SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 27,305 sq. ft. lot has 185.61 ft. along C.R. 48 and 150 ft. in depth. The property is vacant, and borders a County of Suffolk access road to the County sump to the north. Bordering the property on the east is Van Duzer Gas Appliance Co. and to the west of the county right-of-way is Quad Enterprises (vehicle repair). BASIS OF APPLICATION: Building Department's December 11, 2003, Notice of Disapproval, amended April 1, 2004, citing Code Sections 100-102 and 100-103C, in its denial of a building permit application concerning a proposed building (retail flooring business) with rear yard at less than 35 feet, and building length greater than the code limitation of 60 feet (linear frontage facing C.R. 48). FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 22, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a new building related to retail and warehouse expansion for carpet retail showroom/warehouse/office). The applicant has warehouses at other sites in Southold and in Mattituck. The new building will be set back 43 feet from the southerly front lot line, 25 feet from the easterly property line, and 10 feet from the northerly property line, at its closest points. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's lot is located in the B-General `r Page 2—May 6,2004 S AS ZBA No.5503—L.Vaccariello CTM 55-2-18.1 at Southold Business Zone District, and borders a black-topped County access right-of-way on the west side, and a County sump on the north side. To the east is a well-established propane gas and appliance retailer, and to the south is a well traveled highway (County Route 48). The proposed setback reduction is at the north side of the property adjacent to the County sump, and will not affect any other property. The reduction in the rear setback will allow a greater setback as well as a sidewalk, parking, egress and ingress, as well as landscaped areas in the front yard facing the highway. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant is in need of expanding his 3,000 sq. ft. showroom in Mattituck, and 3,000 sq. ft. warehouse at another Southold site, and requires a building with 4577 sq. ft. of retail and 2547 sq. ft. of warehouse. The building area will accommodate racks for carpet rolls that extend 14 ft. off the wall. A boom is necessary to maneuver the forklifts that swing, and move the carpets. The depth of the building needed in the warehouse area is 43.4 lin. ft. and for retail 49.6 lin. ft. The site is 150 ft. deep and the overall depth of the building is proposed at 96 ft. for the warehouse area and the retail areas. When including a parking area, landscaped areas, and a front yard setback, all to meet the codes, 10 feet is left for the rear setback from the northerly lot line. 3. The variance granted herein is substantial. The requested 10 ft. rear yard setback is a 25 ft. reduction of the code required 35 ft. minimum. 4. The difficulty was self-created when the new construction was planned without conforming to the current Town Code requirements. 5. No evidence has been submitted to suggest that a variance in this business area will have an adverse impact on the physical or environmental conditions in the neighborhood. The property is zoned B-Business and public water exists in the area. 6. Grant of this relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a business building, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Chairwoman Oliva, and duly carried, to GRANT the variance as applied for, as shown on the plan 1/30/04 site map prepared by b. Although Article X, Section 100-103 A., states, "Structures shall be set back at least 100 feet from the right of way," Section 100-103B states, "There shall be an exemption to Subsection A if the adjacent parcels are developed, in which case the minimum front yard setback shall be the average of the setbacks of the adjacent parcels." None of which will greatly affect the character of the area. My present retail Location in Southold is just under 3000 sf with an additional 3000 sf of warehouse space in Mattituck. I am asking for a total of 4577 sf of retail space and 2547 sf of warehouse on route 48. This would allow me to expand my present operation to compete with the larger businesses in Riverhead and West. A frontage of 80 feet is needed to achieve this space. Even with this frontage, I still meet the towns parking requirement. The following will describe my needs in more detail. In order for the showroom to expand to a reasonable size,I need+-4500sf. With a frontage of 80 feet I will need 50 feet of depth to achieve this size. (The numbers appear incorrect only because the space is irregular. Please see plan for clarification.) The racks that are used to hold rolls of carpet in the warehouse extend 14 ft off the wall, the forklift needed to move a roll of carpet is 6 feet and the boom that extends from the forklift is 12 ft. for a total of 32 feet of depth. An additional 11 feet is needed for swing room to maneuver the forklift. This is why I need 43 feet of depth in the warehouse. The summation of these numbers is as follows. (this site on route 48 has a depth of 146 If is from front to back not along the irregular sides) My front set back as per code -43 If The depth needed in warehouse - 43.4 If The depth needed for retail - 49.61f Therefore I am asking for a rear setback of 10 feet A setback is there to protect the quiet enjoyment of the adjacent parcel. This setback will not affect anyone. The adjacent property is a sump and always will be a sump. Town code asks for a rear setback of 35 ft. The precedent has already been set by the Generator building on the corner of Youngs Ave. There is a building on this property with a 15 ft setback. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and detormines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 27,305 sq. ft. lot has 185.61 ft. along C.R. 48 and 150 ft. in depth. The property is vacant, and borders a County of Suffolk access road to the County sump to the north. Bordering the property on the east is Van Duzer Gas Appliance Co. and to the west of the county right-of-way is Quad Enterprises (vehicle repair). FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 22, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a new building related to retail and warehouse expansion for carpet retail showroom/warehouse/office). The applicant has warehouses at other sites in Southold and in Mattituck. The new building will be set back 43 feet from the southerly front lot line, 25 feet from the easterly property line, and 10 feet from the northerly property line, at its closest points. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1,. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's lot is located in the B-General • Page 2—May 6, 004 * ' 4 - ZBA No.5503—L.Vaccarello CTM 55-2-18.1 at Southold Business Zone District, and borders a black-topped County access right-of-way on the west side, and a County sump on the north side. To the east is a well-established propane gas and appliance retailer, and to the south is a well traveled highway (County Route 48). The proposed setback reduction is at the north side of the property adjacent to the County sump, and will not affect any other property. The reduction in the rear setback will allow a greater setback as well as a sidewalk, parking, egress and ingress, as well as landscaped areas in the front yard facing the highway. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant is in need of expanding his 3,000 sq. ft. showroom in Mattituck, and 3,000 sq. ft. warehouse at another Southold site, and requires a building with 4577 sq. ft. of retail and 2547 sq. ft. of warehouse. The building area will accommodate racks for carpet rolls that extend 14 ft. off the wall. A boom is necessary to maneuver the forklifts that swing, and move the carpets. The depth of the building needed in the warehouse area is 43.4 lin. ft. and for retail 49.6 lin. ft. The site is 150 ft. deep and the overall depth of the building is proposed at 96 ft. for the warehouse area and the retail areas. When including a parking area, landscaped areas, and a front yard setback, all to meet the codes, 10 feet is left for the rear setback from the northerly lot line. 3. The variance granted herein is substantial. The requsted/10 ft. rear yard setback is a 25 ft. reduction of the code required 35 ft. minimum. 4. The difficulty was self-created when the new construction was planned without conforming to the current Town Code requirements. 5. No evidence has been submitted to suggest that a variance in this business area will have an adverse impact on the physical or environmental conditions in the neighborhood. The property is zoned B-Business and public water exists in the area. • 6. Grant of this relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a business building, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The size and dimensions of the proposed building before your Board may result in a 28% lot coverage which is close to the maximum allowed coverage in this district. 2. The Board is willing to waive parking along County Road 48 in order to provide for a more substantial landscape buffer in the front yard along the scenic highway. 3. The applicant will be requested to provide an access for a future 15' wide crossover access to the Van Duzer property to the east. 4. The proposed building (as shown with the combination of retail and warehouse uses) will require 26 spaces. With the land banking that the PB is willing to allow, only 21 spaces will be provided and 5 spaces land banked. 5. The PB has no objections to granting relief on the rear yard setback because this site backs up to a County recharge basin. Preliminary discussions with the County DPW revealed that the County will require access to this recharge basin over the subject property because the creation of a new curb cut to access the subject property will be adjacent to the existing County access to the basin. For safety reasons, the County will close its access and use the proposed access over private property. We hope these comments will be useful to the ZBA in its review of this appeal.
