ZUPA applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated April 27, 2004, and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, Public Hearings were held by the Town Trustees with respect to said application, the last of which was on June 24, 2004, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, NOW THEREFORE BE IT RESOLVED, that the Board of Trustees DENY WITHOUT PREJUDICE the application of MARY S. ZUPA because a need was not established and because of the existence of a permit for the same or similar activities, and the permittee has dredged within the last year, pursuant to that permit. If a need arises and the conditions warrant it, an application may be submitted at that time. The Trustees accept applications for maintenance dredging at any of their 12 (twelve) monthly meetings. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency, which may also have an application pending for the same or similar project.
