Dear Sir,
r bave reoeived caaplaints about the drainage on the private
road, SIB Bay View Road, leading to A.Bergen, E. Axien, T.Szala and
others.
Sinoe the lots on the westerly side bave been raised up, the
olaim is that all drainage runs to the easterly side of the road and
is making a stagnent water pond, mud, and not draining oIt properly.
If you still have controll over this roadway will you see
what can be done to correot this matter ? If you do not have controll
ot this roadway any longer please advise me.

Also that any dwell1ng 01' over 15'00 sq ft area shall bave i

Now that the canal has been dredged and the land raised
considerably I think thR.t Romp of the Health Dept objections ';111 have
been overcome also. ,
Mr. Zebrosk1 has picked up application forms for all of the

be issued for each of the nine ( 9) lots and you
advised that such permits would be issued depending
upon who prepared the bu il ding plans.

plans in the Spring of 1964.

Dear Supervisor Albertson:
Please be informed that a field inspection of the site
was conducted and a careful review was given of the entire situation.
After consideration we felt that an exception could be
granted in this case, however, we want it understood that the dredging
of Ii canal up the middle of the property will endanger the 1il11ited
amount of fresh water available to these plots.
If the Town Planning Board wili18s to go along with the propesed
layout (including canal) we will grant our approval upon the proper
submission of maps and application forms to this department.
We hope this is the information you were seeking, however, if
we can be of any additional assistance, please call.

Gentlemen:
This is to certify that the following action was taken by the
Southo1d Town Planning Board at their meeting May 7, 1963:
In the matter of the application of Julius Zebroski for an
Open Development Area on property located on the south side of Main
Bayview Road, Southo1d, New York, bounded north by Main Bayview Road,
east by land of Berg, Tza1a and Axien, south by Canal, and west by
land of Zukas. it was
RESOLVED that the Planning Board is not willing to recommend to
the Town Board this application for an Open Development Area by Julius
Zebroski on property at Bayview Road, Southo1d, in view of the fact
there is a subdivision application being formulated on this matter at
the present time. Mr. Joseph Giordano called the Board on May 7th and
assured the Board he is working on this but has a slight problem with
the Board of Health.
We can find nothing new in this application for an Open Develop-
ment Area from the previous application. This is a self created hard-
ship. As much as two years ago the Planning Board suggested that if
the Board of Appeals was willing we would make some concessions, and
when this failed the Board suggested that the problem would be solved
by filing for a subdivision.
