CHESTER ORLGWSKI: I will speak for its All the garages in that area are within two to twelve feet of ~he ~oade Everyone has the garage in the front yard and this can't change the character of the area at all, THE CHAIRMAN= Anyone present who wishes to speak against this application? (There was no response,) THE CHAIRMAN= Are there ~ny other qUestions? (There was no responses) THE CHAIRMAN= It seems to me we discussed setting this back far enough so that an automobile would be off the street when parked in front of the garage. I don~t think 14 feet set ~ack is enough. M~, ~ERGEN= You could put~e garage back ~wo more feet without too much troubles ~, RAY HC~GAN= May I speak on that. The reason I would lik~ to o brain this permission is to build a garage at 14 feet, I want to build to Foscato lines three feets ~eparatin9 my property from Fosoato. I need more on the east side than on the we~t sides The road runs on an allgles THE CHAIRMAn: The lot narrows on the street, MR= HORGAN= The Fescato house is about 40 feet from the roadway, If I could build a garage without projecting beyond their house lines it will not shut out their vision or their air. I made it a 24 foot garages becuase it is m~ plan to winterize. THB CHAIRMAN= 16 feet is not wide enought for two carss I was just wondering /~ we are going to consider Mr, Foscato~s views MRs BERC~N: It would he more of a question of air, His house is nearer the road than Mr. Horga~s= MR. HC~GA.N= Yes, about 20 feet closer to the road than mines THE CHAIRMAN= If we are going to consider that, I ~nkyou would give consideration to widen~-g the garage ra~her than lenghten it. ne ORLOWSKI: There won't be much left in the frmlt yards THE CHAIRMAN= The thing that concerns us is that there should be enough room to get the car in and out of the garage without having part of the car on the road while you are still backing out of the d~iv~way. BERGEN= This~s a private road, limited access. THE CHAIRMAN= The road will be i~. There will be more houses down there and more traffic~ ~outhold Town Board of Appeals -3- September 19~ 1968 ~. HC~GAN: There is now seven houses on that road. There is room for at least one mores ~f that road were every improved, as it will be some day, certainly~ it would be 40 feet wide. It is m~ ~ntention to, i~ I am granted this, to put a 10 foot service c~ivew~y on the easterly side of this so that trucks will have a place to drive in off the road to m~Me deliveries. CHAIRMAN: Do you mean on the west side? ~o HORGAN: On the west side of the garage. I~ I made the garage 18 feet by 24 feet, I would still need the space, THB CHAIRMAN~ One of the things we are concerned with here is that everyone that has a summer residence, intends to winterize it for permanent occupancy. We are trying to give some consideration to that, In the snow you mould have a car half out on the road. One of the other things we have tried to do is require entrance to the garage from you= own property so that you back in and out of the garage on your owu property, rather than the right of way. M~.(I~LOWSEI~ P~etty hard to do that here becau~ the lot is so THB CHAIRMAN: Are there any other questions? ~There was no responsee) After investigationald inspection the Board finds that the applicant request permission to erect ampi maintain a ~arage in the front yard area. The applicant is the owner of waterfront property and all other property ca~ners in the immectiate vicinity have garages in the front yard area. The Board strongly recommends that the garage should he set back further from the road, however, it shall not he any closer than 14 feet to the closest line on Beechwood Road~ and at least three feet from the east line. The Board finds that strict application of the Or~{:-ance will produce practical dif~culties or un~eccesary hardship; the hardship created ts unique and would not be shared by all properties alike in the {mm~diate Vicinity of $~his property and in the sam~ use district; a~d the variance does observe the spirit of the Ordinance and will not change the character of the district. On motion by Mr. Bergen, seccalded by Mr. Grigonis, it was RESOLVED Raymond T. Horgan, Beechwood Road, Cutchogu~, New York, he granted permission to locate an accessory building in the front yard area~ subject to the conditions pointed out above. Fee paid The Chairman opened the hearing by reading the application for a special exceptions legal notice ~f hearing, affidavit attesting to its publication in the official newspaper, and notice to the applicant. THE CHAIRMAN: The application is accompanied by a copy of the Tax Map T~wn of Southold~ School District No. 9s Sheet No. S1s locating the property under discussion. There is also a survey by Van Tuyl, dated May 6s 1968 which gives the dlm~nsions of the property. We dis=u~sed this somewhat. The application is to organizes operates and maintain a youth centre to provide a wholesome reoreatiunal activitiess meetingss events, entertainment for the inculcating and promoting of the intellectual and sOcial well keing of young people. Do you want to elaborate o~ the recreational activities, What would the entertainment be? JACK SHBRWOfD~ We would have shuffle board, THE CHAIRMAN: How about saftball. JACK SHERWO00: Possibilitys if the funds are ~here. We would have soft balls v~ balls that sort uf thin~. MR, B~RGEN: Did you sa~ something about movies before? JACK SHERWOOD: Possibly, yess o~ Occass~, THE CHAIRMAN: What kind of regular meetings or membership will OyOU have. JACK SHERWOOD~ Anyone who wants to ,owes mmv come. That type of membership, THE CHAIRMAN: This would be for temn-agers? JACK SHERWO(~): Yes. THE CHAI~MAN= What would be c~sidered teen-ager? JACK SHERWOC~: Thirteen years to 19 years old, THE CHAIPJ~LN: Will the meetings be once a ~eks twice a week? Have you given any thought to that? JACK SHERWOOD: I don't know if there will be any such thing as a regular meetin9. The club will be open a couple of hours in the afternoon. Maybe from 3 o~clock to 5 o~clock. The plan is now, Friday evenlngs someplace to 90 after basket-ball 9ames, It may be open one or two saturdays a month, There won't be a regular thing that would be every week, THE CHAIRMAN: This request comes under part of the z0~in9 Ordinance which authorizes the Board ~f Appeals to 9ra~t a special exception for clubs~ fraternity houses and golf courses, What do you mean b~ e~ents? JACK SHERWOCD: We might plan particular events once a monthe Maybe a little feed~ a speech or film~ or some such activity as ~hate THE CHAIRMAN: The application reads entertainment for the inoulcatin9 and promotin9 of the inte]~ctual and sooial well bein9 of young people, Some of that could be educational, HOWARD TERRE, Building inspector: That could be call educational. ~ACK SHERWOOD: I thought that it would be, THE CHAIRF~N: The reli§ious book store part of the application is a secondary activity and would be permitted in these circumstances, This property adjoins the North Fork Baptist Church, I ass~e that they are in full accord with thisproject. I am just trying to eliminate any situation that might 9et out of you hands. This property is in the name of Stephen Harvey, Of course~ any permission here granted goes with the land~ not with North Fork Teen Centre~ Inc, If that dissolves~ whoever~ Stephen Harvey is would still have this permission to operate a club for this purpose. MR. BERGEN: Can't we state that this special e~ception go~s to the one granted to and not with theland~ HOWARD TERRY: A special exception goes to the person it is 9ranted to, A variance goes with the land, With this type of occupancys the special exception goes with the one it · granted to, THE CHAIRMAN: Who is Stephen ~nvvey? JACK SHERWOOD~ He is a businessman located on the west end of the island. He bought ~his property for the sole purpose that it be used for this purpose, Some of the people in the North Fork Church know him better than I do. He has done this in several other places as welle THE CHAI~%~AN: Does he come out here s~mers? What is the reason for doin9 this? JACK SHERWOOD: I think he knows some of the people in the North Fork Church. THE CHAIRMAN: But he actually lives elsewhere? JACK SHERWOOD: Yes. Southold Town Board of Appeals -6- September 19~ 1968 THE CHAIRMAN: What about parkin9 facilities~ Most tenn-a~ers drive cars, JACK SHBRWOOD: North Fork Churc~ has a 9ood size parkin9 lot that will be available for the Centre use. THE CHAIRMAN: How many cars can be parked in the church parkin9 lot? Presnm-blys the church will not be open at the same time the youghcentre is. JACK SHBRWOOD: Probably not, I would 9mess maybe we could park 50 cars, HOWARD TERRY: Could park 40 to 50 cars, THE CHAIRMAN: You also have considerable property ~f your that could be used at night. JACK SF~RWOOD: Yess it could be. THE CHAIRMAN: The owner to the wests Mr, ~aisers sold you this property and is in favor of this project? JACK SHBRWOCO: I won't say that. THE CHAIP~AN: presumabl~ he ,:iss he is not objecting, JACK SHERWOOD: He didn't mn~e any comments, THE CHAIRMAN: This ~rill not adversely affect property values; will not cause undue increase of vehicular traffic, Will there be an orchestra? JACK SHERWOCD: There will be no such activity as that. I can assure you that it will be conducted in a nice manner. We will have rules and regulatiOns, Any kid that doesntt shape up will be asked 1D leave. THE CN~IRMAN: The church backs this activity, The entrance to the property is through the church? JACK SHERWOOD: The actualyentrance is on the east side of the property. THE CHAIRMAN: On ~he road? JACK SHERWOOD: On the far side of the property, Not on the church sides on the other side. THB CHAIRMANy Does anyone else have any questions? $outhold Town Board ~f Appeals -?- September 19s 1968 HOWARD TERRY: We have had quite a few calls on this and when they found out what it was going to bes they had no objection. T~E CHAIRMAN: The only conditions it will be necessary to restrict the use ~f the property to North Fork Teen Centres Inc, as presently constituted. If that condition is violated~ or if the Board determines that North Fork Teen Centres Inc., is s~thing elses the permission can be revoked. Is there anyone present who ~rishes to speak against this application? (There was no response.) After investigation and inspection the Board finds that the applicant request permission to organizes operate and maintain a youth centre to provide wholesome recreational activities, meetingss eventss entertainment for the inculcating and promoting of the intellectual and social well being of ~oung people. The applicants North Fork Teen Centres Inc. is a non-profit orgainization with an evangelic motive. A seco~dary activity of the youth oe~Ware would ~e the -=le of religious books. Any surplus resulting from th~ sale of books would be turned back into the operation of the Centre. The Board finds that the property in question adjoins property ~f the North Fork Baptist Church. Said chuch is in full accord with said use of the property in questions There will be no increase in traffic resulting from this use. There are adequate parking facilities available. The use will not cause disturbing emissions of noise. There is sufficient area on this property for the use intended by the applicant. The Board finds that the public convenience and we]fare and justice will be served and the legally established or permitted use of neighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit of the OrdiDance will be observed. It is the opinion of the Board this is a highly acceptable activity and should be granted. On motion by Mr, Bergen, seconded by Mr, Gillispie, it was RESOLVED North Fork Teen Centres Inc.s Middle Road~ County Road 27~ Mattituck, New Yorks be granted permission to operate a club as outlined in the application and record of the hearin9, A condition of granting this permission is such permission is only gr~nted to North Fork%~-~ Te~n C~ntle~ as constituted. If the Board finds that this condition is violatedj or that North Fork Teen Centre~Inc. constitutes other tha~ whatwas presented at the hearing, this permission shall no longer exist.
