WORK SESSION:

9:07 A.M. - Town Attorney Yakaboski asked for an attorney-client privilege. Supervisor
Cochran asked the other people to leave the room. Town Attorney Yakaboski advised the Town
Board that Riverhead Town has been stopped on their big project on the N/E comer of Mill Road
and Route 58 because the court said that the SEQRA process was not done properly. When you
pass zoning, you
must do SEQRA. The Town Board questioned the attorney/client privilege in this instance.
Town Attorney Yakaboski said that it is exempt from the open meeting law and he will get a
memo on it soon. Jack Williams objected to the attorney/client privilege being invoked.
Attorney Yakaboski stated that he will get the information that he bases it on.
9:15 A.M. - Chick Voohris of Nelson, Pope, & Voohris Consultants appeared before the Town
Board to answer any questions that anyone might have in relation to the environmental impact
statement done for the freshwater wetlands or the public power authority. He explained that
there are some limitations on electric. Councilwoman Hussie questioned what he wrote on this
matter. She said that zoning controls growth, not electric power or work force. Mr. Voohris said
that this would be a Type II action on SEQRA. On feasibility, he feels that there is a reasonable
chance of success. But, he does feel it would be a Type II. He feels that we would be on shaky
ground with a Type I unlisted at this time. Councilman Moore asked about the Town Board
passing the local law and putting it out for a public referendum and a bond for forty million
dollars. Town Attorney Yakaboski handed out information booklets entitled "Gas & Electric
Formation", 1 l-A, 360 of General Municipal Law. He advised that a Town Board resolution to
form a municipal electric company would be subject to a mandatory referendum. Much
information is needed and many questions need to answered before a company is formed.
Councilman Moore feels that we are not being given clear information by the consultants, Power
Alternatives, Inc. The Town Attorney distributed copies of the R.W. Beck Southampton Study to
Town Board members.
9:30 A.M. - Town Comptroller John Cushman appeared before the Town Board to discuss health
insurance. He advised that the town has saved over $870,000.00 under the self-insurance
program. Mr. Cushman suggested changing administrators at this time in order to continue to
keep it cost effective. We have been with Lawrence HHS Administrators for seven (7) years.
However, with the de-regulations of the medical industry, it was felt that they have not done all
that they could have. John Cushman advised that he has some written information on a new
company they think would be good. The new company will be invited to the next meeting on
October 13, 1999.
9:45 A.M. - James Bunchuck, Solid Waste Coordinator appeared before the Town Board to
introduce Deborah M. Hopper, Recycling Coordinator Volunteer. Ms. Hopper has worked in
health care for the past 22 years. She sat on a Solid Waste Board there and her interests are in
recycling and the environment. Duties for this town position were discussed. The Board
envisions her helping out with the following lwo items: (1) Recycling Brochure; (2) Earth Day
special event for 4/22/99. Councilwoman Hussie questioned how much money is left in the
budget for everything. Mr. Bunchuck said there is $4,000.00. He advised that everything that
Ms. Hopper does will go through him and come to the Town Board.

at 4:30 P.M. with the Pledge of Allegiance to the Flag.

SUPERVISOR COCHRAN: May I have a motion to approve the audit of bills for September 28,
1999.
Moved by Councilman Romanelli, seconded by Justice Evans, it was
RESOLVED that the following bills be and hereby are ordered paid: General Fund Whole
Town bills in the amount of $139,438,07; General Fund Part Town bills in the amount of
$8,052.02; Community Development Fund bills in the amount of $34,250.00; Highway Fund
Whole Town bills in the amount of $5,347.35; Highway Fund Part Town bills in the amount of

SUPERVISOR COCHRAN: Approval of minutes of September 14, 1999, Town Board meeting.
Moved by Councilman Hussie, seconded by Justice Evans, it was
RESOLVED that the minutes of the September 14, 1999, Town Board meeting be and hereby
are approved.

SUPERVISOR COCHRAN: To set the next regular Town Board meeting for October 12, 1999,
at 7:30 P.M.
Moved by Justice Evans, seconded by Councilman Murphy, it was
RESOLVED that the next meeting of the Southold Town Board will be held at 7:30 P.M.,
Tuesday, October 12, 1999, at the Southold Town Hall, Southold, New York.

SUPERVISOR COCHRAN: I think we have to set some special meetings. May I have motion
to set October 4, 5 and 6 as Special Town Board meetings.

6, 1999, at the Southold Town Hall, Southold, New York.

SUPERVISOR COCHRAN: I am just going to make a little announcement first before I go into
Reports and Public Notices on the agenda. We have been getting many, many calls all day long
in relation to the mosquitos. People are frightened. People are concerned. Newsday reported
that dead birds were found in Southold. As of this time, a little bit earlier, I called Gaffney, I
called Vector Control. I have spoken with the Health Department, and as of today, verified, are
three dead birds in all of Suffolk County that were tested and proved positive. Those three birds
are in the Huntington area. They will start spraying Huntington this evening at five o'clock.
There have been some birds found in other locations, but they haven't tested, so nothing is
proven as far as any of the birds found dead, and from time to time you do find dead birds for
whatever reason. They have assured me that I will be notified immediately if any birds found in
Southold are positive, so at this time they feel quite comfortable in the fact that there are only
three dead, and they are in the Huntington area. I will let you know. I will go on the radio if I
have to, and let people know, and work out the spraying and so forth if it becomes necessary. I
talked to a Dr. Mayer from the Health Department, so at this point that is the update. Many
people are being frightened, and rightly so.
TOWN CLERK NEVILLE: Louisa asked who they contact if someone should find a dead bird?
SUPERVISOR COCHRAN: If you find a dead bird it would go to..see I am using numbers
that..I couldn't get through on any of the public numbers, because of the numbers of people
calling the Health Department. Notify Police Headquarters if you find a dead bird, and that way I
will give them the inside number, because if I give it out to the public then everybody is calling
it, and it is no longer a phone you can get through on. We do the same thing through Emergency
Preparedness. We have phones only used for a particular reason, and so if you do find a bird,
please, notify headquarters. I will call and talk to the person that is on duty now, that is in charge,
as soon as we finish here.

SUPERVISOR COCHRAN: As you know the Town Board receives reports every two weeks.
They come from both departments, and committees, and they are available in the Town Clerk's
Office. If there is any area that you are concerned or interested in, we would be very happy to
share this information with you.

II. PUBLIC NOTICES.
SUPERVISOR COCHRAN: In relation to public notices, we have been notified by the
Department of Transportation that the speed limit on Leslie Road in Southold has been reduced
to thirty miles an hour. This is something that the neighborhood asked for, and they did a survey,
and they agree with the request. Also in relation to public notices there is a replacement of a
bulkhead and dredge, ten year dredge maintenance on Brush's Creek in Mattituck. The
Superintendent of Highways Ray Jacobs has posted his public notice in relation to Fall Leaf and
Brush Clean-Up. The dates are in the paper. Call Highway if you don't catch it in the paper.
They should also be able to tell you when they will be coming by your area. We have a Notice of
Application for tidal wetlands and fresh wetlands to propose a ten thousand feet building, and
that is by the Port of Egypt, Main Road, in Southold. We also have an applicant proposing to
construct a vinyl bulkhead, Minnehaha Boulevard here in Southold.

2. U.S. Army Corps of Engineers, Notice of Application of Edgemere Park Associates to

III. COMMUNICATIONS.
SUPERVISOR COCHRAN: We had a very nice thank you from the volleyball ball league for
our providing the volley ball court along with the Mattituck Park District. That is one of the
partnership things we do, and they have been very happy. This is the second or third season up in
Mattituck by the Breakwaters as far as volleyball, and also a thank you from the Nassau Farms
Association to the Highway Superintendent for the repair of the sidewalk.

IV. PUBLIC HEARINGS.
1. 5:00 P.M. for Public Input on Local Housing and Community Development Needs to be
Met with Federal Community Development Block Grant Funds.
2. 5:05 P.M., on the question of the acquisition of the following parcels from The Peconic
Land Trust for open space preservation purposes: SCTM #1000-22-3-19, SCTM #1000-22-3-20,
SCTM #1000-22-3-21, and SCTM #1000-22-3-22 (north of Route 25, East Marion), comprising
approximately 26 acres at a price of $900,000.
V. RESOLUTIONS.
SUPERVISOR COCHRAN: As you know the Town Board has a policy that if you would like
to address the Town Board in relation to any of the resolutions that we will be acting on this
evening I will entertain those now. There is also time at the end of the business that we have to
conduct for you to give input to the Town Board on any Town business. At this point, we will go
for the resolutions. Is there anyone that would like to address the resolutions? Jim, you are first.
JIM DINIZIO: Jim Dinizio, Greenport. Number 68 you have a Local Law to amend the uses and
conditions of Residential Office. Is this in regard to County Route 48 Study? Will that be
available on the 4th, 5th and 6th?
COUNCILMAN MOORE: Yes.
JIM DINIZIO: In other words, there is a list right now of uses, and people when they stand up
will know. By the way Southold Town Police is 765-2600, instead of911.
SUPERVISOR COCHRAN: I would hope they wouldn't use 911, Jim.
ANN MILOWSKI: My name is Ann Milowski from Calverton, and he asked the same question I
did on the Resolution 68. Will we be able to see that before the meeting?
TOWN ATTORNEY YAKABOSKI: Yes, you can pick up a copy in the Clerk's Office. We will
have copies probably on Thursday available. Also, it is all coming out in the paper on Thursday,
the Suffolk Times, in it's entirety. We talked to the paper today. It is supposed to be there in it's
entirety.
SUPERVISOR COCHRAN: Anyone else like to address the Town Board in relation to any of

Clerk Elizabeth Neville to advertise for bids for the Upgrade and Construction of a New
Southold Town Police Department Communications Center.

WHEREAS, the Board of Commissioners of the Fishers Island Ferry District wishes to engage
the services of an additional part-time purser; and
WHEREAS, David F. Grote, 259 Niantic River Road, Waterford, Connecticut has made
application and is considered to be qualified to fill the position; now, therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby appoints David F. Grote to
the position of part-time purser for the Fishers Island Ferry District, at a salary of $12.00 per
hour, effective September 18, 1999.

WHEREAS, M/V MUNNATAWKET must be drydocked for periodic inspection and
maintenance of her underwater body and outboard fittings; now therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby grants permission to the
Board of Commissioners of the Fishers Island Ferry District to advertise for bids for drydocking
the M/V Munnatawket and accomplishing of work thereon in accordance with the specifications.

the amount of $49,000.00, for the construction of restroom facilities at Klipp Marine Park,
Greenport, New York, all in accordance with the plans and specifications as prepared by James
A. Richter, R.A.

RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs
Supervisor Jean W. Cochran to execute an agreement between the Town of Southold and
Construction Consultants/L.I., Inc., for the construction of restroom facilities at Klipp Marine
Park, Greenport, New York, in accordance with the plans and specifications prepare by James A.
Richter, R.A., subject to the approval of the Town Attorney.

RESOLVED that the Town Board of the Town of Southold hereby appoints Jeannette P. Wilke
to the position of School Crossing Guard for the Southold Elementary School, at a salary of
$25.97 per day, effective immediately.

Machinery Company, Inc., to supply a "Rental of D8 Bulldozer for Landfill Capping Purposes",
at a cost not to exceed $11,000.00 per month, subject to the lease agreement, all in accordance
with the approval of the Town Attorney.

Moved by Supervisor Cochran, seconded by Councilman Moore,
WHEREAS, it has been announced that the Federal Government is planning to convert the
Plum Island Center from a "biosafety level 3 facility" to a "biosafety level 4 facility - the most
dangerous", and
WHEREAS, this new facility is proposed to conduct research on "agro-terorism" permitting the
Plum Island Center to conduct research on the "most contagious pathogens affecting plants and
animals and in some cases, "man"; and
WHEREAS, the economy and the "quality of life" of the Town of Southold is based in large
part on agriculture and the environment, including a wide diversity of plants and animals; and
WHEREAS, Plum Island is part of the Town of Southold; and
WHEREAS, Plum Island is approximately one mile from the main land of Southold Town; and
WHEREAS, there are no studies or reports as to how this might effect the health and safety of
the people of the Town of Southold; and
WHEREAS, there has been no assessment as to potential environmental impacts of such action;
and
WHEREAS, there has not been provided to the Supervisor or the Town Board of the Town of
Southold details as to how such "dangerous pathogens" would actually be transported to Plum
Island; and
WHEREAS, no warning system or evacuation plan in case of accident at the research facility
has been established; now, therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby strongly protest the
establishment of such an upgrade until such questions have been answered and details provided;
and be it further
RESOLVED that a copy of this resolution be transmitted to all Federal, State, and County
representatives as well as to the neighboring town and villages.
SUPERVISOR COCHRAN: I had occasion to talk with the Health Department, and they have
been left out of the loop the same as Southold Town has. The Commissioner feels that the health,
safety and welfare is also one of her main responsibilities as it is to this Town Board, and they
are just going ahead and doing things without even going through the County Health
Department. I, also, had a correspondence from a Mr. John Shahan, who is very upset over this,
and he has been working with George Guldi, who is the Legislator for the South Fork, but I think
all the towns are passing their own resolutions, and looking in the same direction, because you
know Plum Island is a part of Southold Town, and we certainly should at least be informed, and
educated as to what is going to be going on over there.
COUNCILWOMAN HUSSIE: I would like to add to that, Jean, the awful part of this is that
Plum Island is Federal property, and therefore we as a town really have nothing to say, which is
too bad. We can protest as much as we want, and the Town Board is going to protest. I hope that
you protest also. This is the USDA, the Department of Agriculture, so if you know anybody
there, or you have a Senator, or Congressman, who might have an ear of the USDA, they ought
to know about it, and know that we are not happy campers.
SUPERVISOR COCHRAN: I am heading down to Washington tomorrow, late afternoon. I
have meetings all day Thursday. I am going to try to shake money out of the trees for a few
problems that we have, and I will hand deliver this resolution to our Congressman and the
appropriate people.

TOWN ATTORNEY YAKABOSKI: Resolutions 21 through 55 deal with the 126 Local Law
regarding the proposed Zoning Map amendments. The public hearings have been set for October
4, 5, and 6. The resolution specifically deal with SEQRA. The particular tax map parcels or
parcels of property have been grouped. According to the groups as they were in the Route 48
recommendations by CCG, the Planning Consultants, Greenport 1, Greenport 2, Mattituck lA,
along that line. Each of the resolutions establishes, describes the particular parcel. The Local
Law established that there are no involved agencies, that the Town Board is the Lead Agency,
and that the action is an unlisted action going to SEQRA. What the Board wanted to do to save
time is to take this opportunity to explain which of the resolutions are, and then have a vote on
each of these resolutions by numbering. For example the Town Clerk would call a vote for
resolution #21, and so on, right down the line. It would be a yes or no vote for the SEQRA
resolution for each one. Anybody have any questions?

the acquisition of the Dam Pond property on the 28th day of September, 1999 pursuant to the
provisions of the Chapter 59, Open Space Preservation of the Town Code of the Town of

WHEREAS, the Town Board deems it in the public interest that the Town of Southold acquire
the Dam Pond property; now therefore be it

COUNCILWOMAN HUSSIE: I have a few things to say before I vote. Yes, I agree this is a
jewel, or was it you, Jim, who said that, and this Dam Pond property is wonderful, but a funny
thing happened on the way to the cash register. In April, this property was $800,000. Now, we
are doing it for $900,000, and I don't care whether it is the County's money, the State's money, or
the Town's money. It is still $900,000, and now I learned from Mr. Caulfield that not only are the
owners getting that much money, they are also getting the tax relief, because the fourth parcel is

being called a gift. We could be buying 206 acres of farmland preservation. I am really disturbed
about the way this thing has gone. I don't think it is a matter of blame anywhere, but it certainly
is a very high price to pay for a view. It is beautiful, but we've been gouged, but I am voting, yes.
It doesn't make sense, does it? The next time anything comes up like this where it is so out of
proportion in the price, or the product that we are getting, this property does not have all of it's
permits. This price is based on, yes, if it could actually be built upon right today. It doesn't have
it's permits, and I am voting, yes.

COUNCILMAN MOORE: Resolution 72 we added this morning after reading today's Newsday.
We have in the audience one of the members of the Southold Town Anti-Bias Task Force. I
asked Dot Wolfe to come in. If you want to say a wor, Dot, now would be the time in support of
this. The County is putting together a hate crimes piece of legislation, such that they can write
on the County level which would impose civil penalties. If someone were found convicted of a
crime of ethnic or racial bias prejudice, and this is what they thought they could do on the
County level since we are having a difficult time presently getting legislation through on and
State level. It has been proposed by Allan Binder, and is supported by the entire Legislature, if
the papers are to be believed is accurate, and we thought on behalf of the town, and through the
Anti-Bias Task Force, that it would be helpful for the town to speak out in favor of the County's
proposed law, so they don't get cold feet when the time comes to vote. So, we have resolution
here, which I will take the time to read.

WHEREAS, the Town of Southold is a community of concerned citizens committed to the cause
of fighting bigotry and hatred and the violence that sometimes accompanies these vile
expressions; and
WHEREAS, to that end, the Town Board of the Town of Southold established the Anti-Bias
Task Force in 1995 in an effort to raise the consciousness of our citizens and work toward
making Southold a bias-free community; and
WHEREAS; hate crime legislation is pending before the Suffolk County Legislature to impose
civil penalties on anyone who commits a crime motivated by ethnic, religious, racial or other
prejudices; now, therefore, be it
RESOLVED that the Town of Southold hereby goes on record in support of the pending
legislation, sponsored by Legislator Allan Binder and co-sponsored by all 18 members of the
Suffolk County Legislature, and urges its swift passage; and be it further
RESOLVED the Southold Town Clerk is hereby directed to forward a copy of this resolution to
Suffolk County Legislature members, Senator LaValle, Assemblywoman Acampora, and County
Executive Gaffney.

Southold. It has been little while since I have made a Board meeting. I might be a little rusty.
Bear with me. I have two questions before I get to my main issue. Madam Supervisor, about six
or eight months ago I spoke to you about additional handicapped parking spaces in the Town
parking lot, in the Town Hall parking lot. I still see there is two. Three o'clock this afternoon I
took a picture of them. Here they are. You get complaints from people, handicapped people, they
can't find a place to park, yet there is all kinds of parking signs for everybody that is employed in
this Town Hall. Maintenance men, everybody that is employed in this Town Hall have signs and
parking spaces, then we have two for the handicapped people here. Explain that to me.

SUPERVISOR COCHRAN: I discussed it with the appropriate people, and it was felt that two
were adequate. They are behind the Judge's and the ramp is right out here, and we normally do
not have more than two at a time, Frank.
FRANK CARLIN: Are you here all the time to know this?
SUPERVISOR COCHRAN: I am here every day nine to five, and usually nine to six or seven,
every day of the week. So, yes, I am here.
FRANK CARLIN: I think a couple of people, one had a very bad heart at one time, and he came
here. He said he rode around the parking lot there, and couldn't find a place to park.
SUPERVISOR COCHRAN: We will review it again, Frank. One of the things the Town Board
worked on today was we are going to have to..down in the basement, as you know, we have
problem as far as the rain and the mold, and we have had to tear up carpets, and we have people
working down there, and PERMA came in this past week, and met with myself and John
Cushman, as to the point where we have to take action in relation to having our workers in the
basement. One of the options that the Town Board looked at this morning was a modular facility,
that would be based probably over on this side of the building. At that time we will also look at
the handicapped parking, because we will have to perhaps provide another space.
FRANK CARLIN: Especially when it is taxpayers.
SUPERVISOR COCHRAN: At tax time.
FRANK CARLIN: People are lined up there, and I am sure that more than two people could be
handicapped people.
SUPERVISOR COCHRAN: That is off-street parking and we will review it again.
FRANK CARLIN: My second question is, what is your rules in this town in hiring Civil Service
people? Is it six month you live in the town, or is it six months you have to move to the town to
be hired?
SUPERVISOR COCHRAN: We don't have any.
FRANK CARLIN: You don't have anything?
COUNCILMAN MOORE: No. We start with a local list.
FRANK CARLIN: I know that. What are the rules on the residents?
COUNCILMAN MOORE: We don't have a rule of residents. Certain attorneys suggest that we
can't even have that. It restricts people's ability to move from place to place. But, we start with a
local list, and for Civil Service to put that person on the list, they have to qualify where the Civil
Service's residence requirements are to justify placing them on a local list.
FRANK CARLIN: We have no rules when somebody from out of town applies to..
SUPERVISOR COCHRAN: Move into town? No.
COUNCILMAN MOORE: But, you start by hiring from the local list.
SUPERVISOR COCHRAN: You have two lists you can call for, Frank, a local list, or a County
list. We always start with the local list, so that we can hire our own people. Okay? If we exhaust
that list, and we still need a body in that particular job or position, we will call on the County list.
Sometimes these people are living up island somewhere, but we do not say to them, you now
have to move your family, your children, and everything to Southold in order to get the job. But,
we do go into the direction of hiring local Southold people first.
COUNCILMAN ROMANELLI: An attempt is always made.
SUPERVISOR COCHRAN: So, we have nothing that says you must move.
FRANK CARLIN: Isn't there some Civil Service rule?
SUPERVISOR COCHRAN: No.

FRANK CARLIN: Alright. That is all I want to know. Thank you for giving me an answer. My
main issue tonight, no, Madame Supervisor, I did not say I that I wanted to debate you. What I
said was, I would like to at some time or some date debate the whole Board on any issue in this
town, and we could go about for about four or five hours with a coffee break in between. That is
what I would like, not only you.
SUPERVISOR COCHRAN: Someone had said that you wanted to.
FRANK CARLIN: You were misinformed.
SUPERVISOR COCHRAN: Someone just mentioned it, Frank, and I thought you would get a
kick out of knowing that is what I was told, that you wanted to..you know.
FRANK CARLIN: It was mentioned several times, Route 25, Route 48, will become another
Route 58. It will never happen. I am going to tell you why. I am going to give you five reasons
why. Riverhead is originally, the original area, served both the North and South Forks, also the
west. A lot of volume of people come in there. Let me give you an example. If we had a Home
Depot in Riverhead, don't forget, and say, you are grasping for outer space here. If we had a
Home Depot on Route 48, for example, do you think the people are going to travel all the way
around the South Fork, from the West, and go by Home Depot to come out here to Route 48 to a
Home Depot? I don't think so. A lot of your businesspeople think twice before they come in this
town for five reasons. Look what happened to McDonalds, what they went through for four years
in order to open up a McDonalds. Look what happened to Mullen Motors. Man has been waiting
now over two years. He is in court trying to get more places to park. Instead they have to park on
the side street there. Look what happened to Southampton Lumber. They leave, they want to
come back after two years, giving them a hard time. I want to ask you a question. Why did they
leave the sign up there all this time for? The sign is still up there, Southampton Lumber. Number
four, two years to build a winery building in Peconic here on the Main Road. The winery log
cabin almost a year before the woman got a final permit to build it. Charlie Zahra, 1989, tried to
open up a restaurant, giving them a hard time, didn't open up. The building was dormant for over
four years. A lot of businesspeople see this, they don't want to get involved. So, Bill Moore,
when you say, or anybody else says on the Town Board, and I hear this so many times, Route 48
could be another 58. We don't want 25 to be another 58. Forget it. It will never happen here.
You don't have the people to support this, so please, don't get the people thinking the wrong way.
You will never see another outfit in Southold, not the way our rules are. That is for sure. So, that
is about what I have to say tonight. Now, I am a man that said what he wants to say, and I will
say it. I want to say something tonight. I hope you don't take it to be political. People ask me,
what are you? What is your party? What are you? I have been a Democrat for 46 years, a
registered Democrat, but I vote for the person I think will do the job. The reason I don't make the
Democratic meetings, or whatever, Mr. Williams, is there is a story behind that.
SUPERVISOR COCHRAN: Keep the politics out of Town Hall, Frank.
FRANK CARLIN: On this Route 48, I will tell you one thing. I am going to tell you right now. I
am going to finish it up. You never, never rock the boat in election year. That is what I think the
Board did on Route 48. Rocked the boat, and you don't know how to stabilize it. Thank you.
SUPERVISOR COCHRAN: Thank you, Frank. Anyone else like to address the Town Board?
Jim?
JIM DINIZIO: Jim Dinizio, Greenport. I asked you at the beginning of the meeting concerning
this resolution 68, concerning RO District, and I got the impression that people are coming from
the 4th through the 6th meeting would have in hand the law.
SUPERVISOR COCHRAN: You will.
COUNCILMAN MOORE: It will be in the Legal Notices on Thursday.
JIM DINIZIO: Have you made up your mind before the hearing on the Law?
COUNCILMAN MOORE: No.
JIM DINIZIO: Well, the public hearing on those laws is on the 12th.
COUNCILMAN MOORE: You asked if they would have the proposed Law in their hand.
JIM DINIZIO: No, I didn't ask that. I asked if they would have the law in their hand? Are these
people going to be, each and every one person coming up here going to know the exact uses that
are going to be in the RO?

COUNCILMAN MOORE: It will be published in Thursday paper.
JIM DINIZIO: If that is the case, why are you holding a public hearing on the Local Law? You
are asking people to give input as to how they feel on a particular piece of properly being
rezoned to RO, when you don't know what the uses are going to be. You have proposed uses.
They could be changed after they have had their hearing. Is that correct? Am I correct?
COUNCILMAN MOORE: Not without a rehearing.
JIM DINIZIO: Okay, so you then ask them to come back again. Is that correct? In other words,
what is this hearing for if you don't have a law that they can make a decision on?
COUNCILMAN ROMANELLI: Public input.
JIM DINIZIO: But you are asking for public input, you are asking for input from people, each
individual lot owner as to whether or not, whatever right you have, what opinion they would like
to give at a public hearing for their piece of properly in the RO zone, and you are telling them,
well, we have proposed uses, but we don't have real uses. We could change our mind, and maybe
you will have to come back again. Why have the hearings? Why don't we have the uses already
in the zone before we have this hearing. Let's give these people at least the consideration, okay?
These people, some of it is their livelihood.
SUPERVISOR COCHRAN: We realize that, Jim.
JIM DINIZIO: No, you do not.
SUPERVISOR COCHRAN: I think we do. Don't contradict me.
JIM DINIZIO: You wouldn't take it so lightly. You would not do it. You would have everything,
every duck in a row, and you have this public hearing. I believe that are not prepared to do that.
You have a proposed Law on the uses going to be discussed after you have discussed it with the
people who are going to be affected. Any comment at all?
SUPERVISOR COCHRAN: None.
JIM DINIZIO: I have one more thing I have just comment on, if I could. The Dam Pond thing
actually comes out to $25,000 per lot. It hasn't been subdivided. Okay, and if you wanted to look
at that a little step further all 26 acres could never be developed. I am wondering just how many,
how much, acreage could actually be developed, and what we are actually purchasing? Just a
thought.
SUPERVISOR COCHRAN: I wished you had gotten up at the hearing.
JIM DINIZIO: I will tell you a little story. I worked for Cablevision for a number of years, and
one day I was sitting in my office watching TV, and lo and behold I saw the most beautiful scene
I could ever see. I said, gee, that is lovely. Well, it was end of my road, okay, and I didn't even
realize it was, because I had worked out of town for eighteen years, and the reason why I came
back here, the reason why I am still here, is because I enjoy those views. Dam Pond is certainly
one. It should be saved. I have got to wonder if $900,000 isn't overpaying for something we
could have negotiated down to a little bit less. Thank you very much.
SUPERVISOR COCHRAN: Jim, when the Town buys properly we can not pay more than the
appraised price. We can pay less, but not more, and we are not paying more than the appraised
price. Yes, ma'am? To the mike.
ANN MILOSKI: My name is Ann Miloski from Calverton. I want for the record on the zoning
changes that are going to be at October 5th and 6th, are you going by the present law, or are
going by this proposed Law, that you are sending to the Suffolk County Planning Board, and
having public hearings on, on October 12th?.
TOWN ATTORNEY YAKABOSKI: The public hearing is a good time for public input on the
proposed zoning changes. In addition to public input on the proposed zoning amendments, in
addition the Board can not vote immediately after those public hearings. There is period of
comment for that from the Planning Board and Suffolk County Commission. Does that answer
your question at all?
ANN MILOSKI: That answers me in a round about way.

TOWN ATTORNEY YAKABOSKI: I was trying to give you all the information.
ANN MILOSKI: I understand what you are telling me, and I understand exactly. What I am
saying is, how can you have the public hearing before these people know what the proposed
zoning change it is going to be? I mean, I just don't understand this.
TOWN ATTORNEY YAKABOSKI: That would also be something that the properly owner at
the time, as to the current zoning and the proposed zoning changes. There is an ability there..
ANN MILOSKI: You are having a public hearing on a proposed zoning change on about 48
parcels.
COUNCILMAN MOORE: As a practical matter, what Greg was saying in that round about way,
chronologically no action can take place on any of the proposed land changes until after October
6th at the very earliest, because that is the night on which the Suffolk Counly Planning
Commission to consider the proposed rezones of those parcels. At that same time they are going
to have it in front of them our proposed Code changes, the calendar got backwards, but from a
timing standpoint October 6th is the date that no action can take place. We will have public input
on the 4th, 5th, and 6th. On the 6th the Planning Commission of the County meets. Our Planning
Board will make a comment back on both. The proposed amendment to the uses in the district,
and on the proposed changes to the parcels in question. So, although the hearings will be broken
in backwards order. We sat down today, and had a nice long work session wading through the
final proposals for the uses. We won't be acting on that until after the next meeting, October 12,
so it will be back in place where you will have both in front of you.
ANN MILOWSKI: So, you have a public hearing on the 5th and 6th, it is going to stay open
until after..
COUNCILMAN MOORE: You can do it.
ANN MILOWSKI: I would think it would have to be if you pass any laws.
COUNCILWOMAN HUSSIE: I think what the question is that has been raised by everybody is,
how can an argument be made for or against a zone change as a public hearing, which are going
to happen on the 4th to the 6th, when you don't really know what the zone change is, although
proposed generally becomes reality, but I have to agree. I think we missed the boat there.
SUPERVISOR COCHRAN: Mr. Williams?
JACK WILLIAMS: Jack Williams from East Marion. Thank you, Madam Supervisor. I will try
to be very brief, because I know you are fired from all those yeses. I was sitting in the Work
Session this afternoon, and I listened to a presentation on the Farmland Protective Strategy,
which was accompanied by a book, and a bunch of maps, and all that sort of thing. There was
quite a good deal of discussion of the recommendations, and that is studied by Mrs. Scopaz, and
others. Then there was some discussion about members of the Town Board, and if I recall
correctly the discussion first went to the Jones Study, and then it sort of sashayed to Waterfront
Revitalization. Then from there it went to the need for further Town Planners. From there it went
to the relocation of space within Town Hall. This was all within the space of about three or four
minutes that there were these kind of changes in subject, and I think what we were seeing was a
certain lack of discipline on the decision making part of the Town Board's job. I have a remedy,
which is that instead of saying for discussion on those early items for the Work Session that you
say, for decision, because I think it would sharpen your thinking in terms of what you are here
for. Obviously you are not going to make a decision on every item for instance the report that
we see here today. You only got today, and so certainly you weren't going to make a decision on
it, but if you were thinking during the Work Session in the direction of making decisions then the
people of Southold Town would be less inclined to think that the Town Board is a kind of
debating society, and more of a decision making body.
SUPERVISOR COCHRAN: Thank you for your comments, Mr. Williams. Dorothy? And then I
will take you.
DOROTHY WOLFE: Dorothy Wolfe, Southold. I guess everyone who comes here comes on
their own planet. I want to thank you for two things, for the resolution on behalf of the Anti-Bias
Task Force. I think that is extraordinary, and your support is extraordinary, and the additional
surprise when the New York Times announced that ....is going to be much more than it is now. I
became a wild woman. I wanted to scream. I was shaking, and I looked for things that we do that
are so alarming, and your passing of this resolution is very comforting, and very important, and I
applaud you for it. I wonder whether or not a copy is available, and if there is a copy I would be
happy to have it.

BARBARA SCZOTKA: Barbara Sczotka from Southold. My question is when do you plan on
voting on the Route 48? Are you going wait until after the 12th?
COUNCILMAN MOORE: We have to wait until after the 6th.
BARBARA SCZOTKA: How are we going to know what we on Route 48, as properly owners?
Are we under the present law, or under the proposed law. What are we arguing for? This has
been a year, and I don't think that is fair. What is the angle?
TOWN ATTORNEY YAKABOSKI: Regarding the actual zoning question?
BARBARA SCZOTKA: All of it.
TOWN ATTORNEY YAKABOSKI: It is up to the Board as to when to schedule voting on the
Local Laws, but I think, I can't speak for the Board, but I think what the Board was trying to do
on the public hearings on the 4th, 5th, and 6th at the Work Session, we are trying to bring in
public input, comments like you make, and I think that was what the Board was trying to elicit,
what was out there, what was happening. We will have the opportunity to bring all those
comments into the table, make them part of the record, make them each of the record of each of
proposed zoning changes, and probably based on the public input that is received from that, then
the Board can make decisions as to when it will go for a vote, and when to set the vote, and I am
sure the Board will give notice to everybody.
BARBARA SCZOTKA: How will we know what we are arguing against on our own properly?
TOWN ATTORNEY YAKABOSKI: That is in a two question form. The first question is has
the Zoning Map change whether your properly goes from, say, RO to HB (tape change.) The
second question you have is, and I understand the point has been raised, is the question of the RO
and the LB current uses permitted by permit as right with a special permit, and there has been
based on some of the comments made by CCG, that there is proposals to amend some of the uses
in those zones. Your second question really centers on if I am involved in RO, LB, what am I
voting for, what am I going to get? Again, rather than be a negative, it is actually a positive
because with the public hearings right then, and having it in your hand at the time the current LB,
the current RO, plus in addition to that, not just those two, but the relief which is given under the
non-conforming use, use of non-conforming buildings, you have those right in your hands before
the public comment period. You are able to comment on it. For example, a comment could be,
hey, I like my properly the way it is, because of the current zoning, but if you are going to
change it, please do it. You have all the information right before, before you make you make all
the different options, all the variables, before the Board votes. You get to have public input at
that time.
BARBARA SCZOTKA: You could change it again, correct? Change the proposed?
TOWN ATTORNEY YAKABOSKI: If the change happened, the Board could always change a
Local Law, it is a legislative body, but if the change happened it can not happen unless there is
public notice, unless there is public hearing, and that type of input, so there are a lot of safely
valves built in, so that people who would effected or might be affected by the zoning change,
have the opportunity first to hear about it, and then to comment on it. You have it all right before
you.
COUNCILMAN ROMANELLI: I think everyone's argument is they don't know how to argue
pro or con for their land if they don't know how the zone is going to be, what the use is going to
be, what your zone is going to be, and what the use of that zone is going to be before they come
and argue probably for a zone change.
BARBARA SCZOTKA: Could they change all together after all that? I would have to go
through this whole process again. How many hearings are we going to have?
TOWN ATTORNEY YAKABOSKI: See, Barbara, right now, if you had an RO, personally you
have a benefit in front, you can say, here is the current RO as it is, you can decide, is this
beneficial? Maybe I like the new change. You could say, hey, move me to RO, and give those
changes to benefit me, you know what you want to do with your properly. Maybe you don't care
for it, but you have all the variables, all the options from here, and you have a chance to
comment on all those variables, and all those options. In a way, really, it is a plus. It is a plus.
The time spent in addressing it might be a little longer, but the properly owners, and the people
who are concerned, who come to comment on it, you have it all right there. It is all right there,

and you can say, hey, and it can make sense to the Board, and say, hey, that makes sense. If it
goes to RO, then this person wants RO, so I know they are going to be for it, and they want that
zone change, or maybe you don't, but that is your opportunity to address all those variables at the
same time. Given a lot of input, and a lot of facts to digest it to decide when to vote, and how to
vote.
SUPERVISOR COCHRAN: Thank you, Barbara. Jim?
JIM DINIZIO: Jim Dinizio, Greenport, high school graduate. I say that because I am confused.
Greg, you just tried to sell this lady a bag of goods, because what are going to do here? If you are
going to give a person who has invested their life savings sometimes ten minutes to make a
decision on something that may not even happen, or something that may change two weeks later.
Okay? You can't give them that amount of time. This is all supposed to be done in Planning and
Zoning Committee meetings. I don't know how they have been held for the past two years, but I
got a pretty good idea, that hasn't been many, because the homework hasn't done concerning this
particular piece of legislation. Now, I am sorry but I feel for these people. I am not affected at all
by the County Road 48 Study, but I am going to tell you I can just see a lot of people are going to
be coming afterwards begging for relief, because you are totally unclear on what you want. You
are asking these people to come, discuss this matter, when you haven not gotten all your ducks in
a row, number one, concerning the law. How can you discuss RO zone if you change it two
weeks later? The Planning Board hasn't even submitted their comments yet. I don't know when
they meet but I have a sneaky feeling that if they address this week that is going to be a record.
Okay? Anybody is going to tell you that. I don't know how you are going to address this, but it
sounds to me like you are confused, and you really ought to stop and think exactly what you are
going to be doing, because these people are going to be waiting around for a lot more than the
allotted amount of time, I might say.
TOWN ATTORNEY YAKABOSKI: One thing, I don't believe that the public hearings are
limited in time.
JIM DINIZIO: I just see it from eight o'clock, and it is nine o'clock, and it is ten o'clock, and you
got five or six in there. If someone wants to stand up and say something for twenty minutes, then
twenty minutes goes right on down the line, so you got two people want to say something for
twenty minutes, that is forty minutes, you got twenty minutes left for four people to say
something, so I can see where that is going to go.
SUPERVISOR COCHRAN: We will stay as long as necessary. Everyone will be heard.
JIM DINIZIO: I hope that you do, and I really feel that you will, but I think the point is that you
are asking laypeople, people who have not been involved in this process, people have been
paying their taxes, assume they had a piece of land that they plan to use at some particular point
in time for what they purchased it for, and you asking them in ten minutes to plead that you not
change the zone or make a decision concerning that. I think it is totally unfair of you to do that.
COUNCILMAN ROMANELLI: I move that we put off the public hearing, because I really do
believe that until we accept the proposed zone changes, because I don't how anyone can argue
for their piece of property, and I am actually more embarrassed than anything at this point until
Jim spoke, but I believe that makes more sense, that someone can argue for their property
knowing what their zone is going to be.
Moved by Councilman Romanelli, seconded by Councilwoman Hussie,
RESOLVED that the public hearing on zone changes be postponed until after the Route 48
hearings.
COUNCILMAN ROMANELLI: I know that creates a big problem with the legal notices that
went out, and the certified mail that went out. I understand that, but..
SUPERVISOR COCHRAn: I am going to move to table the motion. Do I have a second to
table? We have a Special Board meeting set up on Monday. Public hearings are a part of a
Special Board meeting, and I think we have to look at all aspects of this.
COUNCILMAN MOORE: If you left the hearing open, then you could have the benefit of those
comments, and entertain the information as far as the Code change, and the actual land use
change. The Board is not going to act anyway until after.
COUNCILMAN ROMANELLI: We are not going to act on it before that also. I just put myself
in the shoes of do I come down here, and do I..I want RO. I might not protest my piece. If you
are going to make the change, whatever the change is, I may not protest, accept the zone change.
If you don't change it then I will protest. That is the gray area, that we created.

COUNCILWOMAN HUSSIE: Then do we have a second public hearing on the zone changes?
SUPERVISOR COCHRAN: That is why we should discuss it first thing Monday morning, so
we can get some good legal counsel here.
COUNCILMAN MURPHY: I think that would be unfair to people who have public hearings
coming up. We can turn around Monday morning and cancel the public hearings, and they have
made all their plans. You know some of them may have their attorneys coming here to represent
them.
SUPERVISOR COCHRAN: That is true. We can leave it open, anyhow.
COUNCILMAN ROMANELLI: That is the only way you can do it. That is the only options at
this point is all your hearings be left open. Then if and when the proposed changes on the two
laws are, or amendments on the two laws are accepted, renotice all the people who were at the
public hearings before the changes were put in effect, come back to the public hearings and
discuss it again, and close it.
COUNCILWOMAN HUSSIE: So, that is two public hearings.
COUNCILMAN ROMANELLI: In essence, if your public hearing is before the 12th you are
having two public hearings.
SUPERVISOR COCHRAN: I will withdraw my motion to table. I don't think I had a second
anyhow, did I? It dies for lack of a second.
COUNCILMAN ROMANELLI: I had a motion stopping the existing public hearing, and
waiting for the 12th.
COUNCILWOMAN HUSSIE: Okay, so instead we are going to have the hearings on the 4th to
6th, leave them open until after the 12th, when we will have the hearings on the Code changes,
and then we will reschedule more hearings on the zone changes. Is that right?
SUPERVISOR COCHRAN: Okay, Greg, legally we can take each step as it comes? I have a
motion on the floor. John, are you changing your motion to what we are doing, or are you
staying with your..
COUNCILMAN ROMANELLI: I will take it back for the sole reason I don't know if we can..I
pity the people that have to come back twice, but I don't know if we can stop everything.
SUPERVISOR COCHRAN: Alice, you withdraw your second?
COUNCILWOMAN HUSSIE: Yes.
SUPERVISOR COCHRAN: John, do you want to move the question stating that the hearings
will be left open?
COUNCILWOMAN HUSSIE: We can do that then,
SUPERVISOR COCHRAN: We can just do it. I can rule them open at the time of the hearing. I
can keep them open.
JIM DINIZIO: Can I comment on one more thing? The problem with what you have just been
discussing is that unless you are going to notice each one of them individually like you did just
today, and I am hoping that is your intention, and not just leaving the hearing open...
SUPERVISOR COCHRAN: We said they would noticed. They will be noticed individually. Be
noticed as they just were.
JIM DINIZIO: Because they are not going to know the day of the hearing what the next date is
going to be.
COUNCILMAN ROMANELLI: I make a motion the second hearing will be noticed, treated just
as the first hearing was by certified mail.
TOWN ATTORNEY YAKABOSKI: We would do it the way we did it the first time, both by
certified mail, and regular mail.

RUTH OLIVA: Ruth Oliva. I hate to put more irons in the fire here, but this is about setting the
hearing for the Mullen zone change on the 12th. I am just afraid, this is a rezoning, and many
people are interested on both sides, and it is just going to get all muddled up with everything
else. I mean it is just so much for everybody to comprehend. Here's the Route 25 being
downzoned, or applied for a downzoning, and you are upzoning Route 48. I don't know, it just
seems a bit much for everything, and then you are going to change the RO's, the LB's, or what
have you. It is kind of overwhelming I think.
SUPERVISOR COCHRAN: Well taken, Ruth. Yes, sir?
ANDREAS MARKAKIS: I am Andreas Markakis of Southold, and in the midst of the confusion
I will just make a clear statement, and reserve my constitutional rights for the next meeting.
SUPERVISOR COCHRAN: You are always welcome each meeting.
ANDREAS MARKAKIS: My statement at this moment would be, I am a voting citizen in the
Town of Southold. I do not personally own any properly on the Route 48. I pay taxes here since
1967, and I would like to state that I object and I oppose the zone changes on Route 48. The rest
of the remarks I reserve for the next meeting, because time is passing.
SUPERVISOR COCHRAN: Thank you. We do have another meeting this evening in this hall.
Yes, ma'am?
PAT MILOWSKI: Pat Milowski. Mrs. Cochran, I just want to ask a question. When you
announce before the pubic hearings that it will kept open, will you also tell the public that there
is a chance that the ROs may change, and the LB may change also?
SUPERVISOR COCHRAN: I don't follow you.
PAT MILOWSKI: Will the public know that you are talking about the current RO, and there
might be a proposed change for it.
COUNCILMAN MOORE: Those proposed changes are going to be in Thursday's paper, this
Thursday's paper. That is what you are saying, there is a proposed change there, take a look at it,
and see what you think about it.
SUPERVISOR COCHRAN: In the Suffolk Times.
COUNCILMAN MOORE: It will be said in the beginning of the hearing I am sure.
PAT MILOWSKI: Thank you.
ANN MILOWSKI: My name is Ann Milowski, Calverton. The reason I am here, of course you
know is my daughter. I understand what you are doing now that the public hearings, and you are
going to extend the public hearings. Now, will their public hearings be extended long enough so
you get the report from the Planning Board, and the Suffolk Counly Planning Board, and the
proposed Local Laws become law? Is that hearing going to extend after that second hearing?
COUNCILWOMAN HUSSIE: That is what I understood.
ANN MILOWSKI: That's the way it should be, but I want it on record exactly how you are
going to do this. What I am saying is, the public hearing that you are going to have the first
time..
TOWN ATTORNEY YAKABOSKI: On the 4th, 5th, and 6th.
ANN MILOWSKI: On the 4th, 5th and 6th, will that hearing be kept open until after you get
your report from Suffolk Counly Planning Board after your proposed Local Law, your new
proposed Local Law, becomes law?
TOWN ATTORNEY YAKABOSKI: As to keeping it open until after the Suffolk County
Planning Commission? The Board has to by law. Yes, it will be kept open, and if I understood
everything correctly what also is going to be happening those on the 4th, 5th and 6th, those are
going to be kept open until after the Board votes on the 12th on the proposed Local Law as to
amend the RO, to amend LB in non-conforming.
ANN MILOWSKI: They won't vote on the 12th, because isn't that the day you are having the

public hearing?
COUNCILMAN MOORE: You wouldn't vote on the properly zone.
ANN MILOWSKI: The only thing is after it becomes law, your proposed law, will that hearing
be kept open until that proposed law comes into effect so they can come back again?
TOWN ATTORNEY YAKABOSKI: Yes.
COUNCILMAN MOORE: You are not going to rule upon a particular piece of properly until
you have made a decision on the Code change.
COUNCILWOMAN HUSSIE: So, the sequence is we are going to have 4th, 5th and 6th of
Zoning Map changes. Then we are going to have the hearing on the Code changes, and then we
are going to revisit the Zoning changes. It must be on the record three or four times now, we
certainly better know what we are doing.
SUPERVISOR COCHRAN: Okay, anyone else like to speak to the Board?
COUNCILWOMAN HUSSIE: The Cramer Study, and I brought up a problem that I had,
because there is also the, so called, Jones Study to be talked about, and I was told a couple of
things. I don't know. It is not exactly right. There is a confusion in my mind about what is going
on with the Cramer Report, and the so called, Jones Study. Last year at the request of the
Planning Board, the Suffolk Counly Planning Department was asked to do a Groundwater
Protection Study, which we now know as the Jones Plan. A presentation was made to the
Planning Board, and the Town Board was invited to attend. Sometime after the presentation the
plan was delivered to the Planning Board, but copies were not distributed, and rumor had it that
it was too controversial, and as time went by further rumor had it that the plan was not going to
be passed. That is the Jones Plan. The Jones Plan was presented to the Planning Board after the
Cramer Study was commissioned, and after the moratorium was declared. However, the Jones
Plan is cited as a reference in the Cramer Study. To me this makes the two plans interactive.
The Town Board has not discussed the Jones Plan, and yet at the last Board meeting the Board
passed a resolution that $20,000 be spent to explain the Jones Study, which leads me to believe
that there is acceptance of it. Upon careful reading of both plans, both studies, I find an
interrelationship between them in a concomitant sequence, accepting the recommendations of the
Cramer Study as part of the Jones Study. Both of these plans are presented as recommendations.
The Town Board is moving ahead with the recommendation of the Cramer Plan, and now it
seems that to be considering the Jones recommendations. We are familiar with the Cramer Plan
changes to a number of properties from one zoning to another, and in almost every case, though,
it's uses have been reduced. Many are being suggested to be AC, or Agricultural Conservation,
or R80, two acres. Looking at the Jones Plan one finds recommendations for those two zones to
be five acres. The Jones Plan also recommends adoption of incentive zoning, and density
transfers. To reduce these to very simple terms, incentive zoning would allow a developer to a
greater density if he bought development rights. Density transfers would permit the owner of a
undersized lot, which is made undersized because what used to be okay under the R40 is now
going to be R80 to buy development rights elsewhere, and the effect on school taxes and school
districts hasn't been considered. All of these recommendations have merit. My question arises
that as a Town Board we have not discussed this. I hear from some people in the public that they
have been assured that the Jones Plan is permanently on the shelf, and then other people tell me
that they are very pleased that the Jones Plan is going to become law, so evidently there has been
some discussion between the Board or Board members, and some members of the public. Before
we forge ahead I wish we would consider what is before us. Consider where this will take us.
Find out from the entire public, not just the political action groups where we should go, and how
we should get there. We all know that water is precious. We all want keep Southold green and
pure. The climate that has been created by the actions of this Board, myself included, in the past
few weeks is one of panic, and I don't think we can solve our problems in such an atmosphere.
SUPERVISOR COCHRAN: Thank you. May I have a motion to adjourn?

RESOLVED that this Town Board meeting and hereby is adjourned at 6:30 P.M.
