Dear Mr. Dowd,
The following action was taken at the Southold Town Board of
Trustees meeting on January 22, 1999:
RESOLVED, that the Southold Town Board of Trustees grant the
request for a Waiver to place two split rail fences from
bulkhead to high water mark as indicated on survey with
condition that if the high tide changes, applicant must move
fence either back landward or forward depending on tide
change.
However, this does not constitute approval from any other
agencies.

Dear Mr. Dowd,
On December 21, 1998 we received your request for a Waiver to
place two split rail fences from the bulkhead to the high water
mark on the property listed above.
I have tried to call the phone number you gave us in your letter
and the person who answered said there was no one by the name of
Ted Dowd or Worth Enterprises. I called Mr. Mc Dougall of the
DEC and he gave me this address but the same phone number I
tried.
The reason I am trying to get in touch with you is that you have
to notify your neighbors (listed separately) to let them know
what you are doing on this property, namely putting up fences.
You must include a copy of the survey showing where you are
placing these fences and a brief description of the type of
fence and how high it will be. By law and Town Code you must
notify the neighbors before you are granted a Waiver is
granted. I am enclosing forms to be filled out by you and cards
that must be posted before our meeting which is on January 21,
1999. You can FAX me these back when you have filled them out.

RE: Letter for Waiver.
Dear Board Members,
We are requesting place two split rail fences from
the bulkhead to the hi mark on the property at 1775 Inlet
Way, Southold as outlined on Attachment One. The property is
bounded on three sides by water and on the West by Inlet Way.
We have worked with several environmental groups and Mr
McDougall of the DEC (ATCH 2) in order to set aside two portions
of the property as a bird sanctuary and wildlife preserve.
The beach area is considered an excellent area for Piping
Plover, Terns and other small birds. The DEC is considering
marking that area for Piping Plover this Spring with fences and
signs. However, they have agreed to let us place a more attractive
fence and signs to mark the area.
The other portion is a separate area that has a bulkhead to
protect wildlife along with an existing pole that can be made into
an Osprey Nest.
The entire area is unused for nine months a year and abounds
with birds, geese and other small wildlife if they are not
disturbed. The fence and signs would help to protect birds and
wildlife particularly during the six month Spring and Summer
nesting season.

Dear Mr. Dowd,
I mn writing in regard to our meeting on 8 September. I was glad to hear of your interest in, and concern
for the wildlife that occurs in your area, and your intent to keep your property in a state conducive to the
maintenance of these wildlife populations. As I mentioned to you, thc federally threatened and New York
State endangered piping plover breeds at a number of sites in the Peconic Bay region, some in quit~ close
proximity to your property. Though your beach is probably too narrow to serve as a nesting area, it may
have the potential to be uscd as a foraging ama. Bccaas= of this, as we discussed, either NYSDEC or our
cooperators in thc piping plover conservation program will visit your property during thc early spring to
survey the area for piping plovers. If we do find any, with your permission, symbolic fencing (flagged
string and metal posts) would be erected that would delineate the area being used by the birds. Signs
indicating that the area is fenced to protect piping plovers would be placed on a number of the posts. If
no birds am observed, no fencing would be erected, however thc site would bc cbecked periodically to
see if plovers are utilizing the site. I understand from our oonversatioos that you are planning to erect
more permanent fencing at the site.
