KAYTIS applied to the Southold Town Trustees for an Amendment to Wetland Permit #5847 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated January 24, 2014, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued 9"f2commendation that the application be found to be Consistent with the Local Waterfr, t Revitalization Program policy'", standards, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, 0 2 WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Southold Town Board of Trustees APPROVES the Amendment to Permit #5847 for the in-place replacement of approximately 101 linear feet of existing timber bulkhead with vinyl bulkhead, approximately 6" higher than existing; the replacement within +/-24" of approximately 20 linear feet of existing timber bulkhead (located in front of existing shed and deck to remain) with vinyl bulkhead, approximately 6" higher than existing; the in-place replacement of existing +/-4'x4' wood landing and +/-4'x8.5' steps to beach; the construction of a +/-12' vinyl return along the southerly property line; re-nourish the eroded embankment with approximately 200 cubic yards of clean sand fill and loam to be trucked in from an approved upland source and re- vegetate with native vegetation; and as depicted on the site plan prepared by En- Consultants, last dated January 22, 2014, and stamped approved on March 7, 2014. BE IT FURTHER RESOLVED, that the Southold Town Board of Trustees APPROVES the request for a Transfer of Wetland Permit #5847 from George Kaytis to Jane W. Kaytis, as issued on December 17, 2003. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) Southold: Wetlands Permit 5847/5847-E Dear Mr. Bredemeyer: Attached please find an application to transfer the captioned permit from the late George Kaytis to Jane W. Kaytis, his widow, and to modify the existing permit to authorize the most recently updated plan to replace and restore the existing bulkhead and embankment, which were severely damaged and eroded during Hurricane Sandy, all as depicted on the project plan prepared by En-Consultants, dated January 22, 2014. Specifically, Wetlands Permit No. 5847, which was issued on December 17, 2003, authorized the construction of a new timber bulkhead within 18" of the existing timber bulkhead and other associated work, including the reconstruction of the bank stairs; the landward relocation/reconstruction of a shed and deck, which at the time were located seaward of the bulkhead; and the construction of a new landing and beach steps seaward of the bulkhead. Although all of the other permitted work was completed at that time, a new bulkhead was never constructed in front of the existing bulkhead. As the existing bulkhead later sustained severe storm damage during Hurricane Sandy, Hurricane Sandy Emergency Permit No. 5847-E was issued on November 30, 2012, to allow for the in-place reconstruction of the storm damaged bulkhead, landing, and beach steps. Since a new bulkhead had not been constructed in front of the old as authorized by the 2003 permit, however, it was unclear to me whether the Hurricane Sandy Emergency Permit intended to allow for the same work that was approved by the original permit, i.e., a new bulkhead seaward of the existing, or only an in-place replacement of the still existing bulkhead. Regardless, because the landward location of the shed and associated deck were completed in anticipation of the new wall being constructed in front of the old, that approximately 20' section of wall can now only be replaced out in front, else the entire deck, shed, and stairway structures would have to be removed and relocated and/or reconstructed all over again. The remainder of the wall, however, can be replaced in-place, as is currently authorized by the Hurricane Sandy Emergency Permit. Upon my discussion of this matter with Jim King several months ago, it was his suggestion that I submit an updated plan and accompanying application to modify the permit(s) as described above in order to include all of the proposed work, including that previously authorized, into a single, amended permit. Because George Kaytis passed away last year, we are also requesting that the permit(s) be transferred to Jane W. Kaytis for that purpose.
