Box 1179 Southold, New York 11971-0959 Telephone (631) 765-1892 Fax (631) 765-1366 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD September 22, 2004 Ms. Theresa Prendergast, President Cedar Beach Park Association P.O. 409 Southold, N.Y. 11971 RE: CEDAR BEACH PARK SUBDIVISION AT BAYVlEW, SOUTHOLD SCTM #s 89,90,92 Dear Ms. Prendergast: The Board of Town Trustees took the following action during its regular meeting held on Wednesday September 22, 2004, regarding the above matter: WHEREAS, CEDAR BEACH PARK ASSOCIATION applied to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated August 27, 2004, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on September 22, 2004, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE iT, RESOLVED, that the Board of Trustees approve the application of CEDAR BEACH PARK ASSOCIATION to repair the residential driveways, currently dirt roads, by grading and covering with bluestone chips, for areas within 100' of tidal or freshwater wetland, and all as depicted on the map of Cedar Beach Park. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) I have also enclosed copies of the vote forms for all (42) members in good standing, with the handwritten votes. They tally as follows: 36 in favor of the Association repairing the right-of-ways, 4 in favor of individuals repairing the right-of-ways, and 2 abstentions. There are sixty-six (66) properties affected by the proposed project, including those above, and all sixty-six will receive the requisite hearing notification by certified mail. We have also voted to amend our Constitution and By-laws to make right-of-way repair and maintenance the Association's continuing responsibility. This second confirming vote was conducted at a later date and was in full accordance with the stipulations of our By-laws for such amendments (min. 75% vote of 51% quorum, present or by proxy). A copy of the By-laws, amendments, and a tally of these votes will be provided to you, should you require it. Please understand that these repairs are being undertaken onlyto meet access requirements specified in Town Zoning Code 100-235 B and C in Part II- General Legislation, Chapter 100 -Zoning, Article XXVII, Supplementary Regulation. Because of the present condition of the right-of-ways, with multiple large potholes, they are a significant safety hazard to the residents of the community and an impediment to the passage of emergency, fire, and police vehicles. Apparently, there is a misconception on the part of the property owners on those right-of-ways that they were to be included in the Park Association's repair plans. Because only one property owner on those right-of-ways expressed interest in membership in our organization, we did/do not plan to include either street. This is evident in our application, and was also explained to Mr. Krupski. Apparently, they have gathered a petition to the Board of Trustees to prevent our repairs because of the confusion. The letter enclosed reiterates and confirms what is and always has been our intention (i.e. EXCLUSION of Orchard Lane and Clearview Road, except as diagrammed in our application) and what I discussed personally with Mr. Krupski on September 8. There appears to be considerable confusion and misunderstanding. The Cedar Beach Park Association plans to repair the following right-of-ways: Cedar Beach Drive - south of Park Association sign Private Road West Orchard Lane Oakwood Drive/Court Clearview Road - cleared portion b/w Oakwood & Private Rd Lakeside Drive North Cedar Point Drive East Lakeside Drive South Inlet Way Cedar Point Drive West Midway Road West Lake Drive - east of West Lake Inlet The application to the Board of Trustees clearly defines, on the maps required with the application, that the above referenced right-of-ways are the ONLYones involved in the application. This point has been discussed at length by Mr. Krupski, President of the Board of Trustees and our President, Terri Prendergast. The application and attached maps are available for your review in Town. As only ONE(l) property owner on Orchard and Clearview Lanes responded with interest in membership in our Association, we have NO INTENTION of including either of those right-of-ways in our repairs. Obviously, there is NO FINANCIAL RESPONSlBILITYto the property owners on Orchard or Clearview Lanes (east of the Cedar Beach Park Association sign), and there will be NO ASSESSMENT. Krupski, President Re.: Road repair and maintenance Map of the Subdivision of Cedar Beach Park at Bayview AUG - 3 2004 Southold Town Board of Trustees Dear Mr. Krupski and Members of the Board: We are writing to request assistance in the management of the right-of-ways within the Map of the Subdivision of Cedar Beach Park at Bayview, Map No. 90, filed December 19, 1927. The members of the Association recently approved the assumption of the repair and maintenance of our right-of-ways by the Association. The roads involved are highlighted on the map enclosed, and include: - Cedar Beach Drive West - Cedar Point Ddve East & West - Pdvate Road - West Orchard Lane - Oakwood Drive - Lakeside Drive North & South - Clearview Road - Inlet Way - Midway Road - West Lake Ddve, east of West Lake Inlet - Orchard Lane The costs of the repair and maintenance of the right--of-ways will be borne by equal assessment of all property owners whose property faces on to one or more of the roads highlighted on the map. For a small association, the costs of this maintenance are high, and as such would like to keep them to a minimum. Page 2 We are requesting that any building permits issued for properties adjacent to these roads be required to post a bond to repair any and all damage to the repaired roads.
