Krupski President · Southold Board of Trustees 53095 Main Road Southold, NY 11971 Dear Mr. Krupski: Re: Request for amendment to permit ~5481 - We have received a second notice regarding the illegal deck of our easterly neighbor that was disapproved by the Building Department on December 3, 2002 because the "as built" deck is only 36.4 feet from bulkhead instead of the required 75 feet set back. At the public hearing of January 23,2002 we called your attention to fact that the only notice we had received was in in regards to reconstruction of the deck ONLY although the posted NOTICE OF HEARING was for "Wetland Permit for a pre-existing one story private dwelling, bulkhead and wood jetty - removal of existing deck. Your reply was a definite "no"! for the rebuilding. Please be advised that when the house was originally built in the late 1960, it had only a stoop and a standard back door. Although we were aware of the illegality of both the bulkhead and especially the jetty which was "sneeked in" April 2001, we made not comment at the hearing and the Board voted to grandfather them both. Before the erection of our shed in middle March 2001, we were told by the building that NO PERMIT WAS REQUIRED. n August 2002, we received a registered letter from the .Building Dept. which was initiated by neighbors complaint. We went to file application but were refused because they could find no record of our original survey submited in 1964, and requested an up to date survey. In the interim we discussed the matter with acting Supervisor Jean Conchran, who upon checking the illegality of the eastern homeowners jetty, with Assistant Town Attorney, Ms Mary C. Wilson stated: "Instead of starting an investigation at taxpayers expense", that upon obtaining a new survey, she would permit it to be grandfather. We are enclosing our letter addressed to you with a copy sent to Southold Town Attorney (Enclosure 1) and also a letter ~ dated April 6, 1998,to Ms Jill Thorpe,~after the field ~~z- inspection made to our premises by your board because of failure to notify us "As adjacent homeowners" with regards to our westerly homeowner upon reconstructing her jetty, and leaving the stones flowing in the Bay. Both were ignored. We do have CONSTITUTIONAL & CIVIL RIGHTS. As evidenced in the Newspapers. there is a struggle within the political arena as you personally made the front page with the statement "It is all politics". We have been victims since 1982, On January ~,2002, we again applied with the Building Dept. Although they stamped our survey plan, they refused to accept it, stating that Supervisor Cochran had no authority" to make the grandfather commitment. She is in the Executive Branch of Goverment who has the power of enforcement. Your Board issued our permit, ~5435 dated October 26, 2001, however, we did not present the new survey until JANUARY ~/~ 2002 because of the difficult time we had obtaining a surveyor. We would be grateful if you kindly amend our permit showing the shed grandfather. Since the two bulkheads were originaly legal, we have no objections, but request the opportunity to respect~uly voice our views in the mawr so that we can pursue our attempt to resolve this long existing problem.
