer Chair i Horning.
