Dear Mr. Hall:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, June 26, 2002 regarding the above matter:
WHEREAS, Land Use Ecological Services, Inc. on behalf of JACK BIGGANE applied to the
Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold To~vn
Code, the Wetland Ordinance of the Town of Southold, application dated May 29, 2002, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and reconunendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
June 26, 2002, at xvhich time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,

NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of JACK BIGGANE to
construct a 4'X 150'+/- CCA timber stairway to be raised 4' above the existing grade/slope,
using (60) 4"X 4" CCA timber posts and installed with a depth of penetration of 6', with the
condition that the drainage work is complete before construction begins, and as depicted on the
plan dated March 1, 2002 and last revised October 22, 2002.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire two years from the date the permit is signed.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of $5.00 per inspection. (See attached schedule.)

Contract Vendees requests a Wetland Permit to construct a two-story, one-
family dwelling on pilings; install a sanitary system, pervious driveway, drywell-
drainage system, and public water service; establish a 50' wide non-
disturbance/non-fertilization buffer adjacent to the tidal wetland boundary;
remove existing driveway; and replant with native vegetation the approx. 1,150
sq.ft, podion of existing ddveway located within the proposed buffer area.

En-Consultants, Inc. on behalf of DONNA BLANCHARD requests a Wetland
Permit to remove and replace (inkind/inplace) approx. 27 linear ft. (including 5' &
7' returns) of existing timber bulkhead and backfill with approx. 5 cy. of clean
sand to be trucked in from an upland source and planted with beach grass (18"
on center). Replant (12" on center) any disturbed spartina alterniflora adjacent to
southerly return. Construct a timber dock, consisting of a 3'X 10' hinged ramp to
extend from bulkhead onto a 6'X 12' float secured by (2) 8" diameter pilings.

is another problem on the property that has to be addressed. Are there any other
comments on this application? Board comments?
TRUSTEE KRUPSKh I think we discussed this with the agent.
TRUSTEE FOSTER: Yes, we did discuss it with the agent. They have a problem
there that he's aware of and that's got to be corrected. How did you leave that
with him?

grade that corner to prevent any further erosion, and that should all be part of the

Proposed Beech Access S~airway
Dear Mr. Krupski:
An application for a proposed set of beach access stairs was submitted by our office in May
2002. Upon a site inspection by the Southold Trustees, the Trustees had concern over drainage and
runoff on the northeast comer of the existing lawn area. Our office submitted a proposal and
amendment to the plans on July 16, 2002 which wa believed would address the concerns of the trustees.
After spealdng with the owner of the property (Jack Biggane) and a recent site visitation it seems an
additional dry well er ~-setting the current dry well would be not only costly but would cause unnecessary
disturbance to successfully vegetated lawn and landscaped area. The current dry wall seems to function
properly, except dudng extreme or abnormal rain events in which several dry wells at the project site
would not prevent runoff from overflowing the bluff. Can you please either contact our office or schedule
a discussion session at the next trustee meeting so it can be determined howto proceed as Mr. Biggane
is anxious to begin construction of the beach access stairs. Thank you for your time and anticipated
cooperation on this matter,

CONSERVATION ADVISORY COUNCIL
At the meeting of the Southold Town Conservation Advisory Council held Monday, June
24, 2002, the following recommendation was made:
Moved by Bob Ghosio, seconded by Jason Petrucci, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH
A STIPULATION of the Wetland Permit Application of JACK BIGGANE to construct a
4'X 150'+/- CCA timber stairway. Proposed stairs to be raised 4' above the existing
grade/slope. (60) 4"X 4" CCA timber posts are to be utilized in conjunction with the stair
installation, and the posts are to be installed with a depth of penetration of 6'+.

The CAC recommends Approval with the Stipulation that the erosion problem is
addressed before the stairs are constructed. The CAC recommends re-establishing the
area with native plantings.
