GRATHWOHL, residing at 11690 Stockbridge Lane, Reston, Virginia 20194, hereinafter referred to as "DECLARANT"; WITNESSETH: WHEREAS, DECLARANT is the owner of a certain plot, place and parcel of land located on Williamsburg Road, in the hamlet of Bayview, in the Town of Southold, County of Suffolk, and the State of New York, known and designated as SCTM No. 1000-078.00-05.00- 016.000, being more particularly bounded and described as set forth in Schedule "A" annexed hereto; and WHEREAS, the DECLARANT made application to the Boazd of Trustees of the Town of Southold for a permit pursuant to the Wetlands Law of the Town of Southold to construct a two-story one-family dwelling with porches as depicted on the "Map for Property Situated at Bayview", surveyed and prepazed by Joseph A. Underwood, Jr., Justice of Supreme Court, in a certain action brought before the Supreme Court of the State of New York under James F. NOW, THEREFORE, THIS DECLARATION WITNESSETH: That the DECLARANT, for the purposes of carrying out the intentions above expressed, does hereby make known, admit, publish, covenant and agrees that said premises herein 1 described shall hereafter be subject to the following covenants, restrictions and agreements, which shall run with the land and shall be binding upon all purchasers and holders of said premises, their heirs, executors, legal representatives, distributees, successors and assigns, to wit: (1) Non-Disturbance/Non-Fertilization Buffer. In the aforesaid buffer azea, there shall be no•use of fertilizers, except compost and mixtures of decayed organic matter used as fertilizer may be applied, nor shall this buffer area be disturbed in any. manner, except as allowed herein. Additionally, the following shall be adhered to in this buffer azea: a.) No clearing of the vegetation within said buffer azea, except as may be approved by the Board of Trustees of the Town of Southold; b.) No topsoil, loam, sand, gravel, rock or minerals shall be excavated or removed therefrom; c.) No streets, roadways or other rights,of way or easements for vehiculaz use shall be constructed or granted therein; d.) No trees, plants or other vegetation shall be artificially transplanted into the said buffer area, except such plants and vegetation as may be approved by the Boazd of Trustees of the Town of Southold; e.) No liquid or sewage waste or other objectionable oroffensive material or refuse shall be permitted to be discharged into the said buffer azea nor shall ~3' portion thereofbe used as a leaching field for sewage disposal or for the placement, construction or maintenance of individual or shazed septic systems; f.) No dumping, placement, storage or burning of any liquid or solid waste, garbage, ashes, sawdust, trash, rubbish, refuse or other objectionable, unsightly or offensive materials shall be permitted on or within said buffer area; and -_ _. _.__ g.) The said premises will be forever kept open and free of all buildings and other structures, including, but not limited to, wails, fences and berms. (2) Conservation Mana¢ement Plan. Notwithstanding anything to the contrary contained herein, nothing shall preclude the DECLARANT or his heirs, successors or assigns 2 from instituting necessary conservation measures to protect and conserve the natural resources and features which are the subject of this Declaration of Covenants, provided that the said conservation measures aze part of a Conservation Management Plan, which must be submitted to and approved by the Board of Trustees of the Town of Southold or its Designee. Said plan may include, but not be limited to, the removal of noxious, dead or decayed vegetation and shrubbery, including tree trunks and limbs; clearing pervious walkways and paths; and the placement of compafible plantings, shrubs and trees. (3) At such time a sanitary septic system is constructed upon the premises, the DECLARANT, his heirs, successors and assigns, shall cause to have the sanitary septic system annually inspected, maintained, and serviced to assure the proper performance of said septic system. (4) This Declaration of Covenants shall run with the land and shall bind the DECLARANT, his heirs, assigns, purchasers and successors in interest. (5) This Declazation of Covenants shall not be changed, altered modified or extinguished, except by a vote of a majority, plus one, of the Board of Trustees of the Town of Southold, or any successor Town agency or anyone having jurisslicton over wetlands regulated by the Town of Southold. Item C: Permittee Responsible for Obtaining Other Required Permits The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-way that may be required to carry out the activities that are authorized by this permit. Item D: No Right to Trespass or Intertere with Riparian Rights This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted w.erk nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. GENERAL CONDITIONS General Condition 1: Facility Inspection by the Department The permitted site orfacility, including relevant records, is subjectto inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department) to determine whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit. General Condition 2: Relationship of this Permit to Other Department Orders and Determinations Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any order or determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. General Condition 3: Applications for Permit Renewals or Modifications The permittee must submit a separate written application to the Department for renewal, modification or transfer of this permit. Such application must include any forms or supplemental information the Department requires. Any renewal, modification or transfer granted by the Department must be in writing. The permittee must submit a renewal application at least: a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SFDES), Hazardous Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste Management Facilities (SWMF); and b) 30 days before expiration of all other permit types. Submission of applications for permit renewal or modification are to be submitted to: NYSDEC Regional Permit Administrator, Region 1, SUNY Bldg #40, Stony Brook, NY 11790-2356 General Condition 4: Permit Modifications, Suspensions and Revocations by the Department The Department reserves the right to modify, suspend or revoke this permit. The grounds for modification, suspension or revocation include: a) the scope of the permitted activity is exceeded or a violation of any condition of the permit or provisions of the ECL and pertinent regulations is found; b) the permit was obtained by misrepresentation or failure to disclose relevant facts; c) new material information is discovered; or d) environmental conditions, relevant technology, or applicable law or regulation have materially changed since the permit was issued. DEC PERMIT NUMBER I I PAGE 2 OF ~ 1-4738-02385/00001 ADDITIONAL GENERAL CONDITIONS FOR ARTICLES 15 (TITLE 5), 24, 25, 34 AND 6NYCRR PART 608 ( TIDAL WETLANDS) If future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters or flood Flows or endanger the health, safety or welfare of the people of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of the watercourse hereby authorized shall not be completed, the owners, shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal or alteration. 2. The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may be caused by or rosult from future operations undertaken by the State forthe cerservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. 3. Granting of this permit does not relieve the applicant of the responsibility of obtaining any other permission, consent or approval from the U. S. Army Corps of Engineers, U.S. Coast Guard, New York State Office of General Services or local government which may be required. 4. All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. 5. Any material dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause damage to navigable channels or to the banks of a waterway. 6. There shall be no unreasonable interference with navigation by the work herein authorized 7. If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. 8. If granted under 6NYCRR. Part 808, the NYS Department of Em^rcnmental Conss; vaticn hereby cartifies that the subject project will not contravene effluent limitations or other limitations or standards under Sections 301, 302, 303, 306 and 307 of the Clean Water Act of 1977 (PL 95-217) provided that all of the conditions listed herein are met. 9. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of project, the bottom portion of the form must also be signed and returned, along with photographs of the completed work and, if required, a survey. 10. All activities authorized by this permit must be in strict conformance with the approved plans submitted by the applicant or his agent as part of the permit application. There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted activity. 2. During construction, concrete or leachate shall not escape or be discharged, nor shall washings from transit mix trucks, mixers, or other devices enter tidal wetlands and or protected buffer areas. 3. Any debris or excess material from construction of this project shall be completely removed from the adjacent area (upland) and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands and or protected buffer areas. 4. All fill shall consist of "clean" sand, gravel, or soil (not asphalt, flyash, broken concrete or demolition debris). 5. The storage of construction equipment and materials shall be confined to within the project work site and or upland areas greater than 50 linear feet from the Pidal wetiand boundary. 6. Sanitary system (bottom of tank and leaching pools) shall be located a minimum of 2' above seasonal high groundwater. 7. To protect the values of the tidal wetlands, a permanent vegetated buffer zone shall be established. There shall be no disturbance to the natural vegetation or topography within an area extending 25 linear feet landward of the tidal wetland boundary. 8. A row of staked hay bales or approvable erosion control devices shall be placed at the landward edge of the buffer area or 25 linear feet from the tidal wetland boundary, or as per NYSDEC approved plan, at commencement of regulated activities and remain in place until project is completed and all disturbed areas stabilized with vegetation. 9. Roof runoff shall be directed to drywells a minimum of 35 feet landward of the tidal wetland boundary for immediate on-site recharge. 10. All areas of soil disturbance resulting from this project shall be stabilized immediately following project completion or prior to permit expiration, whichever comes first. The approved methodologies are as follows: a. Stabilization of the entire disturbed area with appropriate vegetation (non-fertilizer /non-pesticide dependent grasses, etc.) 11. If seeding is impracticable due to the time of year, a temporary mulch must be applied and final seeding performed at the earliest opportunity when weather conditions favor germination and growth, but not more than six months after project completion. 12. All disturbed areas where soil will be temporarily exposed or stockpiled for longer than one (1) week shall be contained by a continuous line of staked hay bales/silt curtain (or other NYSDEC approved method) placed on the seaward side between the fill and wetland or protected buffer area. Tarps are authorized to supplement these approved methods. 13. Driveways and parking areas shall be constructed of pervious material. Special Condition 14 is on page 5 of 5. The permittee shall incorporate the following language as a notice covenant to the deed: "Regulated tidal wetlands associated with Corey Creek are located at Williamsburg Road, Suffolk County Tax Map Number: District 1000, Section 78, Block 5, Lot 16, otherwise known as the properties of James Grathwohl and his/her/their heirs, assigns, or successors. This property is subject to the provisions of New York State Environmental Conservation Law (ECL) Article 25 or its successor, and the conduct of regulated activities may occur only pursuant to ECL Article 25 if prior approval is given by the New York State Department of Environmental Conservation (NYSDEC) or its successor. Please note that this is a violation of Section 5-105, paragraph B-10 of the Department's "Standards -Approval of Plans and Construction -Sewage Disposal Systems For Single Family-Family Residences," in that disposal systems should not be located under any building, or other improvement that may'. prevent access for repair or maintenance of the system. In addition, the location of the deck structure was not shown on plans approved by this office. Also, our records indicate that only part of the sewage disposal system has been installed. Some of the outstanding items include the connection of the building sewer line into the septic tank as well as the construction of retaining walls, shown on plans approved by this office on June 2, 2004. Please note that the resolution of these items are necessary prior to the issuance of Final Approval from this office. Drifting the excavation away from the neighbor's property to prevent undermining would move the septic system closer to thc surface waters and may not be acceptable. I have verified with the Department of Health that the proposed retaining walls do not stop contaminants from leaching into .the groundwater and that in this case any contaminants that reach the gronndwat/~r table will be taken up in the groundwater flow and travel accordingly. Therefore, monitoring for nitrogen in the water table may be warranted. My reconm~endation is that due to the distance to the wetlands, the Trustees should retain Chick Voorhis from Nelson Pope and Voorhis, LLC (631) 427-5665 to conduct a more thorough engineering analysis of the proposed septic system. As you are aware, the Trustees have the right pursuant to SEQR, to mandate this action and have the applicant pay for the ,analysis. These concerns include but are not limited to location of the proposed project to my client's premises and more fundamentally, a concern that such approval would establish a precedent for eroding the well reasoned prohibitions against allowing such development of environmentally sensitive and critical areas. As the Board knows, this parcel is located immediately to the east of the dredged canal between Williamsburg Lane and Elizabeth Lane off of Main Bayview Road. Moreover, the proposed development of this parcel would virtually eliminate any and all natural screening and vegetation that currently exists at this location. Certainly, had he been able to afford to do so, Mr. Grathwohl could have improved the property with a residence at the time, as there were not yet in place any State, County, or Town laws, regulations, or other restrictions which could have prevented him from freely doing so. The purpose of this request was to verify that the soil types Frederick Keith predicted would be more or less uniformly present throughout the site were indeed present and thus conducive to the functioning of the sanitary system as he described. Therefore, two additional testholes were bored, and the associated data sheets are enclosed as attachments to Mr. Keith's "Amendment to Engineer's Report," which was prepared to provide the Board with further technical information regarding the potential impacts of the sanitary system, taking into account this new testhole information. Also enclosed are (3) copies of a revised site plan, which depicts the locations of the additional testholes and the elimination of the portion of the driveway that was errantly extended into the non- disturbance/non-fertilization buffer. Finally, due to the incompleteness of the January hearing minutes, which I described in my 18 March 2002 letter, I have enclosed a narrative summation of the substance of the testimony I offered during that hearing. Upon my client obtaining a copy of the Notice of Proposed Plan, a closer examination of the proposed development and utilization of this undersized parcel has raised substantial concerns about the application. First, with respect to the location of the proposed project to my client's premises, but more fundamentally a concern that such approval would establish a precedent for eroding the well reasoned prohibitions against allowing such development of environmentally sensitive and critical areas. More specifically, as the Board knows this parcel is located immediately to the east of the dredged canal between Williamsburg Lane and Elizabeth Lane off of Main Bayview Road. The parcel in question has significant non bulkheaded wetlands that aid in preventing the further erosion of the area with each passing tide. Moreover, the proposed development of this parcel would virtually eliminate any and all natural screening and vegetation that currently exists at this location. That would result in a loss of aesthetic quality of the area, increase the exposure to the surrounding parcels and further heighten the possibility of erosion and damage resulting from high winds and water levels during stormy weather. Furthermore, the apparent elevation and proposed retaining wall enclosure for the sewage system and proximity to the aquatic habitat located immediately in front of this parcel should raise additional significant concerns of the possibility of contamination with a high water storm or abnormally high tide that could easily breach the containment wall design proposed. My client urges the board to carefully scrutinize the applicant's proposal and avoid the urge to succumb to a plea to develop for development sake. Groundwater has been recorded at a depth of 2.5 feet. The design for the development of this property optimizes setbacks from the edge of flagged wetlands along a dredged canal which abuts the southwest and south east property line. The design provides for a 25 foot non-disturbance buffer, 40 foot structure setback and 55 foot sewage system setback. Prescribed sewage design separations from groundwater require that the bottom of the septic tank and leaching pools to be above elevation 4.9 and that a watertight retaining wall enclose of the system. Removal and Replacement of Unsuitable Soils The removal and replacement of 18 feet of unsuitable soils, most of which will be within groundwater must be accomplished by an experienced and properly equipped contractor. The contractor should be equipped with a crane having a clamshell bucket with a capacity of at least one cubic yard. Excavation must proceed as rapidly as possible to minimize caving of the soils and spreading of the excavation at the top to avoid affecting the property of others jeopardizing the foundation conditions under the retaining wall or proposed dwelling. There are reasons for planning the soil replacement operation so the soils that are removed from below the water table are not immediately trucked away as they are excavated. First, the speed with which the unsuitable soils are excavated would be slowed by the movement of trucks into position to accept the soils as they are excavated. Secondly, the soils excavated from below water level will be saturated and need to drain before being trucked over the roads. It is therefore proposed that soils excavated below groundwater level be stockpiled with appropriate measures to prevent runoff and sediment from reaching the non-disturbance area and the wetland. A hopper like depression approximately 3 feet deep is proposed to be initially excavated in the area of the proposed house. These soils would be trucked off site. Also, soils above the watertable in the area of the sewage system leaching pools within the 3 foot ~collar' perimeter should also initially be removed and trucked away. When the crane rapidly excavates the underwater unsuitable soils from below the proposed leaching pools, they will be boomed over and deposited in the hopper depression where they can drain before they are trucked. The high permeability of the sand backfill used to replace the removed soils allows the interface with natural sand and gravel at the 18 foot depth to be no greater than 6 to 8 feet in diameter. Because the soils excavated "in the wet" beneath the sewage system ara silty and have some cohesion, it is estimated that the hole below groundwater will hold on a 1 on 1 slope or steeper. However, should sloughing be greater than expected, the contractor will be instructed to drift the excavation as necessary to avoid impact on neighboring property or the proposed dwelling. The sand and gravel soil used to replace the unsuitable soils should be placed rapidly with as little impact as possible to avoid caving. Because the backfill soil will be cohesionless, the filled material will flow freely under water and be free of voids. Figure 1 shows a plan of the proposed site and sewage system. Two cross sections of the site, drawn through the proposed location of the leaching pools are shown on Figure 2. They showing final grades and structures in dashed lines and the hopper and excavation in solid lines. The initial excavation above the groundwater level (area A) will equal 250 cubic yards. The remaining material removed from below the sewage system (area B) is predicted to be approximately 300 cubic yards, which when stockpiled in the house area (area C) will result in a temporary fill having a depth of about 5 feet. Subsequent Construction When the excavation is completed, sand and gravel backfill in the area of the sewage system should be brought to elevation 7.0 and allowed to stabilize until hard enough to support the truck traffic necessary to remove the drained excavated soils. The installation of the septic tank and leaching pools and the construction of the retaining wall should not occur until after the construction of the residence, both to allow a better staging area for house construction and so the sewage system area will gain the benefit of the consolidation of, soils from construction activities. Because the soil replacement is sand and gravel, and both time and activity will allow for consolidation to occur before their construction, the retaining wall and sewage system units are not expected to settle after they are installed. As you learned at the April 4th information session, the Critical [ands Protection Strategy (fully described in Chapter 7 of the Peconic Estuary Comprehensive Consenfation Management Plan (CCMP)), provides a method by which to identify lands that are critical to protect for habitat and water quality in the Peconic Estuary. The parcel above meets 2 of the 4 criteria in our initial analysis. It is within 1000' of the shoreline (considered important because groundwater inputs into the bay are the primary source of freshwater into the system, and a large source of contaminants such as nitrogen and pesticides). It is within a Critical Natural Resource Area (CNRA). Corey's Creek has significant biological diversity. CNRA's are defined as areas containing concentrations of high quality spawning, breeding, feeding, and wintering or seasonal habitat for shellfish, finfish, watertbwl, shorebirds, anadromous fish, and rm'e plant, animal, and nd~ural communities. (see Chapter 4 in the CCMP for more information about how CNRA's were created) A third criteria is met by this parcel if it contains tidal or freshwater wetlands. Our wetlands data is not comprehensive and some smaller wetlands areas were not included in our analyses. The proposed leaching system is placed as far from the shore as the lot will allow, thus providing a separation distance of 75 ft., which is less than the 100 ft. required. 12. The applicant's engineer submitted a plan for removal and replacement of unsatisfactory soil for the leaching system. 13. A standard five-pool shallow disposal system, with a retaining wall, will be used. 14. The applicant's engineer made the point that, even though the sanitary system is relatively dose to the shore, the tight soils will force the sanitary flow down deeply through the sand column, rather than allowing the short, horizontal, flow to the shore. Determination It was a 3 to 0 determination of the Board of Review to grant the request for the variance, provided the applicant removes the poor soils and achieves a hydraulic connection to acceptable soil strata to the satisfaction of the Department. The Suffolk County Sanitary Code, and the Department's Standards for Construction of Subsmfaee Disposal Systems, are intended to protect surface and groundwater quality. Approval of a properly installed disposal system will have no significant adverse effect on surface or groundwater quality despite the reduced distance to the shoreline. Date )'am.~ H. PROPOSED GRATHWOHL RESIDENCE Williamsburg Road, Bayview, Town of Southold, New York SCDHS Reference Number R10-99-0168 Purpose The purpose of this report is to present the technical aspects of the construction of a sewage disposal system on the subject property in accordance with Suffolk County Department of Health Services standards. Specifically, the system must be constructed on a site where space is very limited and the test hole indicates that 18 feet of unsuitable soils will have to be removed and replaced below the leaching pools. Groundwater has been recorded at a depth of 2.5 feet. The design for the development of this property optimizes setbacks from the edge of flagged wetlands along a dredged canal which abuts the southwest and south east property line. The design provides for a 25 foot non-disturbance buffer, 40 foot structure setback and 55 foot sewage system setback. Prescribed sewage design separations from groundwater require that the bottom of the septic tank and leaching pools to be above elevation 4.9 and that a watertight retaining wall enclose of the system. Removal and Replacement of Unsuitable Soils The removal and replacement of 18 feet of unsuitable soils, most of which will be within groundwater must be accomplished by an experienced and properly equipped contractor. The contractor should be equipped with a crane having a clamshell bucket with a capacity of at least one cubic yard. Excavation must proceed as rapidly as possible to minimize caving of the soils and spreading of the excavation at the top to avoid affecting the property of others jeopardizing the foundation conditions under the retaining wall or proposed dwelling. There are reasons for planning the soil replacement operation so the soils that are removed from below the water table are not immediately trucked away as they are excavated. First, the speed with which the unsuitable soils are excavated would be slowed by the movement of trucks into position to accept the soils as they are excavated. Secondly, the soils excavated from below water level will be saturated and need to drain before being trucked over the roads. It is therefore proposed that soils excavated below groundwater level be stockpiled ', with appropriate measures to prevent runoff and sediment from reaching the non-disturbance area and the wetland. A hopper like depression approximately 3 feet deep is proposed to be initially excavated in the area of the proposed house. These soils would be trucked off site. Also, soils above the watertable in the area of the sewage system leaching pools within the 3 foot "collar" perimeter should also initially be removed and trucked away. When the crane rapidly excavates the underwater unsuitable soils from below the proposed leaching pools, they will be boomed over and deposited in the hopper depression where they can drain before they are trucked. The high permeability of the sand backfill used to replace the removed soils allows the interface with natural sand and gravel at the 18 foot depth to be no greater than 6 to 8 feet in diameter. Because the soils excavated "in the wet" beneath the sewage system are silty and have some cohesion, it is estimated that the hole below groundwater will hold on a 1 on 1 slope or steeper. However, should sloughing be greater than expected, the contractor will be instructed to drift the excavation as necessary to avoid impact on neighboring property or the proposed dwelling. The sand and gravel soil used to replace the unsuitable soils should be placed rapidly with as little impact as possible to avoid caving. Because the backfill soil will be cohesionless, the filled material will flow freely under water and be free of voids. Figure 1 shows a plan of the proposed site and sewage system. Two cross sections of the site, drawn through the proposed location of the leaching pools are shown on Figure 2. They showing final grades and structures in dashed lines and the hopper and excavation in solid lines. The initial excavation above the groundwater level (area A) will equal 250 cubic yards. The remaining material removed from below the sewage system (area B) is predicted to be approximately 300 cubic yards, which when stockpiled in the house area (area C) will result in a temporary fill having a depth of about 5 feet. Subsequent Construction When the excavation is completed, sand and gravel backfill in the area of the sewage system should be brought to elevation 7.0 and allowed to stabilize until hard enough to support the truck traffic necessary to remove the drained excavated soils. The installation of the septic tank and leaching pools and the construction of the retaining wall should not occur until after the construction of the residence, both to allow a better staging area for house construction and so the sewage system area will gain the benefit of the consolidation of soils from construction activities. Because the soil replacement is sand and gravel, and both time and activity will allow for consolidation to occur before their construction, the retaining wall and sewage system units are not expected to settle after they are installed. GENERAL CONDITIONS General Condition 1: Facility Inspection by the Department The permitted site or facility, including relevant records, is subject to ~nspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department) to determine whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). The permit'tee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit. General Condition 2: Relationship of this Permit to Other Department Orders and Determinations Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any order or determination previousJy issued by the Department or any of the terms, conditions or requirements contained in such order or determination. If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. Any debris or excess material from construction of this project shall be completely removed from the adjacent area (upland) and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands and or protected buffer areas. 4. All fill shall consist of "clean" sand, gravel, or soil (not asphalt, flyash, broken concrete or demolition debns). 5. The storage of construction equipment and materials shall be confined to within the project work site and or upland areas greater than 50 linear feet from the :idal wetland boundary. 6. Sanitary system (bottom of tank and leaching pools/ shall be located a minimum of 2' above seasonal high groundwater. 7. To protect the values of the tidal wetlands, a permanent vegetated buffer zone shall be established. There shall be no disturbance to the natural vegetation or topography within an area extending 25 linear feet landward of the tidal wetland boundary. 8. A row of staked hay bales or approvable erosion control devices shall be placed at the landward edge of the buffer area or 25 linear feet from the tidal wetland boundary, or as per NYSDEC approved plan, at commencement of regulated activities and remain in place until project is completed and all disturbed areas stabilized with vegetation. 9. Roof runoff shall be directed to drywells a minimum of 35 feet landward of the tidal wetland boundar, for immediate on-site recharge. 10. All areas of soil disturbance resulting from this project shall be stabilized immediately following project completion or prior to permit expiration, whichever comes first. The approved methodologies are as follows: a. Stabilization of the entire disturbed area with appropriate vegetation (non-fertilizer / non-pesticide dependent grasses, etc.) 11. If seeding is impracticable due to the time of year, a temporary mulch must be applied and final seeding performed at the earliest opportunity when weather conditions favor germination and growth, but not more than six months after project completion. 12. All disturbed areas where soil will be temporarily exposed or stockpiled for longer than one (1) week shall be contained by a continuous line of staked hay bales/salt curtain (or other NYSDEC approved method) placed on the seaward side between the fill and wetland or protected buffer area. In order to make your records as clear as possible, therefore, I have completed and attached an application completed in its entirety, based upon Mr. Grathwohl's most recently revised site plan and project description. In order to refresh the Board's memory of the application process that has transpired thus far, I have for your convenience excerpted and included below the summation of events described in my 2 January 2002 letter, faxed to your office yesterday: "On or about 11 August 1999, an application for a wetland permit to improve the captioned parcel with a one-family dwelling was submitted by our office on behalf of Brian and Martina Faerber, then contract vendees. At a public hearing held on 25 August 1999, the Board indicated that it would not render a decision unless and until documentation fi.om the Suffolk County Department of Health Services was provided to indicate that the proposed sanitary system would be approved by that agency. I subsequently informed your office by letter dated 2 December 1999 that the Faerbers were no longer in contract to purchase the property but that the owner, James Grathwohl, intended to keep the application open in order to develop the property for his own use. After finally receiving a Tidal Wetland Permit fi.om the New York State Department of Environmental Conservation (DEC) dated 10 May 2001 (copy enclosed), I attended the Board's May 2001 work session to discuss your request concerning the Suffolk County Department of Health Services approval. As you no doubt recall, Board members reiterated objections to the idea of a sanitary system being approved less than 100 feet from the wetlands and contemplated how and whether the Board should approach the Suffolk County Department of Health Services with its concerns. Although we did not subsequently receive any direct or copied correspondence fi.om your office regarding the matter, we continued to pursue the application with the Health Department. Due to the need to obtain a variance t?om the Suffolk County Department of Health Services standards, I attended a public hearing held by the Department's Board of Review on 11 October 2001, together with Frederick Keith, P.E., who professionally designed the proposed sanitary system and prepared the engineer's report in support of the application (copy enclosed). The Board subsequently rendered a decision in which the requested variances were granted (copy enclosed). Specifically, the Board found that the "approval ora properly installed disposal system will have no significant adverse effect on surface or groundwater quality despite the reduced distance to the shoreline.'"' As I also stated in that letter, we have now followed the regulatory course requested by the members of the Board and can go no farther in the process of obtaining a building permit without an action by the Trustees on the wetland permit application.
