Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP; provided the applicant demonstrate that the dock standards pursuant to § 275-11 Construction and operation standards have been met. Achievine ~reater water depths through the reconfiguration of the existing dock will mitigate the potential impacts (from an associated vessel) to the bottomland~ such as the re-suspension of bottom sediments. Further~ the use fiberglass grid materials on the catwalk will allow for greater light penetration to the substrate. The following BMP is further recommended: 1 ) Use grid decking on the 6' X 20' float having greater than 50% light penetration (irradiance) to the substrate. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. James F. If you have another objective that's ok with us so tong as the new location of your dock does not cause a problem getting in and out of our dock. t have no objection if you were to simply move the dock out 5 feet so long as the location of the ramp and platform remains where they are. The problem is the ramp and platform are switched to the side closest to us. have two proposals for your consideration as shown on the attached map: Option A is the platform and ramp go out perpendicular to the shoreline the same as ours does. Option B is the same as your present arrangement. Both options prevent a structure close to ours that I have to worry about when I turn. The problem is that with the Association dock and a dock such as Scalia's, I have great difficulty getting in and out--- even with my small boat since it is a single screw. I have to turn both boats in front of your dock and 1 come very close to your boat. However, I can accommodate either one of the above. As an aside, Mary and I thought we had a relationship of trust or at least full disclosure with you. We were very saddened that you did not tell us about the dock, and chose to believe we had an arrangement with the Association when we repeatedly told you we did not. As Steve and I figured, the earlier Bob Fox survey and Pat Moore's letter describing the Trustees comments in the adjacent landowner notice may have left you with an inaccurate/confused picture of what we were asking for. Did you see the updated Bob Fox drawing that Pat had at the hearing? This dock is much farther away from your dock, so are you still objecting to the update? Not having the minutes of the meeting, I cannot get a complete picture of what your objections are. According to Pat, you mentioned something about the ramp going straight out and this creating more room. Could you please explain this because it seems to make less room for you. The letter from Pat Moore states that the Trustees are recommending that the proposed dock be moved "no more" than 10 feet southerly from the proposed location, which really means the dock is being moved 25 feet or more to the north. The map shows two lots owned by the Kolyers when in fact these lots have been merged into one lot SCT# 1000-81-1-10.1. Attached are copies of records from the assessor's office showing that the Kolyers' have only one lot, and hence a right to only one dock. For the reasons stated in my previous email to you, the Kolyers' dock should not be moved northerly from its present location, and if it is moved seaward 5 feet (to allow two boats to be docked), that the ramp be placed perpendicular to the bulkhead as to reduce the structure's impact on navigation. There is absolutely no reason to move the dock in a northerly direction since the depths in its present location are the same if not more than the any location to the north, and the detriment to navigation will be severe. Compare the depths in the two attached maps of the Kolyer dock from 2003 (when they received a permit from the trustees to move it out for greater depth) and from 2009. I have been informed the depths today are basically the same as in 2003. Also there is no justification for having the ramp parallel to the shoreline which causes twice as much space to be taken up as ramps perpendicular to the shoreline and dock, e.g. other docks on the Basin including mine. Again, I don't believe the Kolyers lose anything by keeping the dock in its present location, and if permission is given to move it out, then the ramp should be constructed perpendicular to the shoreline and dock. This former dock lay parallel to the existing bulkhead wall. Its dimensions, I believe, were 4 feet wide by 12 feet in length. Hence, it did not extend out into navigable waters. I feel the newly proposed plan of dockage will quite possibly extend too far out into the boat basin so as to obstruct those other vessels that have to turn and pass directly in front of this proposed new dock, when entering or exiting from their berths in the basin, making such navigation most difficult, particularly in windy conditions.
