SHERATON: There is a need for an Episcopal place of worship in Town. THB CHAIRMAN: Where is the nearest? RBV. tHEP~tTON: Five miles away. The rectory is inadequate. THB CHAIRMAN: What is the usual attendance? RBV. SHERATON= We use the rectory on Sunday for worship, It is inadequate because of its constructi~. 1T~ C~AI~MAN: We are wondering what the usual attendance is. What we are. concerned with is the parking area. RBV. SHBRATON: I thi~k there ~ public ps~<-9 across the street. HOWARD TBR~Y, ~Uilding Inspector: The Town leases that, itfs a Town parkin9 field. THE CHAIRMAN: You propose to create a 12 car parkin9 lot. You might beable.to get several more cars than that ~ there. MRe WILLIAM R. CLRAK, JR.: That would be parking 12 cars by municipal standards. THE C~AIRMAN: You probably could get 25 cars in here. MR. CLARK: The parking lot is arbitrary. It could be more. THB CHAIRMAN: Did you draw these plans for the cht~roh? ~. Saixt lot will be 80 feet by 200 feets total area of 16sO00 square feet, There will be adequate parking facilities, al side yards rear yard, and setback requirements will be adhered to. It is unlikely that the parsonage will be added to~ however if this does occurs no side yards reuryurds or setback varianoe shall be 9ranted for the addition to ~he parsonage. MARY MC~ssEY: I talked to the builder today, I might not need five feet, I might.only need three feet for the garage, A detached garage would.spoil the other properties, To put the garage on the other side would obstruct the windows of m~ bedroom and speil my view of Peconic Bey. My property will he impDoved by this application, I have no objection from my neighbors, The Town is benefited by the t~c increase. I plan to m~e this my home upon retirement, This is worthy of my efforts. I need this garage to protect against vandalism. THBCHAIRMAN: How serious is the vandalism? MA~y McAssBY= Fine ;~art work has been destroyed, Mail boxes have been tampered with and so on, Has it increased in the last 10 years? MARY McASSE¥: I am sorry to say it has increased, Throwing of cherry-bombs is very distressing when you have valuable property, 1%2 CHAI~N~ Is theze anyone else present to speak for this application? (There was no response.) M~. HULSBt How far back are the other dwellings? MA~yMCAsSBY= About 40 feet, HOWARD I~RRY: They are all in a straight line. MARYMcASSEY: They do not appear straight but if you meastu:ed the property they would he, TH~CHAIP. MAN= Mr. Bergen happen to see this afternoon the bu/lder of you house~ and while we are not concerned with deed restrictions they are used as a guide here, We are not bound by deed restrictions, This mnn recalls there was a deed restriction in regard to the front yard of all these houses, I was just wondering ~f you happen to have the dded with you for your own gn~dance. MARY M~ASSEY: be restriction is a garage not attacted tothe house, Also fences, Dwellings unattached to the house and fencess both of these are violations, MR. B~RGBN: No fences in the front of the house. MARY McASSEY: O~ the side as welle MR, ~: This has no hearing on this decision. (There was no response°) TH~ C~I~.N: I will have to speak ~gainst this application, This applicatio~ would violate the present average setback which gu/des us and frequently we have in the past had a case due to error or carelessness, House was put six inches or one foot too close to the line, If ~he Board was guidedby interior arrangement of a ho~e we w~ld have very irregular front yards. In this case it appears you have enough side yard to put the garage on either side, attached to the house, If you put it in the side yard it must be attached to the house in the.same lir~ with the house, In order to get ~entilation of the kitchen you would have to have.a breezeway, You could put the garage on the other side of the house, I think there is adequate land and area there, It would he difficult to sho~hardship, ~ McASS~Y: I dontt know if you observed this, It would obstruct the view of Peconic.Ba¥ to m~ neighbors and tome. I den~t need five feet, I need only 3 feet, THE CHAII%MAN: Our situation is thist if you give six inches where do you stop?. MARY McASSBY: If you ~ive 36 inches you will increase taxes, T}~ CHAIRMAN: The purpose of th~ application is to build a garage for yourself. Financial hardship is not legal basis for a variance, Bveryone has financial hardship to some degree. MARY McASSEY: What is hardship? TH~ CHAIRMAN: Perhaps you acquired a piece off property that was too small. Was the last lot in a development, that was too narrow, that was on the side of a hill~ or that was in single ~-~ separate ownership prior to the zoning ordinance. When you pass an ordinance on a Town that is several hundred years old, parts ~f it anyways it canf$ be made to adapt t~ every piece of property. There are things we must be guided by in grantin9 a variance. MARY McASSEY: I bouhgt this house without knowing I couldnft attached a garag~ .If there were women on the Board they would know you need ventilation.when you cook. T~ CHAIRMAN: I know you need ventilatlon when you cook. We can- not grant what you are asking for, MARY McASSBY: You leave me with h~deous alternatives. I can't put this on the other side. I have been in this for 10 MARY McASSBY: I can appreciate your experlen~es but I dontt tbi~k this would deface the neighborhood. TH~ CHAIRMAN: Nobody said it would defao~ the neighborhood. This is not permitted under zoning law, These laws may be peculiar to you. MARY McASS~Y: That is the reaso~ for the variance. TH~ CHAIRMAN: It is up to the Board to determine if you have a hardship. . Is there anyone else who w~shes to be heard against this applicatio n? (There was no response.) TNB CHAIRMAN: Do you understand what you can do? MARY McASSEY= I understand I can do nothing. I can not detach it from the house without spoiling m~ property. CHAIRMAN: You can have a three foot breezeway. MARY McASSBY: That is not ventilation. TH~ CHAI~t~N: You are more fortunate than people that do not have room. It will not deface the area at all. MARY McASSBY: I would have a fourteen f~ot garages I need twentF feet, Tt~ CHAIRMAN: I have nothin9 more to add to this. After investigation and inspection the Board finds that the applicant requests permission to construct an attached 9arage violati~ the established front yard setback b y five feet. The Board finds that all other dwellings on the same side of the streetare constructed the same distance from the road line. The Board finds that the applicant does not have a legitimate hardship.. The interior la, out of the house cannot he considered in this case. THE CHAL~MAN: Is there anyone present who wishes to speak for this application? MR. CLARK: She asked me to come up here this evening. She intended to be here. I am a little confused about this. This is two separate parcels of land, THE CHAI~T4AN: Were they bought at separate times? MR. CLARK: They were bought at separate times. MR, HuLS~: How big is the lot that was built on? Hf~ARD TERRY: It is 180 feet on the road feet deep, and they want to cut it in half. MR. CLARK: This is one separate piece that she wants to sell. $oithold Town Boa~d o~ Appeals -9- August 1, 1968 ~. HULSB: She built on a gO foot lot and she wants to sell 90 feet. THE (liAIRMAN: She is n~v ~idowed? / I,R{. CL~K: Yess she intends to move out here. THE CHAIRMAN: This is summer residence. If she ~ hadn't bought this lot somebody else would have. How long ago did they build the house? Was it prior to zoning? HOWARD TERRY: After zoning. There was no filed map on that, there was a sales ~ap. Thatts what that B & b means. THE CHAIRMAN: Is there anyone else who wishes to speak for this application? (There was no response.) THE CHAIRMAN: Is there anyone who wishes to speak against this application?. (There was no response.) After investigation and inspection the Board finds that the applicant wishes to divide a lot with insufficient frontage and area. The Board finds that the applicant is the owner ~f a parcel of land.180 feet wide by 100 feet deep. The applicant has built a home on half of the parcel with 90 foot frontage. The other 90 foot lot was bought as a separate parcel at a separate tine. It is the opir~bn of the Board that if the applicant had not bought the adjoinin9 lots rome else could have bought the lot add erected a dwelling thereon. The variance will not change the character of the district. The lot size will be in keeping with the other lots in the area. A condition of granting this variance is that any dwelling built upon the lot 90 feet by lOO feet shall not be 9ranted any front yard, side yards or rear yard variances. In general the Board is in agreement with the reasoning of the applicant. The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance does observe the spirit of the Ordinance and will not change the characterof ~he district. Southold Town Board ~f Appeals -Il- August ls 19(~ THE CHAIRMkN: The sketch on the building permit application indicates that the g~rage will be 22 feet by 16 feet, will be located on lot #2. As I understand it this will be on lot number 3. It will be 35 feet from Stillwater Avenue. The lot we are discussing is lot number 2. The lot is 287 feet deep, 75 feet on Stillwater Ava~e, and looks like 70.9 on Bu~enets Creek, with the use of 1/3 ~f lot number 3. That is included for 75 feet. Is there anyone present to speak for this application? That would be your Mr,. lirug. Do you have anything to add? MR. KRUG: Nothin9 more. THB CHAIRMAN: This will be a two car garage? KRUG: Yes. T~ CHAIP34AN: Are there any questions for Mr. Krug? MR. BERGEN: You have three utility buildings on the property. Would you be willin9 to move them if this variance is gr~nted to build a garage? MR. KRUG: Two shacks are only temporary. The~small one in front will be put dow, near the bulkhead. The big one is going back home= The other one is going next to the house. I will move the three shacks, THE CHAIRMAN: The first sm~ll one youare going %o move near the water for gas cans?. MR. KRUG: For boat equipment. THE CHAHRMAN: You hav~ to have a p~rmit for that. HOWARD TERRY: We got that all straightened out. THBCHAIRMAN: The other one is g~ng to be next to the house. How soon do you want to build this garage? MR. KRUG: As soon as I get it. THE CHAIRMAN: How much time do you want to take care of these buildings ? . MR. ~UG: As soon as the garage is up. IiiECHAIRMAN: sixty days? ninety days? MR. KRUG: Ninety days is plenty. Herucy Ao Clark~ the follow,lng letter was written~ Dear Mrs. Clark ~ In response to your letter of August 1~ 1968~ the Board is agreeable to grant you permission to put.up two signs advertis~n~ Greenpert Methodist Church A~ique ~how to be held August 6~ ?~ 8~ and 9~ 1968. However~ we are not in position to grant you permission to place one. of these signs in the traffic circle at the head of Main Street~ outside of Greenport Village. Both signs must be placed on private property with permission of the o~ners~ and be located at least five feet from any property line, The signs shall be removed by August 10~ 1968.
