Southold, NY 11971 Re: 13565 Bayview Rd., Southold SCTM#88-2-17 Dear Mr. Akscin: The following action was taken by the Board of Town Trustees during its regular meeting held on Wednesday, February 21,2001 regarding the above matter: WHEREAS, RAYMOND J. AKSCIN applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated December 27, 2000, and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Heating was held by the Town Trustees with respect to said application on February 21,200l at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar xvith the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of RAYMOND J. AKSCIN to install a driveway within 75' of the wetlands to access the basement garage. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct and complete project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. DeHaan is the surviving spouse of Rudolph J. DeHaan and owner of the parcel located at 14105 Main Bayview Road, Southold, NY (SCTM #1000-8%1-1). She received the notice regarding the February 21, 2001 hearing on Raymond Jay Akscin's request for a wetlands permit for #1000-88-2-17. She is confused by the notice. Because she is elderly and currently is in Arizona, she asked that, on her behalf, [ write to the Board seeking clarification. The Southold Assessors Office advises that #1000-88- 2-17 is an inactive tax map number and there is no lot relating to that number. Although the subject parcel appears to be the large parcel to the north and west, the seemingly incorrect notice has resulted in Mrs. DeHaan's uncertainty as to the actual location of the lot on which Mr. Akscin is requesting the permit. The property has been in the DeHaan name since 1953. That premises is located to the east and south of the parcel owned by Raymond Jay Akscin which is schedule for a hearing before the Trustees on January 24, 2001. This is to advise that Mrs. DeHaan has not received a notice pursuant to the Town Code regarding the hearing. It would appear that the reason no notice was issued to Mrs. DeHaan is that Mr. Akscin believes that he is a co-owner of 14105 Main Bayview Road. That belief is incorrect. The premises known as 14105 Main Bayview Road was erroneously included in a January 11, 1983 deed from Francis E. Akscin/George B. Akscin/Raymond J. Akscin/Robert G. Titus to Raymond J. Akscin/Geraldine Akscin and then again erroneously included in a deed dated May 2, 1996 from Raymond J. Akscin to Raymond Jay Akscin. The grantors on the 1983 and 1996 deeds have never been in title to 14105 Main Bayview Road. Accordingly, because of the failure to provide of proper notice, my client objects to the hearing going forward as scheduled. For your consideration, I offer the following comments: This project is immediately adjacent to freshwater wetlands. The original Trustee review and comments that were found in the file were addressed to the building envelope for lot number one only and did not include the remaining lots or proposed road construction. It also appears from the sketch plan that the wetlands encroach somewhere near the ten foot elevation contour. It is recommended that the wetland line be extended to include the adjacent property along the southerly lot line of lot numbers 3 & 4 to verify any building envelope concerns that the Trustees may have. The Trustees jurisdiction has also been increased from 75' to 100' and it is recommended that the Trustees re-review this project. A new Suffolk County Water Main has been installed along Main Bayview Road. Covenants should be established to require the subdivision to connect to the Public Water System. The drainage calculations for the proposed road construction are adequate but there appears to be a design problem. From the contours located on the sketch plan it would look as if catch basin # 3 is located at a high point in the proposed roadway. A considerable amount of unnecessary grading will need to be done to make this basin functional. Catch basin # 4 may be designed too close to the ground water elevation. Seven-foot deep basins with a flat traffic bearing slab and road construction materials may be as much as nine feet deep. This would not appear to have a three-foot separation from the bottom of the pool to the ground water table. Moore pools with a shallower depth may be required. The inside radius of the turn in the proposed roadway should have a minimum turning radius of twenty-five (25') feet to allow for safety and two way traffic. The Cull-de-Sac should have a minimum outside turning radius of eighty-eight (88') feet to meet Town Code. If you have any questions concerning this report, please contact my office. ames A.
