Dear Mr. Aylward:.
The following action was taken by the Board of Town Trustees during a Regular Meeting, held
on May 24, 2001, regarding the above matter
WHEREAS, FFILLIAM J. A YL ff,'ARD applied to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of S outhold, application dated
March 16, 2001 and
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
May 24, 2001 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testim6ny and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold
Town Code.
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT.
RESOLVED, that the Board of Trustees approved the application of WILLIAM J. AYLWARD
(CONTRACT VENDEE) Wetland Permit to construct a dwelling, cesspool and septic tank,
impervious driveway, 24x24 detached garage, drywells and related necessary activities to
construct. No fill to be brought in and a row of haybales at the 50 foot buffer to be lett there and
that be an undisturbed buffer.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency which may also have an application pending for the
same or similar project.
Permit'to construct project will expire two years from the date it is signed. Fees must be paid, if
applicable, and permit issued within six months of the date of this notification.

Aylward Application
This is in response to the notice of the pending request of Mr. Aylward to the Board
of Trustees for a variance from the 100 foot setback requirement in order to construct
a new residence and a garage adjacent to Town property. You asked for comments.
I would like to offer the following observations.
1. The driveway location should be relocated to the other side of the house, so
that it runs between the house and the next lot, # 157. The garage can
be re-oriented so that the entrance to the garage faces the street. These
changes to the site layout will remove the necessity to pbtain as much of
a variance. They also will protect the wetlands. Construction of a
ddveway in the original proposed location will require construction closer
than 75 to the wetlands.
Although not specified on the application to the Trustees, it is evident that the
applicant intends to bring in fill in order to raise the first floor elevation of
the new residence to 15 feet above sea level. The currant elevation is
just 10 feet above sea level. Accordingly, the change in grade of 5 feet
will have an impact on the wetland.....unless the fill is very carefully
regarded AND all roof runoff and driveway runoff is channeled to dry
wells. None of these mitigative measures ara indicated on the
application.
3. My recommendations in sum are as follows:
a. Relocate driveway to other side of proposed dwelling.
b. Covenant that ddveway remain pervious, or if paved, that drainage
will be installed in the driveway.
c. Require a drainage and regrading plan to be submitted to Jamie
Richter and Trustees for approval PRIOR to the issuance of a
vadance and/or a building permit.

I am interested in purchasing a lot owned by Florence DeHaan located at Bayview Road,
Southold, either next to, or across the street from your property. Enclosed is a copy of a map
showing the property with the approximate location of the proposed house, driveway, cesspool
location, and other information, and a copy of the Town form referred to as "Notice to Adjacent
Property Owner."
I am send/rig this letter as a Town Code requirement to neighboring landowners to let you
know my application is being considered, and that a date and time of the public hearing has been

Dear Member of the Board,
I am the owner of a one-family residence at 13675 Main Bayveiw Road,
Southold, New York, which is listed on the Suffolk County Tax Map as
1000-88-2-17.3. I have been told that William J. A~w, ard is applying to
the Trustees for a pemiit to build a house in the fresh water wetlands
adjacent to my property. I have not seen Mr. Aylward's application, as I
have not been notified of his application for a wetland permit. Since I am
an adjoining property owner to this property I should have received
notice.
Over the years Raymond Akscin and his son, Jay Akscin have both taken
great care to make sure the water does not get polluted in this wetlands
area. I realize there is a dispute as to who owns the property
immediately north of Mr. Aylward's application as I know Florence
DeHaan claims to own it. However, Raymond Akscin also claims to own
it and Akscin's Nursery has been there for many years growing nursery
stock on the property. I realize there is a 15 foot strip of land between
my property and the land for which Mr. Aylward is making application.
However, since DeHaan claims to own this strip you would think I would
have gotten official notice of this application.
Because of the failure to provide proper notice, I object to the hearing
going forward, until I am more informed as to what is proposed to be
built.

Dear Mr. Krupski:
I represent Raymond J. Akscin who claims to be the owner of
property known on the Suffolk County Tax Map as District 1000,
Section 089.00, Block 01.00, Lot 001.00. This property has been
in continuous ownership and occupancy of the Akscin family since
1908. Initially, it was used as a pasture for family livestock
and subsequently it was farmed for vegetables. For the last 20
years it has been planted with nursery stock.
In the early 1950's, Rudolph and Florence DeHaan, as was his
practice, obtained quitclaim deeds to various parcels in this
area. Then sometime in the 1970's the DeHaan's in conjunction
with Mr. Sherwood of the Assessor's Office, placed the parcel on
the tax rolls. It is my understanding the DeHaan family never
occupied this particular property and claim ownership by virtue
of paying taxes on it.
In any event, I believe the Board is aware of the DeHaan
claim as an attorney wrote ~he Bua~d on January 22, 2001 claiming
ownership in connection with Raymond Jay Akscin's permits in
regard to his subdivision for other property to the west.
Raymond Jay Akscin feels that since he has not been
furnished proper notice, he objects to the hearing going forward
as scheduled until receipt of same.

I faxed the permit to you.
Mark Terry and I went out and looked at this yesterday. Briarcliff was there with heavy equipment and they were
working in the buffer, right on the edge; they took out 2 trees and were doing some clearing along the driveway.
We spoke with the owner, showed her the approved survey and explained about non disturbance buffer and asked her
to stop the work.
Basically we gave her a big warning and told her that she would be in violation of her permit if there was any more
clearing;
If you get a chance drive by there today and make sure the equipment is gone. It is just too hard to replace those
buffers. Thanks.

Would you please check this out ASAP.? I did ask Ed but he is busy in a Town Board meeting.
Check what clearing is happening at 14395 Main Bayview Rd, Southold, SCTM# 89-1-3.1
They had a trustee permit to build a house (the log house) with keeping 50' buffer to the wetland, and it was reported that
work was being done there. I will fax over the survey.

I am sending this letter as a Town Code requirement to neighboring landowners to let you
know my application is being considered, and that a date and time of the public hearing has been
scheduled by the Town Trustees. Your attendance is not reqinred, although the hearing is held to
