WHEREAS, Land Use Ecological Services, Inc, on behalf of North BayPtoperties, Inc. applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated February 27, 2002 WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on March 20, 2002 at ~vhich time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code. WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the toxvn, NOW THEREFORE BE IT. RESOLVED, that the Board of Trustees approved the application of North Bay Properties, Inc. for a Wetland Permit to stabilize/restore eroded bluff face by undertaking the following activities - approximately 4,250 c. yds. of clean mat6rial to be utilized to re-grade slope 4, 150 c. yds. to be tracked in and supplemented with 100 +/- c. yds of material recovered fi.om beach area - approximately 375+/- tons of 500-2000 lb. stone to be placed on filter fabric along toe of eroded bluff the armor returns to extend into existing bluff face - approximately 4,200 +/- cubic yards of clean fill to be utilized to re-grade existing slope. All material to be trucked in from an approved off site location. Approx. 300 tons of 500-2000 lb. stone to be placed on filter fabric along toe of eroded bluff. Toe armor returns to extend into existing bluff face. Approx. 9,750 sq. fi of bluff face to be augmented with 75 cubic yards ofT'thick layer of topsoil and then hydroseeded in accordance with plan specifications install 4'x85' timber access walk with 4'x6' timber platforms for access to the beach area starting the stone adjacent west of the large stone adjacent to the bulkhead and following that toe of the bank. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency, which may also have an application pending for the same or similar project. Fee must be paid, if applicable and permit issued within six months of the date of this notification. Two inspections are required and the Trustees are to be notified when project is started and on completion of said project. Under the Terms and Conditions of the Permit, s~d Permit expires m enty-four (24) months (on or about March 23~ 2004) from the date of the i ,suance of thereof~ Mr. Suquet respectfolly requests that the Trustees grant him an extension (the "Extension) of the Permit and that the Extension be issued in his name, as the current fee owner of the Property. The reason for the Extension is that North Bay abandoned the post-closing work at the Property, including the Permitted work. Furtber, the contractor hired by North Bayto perform the Permitted AMaTo & ASSOCiaTes, P.C. work also repudiated its obligations by failing to undertake the Permitted work, despite repeated assurances to Mr. Suquet to the contrary. Mr. Suquet, presently, is undertaking to retain the services of auother contractor to perform the Permitted work. Moreover, the Permit expires in late Winter (3/23 '04) and the Permitted work is not expected to being until April 2004, after the abatement of the Winter weather.
