Box 1850 Southold, N.Y. 11971 RE: ERNEST SCHNEIDER 1015 LAKESIDE DRIVE, SOUTHOLD SCTM #090-04-06 Dear Mr. Schneider: The Board of Town Trustees took the following action during its regular meeting held on Wednesday August 18, 2004 regarding the above matter: WHEREAS, Ernest Schneider applied to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated March 12, 2004, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 18, 2004, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold Town Code, 2 WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, That the Board of Trustees approve the application of ERNEST H. SCHNEIDER, SR. to construct a 1,395 sq. ft. single-family dwelling with second-story balcony, second- story deck, stairway with platform, and sanitary system, with the condition of a 50' non- disturbance vegetation buffer from the wetland line landward on two sides of the property, a row of staked hay bales along the 50' line, drywells and gutters on the house and all as depicted on the survey prepared by Stanley J. Isaksen, Jr. last dated May 7, 2003. Also, the previously disturbed buffer area must be planted with the species that were agreed upon in the attached planting plan and letter from the Trustee office, and a one- year survivability on the trees and shrubs. Any additional activity within 100' of a wetland line will require permits from this office. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) RESTORATION/MITGATION PLAN The Landscape Remediation Plan submitted to this office is accepted with the following changes, additions, and requirements: TREES The proposed Shadbush and Red Cedar as proposed are approved. Replace the four 2' Black gum and three 2' Scarlet Oak trees with seven trees from the following list, and the sizes must be larger to replace mature trees which xvere removed. Box 1850 Southold, NY 11971 Re: Replanting Plan 1015 Lakeside Drive, SCTM# 90-04-06 Southold, NY Dear Mr. Schneider: The Trustees are responding to your landscaper's request to work in the non-disturbance buffer area with a bulldozer to remove tree stumps and regrade for replanting. The Trustees want the replanting of the area to be done without the use of machinery in that area. The tree stumps are to be left in the ground; some will sprout and grow back and the others provide a large layer of underground biomass, filtering, and protection for the wetland area. The area can be raked out and planted with the trees and shrubs as requested. Please remember that this is a non-disturbance 50' buffer area to the wetland, which needs to be a natural area, not a landscaped area. Please call our office with any further questions. Sincerely. Schneider, Sr. PO Box 1850 Southold, NY 11971 Re: Planting/Remediation Plan Violation A 2043 Tax Map #090-04-06 Lakeside Drive North Southold, NY 11971 Dear Mr. Schneider: The Board of Town Trustees has inspected the above referenced violation and reviewed the planting plan that was submitted to our office. VIOLATION The violation on April 19, 2004 was clearing within 100~ of tidal wetlands. The permit xvhich ~vas approved on December 19, 2001 authorized and permitted the following, "Wetland Permit to re-locate an existing lot line and construct a 1,320 sf. single-family residence and sanitary system on the southern lot. Dwelling will be located a min. of 100' landward of the tidal wetland boundary and the proposed sanitary system shall be located 109' landward of said boundary, all with the condition that a 50' non-disturbance buffer is maintained and that the debris that is pushed to the top of the bluffis removed, and that a row of staked hay bales be places at the 50'setback line prior to construction, all as depicted on the survey dated May 7, 2001 and last revised June 24, 2002." The plan submitted shoxved the 50' undisturbed buffer from the xvetland line. The permit expired December 19, 2003. The Trustees require that the buffer be replanted before a ne~v permit is issued for the house. Please notify the Trustee Office when the planting is complete. There will be an inspection with a $50 inspection fee, and then the application for construction of a house submitted on March 12, 2004 will be reconsidered. Dwelling will be located a min. of 100' landward of the tidal wetland boundary and the proposed sanitary system shall be located 109' landward of said boundary, all with the condition that a 50' non-disturbance buffer is maintained and that the debris that is pushed to the top of the bluff is removed, and that a row of staked hay bales be placed at the 50' setback line prior to construction, all as depicted on the survey dated May 7, 2001 and last revised June 24, 2002. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency, which may also have an application pending for the same or similar project. Permit to construct and complete project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification.
