Wiggin on behalf of DOUGLAS DE FEIS applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated January 10, 2000, and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on March 22, 2000 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97 of the $outhold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of DOUGLAS DE FEIS to build a new PVC bulkhead to be located on the southerly property line with deck built on top of it, and any rip-rap that is disturbed should be replaced, ALL in accordance with plans dated August 7, 1999 and last revised March 20, 2000, stamped and approved March 22, 2000. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct and complete project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. We moved the bulkhead back 12 feet to put it behind the original deck. So now there will be no requirements for dredging· The old bulkhead will be removed. Until that happens (cannot understand) Based on the discussion we had on the site with the Board. TRUSTEE KING: You are Just moving the whole structure back. MERLON WIGGIN: It doesn't really show the erosion taken place because of the damaged bulkhead underneath the upland scrubs and the stuff that the erosion gets back undermines the float in front of the house. Its existence prior to the 1973 wetlands act was proved by various independent means; - preexisting surveys - photographs from the family - affidavits from neighbors - aerial photographs During this process we have acted in good faith and enlisted the help of an intermediary, as we are somewhat handicapped being away much of the year. Peconic Associates had reported to me that one of the trustees had suggested that we build our new bulkhead back 4 feet from its existing place. I am writing this letter to vedfy that this indeed the case as the permit I received basically approved our bulkhead replacement as originally submitted to place the new bulkhead in front of the old. This approval certainly would be the most logical and have many direct benefits to the community for several reasons as wall as protect my rights as a property ovmer; - Building the new bulkhead back 4 feet would have the unwanted consequence of bringing our existing cesspool structure closer to the sensitive wetlands. - Removal of existing seawall would cause creosote leaching into the delicate ecosystem into the lake which many neighbors have voiced concerns about. - It would increase the ~ of my site. - It would make the remaining slope of grade too steep to traverse and result in potential life safety hazards. Not having been able to attend the meeting, I am completely confused and seek resolution in this matter. It has been pointed out to me that my existing approval constitutes reasonable reliance and the verified pre-existence of this structure touches on eminent domain i~ues. Since I am already in possession of the Trustees Permit that I need to move forward (Permit #5141 issued 3/22/00), I just wanted to verify that this is okay before proceeding a8 the DEC has already indicated it has no problems with our project as previously submitted ( as well as the Army Corp of Engineers). The neighbors to the right of me (DeFeis from Florida) rebuilt a Bulkhead and tied it into my return which is approximately 2 ½ - 3 feet inside my property line. I don't think I was notified. They moved my bulkhead, which was only large stone to do this. I want to know if they are allowed. I did have a surveyor stake the property and they are on my property approximately 2 V:-3 feet. I did call DeFeis and they were going to check with their engineer and get back to me but they have not. Due to an illness and death in my family, [ have not had time to check on this sooner. The last time I was there was 07/04/03 and they have not put the top on the bulkhead yet. I have not checked since 07/04/03 due to the fact my fianc~ was rushed to the hospital and is still in the hospital. 1 would just like a simple answer to the question, "Do they have the right to move my bulkhead which is stone to hook into my returns and use my property.
