The following action was taken by the Board of Town Trustees
during its Regular Meeting held on May 28, 1998, regarding the
above matter:
WHEREAS, COVE CONDOMINIUMS,, applied to the Southold Town
Trustees for a permit under the provisions of the Wetland
Ordinance of the Town of Southold, application dated February 9,
1998, and,
WHEREAS, said application was referred to the $outhold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on May 28, 1998, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
COVE CONDOMINIUMS to maintenance dredge to 3' below ordinary low
water approx. 90 c.y. from channel at entrance to Homeowners
Association docking area, dredge as necessary in the same area
to maintain width of depth of entrance channel on a max. of 3
additional occasions during the next the years and spoil will be
removed to an upland location for deposition. Located: off Main
Bayview road, Southold.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

the floats in question. As you well know, all the dock builders in the area are very busy at

and received in our office on March 3, 2000, and determined that
the renovation of the roads and driveways in the common areas by
two treatments, to be out of the Wetland jurisdiction, under
Chapter 97 of the Town Wetland Code.
However, any activity within 75' of the Wetland line would
require permits from this office.
This determination is not a determination from any other agency.

Dear Sir:
The Association wishes to have the roads and driveways in the common areas renovated by two
treatments, each treatment consisting of the application of RC250 road oil at the rate of 0.3 to 0.5
gallons per square yard, followed by the placement of bluestone at the rate of 40 to 60 pounds
per square yard.
It appears from the site map that all of the roads and driveways are more than 75 feet from the
nearest edge of the wetlands. I would appreciate it if you would review this project and issue and
letter of non-jurisdiction if you find it to be appropriate.

My staff has reviewed your application for dredging of Corey Creek as it pertains to the
Cove Condominium Homeowners Association. The drawings for your project have also been
reviewed by the Suffolk County Parks Department's Superintendent, Charles Bender. Both
departments concur there will be no negative impact on County property as shown on the
drawings submitted by letter dated February 5, 1998.
All permits must be obtained by the homeowners association. In addition, the County
does not assume any liability for this project.

A detailed description and plans of the applicant's activity are enclosed to assist in your review.
The decision whether to issue a permit will be based on an evaluation of the probable impact,
including cumulative impacts, of the proposed activity on the public interest. That decision will reflect
the national concern for both protection and utilization of important resources. The benefits which
reasonably may be expected to accrue from the proposal must be balanced against its reasonably
foreseeable detriments. All factors which may be relevant to the proposal will be considered including
the cumulative effects thereof; among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, historical properties, fish and wildlife values, floodplain values, land
use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality,
energy needs, safety, food and fiber production, mineral needs, consideration of property ownership and,
in general, the needs and welfare of the people.
The Corps of Engineers is soliciting commems from the public; Federal, state, and local agencies
and officials; Indian Tribes; and other imerested parties in order to consider and evaluate the impacts of
this proposed activity. Any comments received will be considered by the Corps of Engineers to determine
whether to issue, modify, condition or deny a permit for this proposal. To make this decision, commems
are used to assess impacts on endangered species, historic properties, water quality, general
environmental effects, and the other public interest factors listed above. Comments are used in
preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the
National Environmental Policy Act. Comments are also used to determine the need for a public hearing
and to determine the overall public interest of the proposed activity.
ALL COMMENTS REGARDING THE PERMIT APPLICATION MUST BE PREPARED IN
WRITING AND MAILED TO REACH THIS OFFICE BEFORE THE EXPIRATION DATE OF THIS
NOTICI~, otherwise, it will be presumed that there are no objections to the activity.

Any person may request, in writing, betbre this public notice expires, that a public hearing be
held to collect information necessary to consider this application. Requests for public hearings shall state,
with particularity, the reasons why a public hearing should be held. It should be noted that information
submitted by mail is considered just as carefully in the permit decision process and bears the same weight
as that furnished at a public hearing.
Our preliminary determination is that the activity for which authorization is sought herein is not
likely to affect any Federally endangered or threatened species or their critical habitat. However,
pursuant to Section 7 of the Endangered Species Act (16 U.S.C. 153 l), the District Engineer is consulting
with the appropriate Federal agency to determine the presence of and potential impacts to listed species
in the project area or their critical habitat.
Based upon a review of the latest published version of the National Register of Historic Places,
there am no known sites eligible for, or included in, the Register within the permit area. Presently
unknown archeological, scientific, prehistorical, or historical data may be lost by work accomplished
under the required permit.
Pursuant to Section 307 (c) of the Coastal Zone Management Act of 1972 as amended [16 U.SC
1456 (c)], for activities under consideration that are located within the coastal zone of a state which has
a federally approved coastal zone management program, the applicant has certified in the permit
application that the activity complies with, and will be conducted in a manner that is consistent with, the
approved state coastal zone management program. By this public notice, we are requesting the state's
concurrence with, objection to, or waiver of the applicant's certification. No permit decision will be
made until one of these actions occur. For activities within the coastal zone of New York State~ the
applicant's certification and accompanying information is available from the Consistency Coordinator,
New York State Depatm~ent of State, Division of Coastal Resoumes and Waterfront Revitalization,
Coastal Zone Management Program, 41 State Street, Albany, New York 12231, Telephone (518) 474-
3642. Comments regarding the applicant's certification, and copies of any letters to this office

WORK DESCRIPTION
The applicam, Cove Condominiums Homeowners Association, has requested Department of the
Army authorization to dredge material from Corey Creek, Little Peconic Creek at the Town of
Southold, Suffolk County, New York with ten years maintenance and subsequent upland
disposal.
The work would involve dredging, with ten years maintenance, of material from a crescent-
shaped shoaled area at the mouth of the entrance channel to the Association's mooting area to
a maximum depth of 3 feet below low water, removing approximately 90 cubic yards of
material. Three additional dredging events are anticipated during the ten year life of the permit,
removing approximately 50 cubic yards of material per event. All dredged material would be
disposed of at state-approved upland site and would be suitably retained so as to prevent reentry
into any waterway.
The stated purpose of this project is to provide safe access to the Association's mooring area.
