A. This application must be filled in by typewriter OR ink and submitted to the building
inspector with the following: for new building or new use:
1. Final survey of property with accurate location of all buildings, property lines,
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal(S-9 form) .
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains
less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings
and installations, a certificate of Code Compliance from architect or engineer
responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and
"pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and
unusual natural or topographic features.
2. A properly completed application and a consent to inspect signed by the applicant.
If a Certificate of Occupancy is denied, the Building Inspector shall state the
reasons therefor in writing to the applicant.

Dear Sir,
With regard to the home on 190 Willow Terrace Lane in Orient, I have reviewed a May
9, 1998 appraisal prepared by Vincent Cannuscio NYS Certified Residential Real Estate
Appraiser and a June 6, 1998 proposal by Robert Bohn Contracting to complete the proposed
renovations for the residence.
The 1998 appraisal concluded that the replacement cost for the improvements was
$156,450.00. The proposal from Robert Bohn Contracting Inc. dated June 6, 1998 for the
proposed improvements was $74,257.00. While this replacement cost is 4 years old the proposal
is also from the same period and will be consistent when used in the calculation of"Substantial
Improvement".
The calculation of the percentage of proposed work to the existing value of the structure is:
$74,257.00/$156,450.00 = 47.5%
This is less than the 50% limit definition of"Substantial Improvement"

The following action was taken by the Board of Town Trustees during its regular meeting held
on Wednesday, February 21, 2001 regarding the above matter:
WHEREAS, Suffolk Environmental Consulting, Inc. on behalf of BARBARA DEFINA applied
to the Southold Town Trustees for a permit under the provisions of the Welland Ordinance of the
Town of Southold, application dated January 18, 2001, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
February 21, 2001 at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold

Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of BARBARA DEFINA to
construct an addition to a one-story single-family residence, including a 24'X 26' second story
addition and the enclosure of a 12'X 12' breezeway. Two 8' diameter drywells are to be
installed in order to catch roof run-off. Remove the existing chimney and build a set of 6'X 10'
steps towards the east elevation of the existing house.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire two years from the date it is signed. Fees
must be paid, if applicable, and permit issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified upon completion of said project.

Pan of the consideration for the Issue of the Permit does understand and prescribe to the fol-
lowing:
1. That the said Board of Trustees and the Town of Southold are released from any and
all damages, or claims for damages, of suits arising directly or indirectly as a result of any oper•
ation performed pursuant to this permit, and the said Permittee will, at his or bet own expense,
defend any and all such suits inklaxd by third patties, and the said Permittee asahmes full liability

work stall cause unreasonable obstruction to free navigation, the said Permittee will be requited,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold.

Enclosed herewith please find the revised survey prepared by Joseph A. Ingegno
last revised December 15, 2001 for the property referenced above. You will note that an
active Building Permit Application is before you and you have requested that the front
stoop be amended to only include the steps and that the proposed breezeway be likewise
removed. The enclosed survey satisfies these concerns.
I also enclose the NYSDEC Permit Renewal #1-4738-01101/0004 for your
records and in furtherance of your requirements for permit issuance.
I alert you that Mr. Tuthill will shortly be providing you with two
correspondences, the first of which will certified that the proposed improvements do not
constitute a substantial addition, the second of which will certify that the septic system is
adequate for the project as proposed. Upon receipt of these items, I would presume that
the requested Building Permit would be issued.
As a final matter, please be advised that it is our intention to seek a zoning
variance for the non-conforming shed and I am of the belief that the Zoning Board will be
successfully persuaded to grant same given that the shed has been in existence for years,
that there are no sensible alternative locations for the shed and that the effected neighbor
has no objection to the continued existence of the shed. Upon issuance of the Building
Permit, I would request a Notice of D wappFoval a theshed w1mch would rintmine to
resolve this issue prior to issuance of a Certificate of Compliance..

Inspections
1 . The permitted site or facility, including relevant records, is subject to in-
spection at reasonable hours and intervals by an authorized representative of
the Department of Environmental Conservation ( the Department) to determine
whether the permittee is cm-plying with this permit and the ELL. Such represen-
tative may order the work suspended pursuant to ECL 71 -0301 and SOPA 401 (3) .

2. The Department reserves the right to rrodify, suspend or revoke this permit when:
a) the scope of the permitted activity is exceeded or a violation of any
condition of the permit or provisions of the ECL and pertinent regula-
tions is found;
b) the permit was obtained by misrepresentation or failure to disclose
relevant facts;
c) new material information is discovered; or
d) envirorTrantal conditions, relevant technology, or applicable lav or
regulation have materially changed since the permit was issued.
3. The permittee rrust submit a separate written application to the Departrrent for
renenel , modification or transfer of this permit . Such application must include
any four-s, fees or supplarantal info nation the Departrrant requires. Any
renenal , modification or transfer granted by the Deparlmentrrust be in whiting.
4. The permittee rust submit a renenel application at least :
a) 180 days before expiration of permits for State Pollutant Discharge
Elimination Systen (SPCES) , I-lazardous V�hste Nbnage-rent Facilities
(WWF) , rrejor Air Pollution Control (AFC) and Solid Vkbste fvmnaga ent
Facilities (&VX) ; and
b) 30 days before expiration of all other permit types.
5. Unless expressly provided for by the Departnent, issuance of this permit does
not rrodify, supersede or rescind arty order or determination perviously issued by
the Department or any of the terns, conditions or requirements contained in such
order or determination.

6. The permittee has accepted expressly, by the execution of the application, the
full legal responsibility for all damages, direct or indirect, of whatever
nature and by Wiormver suffered, arising out of the project described in this
permit and has agreed to indam ify and save harmless the State frau suits,
actions, damages and costs of every name and description resulting from this
project .
7. This permit does not convey to the permittee any right to trespass upon the
lands or interfere with the riparian rights of others in order to perform the
permitted work nor does it authorize the irrpai m-ent of any rights, title, or
interest in real or personal property held or vested in a person not a party to
the permit .

SPECIAL CONDITIONS
I. 'I be storage of construction equipment and materials shall be confined to within the
project work site and or upland areas greater than 40 linear feet from the tidal wetland
boundarv.
2. During construction, concrete or leachate shall not escape or be discharged, nor shall
washings fronT transit mix trucks, mixers, or other devices enter tidal wetlands and or
protected buffer areas.
3. /any debris or excess material from construction of this palest shall be completely
removed from the adjacent area (upland) and removed to an approved upland area for
disposal. No debris is permitted in tidal wetlands and or protected buffer areas.
4. Necessary erosion control measures i.e., haybales, silt fencing, etc. are to be placed oil the
downslope edge of any disturbed area. This sediment barrier is to be put in place before
any disturbance of the ground occurs and is to he maintained in good condition until thick
vegetative cover is established.
5. Roof runoff must be directed to drywells a minimum of 75 linear feet landward of the
most landward edge of the tidal wetland boundary, and must be installed a minimum of 2
feet above seasonal high groundwater.

SUPrLEMENTARY SPECIAL CONDITIONS
The following conditions apply to all Tidal Wetlands; Freshwater
Wetlands; Coastal Erosion Management; and Wild, scenic, and
Recreational Rivers Permits:
A. A copy of this permit, including all conditions and
approved plans, shall be available at the project site
whenever authorized work is in progress . The permit
sign enclosed with the permit shall be protected from
the weather and posted in a conspicuous location at the
work site until all authorized work has been completed.
B. The permittee shall require that any contractor,
project engineer, or other person responsible for the
overall supervision of this project reads, understands,
and complies with this permit and all its general,
special, and supplementary special conditions. Any
failure to comply precisely with all of the terms and
conditions of this permit, unless authorized in
writing, shall be treated as a violation of the
.Environmental Conservation Law. If any of the permit
conditions are unclear, the permittee shall contact the
Division of Regulatory Affairs at the address on page
one or telephone (516) 444-0365 .
C. If project design modifications become necessary after
permit issuance, the permittee shall submit the
appropriate plan changes for approval by the Regional
Permit Administrator prior to undertaking any such
modifications . The permittee is advised that
substantial modification may require submission of a
new application for permit.
D. At least 48 hours prior to commencement of the project,
the permittee and contractor shall sign and return the
top portion of the enclosed notification form
certifying that they are fully aware of and understand
all terms and conditions of this permit. Within 30
days of completion of the permitted work, the bottom
portion of that form shall also be signed and returned,
along with photographs of the completed work and, if
required, a survey.
E. For projects involving activities to be undertaken in
phases over a period of more than one year, the
permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to
recommencing work in subsequent years .
F. The granting of this permit does not relieve the permittee
of the responsibility of obtaining a grant, easement, or
other necessary approval from the Division of Land
Utilization, Office of General Services , Tower Building,
Expire State Plaza, Albany, NY 12242 ( 516) 474-2195 , which
may be required for any encroachment upon State-owned lands
underwater .
