Dear Ms. Moore:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday August 18, 2004, regarding the above matter:
WHEREAS, Patricia Moore as agent for LISA EDSON applied to the Southold Town
Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code,
the Wetland Ordinance of the Town of Southold, application dated March 8, 2004, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on August 18, 2004, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of Patricia Moore as
agent for LISA EDSON to construct on pilings a two-story, one-family dwelling, deck,
swimming pool, pervious drive, sanitary system, and retaining wall, place approximately
450 cubic yards of fill, install dry wells for roof runoff, and establish a 50' non-
disturbance, non-fertilization buffer adjacent to the tidal wetland as per plans surveyed
by Joseph Ingegno last dated October 5, 2004.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)
This is not a determination from any other agency.

Your recent request to modify the above permit has been reviewed pursuant to 6NYCRR, Part 621. It
has been determined that the proposed modifications will not substantially change the scope of the
permitted actions or the existing permit conditions. Therefore, the permit is amended to authorize the
construction ora two story single family dwelling, porch, decks, pool, pervious driveway, and a
drainage system. All work shall be in accordance with the plan prepared by Joseph A. lngegno on
2/18/00, last revised 12/6/01, and stamped NYSDEC approved on 2/21/02.

The attached plan, when duly signed by a representative of the Department, constitutes a permit to consta'uct a
water supply and/or collection system for the property as depicted. The applicant should take note of any
conditions of approval, which may be indicated on the plan or enclosed herein. Construction must conform with
applicable standards including "Standards for Approval of Plans and Construction for Sewage Disposal
Systems for Single Family Residences" and "Standards and Procedures for Private Water Systems." Omissions,
errors or lack of details on the plan does not release the applicant from the responsibility of having the
construction done in conformance with applicable standards.
The permit (plan) expires three (3) years after the approval date. Any modifications which may affect the
proposed sewage disposal or water supply systems requires submission of a revised plan and additional fees
(if applicable) for reapproval prior to construction. No inspections will be performed by the
I)e?artment on ex?ired permits.
Permits may be renewed, extended, transferred or revised in accordance with the procedures described in
"Submission Requirements for Approval of Sewage D'isposal and Water Supply Facilities for Single Family
Dwellings" (Form WWM-041).
It is the applicant's responsibility to call the depa,~ent at 852-2097, in advance, to arrange inspections of the
sewage disposal and/or water supply facilities prior to backfilling. These include inspections of the sewage
collection and disposal systems, water supply system components and piping, and final grading as shown on the
approved plans. In certain cases, inspections of the soil excavation may be required to determine the acceptability
of the so'tls for sewage disposal systems. The Department must be notified at least 24 hours in advance to schedule
an inspection and excavation inspections must be confirmed by calling 852-2100 prior to 9:30 Aa~L, the morning
of the inspection.

NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of LISA EDSON to construct
on pilings a two-story, one-family dwelling, deck, and swimming pool; install a pervious
driveway and sanitary system with concrete retaining wall; place approx. 450 cy. of fill; install
drywells; establish a 50' non-disturbance/non-fertilization buffer adjacent to the tidal wetlands;
and connect to public water and other utilities, all as depicted on the approved survey dated
February 18, 2000 and last revised September 17, 2001.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire two years from the date it is signed. Fees
must be paid, if applicable, and permit issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified upon completion of said project.

The storm drainage design for the right-of-way is intended to capture and
recharge runoff from the driveway and proposed 20 foot right of way extending
from Main Bayview Road to the subject property, a distance of 450 feet.
It is proposed to catch, store and recharge to groundwater 2 inches of runoff
from a 12 foot wide granular surface driveway and from a 7 foot shoulder width
on the northwast side of the driveway. The calculation of the volume of runoff is
obtained by using a coefficient which represents the percentage of rein which
runs off (does not directly percolate into the ground). The granular roadway was
assigned a runoff coefficient of 0.7 and the stone lined ditch and natural ground
was assigned 0.3. These coefficients are generally accepted engineering
values for the type and slope of ground surface.
In addition, there is a built-in conservative factor in this determination of storage
volume. Not considered in the volume of storage calculation is the volume of
storm water which recharges into the ground from the storage facility during the
duration of the storm itself. In actuality, the storage will accept runoff from a
storm which is greater than 2 inches.
The driveway is proposed to be one foot away from the southeasterly boundary
of the right-of-way so as to provide a 7 foot width within which storm drainage
can be directed within a shallow 6 inch deep stone lined trench to dry walls or a
stone storage layer for recharge. The drive surface is shown to pitch very
slightly toward the stone ditch. A crushed bluestone surface is proposed
because it will provide a strong stable surface and still have the relatively high
permeability which will minimize runoff.
Storage and Recharge of Stormwater
Four shallow precast concrete dry walls are proposed to be located to pick up
drainage from the upper northerly portions of the drive and right-of-way. As the
driveway surface elevation gets close to the level of the groundwater, dry walls

cannot be used. In the southerly most 200 feet of right-of-way, a shallow 12 inch
deep stone filled blanket has been designed beneath the driveway. This stone
layer will provide void space within the stone matrix equal to or greater than 30%
of the volume of the layer. In addition, this stone drainage system will enhance
local percolation of any runoff which might flow to the immediate area on the
easterly side of the drive.
To prevent the gradual migration of fine soil into the stone which could reduce its
ability to store and release storm water, the stone blanket will be wrapped with a
geotextile fabric which allows for the passage of water but not soil.
The two inch storm volume and the storage volume calculations are shown on
the drawing.
Summary_
The drainage facilities proposed will more than offset any new runoff which might
occur as the result of the construction of this driveway. However, because these
drainage improvements only serve to locally reCharge runoff to groundwater and
do not divert water, they should not have any effect on the nearby wetlands.

87-5-24 and I am recorded in the tax assessors office. I am the owner of this parcel of
land not Grace Edson (as misrepresented in the Edson application) and have been for
over a year. It is not vacant. I am in the process of building a house with the foundation
completed and the fi.aming in progress. Please have your agency note this and correct the
survey.
#2 I have an approved D.E.C. building permit fi.om your agency. My permit number
is 1-4738-02305/00001 and was issued in September of 1999. On March 17, 1999 E.N.
Consultants flagged tidal wetland on my parcel of land to determine setbacks, buffers and
the location of my house etc. My established tidal wetlands are omitted ~om Lisa
Edson's survey. My property is adjacent to hers and these tidal wetlands will effect her
entire proposed survey i.e. setbacks, septic, non-disturbance buffers, utilities, side yards,
front yard, and right-of-way. This blatant oversight of my established wetlands needs to
be noted and corrected with your agency and her survey.
#3 The Edson survey misrepresems that they (Edson) own the right of way. This is
incorrect as I own the entire fight-of-way. Upon request I will be happy to show you the
documem. This makes building her proposed above ground septic and retaining walls on
my land (right-of-way) an impossibility. Furthermore, this septic setback does not meet
D.E.C. regulation fi.om the established tidal wetlands on my property. Again, please have
your agency note this for future survey proposals
#4 Concerning her 50 foot non-disturbance buffer, this too is misleading. Edson is
using my right-of-way on the east side of her property as if it is her property. I am not
sure if side yards and fi'ont yard codes are under your jurisdiction or only Southold
Building and Zoning Board, but she is building directly on my property line without a fi'ont
yard or side yards which is required code.
Thus, in order to comply with Southold building code Edson's proposed building
package will violate the D.E.C. 50 foot non-disturbance buffer and tidal wetlands
regulations.
#5 Lisa Edson's permission to put her water and electric utilities on the south right-
of-way side again creates further problems. Everyone has overlooked the fact that she
proposes digging at least 4 1/2 foot trenches tbr water and again trenches for electrical
utilities in the middle of my 50 foot non-disturbance buffer. These are established tidal
wetlands that they conveniently disregarded. My 50 foot non-disturhance buffer will be
disturbed for approximately 110 feet! Some of it within 15' of the tidal wetlands!
I feel to many misleading proposed surveys have been submitted to you. I just
want the D.E.C. to know who I am, where I am and everyone abide by the same roles.
Hopefully, after everyone has received this letter we will all be in the same loop. Thank

Environmental Conservation Law as those prescribed for the perm{flee.
Item C: Perm{tree Responsible for Obtaining Other Required Permits
The perm{tree is responsible for obtaining any other permits, approvals, lands, easements and rights, of-way that
may be required to carry out the activities that are authorized by this permit.
Item D: No Right to Trespass or Interfere with Riparian Rights
This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian
rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or
interest in real or personal property held or vested in a person not a party to the permit_
GENERAL CONDITIONS
General Condition I: Facility Inspection by the Department
The permitted site or facili~', including relevant records, is subject to inspection at reasonable hours and intervals
by an authorized representative of the Department of Environmental Conservation (the Department) to determine
whether the perm~ee is complying with this permit and the ECL. Such representative may order the work suspended
pursuant to ECL 7'[-0501 and SAPA 401(3),
The permittae shall provide a person to accompany the Department's representative during an inspection to the
permit area when requested by the Department.
A copy of this permit, including all referenced maps, drawings and special conditions, must be available for
inspection by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon
request by a Department representative is a violation of this permit.
General Condition 2: Relet]enship of this Permit to Other DeparbTtent el'dare and Determinations
Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind
any order or determination previously issued by the Department or ahy of the terms, conditions or requirements
contained in such order or determination.
General Condition 3: Applications for Permit Renewals or Modifications
The perm~ee must submit a separate written application to the Department for renewal, modification or transfer
of this permit. Such application must include any forms or supplemental information the Department requires. Any
renewal, modification or transfer granted by the Department must be in writing,
The perm{tree must submit a renewal application at least:
a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES),
Hazardous Waste Management Facilities (HWMF), major Air Pollution Control (APe) and Solid Waste
Management Facilities (SWNIF); and
b) 30 days before expiration of all other permit types.
Submission of applications for permit renewal or modification are to be submitted to:

General Condition 4: Permi(~ Modifications, Suspensions end Revocatlol'ts by the Department
The Department reserves the right to modify, suspend or revoke this permit. The grounds for modification,
suspension or revocation include:
a) the scope of the permitted activity is exceeded or a violation et any condition of the permit or provisions
of the ECl. and pertinent regulations is found;
b) the permit was obtained by misrepresentation or failure to disclose relevant facts:
c) new material information is discovered; or
d) environmental conditions, relevant technology, or applicable law or regulation have materially
changed since the permit was issued.

If future operations by the State of New York require an alteration in the position of the structure or work herein
authorized, or tr, in the opinion of the Department of Environmental Conservation it shall cause unreasonable
obstruction to the free navigation of said watem or flood flows or endanger the health, safety or welfare of the
people of the State, er cause loss or destruction of the natural resources of the State, the owner may be ordered
by the Department to remove or alter the structural work, obstructions, er hazards caused thereby without expense
to ti~e State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other
modification of the watercourse hereby authorized shall not be completed, the owners, shall, withoul expense to
the State, and to such extent and in such time and manner as the Department of Environmental Conservation ma),
require, remove all er any portion of the uncompleted structure or fill and restore to its former condition the
navigable and flood capacity of the watercourse. No claim shall be made against the State o? New York on
account of any such removal or a~teration.
The State of New York shall in no case be liable for any damage or injury to the structure or work herein
authorized which may be caused by or result from future operations undertaken by the State for the conservation
or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any
such damage.
Granting of this permit does not relieve the applicant of the responsibility of obtaining any other permission,
consent or approval from the U.S. Army Corps of Engineers, U.S. Coast Guard, New York State Office of General
Services or local government which may be required,
At; necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended
solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachata or any other
environmentally deleterious materials assoc[afed with the project.
Any material dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large
refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause
damage to navigable channels or to the banks of a waterway.
6. There shall be no unreasonable interference with navigation by the work herein authorized.
If upon the expiration or revocation of this permit, the project hereby authorized has net been completed, the
applicant shall, without expense to the State, and to such extent and in such time and manner as the Department
of Environmental Conservation may require, remove all or any portion of the uncompleted structure or till and
restore the site to its former condition. No claim shall be made against the State of New York on account of any
such removal or alteration.
8. If granted under 6NYCRR Part 608, the NYS Depa~ment of Environmental Conservation hereby certifies that the
subject project will not contravene effluent limitations or other limitations or standards under Sections 301,302,
303,306 and 307 of the Clean Water Act of t977 (PL 95-2'17) provided that all of the conditions listed herein are
met.
9. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top
portion of the enclosed notification form cerUfying that they are fully aware of and understand all terms and
conditions of this permit, Within 30 days of completion of project, the bottom portion of the form must also be
signed and returned, along with photographs of the completed work and, if required, a sur~ey.
10. All activities authorized by this permit must be in strict conformance with the approved plans submitted by the
applicant or his agent as part of the permit application.

1 During construction, concrete or leachate shall not escape or be discharged, ncr shall washings from transit mix
trucks, mixers, or other devices enter tidal wetlands and or protected buffer areas.
2 Any debris or excess material from construction of this project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for disposal, No debris is permitted in tidal wetlands and or
protected buffer areas.
3. There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted
activity.
4. The storage of construction equipment and materials shall be confined to within the project work site and or upland
areas greater than 75 linear feet from the tidal wetland boundary.
5. Air fill shall consist of "clean" sand, gravel, or soil (not asphalt, flyash, broken COncrete or demolition debris).
6. To protect the values of the tidal wetlands, a permanent vegetated buffer zone shall be established. There shall
be no disturbance to the natural vegetation or topography within an area extending 50 linear feet landward of the tidal
wetland boundary.
7, A row of staked hay bales or approvable erosion control devices shall be placed at the landward edge of the buffer
area or 50 linear feet from the tidal wetland boundary, or as per NYSDEC approved plan, at commencement of
regulated activities and remain in place until project is completed and all disturbed areas stabilized with vegetation.
8. Roof runoff shall be directed to drywells a minimum of 80 feet landward of the tidal wetland boundary for immediate
on-site recharge.
9. Dry wells for pool filter backwash shall be located a minimum of 80 feet landward of the tidal wetland boundary.
10. There shall be no draining of swimming pool water directly or indirectly into tidal wetlands or protected buffer areas.
11. Driveways and parking areas shall be constructed of pervious material.
12. Sanitary system (boffom of tank and leaching pools) shall be located a minimum of 2' above seasonal high
groundwater.
13. The permittee shall incorporate the following language as a notice covenant to the deed:
"Regulated tidal wetlands associated with Corey Creek are located at Main Bayview Road, Southold, Suffolk County
Tax Map Number: District 1000, Section 87, Block 05, Lot 25, otherwise known as the properties of Lisa Edson and
her heirs, assigns, or successors. This property is subject to the provisions of New York State Environmental
Conservation Law (ECL) Article 25 or its successor, and the conduct of regulated activities may ~ccur only pumuant
to ECL Article 25 if prior approval is given by the New York State Department of Environmental Conservation
(NYSDEC) or its successor. Regulated activities include, b~ are not limited to the erection of any structure(s);
excavation; dredging grading and filling; cleadng of vegetation; and application of chemicals."
This deed covenant shall be recorded with the Clerk of Suffolk County within 90 days of the issuance of this permit.
A copy of the covenanted deed or other acceptable proof of record, along with the number assigned to this permit,
shall be sent within one calendar year of the issuance of this permit to; NYSDEC, Regional Manager, Bureau of
Habitat, SUNY Building 40, Stony Brook, New Yore 11790-2356.

owners, I understand from our conversation that the stakes placed by the surveyor were removed
prior to the Board's inspection or that the Board was simply unable to locate them due to
overgrowth of vegetation. Either way, we wish to postpone the hearing again so that the site can
be staked for a proper Board inspection.
In order to allow for a coordinated field inspection with the New York State Department of
Environmental Conservation and to ensure that the stakes are in place and visible at the time of
that inspection, Chris Arfsten has agreed to contact the surveyor a day or so prior to his visit so
that the site can be staked at that time. Chris will also inform me of his timing so that I can
arrange t'or you to meet all of us at the site at one time. Although arranging a coordinated review
on such short notice may be difficult, I believe that it is the only way to ensure that the site can
be inspected properly and will enable the remainder of the review process to proceed more
smoothly.
Please contact me if you have any questions regarding my request and otherwise, I will contact
you directly as soon as I hear from Chris. I appreciate your patience a~d anticipated cooperation.

A wetland permit was issued Permit No 5427 on October 26, 2001 to construct
on pilings a two-story, one-family dwelling, deck, and swimming pool; install petwious
driveway and sanitary system with concrete retaining wall; place approx. 450 cy of fill;
install dryxvells; establish non-disturbance/non-fertilization buffer adjacent to tidal
wetlands; and connect to public water and other utilities. All as depicted on approved
survey dated February 18,2000 and last revised September 17, 2001.
Thereafter on April 24,2002 the permit was amended to reconfigure drywells
located beneath the proposed driveway to conform with the Health Department
requirements.
The Trustees thoroughly reviewed this permit in 2001, and again in 2002, and
placed conditions on the permit in accordance with your then stated "policies". My
client wishes to obtain the same permit which expired. The proposed permit conforrr~
to the new requirements, xve ~vould ask that this application be approved as an
administrative permit since the Trustees already revie~ved this application twice before.

NOTIFICATION OF OTHER PERMITTEE OBLIGATIONS
Item A: Permittee Accepts Legal Responsibility and Agrees to Indemnification
The permittee expressly agrees to indemnify and hold harmless the Department of Environmental Conservation
of the State of New York, its representatives, employees, agents, and assigns for ail claims, suits, actions, damages,
and costs of every name and description, arising out of or resulting from the permittee's undertaking of activities or
operation and maintenance of the facility or facilities authorized by the permit in compliance or non-compliance with
the terms and conditions of the permit.
Item B: Permittee's Conffactors to Comply with Permit
The permittee is responsible for informing its independent contractors, employees, agents and assigns of their
responsibility to comply with this permit, including ali special conditions while acting as the permittee's agent with
respect to the permiffed activities, end such persons shall be subject to the same sanctions for violations of the
Environmental Conservation Law as those prescribed for the permittee.
Item C: Permittee Responsible for Obtaining Other Required Permits
The permit'tee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-way that
may be required to carry out the activities that are authorized by this permit.
Item D: NO Right to Trespass or Interfere with Riparian Rights
This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian
rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or
interest in real or personal property held or vested in a person not a party to the permit.
GENERAL CONDITIONS
General Condition 1; Facility Inspection by the Department
The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals
by an authorized representative of the Department of Environmental Conservation (the Depadment) to determine
whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended
pursuant to ECL 71-0301 and SAPA 401(3).
The permittee shall provide a person to accompany the Department's representative during an inspection to the
permit area when requested by the Department.
A copy ofithis permit, including all referenced maps, drawings and special conditions, must be available for
inspection by the Department at all times at the project site or facilibJ. Failure to produce a copy of the permit upon
request by a Department representative is a violation of this permit.
General Condition 2: Relationship of this permit to Other Department Orders and Determinations
Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind
any order or determination previously issued by the Department or any of the terms, conditions or requirements
contained in such order or determination.
General Condition 3: Applications for Permit Renewals or Modifications
The permittee must submit a separate written application to the Department for renewal, modification or transfer
of this permit. Such application must include any forms or supplemental information the Department requires. Any
renewal, modification or transfer granted by the Department must be in writing.
The permittee must submit a renewal application at least:
a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES},
Hazardous Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste
Management Facilities (SWMF); and
b) 30 days before expiration of all other permit types.
Submission of applications for permit renewal or modification are to be submitted to:

General Condition 4: Permit Modifications, Suspensions and Revocations by the Department
The Department reserves the right to modify, suspend or revoke this permit. The grounds for modification,
suspension or revocation include'.
a) the scope of the permitted activib/is exceeded or a violation of any condition of the permit or provisions
of the ECL and pertinent regulations is found;
b) the permit was obtained by misrepresentation or failure to disclose relevant facts;
c) new material information is discovered; or
d) environmental conditions, relevant technology, or applicable law or regulation have materially
changed since the permit was issued.

If future operations by the State of New York require an alteration in the position of the structure or work herein
authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable
obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the
people of the State, or cause Joss or destruction of the natural resources of the State, the owner may be ordered
by the Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense
to the State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or' other
modification of the watercourse hereby authorized shall not be completed, the owners, shall, without expense to
the State, and to such extent and in such time and manner as the Department of Environmental Conservation may
require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the
navigable and flood capacity of the watercourse. No claim shall be made against the State of New York on
account of any such removal or alteration.
The State of New York shall in no case be liable for any damage or injury to the structure or work herein
authorized which may be caused by or result from future operations undertaken by the State for the conservation
or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any
such damage.
Granting of this permit does not relieve the applicant of the responsibility of obtaining any other permission,
consent or approval from the U.S. Army Corps of Engineers, U.S. Coast Guard, New York State Office of General
Services or local government which may be required.
All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended
solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other
environmentally deleterious materials associated with the project.
Any matedal dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large
refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause
damage to navigable channels or to the banks of a waterway.
There shall be no unreasonable interference with navigation by the work herein authorized.
If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the
applicant shall, without expense to the State, and to such e×tent and in such time and manner as the Department
of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fiji and
restore the site to its former condition. No claim shall be made against the State of New York on account of any
such removal or alteration.
If granted under 6NYCRR Part 608, the NYS Department of Environmental Conservation hereby certifies that the
subject project will not contravene effluent limitations or other limitations or standards under Sections 301,302,
303, 306 and 307 of the Clean Water Act of 1977 (PL 95-217) provided that all of the conditions listed herein are
met.
At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top
portion of the enclosed notification form certifying that they are fully aware of and understand all terms and
conditions of this permit. Vv~thin 30 days of completion of project, the bottom portion of the form must also be
signed and returned, along with photographs of the completed work and, if required, a survey.
10. All activities authorized by this permit must be in strict conformance with the approved plans submitted by the
applicant or his agent as part of the permit application.

SPECIAL CONDITIONS
1 During construction, concrete or leachate shall not escape or be discharged, nor shall washings trom transit mix
trucks, mixers, or other devices enter tidal wetlands and or protected buffer areas.
2. Any debris or excess material from construction of this project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands and or
protected buffer areas.
3. There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted
activity.
4. The storage of construction equipment and materials shall be confined to within the project work site and or upland
areas greater than 75 linear feet from the tidal wetland boundary.
5. All till shall consist of "clean" sand. gravel, or soil (not asphalt, flyash, broken concrete or demolition debris).
6. To protect the values of the tidal wetlands, a permanent vegetated buffer zone shall be established. There shall
be no disturbance to the natural vegetation or topography within an area extending 50 linear feet landward of the tidal
wetland boundary.
7. A row of staked hey bales or approvable erosion control devices shall be placed at the landward edge of the buffer
area or 50 linear feet from the tidal wetland boundary, or as per NYSDEC approved plan, at commencement of
regulated activities and remain in place until project is completed and all disturbed areas stabilized with vegetation.
8. Roof runoff shall be directed to drywells a minimum of 80 feet landward of the tidal wetland boundary for immediate
on-site recharge.
9. Dry welts for pool tilter backwash shall be located a minimum of 80 feet landward of the tidal wetland boundary.
10, There shall be no draining of swimming pool water directly or indirectly into tidal wetlands or protected buffer areas.
11. Driveways and parking areas shall be constructed of pervious material.
12. Sanitary system (bottom of tank and leaching pools) shall be located e minimum of 2' above seasonal high
groundwater.
13. The permittee shall incorporate the following language as a notice covenant to the deed:
"Regulated tidal wetlands associated with Corey Creek are located at Main Bayview Road, Southold, Suffolk County
Tax Map Number: District 1000, Section 87. Block 05, Lot 25, otherwise known as the properties of Lisa Edson and
her heirs, assigns, or successors. This property is subject to the provisions of New York State Environmental
Conservation Law (ECL) Article 25 or its successor, and the conduct of regulated activities may occur only pursuant
to ECL Article 25 if prior approval is given by the New York State Department of Environmental Conservation
(NYSDEC) or its successor. Regulated activities include, but are not limited to the erection of any structure(s);
excavation; dredging grading and filling; clearing of vegetation; and application of chemicals."
This deed covenant shall be recorded with the Clerk of Suffolk County within g0 days of the issuance of this permit
A copy of the covenanted deed or other acceptable proof of record, along with the number assigned to this permit,

Dear Mr. Krupski:
As you no doubt recall, the captioned permit for construction of a one-family d~velling was issued 26
October 2001 and included approval for a drainage system to be installed in Ms. Edson's right-of-way to
Main Bayview Road.
In response to a request by the Suffolk County Department of Heakh Services, a very minor change was
subsequently made to the layout of this drainage system, in that the drywells located beneath the driveway
are to be configured linearly rather than in a cluster. Enclosed is a copy of the site plan revised'to reflect
this change, last dated 6 December 2001. For your reference, I have also enclosed sectional copies of
both this plan and the one approved by the Board last October, highlighting the change.
As this is such a minor and effectively non-substantive modification, 1 am unsure whether the Board
would typically be interested in receiving the additional paperwork. Because Patricia Moore must still
present an application for setback variance to the Zoning Board of Appeals, however, it would be proper
for us to request that the Trustees issue either an amended permit or a simple memorandum
acknowledging receipt of the revised plan with notification that no formal permit modification is
necessary. In either event, I would appreciate your prompt response to my inquiry.
Also enclosed for your reference are copies of the Suffolk County Department of Heakh Services
approval and the DEC permit amendment, which incorporates the drainage system that was requested by
the Trustees subsequent to the issuance of the original DEC permit. I thank you for your anticipated
cooperation.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, October 24, 2001 regarding the above matter:
WHEREAS, Eh-Consultants, Inc. on behalf of LiSA EDSON applied to the Southold Town
Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold,
application dated October 8, 1999, and,
WHEREAS, said application was referred to the Southotd Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
October 24, 2001, at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar w/th the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,

NOW THEREFORE BE IT,

driveway and sanitary system with concrete retaining wall; place approx. 450 cy. of fill; install
dryxvells; establish a 50' non-disturbance/non-fertilization buffer 'attjaeent to the tidal wetlands;
and co~mect to public water and other utilities, all as depicted on the approved ,urvey dated
February 18, 2000 and last revised September 17, 2001.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire two years from the date it is signed. Fees
mast be paid, if applicable, and permit issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified upon cornpletion of said project.

Dear Mr. Krupski:
As you no doubt recall, the captioned permit for construction of a one-family dwelling was issued 26
October 2001 and included approval for a drainage system to be installed in Ms. Edson's right-of-way to
Main Bayview Road.
In response to a request by the Suffolk County Department of Health Services, a very minor change was
subsequently made to the layout of this drainage system, in that the drywells located beneath the driveway
are to be configured linearly rather than in a cluster. Enclosed is a copy of the site plan revised to reflect
this change, last dated 6 December 2001. For your reference, I have also enclosed sectional copies of
both this plan and the one approved by the Board last October, highlighting the change.
As this is such a minor and effectively non-substantive modification, I am unsure whether the Board
would typically be interested in receiving the additional paperwork. Because Patricia Moore must still
present an application for setback variance to the Zoning Board of Appeals, however, it would be proper
for us to request that the Trustees issue either an amended permit or a simple memorandum
acknowledging receipt of the revised plan with notification that no formal permit modification is
necessary. In either event, I would appreciate your prompt response to my inquiry.
Also enclosed for your reference are copies of the Suffolk County Department of Health Services
approval and the DEC permit amendment, which incorporates the drainage system that was requested by
the Trustees subsequent to the issuance of the original DEC permit. I thank you for your anticipated
cooperation.

Almougla I have posted the property and forwarded certified notices to the adjacent property
owners, I understand from our conversation that the stakes placed by the surveyor were removed
prior to the Board's inspection or that the Board was simply unable to locate them due to
overgrowth of vegetation. Either way, we wish to postpone the hearing again so that the site can
be staked for a proper Board inspection.
In order to allow for a coordinated field inspection with the New York State Department of
Environmental Conservation and to ensure that the stakes are in place and visible at the time of
that inspection, Chris Arfsten has agreed to contact the surveyor a day or so prior to his visit so
that the site can be staked at that time. Chris will also inform me of his timing so that I can
arrange for you to meet all of us at the site at one time. Although arranging a coordinated review
on such short notice may be difficult, I believe that it is the only way to ensure that the site can
be inspected properly and will enable the remainder of the review process to proceed more
smoothly.

Dear Mr. Krupski,
Please be advised that I have been in oonlaet with a botanist ftom Cornell University
and he has identified Baccharis haJimifolia (High Tide Bush) ftom a specimen I gave him
from an area on my property adjacent to tile Edson property. He informed me that this
particular wetland indicator (F AC, F ACW) is federally protected as well as protected by
tile N.Y. State D.E.C. It is also mentioned in tile Town Code 97-11 B, Definition of
Wetlands (Tidal).
I am looking forward to seeing you and tile rest of tile Trustees again during your next
visit to tile site so that I can point out this plant There are a few plants on my ploputy,
and ftom wbat I can see from here and from tile rigbt ofway, it covers much of tile
Edson building p8'<.'hge, including tile footprint of tile (Xoposed residence.
