Southold, NY 11971 RE: 1800 Cedar Beach Rd., Southold SCTM#89-2-5.1&5.2 Dear Mr. Akscin: In response to your request for review of a proposed dock permit on SCTM#89- 2-5.2 in Dryads Basin, after review and a site visit, the Board is inclined to disapprove the application for the following reasons: Town Code Chapter 97-27-C(2) (c)1 allows only one dock per residential lot. This property SCTM#89-2-5.2 already has a dock. Moreover, it is not the policy of the Board to approve an application for any activity including construction of a dock and catwalk on property except that of the applicants. For the above reasons, the Board is returning your application. If you would like an official review at one of our monthly hearings, please feel free to resubmit your application with the understanding that we would most likely deny it. This property already has a dock. Your proposal will also require a right-of~way over this property to gain access to the dock. Due to the wetlands, this would require, at minimum, a catwalk to gain access so the construction would have to be approved by the New York State DEC as well as this Board. Also, since the dock is at the end of this proposed right-of-way, it would require consent of the owner. Finally, it is not the policy of the Board to approve an application for any activity including construction of a dock and catwalk on property except that of the applicants. The new Town Code Chapter 97-27-C-2 Wetlands, states under General Rules: #5 - All docks, including any vessel tied to the dock, shall have a minimum clearance of fifteen (15) feet of the seaward extension of any property line from adjacent parcels so as not to interfere with the neighbor's access to waters, unless the Trustees decide otherwise for navigational or other reasons. Waterside boundaries can be identified using the appropriate method for the shape of the shoreline for Long Island waters specified in 9 NYCRR 274.5. #8 - Any application for a dock to be constructed at the end of a right of way or commonly-held land requires the written consent of all parties having an interest in the right of way, regardless of how property interests in the upland parcel may be divided among the owner(s), lessee(s), occupant(s), easement holder(s), or any other person(s) or entity(ies) with a legal or beneficial interest in any existing or proposed docking facility. It is not the policy of our Board to approve an application for any activity including construction on any property except that of the applicants.
