Dear Al:
I'm writing regarding the dredging of West Lake--a longer running show than
"Cats", it seems.
I had talked with Lauren and Charlotte about the possibility of getting some relief
on the $6000 charge we got from the Trustees. They suggested that Jim
Bunchuck might have a solution. I talked to Jim and, while he thought the
capping of the landfill might use the soil, he couldn't guarantee it, mostly
because the project would be run by a private contractor. It would also involve
some 60 truckloads of material being moved, which would surely cancel all or
most of any savings realized. This solution was not a good one.
west lake Association is not a large one, 20 property owners, and in the interest
of keeping costs down I have talked to many people and lots of ideas/questions/
statements have emerged. I'm putting them down in no particular order and ask
you to look them Over and maybe give me a call to discuss whether any have
merit.
* By removing the old, Iow bulkhead and planting grass we are creating a marine
habitat, or parkland, and the Town should at least pay for that portion of the
work. (With this possibility in mind I have asked Joe Edgar to show that work
separately on his estimate/bill).
* The Town receives, or is eligible for, a subsidy from Suffolk County for
dredging. In light of the "marine habitat" question, above, is there any help
available from this direction?
* The Lake is man-made, i.e. was an inland body of water which a developer
opened, and therefore the Trustees/Town do not own the bottom and we should
dematld that their spoil be removed from our lake. I loved this one, as I'm sure
you do.
* All ploys and strategies aside, the Trustees did seem truly pleased to have the
bulkhead/beach cleaned up because of positive and natural environmental
benefits. This is maybe the best reason for you to cancel the fee--the whole
project is important not only to the residents, but to the Town, as you said at the
final hearing.
Our final question: the approval plan calls for spoil to go on Mr. Moy's beach,
with some to Mrs. Greenfield because she asked for it at that last hearing. Is the
distribution of the spoil confined to the sites shown on the plan or can it be
placed on beaches to the right of Moy and/or the left of Greenfield. I don't want
to be coy here--I'm asking because it is uncertain whether either party will
contribute any money to the project and it offends my sensibilities to see them
benefit while getting a free ride.
I'm sure you have OD'd on West Lake dredging, but I would appreciate a call
regarding these various point. Thank you.

Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on June 21, 2000 at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,

WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,

of approx. 600 cy. of dredge spoil on indicated sites on the
approved plan, the area of the old bulkhead will be removed and

We are getting confused about the West Lake dredging permit and wonder if we could
meet with you to talk about it.
* It semms to us that the trustees are, in general, leaning toward the dredging.
* Of the four property owners that we know were opposed (Moy, Greenfield, Barbado,
Christie) two, Moy and Greenfield, have generally eased up and appear to be, if not
wholeheartedly for it, not so vehemently opposed.
*The idea of some kind of bond was raised. Things really got confusing--performance
bond, maintenance bond--who knew?
*After talking to you and Ray Jacobs we talked with Betty Neville, who said we probably
were being asked for a surety/maintenance bond. This apparently calls for us to put up the
entire value of the bond ($50,000?). The Association does not have that kind of money.
*It seems as though we are arriving at the point where we can't do the dredging even
though most people want it done.
Can we come to a different postion on the bonding? If we just dredged the deltas
on each end of the channel, and not the channel, would the need for a bond cease?
Help! We would appreciate meeting with you to discuss this.

Dear Mr. Krutski:
Myself and my family are writing this letter to show our unconditional support
of the dredging project in West Lake Inlet. The hearing will be held on April
19, 2000.
We have just recently appealed to the Board of Trustees to rebuild our
bulkhead and one of the conditions was to relocate the wall back 4 feet
promote the development of wetlands which we, of course, agreed to do.
We have owned our property for 33 years and have enjoyed the natural ebb and
flow of the life cycles in West Lake. Indeed, such natural inlets & estuaries
provide necessary natural protection for an enormous variety of developing
wildlife. With each change of tide into this long established eco-system, the
origins of life become apparent even to the most casual of observers.
Aside from the other(perhaps more obvious)potential detrimental impacts such
as decreased property values & lack of access for small pleasure craft,
denying this preventive measure leaves open the gate for either a fluke storm
or the neglect of property owners on the sides of this inlet to cause it to
fill in. If the act of installing bulkheads alongside an inlet creates a
positive economic benefit for the property owners, and has the by-product of
being positive for this eco-system, it should also create responsible
stewardship on the part of all involved, for with such self-serving actions
also come with it, the price of responsibility.
Although it perhaps is not the responsibility of the Town Trustees to create
new wetlands, is it not charged with the responsibility to preserve existing
wetlands? The only possible objection could be raised by self serving
landowners on either side of the inlet, whom would perhaps like community
funds to maintain the integrity of structures that they themselves are
responsible for maintaining. I should point out that the early tax maps show
a public access right of way on both of these properties right up to the
inlet. One landowner has taken it upon himself to put down railroad ties to
create a barrier for conununity access that has existed for almost a century if
not longer. Such actions are evident of a continuing pattern to shrug off
one's civil responsibility.
I don't think that either of these individuals (Mr. Mol and Mrs. Greenfield)
honestly would like to see West Lake suffer the same fate as Terry Waters
and become a sealed, foul muck-marsh, as it certainly wouldn't be in their
best interest.
The fact that the community is willing to foot the bill for this rather
expensive action should speak volumes to this Board of Town Trustees as to the
commitment to preservation in this con~nunity.

We have owned our property for 33 years and have enjoyed the natural ebb and
flow of the life cycles in West Lake. Indeed, such natural inlets & estuaries
provide necessary natural protection for an enormous vamiety of developing
wildlife. With each change of tide into this long established eco-system, the
origins of life become apparent even to the most casual of observers.
Aside from the other(perhaps more obvious)potential detrimental impacts such
as decreased property values & lack of access for small pleasure craft,
denying this preventive measure leaves open the gate for either a fluke storm
or the neglect of property o~rners on the sides of this inlet to cause it to
fill in. If the act of installing bulkheads alongside an inlet creates a
positive economic benefit for the property owners, and has the by-product of
being positive for this eco-system, it should also create responsible
stewardship on the part of all involved, for with such self-serving actions
also come with it, the price of responsibility.
Although it perhaps is not the responsibility of the Town Trustees to create
new wetlands, is it not charged with the responsibility to preserve existing
wetlands? The only possible objection could be raised by self serving
landowners on either side of the inlet, whom would perhaps like community
funds to maintain the integrity of structures that they themselves are
responsible for maintaining. I should point out that the early tax maps show
a public access right of way on both of these properties right up to the
inlet. One landowner has taken it upon himself to put down railroad ties to
create a barrier for community access that has existed for almost a century if
not longer. Such actions are evident of a continuing pattern to shrug off
one's civil responsibility.
I don't think that either of these individuals (Mr. Moi and Mrs. Greenfield)
honestly would like to see West Lake suffer the same fate as Terry Waters
and become a sealed, foul muck-marsh, as it certainly wouldn't be in their
best interest.
The fact that the cormmunity is willing to foot the bill for this rather
expensive action shou~d speak volumes to this Board of Town Trustees as to the
commitment to preservation in this community.

Dear Board of Trustees,
I am writing this letter in regard to my high degree of concern with the dredging of West
Lake Creek located offofthe Main Bayview Road in our Town of Southold. It has come
to my understanding that there is a question as to the appropriateness of dredging the
West Lake Creek waterway leading into the Little Peconic Bay.
It is with my inmost feeling that the answer to this proposal would emphatically be yes.
Not only will the ambiance of this tranquil setting be tainted, but I feel that this will
undermine Southold's dedication to preserving the wildlife and shellfish reserves it has
long since been involved with. The idea of tabling such a proposal would be ecologically
unsound. In compounding my point on this matter [ find that by looking at several other
creeks in the area and there lack of dredging would surely drive this point home. By sheer
evidence in not dredging Midway Creek and Terry Waters creek, you can see what these
areas have become; potential high taxable residences in a semi-circle around a mud
puddle. It is with great pride that I own property on West Lake Creek. The sheer thought
of it becoming a mud hole disheartens me considerably.
Another factor that I would like [or the Board to consider, is the fact that within the last
year there has been an epidemic of the West Nile Virus. I can almost guarantee that
within this area there would be a great potential for this vires to promulgate. With the
area creeks that were not dredged, one can only imagine the haven that these creeks have
provided ibr the mosquito population. I can recall that when the Terry Waters Creek was
lett to stagnate, the smell and rancid odor that emanated fi`om that creek fi`om non-
dredging was unbearable and offensive.
It is with these and many other factors that the Board should take high consideration in
the importance of keeping West Lake Creek a viable haven for shellfish and wildlife. I
canq imagine the thought of this area having homes encircling a mosquito larvae filled
mud hole. I trust in my heart that with the Board's dedication to preserving wildlife and
keeping Southould a wonderful place to live and visit, that they would consider not
dredging the waterway of West Lake Creek into the Little Peconic Bay.

Dear Sirs/Madams~
I am writing this letter regarding the dredging of West Lake. My
family and I have been property owners on West Lake for over 35
years -- growing up and swimming in both the creek and the bay. In
the past I recall our creek being dredged, thereby enhancing the
swimming potential, access to our sail boat, increasing property
value along the creek and assisting the bay front property owners
by improving their beaches with the dredging spoils.
At this time I feel the creek must be dredged again. I witnessed
the deterioration of the creek at Terry Waters when people decided
to stop the dredging. Not only did all the families along that
creek lose, but so did the marine life and waterfowl that depended
on that estuary. Take a walk through my property in the late winter
or early spring, and observe for yourself the Mergansers,
Buffleheads, and Goldeneyes feeding in the sheltered waters. Come
by in the spring and summer and watch the Black Crowned Night
Herons, Egrets and Blue Herons fishing along the shorelines. You
will not see these birds feeding in the Terry Waters creek because
their food supply is gone.
By maintaining an open and running access to the bay, and cleaning
out the accumulated silt and debris, all qualities of life, marine,
fowl, human and other will be increased. Summer residents may not
realize this because they are busy squeezing so much into such a
short period of time.
The properties along West Lake are residential and private. For
some owners, this is all we've got. Please dredge West Lake both
for us now and for our future generations. Thanks.

I am writing to you regarding the upcoming meeting on April 19th concerning
the dredging of West Lake. Unfortunately, I will be away with my family and can-
not attend.
The dredging of West lake is long overdue as we have been suffering in bas-
ically a stagnant, shallow and un-safe pond.
Currently, access to the bay by boat is strictly limited to row boats or
canoes and only at high tide.
The environment is deteriorating in and around West Lake. There are no more
fish. The crab population is dwindling. Each season, there are more and more
dead clams, steamers, and oysters.
I can remember diving, swimming, snapper fishing and crabbing in West Lake.
~ow I am extremely concerned for the health and safety of my family and
the value of my property.
I am also concerned about the potential of a rising mosquito population
in the stagnant water if it is not dredged.
Is the Town of Spothold going to allow West Lake to seal up and become a
useless mosquito infested swamp like Terry Waters or the Midway Creek, just to
the East?
I worked long and hard to save up my money to be able to buy the property
on West Lake. I am hoping that West Lake will be dredged and maintained in order
to bring it back to the way it was when I purchased it; a useful and thriving
body of water.

We live on Cedar Point Drive, on the east side of West Lake. As you
know, the lake is shoaling badly and the West Lake Association is
seeking permission to dredge. We have been working with 3im Fitz-
gerald of Proper-T Permit Services and with .loe Edgar of Hydraulitall
in order to achieve this.
There are so many issues at hand it's hard to know which one(s) to
focus on. Wetlands, wildlife, access to the bay, property values,
mosquitoes, tidal waters, boating safety--these are all of concern.
If we had to choose a single issue to point to it would be wildlife. The
fish, the crabs and clams; the buffleheads, the swans, the ducks, gulls
and ospreys and kingfishers are the true denizens of West Lake, and
must be allowed to exist as they have for uncounted years. If the
lake closes, they are gone.
We urge you to approve our request and grant the permits we seek.

recreational use and the property values along the lake would decrease dramatically
Wc understand that there is some opposition to the dredging by property owners abutting
the inlet. The property owner on the west side of the inlet wa~ certainly in favor of
dredging less than ten years ago when they dredged the inlet as part of the condition of
installing a new bulkhead between their property and the inlet. I'm surprised that they
would have an objection now. Do you know if they had an obligation to keep the inlet
dredge, d during the 5 year duration of their permit? lfso, it was not done.

Ladies and Gentlemen:
I live at 444 Midway Road, Cedar Beach, Southold, just 4 houses east of the inlet
to West Lake. I will not be able to attend the hearing on April 19 on the application
to open the West Lake inlet. However, I most emphatically request that you grant
this application.
There are a number of reasons why this application should be granted. The
strongest reason lies to the north and east of my property. There is a pond which
once had an opening to the bay but it is now totally blocked and what was once a
vibrant salt water pond is now a stagnant, insect full, nearly lifeless pond. With all
the concern about mosquitoes, encephalitis, West Nile, etc., we need to be certain
that the same situation is not caused by our failure to keep the West Lake inlet
open.
I hold a Town mooring permit for my outboard in West Lake and I have been using
this for the last two or three years. Each year the window of availability around the
high tide to take the boat out into the bay diminishes. Now at Iow tide the waterflow
in and out of the inlet is virtually nil. If the inlet is allowed to fill in, the town will lose
not just my $30 or $40 mooring permit fee each year, but the value of the homes
ringing West Lake, most with docks and outboards, will be substantially diminished
with resultant lowering of assessed valuations and thousands and thousands of
dollars diminished real estate taxes paid to Southold.
Dredging the inlet is not some radical new activity but one which only continues
the rights of the West Lake property owners to access the bay on their boats from
their own docks in front of their homes.
There are many, many additional reasons why this application should be granted
and no valid reasons against. I request that you approve the application to dredge
the West Lake inlet so that this very necessary work can take place promptly.

My name is Michael Zevits. I am writing this letter to request
and encourage you, The Board of Town Trustee's, to allow the
dredging of West Lake in Southold. I am an owner of property
located on this creek.
As you know, this creek is in dire need of dredging. Access to
the bay by boat is possible only at high tides.
I am extremely concerned about the environmental ramification
that would follow if this creek were not dredged. Specifically,
nhe creek will close up and the body of water and all the marine
wildlife will die. Essentially this creek will become an open
water cesspool.
In order to sustain the marine life in the creek, tidal waters
must enter to provide fresh seawater and nutrients. Without this
the existing fish, shellfish, crabs and other marine life will die.
Along with the marine life, birds will also be affected such as the
cranes, blue heron, sea gulls, ospreys and other animal life
feeding off these marine creatures.
This has occurred already in two creeks located in the
vicinity of West Lake. Midway Creek is now dead and Terry Water
Creek is now dead because of no maintenance. The only vestiges
remaining are the decaying docks sitting upon black dead waters.
