At the meeting of the Southold Town Conservation Advisory Council held Tuesday, March 23,
1999 the following recommendation was made:
Moved by Richard Smith, seconded by Ken Meskill, it was
RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the
Amendment Request of ROBERT AND PATRICIA ALCUS 92-1-2.1 to amend Permit #4279
to add 10' to the existing 6'X 20' floating dock for a total length of 30'.

Dear Tanya,
The following aetion was taken by the Board of Town Trustees
during its reqular meeting held on January 27, 1994 regarding
the above matter:
WHEREAS, ROBERT ALCUS applied to the Southold Town Trustees
for a permit under the provisions of the Wetland Ordinance of
the Town of Southold, application dated, July 21, 1993, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on January 27, 1994 at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town, -~
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
ROBERT ALCUS to construct a 3' X 20' catwalk elevated 4' over
grade, a 3' X 10' ramp and a 6' X 20' float. NOTE: The Board
of Trustees denies request to waive any fees with regard to this
project. Located Cedar Point Drive East, Southold. SCTM
992-1-2.1
Permit will expire two years from the date it is signed. Fees
must be paid, if applicable, and permit issued within six
months of the date of this notification. Two inspections are
required and the Trustees are to be notified upon completion of
said project.

Dear Mr. Krupski~
As per letter dated 12/9/93 from Mr. John Bredemeyer, I have enclosed (2) sets
cf plans revised to indicate the proposed dock re-location to the Pleasant Inlet
side of the subject property as requested by the Board at their 12/6/93 meeting.
Please be advised that it was that same board's request that we relocate said
dock from its originally proposed location on the eastern side of the property
to the northern tip of the property and now finally to the western side.
As this newly amended plan requires an additional permit amendment from the
N.Y.S. Dept. of Environmental Conservation, U.S. Army Corps of Engineers and
N.Y.S. Dept. of State and will cost Mr. Alcus additional monies for said
amendments, we are hereby requesting that the T~w~ Board waive their fee due to
these extenuating circumstances.
Kindly place this matter on the agenda for approval at the next Board of
Trustees, meeting.

Dear Mr. Fox:
The Southold Town Trustees concluded a negative declaration on
this project at our December 6, 1993 regullar meeting.
Because of local concerns surrounding navigation expressed at
that meeting, the Board is asking that this dock be moved more
to the west so that it faces Pleasant Inlet on what is a natural
cove feature.
Since we will likely make this a permit condition, we ask that
you modify the proposal accordingly.
Enclosed for your use are two maps showing the preferred
location.

Dear Mr. Frank:
The Department of State received your Federal Consistency Assessment Form and
supporting information on November 1, 1993 and has determined that the submitted
documentation is adequate to commence our review of your proposed project.
However, pursuant to 15 CFR 930.58, the following data and information is necessary to
enable the Department of State to adequately assess the coastal zone effects of this
proposed project.
Thank you for the information submitted thus far. However, the Department of State
(DOS) is concerned with the location of this proposed dock within the Cedar Beach Point
Significant Habitat (see habitat narrative enclosed). Therefore, please respond to the
following concerns.
As noted within the submitted Federal Consistency Assessment Form (FCAC, see
copy enclosed), item 2c. was answered "NO." However, as the proposed dock would
be located within a significant habitat, this should be answered as "YES." In
addition, please submit a consistency, assessment of the project with regards to Policy
#7. This was omitted within the original application.

What type of vessel would be moored at the proposed float? Would the vessel have
a Marine Sanitation Device (MSD) on-board? If so, where is the nearest MSD
pump-out facility. This information is necessary in order for this reviewer to be
assured that a MSD would not be discharged into the Cedar Beach Point Significant
Habitat.
Please provide the information requested above to the Department of State within thirty
days from the date of this letter. Pursuant to 15 CFR 930.64(d), if this necessary data and
information is not provided, the Department of State may object to your consistency
certification on the grounds of insufficient information.
Any additional information which you believe will facilitate our consistency review of this
project would be appreciated.
You and the Corps of Engineers will be notified of our decision when we have completed
our review of this project for its consistency with the New York State Coastal Management
Program. The Corps of Engineers carmot issue a permit for this project unless the
Department of State concurs with your consistency certification.
A copy of this letter has been sent to the U.S. Army Corps of Engineers.

RESOLVED that pursuant to Article 8 of the Environmental Conservation
Law, State Environmental Quality Review and 6NYCRR Part 617,
Section 617.10 and Chapter 44 of the Code of the Town of Southold,
notice is hereby given that the Southold Town Trustees, as Lead
Agency for the action described below, has determined that the
project will not have a significant effect on the environment.
Please take further notice that this declaration should not be
considered a determination made for any other department or agency
which may also have an application pending for the same or similar
project.
TYPE OF ACTION: Type II.
DESCRIPTION OF ACTION: Applicant requests permit to construct a 4' X
30' timber dock elevated a minimum of 4' over grade with a 3' X 10'
ramp and a 6' X 20' float for a the private dockage of a recreational
vessel. Located Cedar Point Drive East, Southold.
LOCATION: SCTM #1000-92-1-2.1
REASONS SUPPORTING THIS DETERMINATION:
1. An on site inspection has been conducted by the Board of
Trustees.
2. An environmental assessment, submitted by the applicant and
reviewed and completed by the Board of Trustees, has indicated that
no significant adverse effects to the environment are likely to occur
should the following mitigation measures be implemented.

Dear Mr. Frank:
Pursuant to 15 CFR 930.58, the following data and information is necessary to enable the
Department of State to adequately assess the coastal zone effects of this proposed project.
As proposed, this dock/float configuration would be located within the Cedar Beach
Point Significant Habitat. As described within the habitat narrative, "Construction
and maintenance of shoreline structures, such as docks, piers, bulkheads, or
revetments, in any part of this area may have a significant impact on the fish,and
wildlife resources of Cedar Beach Point."
In this review's opinion, the installation of a vessels within this significant habitat
represents the potential for adverse impact to the significant habitat as the result of
an unfortunate discharge of petroleum products or sewage from the vessel. Please
comment on how these potential impacts would be minimized.
From the submitted site plan, it appears that the applicant owns the land under the
area of the proposed 25' dock. However, who owns the underwater lands which
would be below the proposed 6'x 20' float? Have the necessary permits for this
proposed installment been obtained from the owner of the underwater land?
Thank you for submitting photographs of the site. If possible, please submit another
photograph which depicts the actual area of proposed construction. Please draw in
the proposed dock and float and indicate general compass direction.

nearest approved MSD pump-out station.

As depicted in the submitted profile, a minimum of 4' clearance between the
proposed deck and existing grade may not be maintained. Adverse impact to the
existing wetland vegetation may result from the reduction of sunlight in areas below
the proposed dock. Please comment. If possible, the proposed dock configuration
should be moved to a location of an existing path from the upland to the shore. In
this manner, existing vegetation would not be adversely impacted. Please comment.
Pursuant to 15 CFR 930.60(a), the review of your consistency certification will begin after
we receive and determine that the necessary data and information is adequate to assess
coastal zone effects.
Any additional information which you believe will facilitate our consistency review of this
project would be appreciated.

WITH STIPULATIONS of Wetland Application of MATTHEW
McKIERNAN 86-5-11.5 to construct a 1 1/2 story residence. All
material is to be redistributed on property to establish proper
grade. Construct a 4' x 50' catwalk over marshland lto be minimum
3' over reeds in meadow) and install post to secure small boat.
The Council recommends approval provided the house is located at
least 75' from the wetlands. The Council recommends approval of the

5.) There are similar structures to the east and north of the
