June 6, 1968
A regular meeting of the Southold Town Board of Appeals
was held at 7:30 P.M., Thursday, June 6, 1968, at the Town
Office, Main Road, Southold, New York.
There were present: Messrs. Robert W. Gillispie, Jr.,
Chairman, Robert Bergen, Fred Hulse, Jr., Charles Grigonis, Jr.
Absent: I~. Serge Doyen, Jr.
At 7:30 P.M., the Board of Appeals took up the matter of
Appeal No. 1181, U~on application of Genevieve T. Daly and Kathrlrn
D. Hoey, 2121 Albemarle Terrace, Brooklyn, New York, for approval
of access in accordance with the State of New York Town Law,
Section 280A. Location of property: Proposed Town Harbor Terrace,
Lot No. 3, Private Road, E/S Town Harbor Lane, Southold, New York.
Bounded north by G. Lewis, east by Hippodrome Creek, south by
private road (Hoey Lane), west by Kathryn D. Hoey.
The Chairman opened the hearing by reading the application
for approval of access, legal notice of hearing, affidavit attesting
to its publication in the official newspapers, and notice to the

applicants.
THE CHAIRMAN: Is there anyone present who wishes to speak
for this application?
(There was no response.)
The Board then inspected the map.
MR. BERGEN: Thomas Street has just been cut through but
never completed, right?
MR. DALY: That's right.
THE CHAIRMAN: Is there anyone present who~ishes to speak
against this applicatinn?
(There was no response.)
MR. CHAIRMAN: If not, I see no reason why we shouldn't
accept it.
MR. DALY: By accepting this application are you accepting
this map 'as the final map?
THE CHaiRMAN: No. This map is just to assist us in discussing
it or locating the right of way which we are granting as applied for.
That is all. This doesn't say that we approve or disapprove the map.
This will not affect what the Town Planning Board does about the road.
How many houses exist on this road?
MR. HOEY: We own that one house on the access road.
MR. BERGEN: On the right hand corner going in?
THE CHAIRMAN: There's no arguement about this road with the
Planning Board?
MR. HOEY: I want to discuss the turnaround because of the zoning
changes made last year. The house that is there was built possibly
in 1907 and that road was the access into that little house.
THE CHAIRMAN: What we are principally interested in is is the
road accessible for emergency vehicles.

MR. CHAIRMAN: I have made a motion that this application be
approved.
MR. GIRGONIS: I second it.
MR. CHAIRMAN: Ail those in favor?
AYES - Ail
THE CHAIRMAN: The application is unanimously granted for
access.
At 7:45 P.M., the Board of Appeals took up the matter of
Appeal No. 1182, Upon application of George Barzac, Jr., Boisseau
Avenue, Southold, New York, for approval of access in accordance
with the State of New York Town Law, Section 280A. Location of
property: Private right of way (Meier Place), E/S Boisseau Avenue
("A" District), Southold, New York. Bounded north by Walter and
Frank 8awicki, east by Walter and Frank Sawicki, south by private
road (Meier Place), west by Joseph Milcetic.
The Chairman opened the hearing by reading the application
for approval of access, legal notice of hearing, affidavit attesting
to its publication in the official newspapers, and notice to the
applicant.
THE CHAIRMAN: The Building Inspector's disapproval merely states
that there is lack of access to this lot. However, we have approved
access to the adjoin/rig lot and the lot is in good condition. Is
there anyone present who wishes to speak for this applicatinn?
MR. BARZAC: I am the applicant, Mr. Chairman.
THE CHAIRMAN: How many more lots can be developed there?
MR. BARZAC: There are a total of 8 lots on this road and you
have already approved access up to the sixth lot on which I am building
now and we are only looking for approval for the two lots beyond this
one which belong to me.
THE CHAIRMAN: And that will be the end of the property?
MR. BARZAC: That's right.
A motion was made by Mr. Bergen, seconded by Mr. Hulse that

that this application be approved.
THE CHAIRMAN: Ail those in favor?
AYES - Ail
THE CHAIRMAN: Application is unanimously granted.
At 8:00 P.M., the Board of Appeals took up the matter of
Appeal No. 1183, Upon application of Fred Masem, 126 Donogan Avenue,
E. Patchogue, New York, a/c Charles & Collette Rivolta, Ole Jule Lane,
Mattituck, New York, for a variance in accordance with the Zoning
Ord/aance, Article III, Section 303, for permission to build on a lot'
with frontage less than 100 feet. Location of property: Ole Jule Lane~
Cl."A" District), Mattituck, New York. Bounded north by J. Zebroski,
east by Ole Jule Lane~ south by Salvina Zahra, west by Canal.
The Chairman opened the hearing by reading the application
for a variance, legal notice of hearing, affidavit of publication
in the official newspapers, and notice to the applicant.
THE CHAIRMAN: This application is accompanied by a sketch
indicating that the proposed lot is an ~rregularly shaped one - 160'
in depth, 65~ on the road and 120' on the creek. Proposal is to
locate the ho~ at least 67' from the road line and at a point 15'
distant from the northeasterly line of the property - 38' plus or
minus from the westerly line of the property. Is there anyone present~
who wishes to speak for this application.
Present were Mr. John S. May, architect-designer of the building,
and Mr. Fred Masem~ contractor.
MR. BERGEN: Is there any particular reason why the house will
only be 15 feet from the line?
MR. MAY: I want to leave the landscape exactly as it is. We
are not going to remove any trees, in fact anything that will be done
would be in addition to what is already there.
MR. BERGEN: That makes the houses only 30' apart.
MR. MAY: Yes, but with the character of the house this would be
no problem. I have a copy of the existing survey if you care to see it.

The Board examined the current survey.
THE CHAIRMAN: ~ notice you made the statement in here that it
isn't possible to buy the property adjoining. There are two different
owners, right?
ER. MAY: Yes. At the house line the frontage across the property
is 85I. We have set the house back 67' specifically to retain what
is there as far as trees are concerned. We are not below the min/mum
allowable coverage of 25% - the plot is over the area required for
building lots.
THE CHAIRMAN: The only thing is we are running into an undersized
frontage. I think it would be better to move the house over to 20'.
You are perfectly within your rights for the 15I.
ER. MAY: To move it the additional 5~ we would have to move a
tree. The 15' is predicated on rough measurements and we could more
than likely move it the 5~.
THE CHA//~MAN: We would grant the 15' but we would recommend the
20'.
THE CHAIRMAN: A motion has been made granting application as
applied for in the location applied for stating that it is the sug-
gestion of the Board of Appeals that the applicant locate the house
at least 20~ from the northeasterly side of the line if possible.
All those in favor?
AYES: Ail
MR. HULSE: A letter has been received from the Mattituck Fire
Department requesting permission to post their usual signs to ad-
vertize their bazaar.
A motion was made and carried that the Board send a letter to
the Mattituck Fire Department approving placing of posters and taking
them down within one week after the affair is over.

RESOLVED that the Southold Town Board of Appeals set 7:30 P.M.
(E.S.T.), Thursday, June 20, 1968, at the Town Office, Main Road,
Southold, New York, as the time and place of hearing upon application
of Robert H. Ohlmann, Box 295B, Bayview Road, Southold, New York, for
a variance in accordance with the Zoning Ord~aance, Article
Sect. 307, for permission to erect a garage within 8½m of 25~ right
of way. Location of property: Bayview Road, Southold, Lots Nos.
75 and 76 on Map of Goose Neck, Map No. 1663.
Vote of the Board; AYES: Ail
RESOLVED that the Southold Town Board of Appeals set 7:40 P.M.
Thursday, June 20, 1968, at the Town Office, Main Road, Southold,
New York, as the time and place of hearing upon application of
Frank W. and Alicia V. Fanning, Main Road, Southold, New York, for
special exception in accordance with the Zoning Ordinance, Article
~I, Sect. 300, subd. 5-A, for use of premises as a two-family
dwelling. Location of property: Main Road, Southold, New York.
Vote of the Board - AYES: Ail
RESOLVED that the Southold Town Board o~ Appeals set 8:00 P.M.
Thursday, June 20, 1968, at the Town Office, Main Road, Southold,
New York, as the time and place of hearing upon application of H.
M. Demarest & Sons, Main Road, Orient, New York, for special exception
in accordance with the Zoning Ordinance, Article X, Sect. 1D0 3-A,
for permission to use premises as a labor camp. Location of property:
S/S of Rte 25, Orient, New York.
Vote of the Board - AYES: Ail
RESOLVED that the Southold Town ~kww/~ Board of Appeals set
8:15 P.M., Thursday, June 20, 1968, at the Town Office, Main Road,
Southold, New York, as the time and place of hearing upon application
of Herman Blum, Bay Avenue, Mattituck, New York, for special exception
in accordance with the Zoning Ordinance, Article IV, Sect. 408,
subd. A, for permission to erect directional sign (Mattituck Motel}
on premises of Mr. George McCarthy. Location of premises: corner of
Main Road and Bay Av~enue~ Mattituck,

Motion was made and~ied that the minutes of the Southold
Town Board of Appeals dated May 16, 1968 be approved as submitted.
Vote of the Board: AYES - All
The next regular meeting of the Southold Town Board of Appeals
will be held at .7:30 P.M., Thursday, June 20, 1968, at the Town
Office, Main Road, Southold, New York.
