Dear Board Members,
Last year I received an extension of the above permit for Maintenance Dredging
of Fairhaven Inlet in Cedar Beach, Southold. At that time, I was told it might be better to
request a 10 year extension of the permit in 2002.
I am requesting the 10 year extension at this time.
The present permits from the Corps of Engineers, DEC and Dept of Flood
Management remain current through 2005.

Dear Board Members,
I am requesting a renewal of the above permit for Maintenance Dredging of
Fairhaven Inlet in Cedar Beach, Southold. Suffolk County delayed the dredging of
Cedar Beach Inlet that caused erosion problems for the current dredging of Fairhaven
Inlet. They are scheduled to start sometime this fall through spring. At that time it will
be possible to evaluate the situation and complete the dredging of Fairhaven Inlet.
The present permits from the Corps of Engineers, DEC and Dept of Flood
Management will remain current through 2005.

A detailed description and plans of the applicant's activity are enclosed to assist In your review.
The decision whether to issue a permit will be based on an evaluation of the probable impact,
including cumulative impacts, of the proposed activity on the public interest. That decision will reflect
the national concern for both protection and utilization of important resources. The benefits which
reasonably may be expected to accrue from the proposal must be balanced against its reasonably
foreseeable detriments. All factors which may be relevant to the proposal will be considered including
the cumulative effects thereof; among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, historical properties, fish and wildlife values, floodplain values, land
use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality,
energy needs, safety, food and fiber production, mineral needs, consideration of property ownership and,
in general the needs and welfare of the people.
The Corps of Engineers is soliciting comments from the public; Federal. state, and local agencies
and officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of
this proposed activity. Any comments received will be considered by the Corps of Engineers to determine
whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments
are used to assess impacts on endangered species, historic properties, water quality, general
environmental effects, and the other public interest factors listed above. Comments are used in
preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the
National Environmental Policy Act. Comments are also used to determine the need for a public hearing
and to determine the overall public interest of the proposed activity.
ALL COMMENTS REGARDING THE PERMIT APPLICATION MUST BE PREPARED IN

WORK DESCRIPTION
The applicant, Ted Dowd, has requested Department of the Army authorization to dredge
material from Fair Haven Inlet, Little Peconic Bay at the Town of Southold, Suffolk County,
New York with ten years maintenance and subsequent upland disposal.
The work would involve dredging, with ten years maintenance, by clamshell or backhoe, of
approximately 150 cubic yards of material from the entrance to Fair Haven Inlet to a maximum
depth of 4 feet below mean Iow water. Material from the initial and subsequent maintenance
dredging events, expected to be approximately the same volume every two years during the ten-
year life of the permit, shall be dewatered close to the dredging area on the site using siltation
control measures at the perimeter of the dewatering area with return flow allowed to re-enter the
inlet and subsequently would be disposed of at an upland portion of the applicant's property
(secondary disposal site) where it would be suitably retained to prevent its reentry into any
waterbody and planted with beachgrass and natural vegetation.
The stated purpose of this project is to restore the flow carrying capacity of Fair Haven Inlet.

Dear Board Members,
Attached are recent pictures taken of the entrance to
Fairhaven Inlet at low tide.
Picture Number 1 faces East taken from inside Fairhaven Inlet
out into Cedar Beach Inlet. Note the far side of Cedar Beach Inlet
where sand and stone was deposited during past dredging. The sand
and stone is similar to that pictured on the South side of the
Fairhaven Inlet where it has accumulated over the years.
Picture Number 2 depicts the shallowness of the entry to
Falrhaven Inlet.
The time of low tide in the orJglnal request was incorrect.
It actually will be 11:30 AM on August 18, 1999.

We ara greatly concerned that the dredging of Cedar Beach
Inlet over the years has resulted in sand and stone accumulating
at the mouth of Fairhaven Inlet. As a result, the inlet is nearly
closed and will eventually become stagnant.
Falrhaven Inlet is a natural estuary as depicted in Attachment
One which is a September 5, 1926 copy Van Tuyl's survey prepared
prior to the development of Cedar Beach Park. The survey was
obtained from the Town Tax Assessor's Office.
Falrhaven Inlet began to slowly close after dredging began on
Cedar Beach Inlet. The sand and stone accumulating there is the
same material deposited on the East side of Cedar Beach Inlet.
Enclosed are pictures that depict what has occurred. In addition,
we have framed pictures that can be made available on site.
During the last inlet dredging, the county removed some
material from the mouth of Falrhaven Inlet. Since they are
scheduled to dredge the inlet again this Fall, we requested they
remove material again. We were told to make the request through
the Town of Southold.
Mr Alessi discussed the matter with Mr Krupski and was told
to request the Trustees view the inlet on August 18, 1999. We
would be glad to meet the Trustees at their convenience. Low tide
is at 10:O0 when the full effect of the problem can be easily seen.

The following action was taken by the Board of Town Trustees
during its regular meeting held on October 27, 1999 regarding
the above matter:
WHEREAS, TED DOWD applied to the $outhold Town Trustees for a
permit under the provisions of the Wetland Ordinance of the Town
of Southold, application dated OCTOBER 4, 1999, and,
WHEREAS, said application was referred to the $outhold Tow~
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on October 27, 1999, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the .surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,

RE: Closing off of Fairhaven Inlet.
Dear Board Members,
We are greatly concerned that the dredging of Cedar Beach
Inlet over the years has resulted {n sand and stone accumulating
at the mouth of Fairhaven Inlet. As a result, the inlet is nearly
closed and will eventually become stagnant.
Falrhaven Inlet is a natural estuary as depicted in Attachment
One which is a September 5, 1926 copy Van Tuyl's survey prepared
prior to the development of Cedar Beach Park. The survey was
obtained from the Town Tax Assessor's Office.
F~irhaven Inie< began to slowly clnse after dredging began on
Cedar Beach Inlet. The sand and stone accumulating there is the
same material deposited on the East side of Cedar Beach Inlet.
Enclosed are pictures that depict what has occurred. In addition,
we have framed pictures that can be made available on site.
During the last inlet dredging, the county removed some
material from the mouth of Fairhaven Inlet, Since they are
scheduled to dredge the inlet again this Fail. we requested they
remove materiel again. We were told to make the request through
the Town of Southcld.
Mr Alessl discussed the matter with Mr Krupski and was told
to request the Trustees ~iew the inlet on August 18, 1999. We
would be glad to meec the Trustees ac their convenience. Low tide
is at i0:O0 when the full effect of the problem can be easily seen.
