REGULAR MEETING
A ReRular MeetinR of the Southold Town Board was held on May 23, 2000 at the Southold
Town Hall, Main Road, Southold, New York. Supervisor Cochran opened the meeting at 7:30
P.M. with the Pledge of Allegiance led by Town Clerk Neville.

SUPERVISOR COCHRAN: May I have motion to approve the audit of bills for May 23, 2000?
Moved by Councilman Romanelli, seconded by Councilman Murphy, it was
RESOLVED that the following bills be and hereby are ordered paid: General Fund Whole

SUPERVISOR COCHRAN: Approval of the minutes of May 9, 2000.

RESOLVED that the minutes of the May 9, 2000, Town Board meeting be and hereby are
approved.

SUPERVISOR COCHRAN: Set the next regular Town Board meeting for Tuesday, June 6,

Moved by Councilman Murphy, seconded by councilman Richter, it was
RESOLVED that the next meeting of the Southold Town Board will be held at 4:30 P.M.,
Tuesday, June 6, 2000 at the Southold Town Hall, Southold, New York.

II. PUBLIC NOTICES.
SUPERVISOR COCHRAN: Public notices, we have different public notices. Does everyone
have a copy of the agenda? If not, they are in the back. I won't read through them. They are from
the Department of Transportation and Corp of Army Engineers. They notice us, and you have a
time frame to respond to any of these projects.
1. State of New York Department of Transportation Notice of 25 MPH school speed zone on
NYS Route 25 at Our Lady of Mercy Elementary School, Cutchogue.
2. U.S. Army Corps of Engineers, NY District, Notice of application of Edmund E. Zeneski to
place shellfish cages in Southold Bay, Shelter Island Sound, Town of Southold. Written
comments to be received by May 26, 2000.
3. U.S. Army Corps of Army Engineers, NY District, Notice of application of Kermit Johns
to install a pier and a set of steps to provide access to a boat in Haywaters Cove, Little
Peconic Bay, Cutchogue, Town of Southold. Written comments to be received by May 26,
2000.
4. New York State Department of Environmental Conservation Notice of Complete
Application of John and Joyce Holzapfel to begin a four year plan to attempt to eliminate
the Phragmites by cutting and spraying, then seeding and replanting the area with native
plant species in Major Pond, Major Pond Road, Orient, Town of Southold. Written
comments to be received by June 16, 2000.
5. State of New York Department of Transportation Notice of amending the existing "No Left
Turn" restriction at the Mattituck Shopping Center on Route 25 to permit left turns by
traffic from the west into the westernmost driveway at the shopping center.
III. COMMUNICATIONS.
SUPERVISOR COCHRAN: We had a letter from Larry Rappaport in relation to the local TV
access, a letter from Bill Higgins, Darlene Duffy is wonderful, one of our stafl~ It is a very nice
letter that the kind treatment he was given in the Assessors Office. We like to record these, and a
copy goes into an elected official or employee's file. A letter to Supervisor Cochran in relation to
Literacy Volunteers of America, as you know they did a presentation to the Town Board a
couple of weeks ago. I, also, had them on my TV show, and the exposure they felt was positive.
Had a letter from Christina Speiser, who is the Southold Mothers Club in relation to a thank you
for use of Town Hall. They had a meeting here. Also, a letter from Claire Bradley from the
Health Department in relation to the West Nile, I would like to share with you, the Vector
Control for Suffolk County, and the Health Department have been very, very good in relation to
notifying us when they are going to be spraying or putting larvicide down for the mosquitoes,
and this is the latest bulletin I go today, and they will begin to do aerial control of mosquito
larvae. Tomorrow if the weather is permitting, if not the shoot for the next day, because
residential and other populated areas will not be treated. Low drift applications techniques are
being used, and it is essentially non-toxic to humans. No special precautions are required on the

part of the general public, and there is a telephone number Vector Control 852-4270, if you have
any questions in relation to the demise of our mosquitoes. We also had a letter from the director
for The Way Back, Inc. a letter of appreciation in the treatment and the service they were
provided by the Southold Police Department. A letter to the Town Attorney, Greg Yakaboski,
from Abigail Wickham in relation to the Cutchogue Cemetery Association. A letter to myself in
regard to the Building Department and the Assessors, especially thanking Scott Russell, and then
we had a letter from Barbara Poliwoda, who is our American Heart Association lady in the town,
and it was a thank you to myself for help with the Heart Ball and Wine Auction.

IV. PUBLIC HEARING.
1. 8:00 P.M., on a proposed "Local Law in Relation to Parking on Hobart Road".
2. 8:02 P.M., on a proposed "Local Law in Relation to Parking on the Anchorage".
3. 8:05 P.M., on the purchase of parcels of Lappe (SCTM #1000-1000-4-2), South Harbor
Road, Southold, New York.
4. 8:07 P.M., on the purchase of the parcel of Caracciolo (SCTM #1000-100-4-2), Oregon
Road & Mill Lane, Mattituck.
5. 8:10 P.M., on the purchase of the parcels of Bedell (SCTM #1000-97-1-25.1, 1000-85-2-
20.2, and 1000-2-10.3), Main Road, Cutchogue.
V. RESOLUTIONS.
SUPERVISOR COCHRAN: As you know the Town Board has a policy that you are more than
welcome to address the Town Board at this time on any of the proposed resolutions. If it is not
on the proposed resolutions we do have a period at the end of the meeting that you may address
the Town Board on any given Town business. So, is there anyone that would like to address the
Board in relation to that of the resolutions? Mr. Williams?
JACK WILLIAMS: Jack Williams from East Marion with regard to resolution #27, do you
know how much the dollar figure is in connection with that, and also some indication of what
work has to be done?
JUSTICE EVANS: The number is $10,139.30.
SUPERVISOR COCHRAN: This was the borings that we hired H2M to do in relation to the
bridge. Okay? So, that we can evaluate our position.
JACK WILLIAMS: Now, I understand that there may be or is litigation in connection with this,
and will be an attempt by the town to recoup some of their expenses in connection with an earlier
version of the bridge. I was wondering if this cost, this $10,000 will be added to the amount that
the Town will attempt to recoup.
SUPERVISOR COCHRAN: We are investigating and gathering information at this point. Yes.
JACK WILLIAMS: Was the answer yes?
SUPERVISOR COCHRAN: Yes, we were investigating it at this point, and looking at all the
circumstances.
JACK WILLIAMS: Oh, I feel much better now.

SUPERVISOR COCHRAN: I am glad, Jack. If it goes into litigation that would be something
that may or may not be public information.
COUNCILMAN MOORE: That would be if we choose to sue.
SUPERVISOR COCHRAN: If we sue. We are looking right now.
COUNCILMAN ROMANELLI: Looking if we can recoup.
SUPERVISOR COCHRAN: Or if we can sue. Okay? We are evaluating all of that believe me.
Trust me, Jack. Anyone else like to address the Town Board on any of the printed resolutions?
(No response.) If not, we will begin the passage.
Moved by Councilman Richter, seconded by Justice Evans, it was
RESOLVED that the Town Board of the Town of Southold authorizes and directs Supervisor
Jean W. Cochran to execute an agreement between the Town of Southold and the County of
Suffolk for the 2000 Community Development Block Grant Program, subject to the approval of
the Town Attorney.

Romanelli, Councilman Moore, Justice Evans, Supervisor Cochran.
This resolution was duly ADOPTED.
Moved by Justice Evans, seconded by Councilman Murphy, it was
RESOLVED that the Town Board of the Town of Southold authorize Southold Town Beach
Attendants and beach managers to be supplied with a petty cash fund in the amount of $54.50
(20 singles, 2 rolls quarters, 2 rolls dimes, 2 rolls nickels, 1 roll pennies) per person, to enable
them to make change due to the tax that is charged for each permit. Check in the amount of
$436.00 to be made payable to Kenneth Reeves; said charge to be made to A210.Petty Cash.

RESOLVED that the Town Board of the Town of Southold authorize the issuance of free beach
parking permits to the following employees: Water Safety Instructors, Beach Attendants,
Lifeguards, Beach Managers, and Recreation Supervisor Ken Reeves.

This resolution was duly ADOPTED.
Moved by Councilman Romanelli, seconded by Councilman Murphy, it was
RESOLVED that the Town Board of the Town of Southold authorize a reimbursement fee of
$.30 per mile to Southold Town Beach Managers and Lifeguards acting as rotating lifeguards
(Lifeguards who drive from beach to beach giving other lifeguards a 15-25 minute break).

RESOLVED that the Town Board of the Town of Southold hereby authorizes Kathleen
DeSimone to take and transcribe minutes on a temporary basis for the Board of Assessment
Review, effective May 16, 2000, at her regular rate of pay. Said time to be charged to the Board
of Assessment 2000 budget.

RESOLVED that the Town Board of the Town of Southold hereby establishes European
American Bank, a state charted banking corporation, having an office at EAB Plaza, Uniondale,
New York 11555, as a depository for U.S. Department of Housing and Urban Development
(HUD) Block Grant funds for the Town of Southold's Home Improvement Program and
authorizes Supervisor Jean W. Cochran to sign an Agreement between the County of Suffolk,
European American Bank and the Town of Southold for the Home Improvement Program
account, subject to the approval of the Town Attorney.

recreation programs, all in accordance with the approval of the Town Attorney.

regarding the hourly rates of pay for Lifeguards, Beach Attendants, Water Safety Instructors,

Playground Instructors, Lifeguard Trainers and Beach Managers for 2000, 2001 and 2002
summer seasons.

RESOLVED that the Town Board of the Town of Southold hereby authorizes a change in title
for Corinne Bednoski from "Wastewater Treatment Plant Helper" to "Laborer" effective May
16, 2000. These are both labor class titles and there is no change in her current salary.

a part-time Detention Attendant effective Friday, May 12, 2000, at a salary rate of $10.63 per
hour. This is in addition to her part-time position as School Crossing Guard.

Supervisor Jean W. Cochran to execute an agreement between the Suffolk County Office for the
Aging and the Town of Southold, from the Supplemental Nutrition Assistance Program (SNAP),
for the period of April 2000 through March 31, 2001, at a total agreement cost not to exceed
$64,810.00, all in accordance with the approval of the Town Attorney.

RESOLVED that the Town Board of the Town of Southold hereby grants permission to
Detective Beth Dzenkowski to attend the New York State Police Juvenile Officers Association
as the Regional Representative of Suffolk and Nassau Counties, commencing Thursday June 1,
2000 and Friday, June 2, 2000 at Ithaca, New York. Meals and accommodations to be covered
by the Juvenile Officers Association. The only expenses incurred will include approximately
$40.00 for transportation costs, which shall be a legal charge to the Juvenile Aide 200 budget
line.

RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs
Supervisor Cochran to execute the covenants and restrictions required by the Suffolk County
Health Department related to an individual on-site private well for the Joyce P. Terry property of
which the Town of Southold owns the development rights on 28.65 acres.

RESOLVED that the Town Board of the Town of Southold hereby requests the New York State
Department of Transportation to conduct a traffic study for the purpose of lowering the speed
limit in the area of Rocky Point Road and connecting roads in the area in East Marion.

WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk
County, New York, on the 23rd day of May, 2000 a Local Law entitled, "A Local Law in
Relation to Adding a Stop Sign at "Seventh Street, Greenport": now, therefore, be it
RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the
aforesaid Local Law at the Southold Town Hall, 53095 Main Road, Southold, New York, on the
6th day of June, 2000, at 5:00 P.M., at which time all interested persons will be given an
opportunity to be heard.

for a public hearing on this Local Law, which reads as follows:

SUPERVISOR COCHRAN: I would just like to say that we had young people with us here
today, and we are trying to encourage if there is anyone out there in young adults, that would like
to have a position with the Town these are the four positions we are looking for. We do call
them student interns. We need two in the Receivers Office, which one of the benefits would be
that you would be able to work during Christmas holidays, or the holidays in addition to just
through the summer, because the need is there at that time of year also. In the Building
Department that is mostly clerical work, and Records Management is with our Town Clerk in
relation to what we call the vault and record room downstairs. We must need one more. Oh, the
Building Department.
COUNCILMAN MURPHY: I thought we had one in the Assessors Office.
SUPERVISOR COCHRAN: There is one missing, the Assessors, but I think we have had one
respond to that. But, encourage any young people if they haven't got a job for the summer yet to
come in, and either get the information from office or Betty, and we would like very much to
have some young people involved.

I. Purpose
The Town Board of the Town of Southold finds that with the increasing
development and population of the Town of Southold, transportation activities are
increasing and impacting the local streets. Regulation of truck usage on local
streets is necessary so as to provide for the safety and welfare of the Town's
citizens and for the orderly flow of vehicular and pedestrian traffic on busy local
streets. There are numerous other alternate local streets linking state and county
highways in the area.
II. Trucks, tractors, tractor-trailer combinations, tractor-semitrailer combinations, or
tractor-trailer-semitrailer combinations in excess of a registered weight of 10,000
pounds are prohibited from traveling upon the following streets. Such exclusion
shall not be construed to prevent the delivery or pickup of merchandise or other
property along the streets from which such vehicles or combinations are otherwise
excluded:

Gilroy, who is the Director of Franchise Management. He says, I would like to take this
opportunity to continue our ongoing discussions that pertain to Cablevision working with our
local community on public access studio based in the Town of Brookhaven, as well as increasing
public access along our cable system. As you are aware I am a longtime proponent of providing
the residents of the Town of Brookhaven and Long Island as a whole with more access to our
cable systems under the classification of public access. As you know from our numerous
discussion there are residents within the Town of Brookhaven that are deeply concerned over the
decision to close the cable studio formally located at the Cablevision complex near Port Jefferson
Station. This has placed a hardship upon many of residents, both disabled and otherwise, who
had enjoyed the opportunity to create their local shows from their hometown studios. I would
continue to encourage the possibility of Cablevision entering into a public-private partnership,
that would benefit our residents as well as the educational system here at Brookhaven in
engaging in the use of Suffolk Community College studio. In addition, over the course of last
week I have engaged in a dialogue with residents of the Town of Brookhaven and eastern
Suffolk County regarding the importance of making more channels available to the public for
local originating shows, that would allow the governmentally education and recreational
activities offered by the local municipalities. I leave this letter with you, and the other night I had
dinner with a friend of mine, who is a CEO for the National Public Relations, and he has decided
with the permission of the public access movement to pro bono. He feels that this is a national
problem, not only a local problem with Cablevision. I took the liberty of writing a cover letter. I
am not a writer, and of course sending them a package, and they will be doing this for us. I will
read some of the letter, which is very brief. Cablevision has tried to make the pubic access
stations in the townships of New York, New Jersey, and Connecticut unwitting accomplices in
its apparent violation of government and state regulations, principally the infringement and
denial of the First Amendment rights, Freedom of Speech. It is rumored that many cable
companies all over the country are pursuing this tact. Public access channels were granted to the
towns by the Government Communications Act of 1984 for community use, if taken back by
Cablevision it could mean billions of dollars for the cable companies. Cablevision recently tried
to install restrictive rules, policies, and procedures governing public access that would infringe
on the freedom of speech rights on the Town of Southold, New York. Cablevision tried to
circumvent the town's political board by sending the public access producers their
contracts/applications, and asking them to sign them under duress before approve or disapprove
of them, breaking the mutual agreement clause in the Town's franchising agreement with
Cablevision. When the representatives of the public access movement met with the Southold
Town Supervisor and attorneys they immediately saw the problem, and sent a cease and dismiss
letter to Cablevision. The Town of Southold held three hearings, and is at present negotiating
with Cablevision for a new franchise agreement, and has hired an independent consultant, who
attended these meetings. We feel that the carte blanche power given us by the government is in
the hands of the Town, which represents the people, not Cablevision. It is estimated that the
current subscribers fees that Cablevision now receives from the east end viewers are
approximately $5,000,000. a month. The Town has many options, the most powerful being that
if you get another cable provider. If they hadn't stopped Cablevision from installing these rules
and regulations they would have possible opened themselves for lawsuits from organizations
protecting the First Amendment rights. To take care of the fox running in the chicken coop the
Town should install public committees to establish it's own group of regulations leaving
Cablevision to only operate the station, not control it, or create rules and regulations limiting
viewing and production. Cablevision's rules and regulations, the public access moving fields are
in violation of the First Amendment, and the community spirit of public access broadcasting. The
public access movement attorneys currently have filed for federal injunction and lawsuits against

Cablevision's rules and regulations, and tactics, which they believe are in violation of State and
Federal Laws. Cablevision rents from the town. The towns do not rent from Cablevision. Public
access belongs to the towns not to Cablevision. Freedom of speech belongs to the people not
Cablevision. I will leave you copies of this.
SUPERVISOR COCHRAN: Thank you, Jay. Anyone else like to address the Town Board on
any Town business?
SID OLMSTED: Two items, one is I live very close to intersection of Route 48 and Westphalia,
and it seems unfortunate that there has got to be almost an accident there.
SUPERVISOR COCHRAN: There was another one yesterday as I went through.
SID OLMSTED: I heard it. We need a study. It is plain and simple. I mean, a couple of people
died at Wickham and 48, they put a light up there. There in 1973 was a terrible fiery death a man
and his son.
SUPERVISOR COCHRAn: We can request a traffic study. It will take a little bit. They are
backed up, but we can from my office send a letter.
SID OLMSTED: The other thing I am concerned about the Southold Town Board boat ramp,
public boat ramp.
SUPERVISOR COCHRAn: Up on that same corner?
SID OLMSTED: Almost the same corner, it is almost the same corner. It is closer to Love Lane.
This ramp was hodge-podge from the first day, and it is basically the wash from it is filling in the
little neck of the creek down there. I mean it is a tail end of the creek. It gets all the junk from
the station, all the junk that floats in, all the beer cans, and all that stufl~ and we all help to get,
can get, to keep it from getting filled up, and part of it is bubbling where the ramp is, and the
public needs access to that. The other day I took a picture of it. May I approach?
SUPERVISOR COCHRAN: Of course you may.
SID OLMSTED: I took a picture of it, and as you can see this is the area that is caved in, and
filling in. The reason that I took this picture when you were elected the first time about eight
years ago, somebody's name was crossed out, and it supposed to say whoever the Superintendent
is, Supervisor, and I waited until the last election. Nobody ever said anything, so maybe you are
ashamed of the place, so you never get out there and look.
SUPERVISOR COCHRAN: I would like to say that under that Board it says, Scott Harris, and
Mr. Wickham chose not to have it changed to his name, and I chose the same.
SID OLMSTED: It is a gift. It could be something to be proud of. Put your name on it.
SUPERVISOR COCHRAN: We are proud of all of our Town endeavors and properties. Now,
that you have asked I will put my name on it. I don't have to take ownership of something to do
the job, but this is the corner up at the corner of Westphalia and 48, and this is Town property.
Years ago there was a bridge that went over the creek, and it was filled in, and this land because
they filled in the creek belonged to the Trustees. The land still belongs to the Trustees. Up this
end is Park District property. As you know we have been studying and looking at Route 48.
Okay? And part of the recommendations was that this area along there become marine use. We
haven't done anything in that direction, but we will be looking at it soon, and studying it more in
depth, because at one point what I wanted to do with this is make it a roadside stop. We have no
place on the North Road for people traveling through to be able to stop and have a picnic lunch,
and the only one we have on the Main Road is Park District property, but it is used constantly
down in here in Triangle Park, so we are very aware of some of the needs that we do have as a
community, and we are working on them. Thank you. I'll put my name of them right now.
Anyone else have anything to address the Town Board? (No response.) If not, I would just like

to give a couple of quick informational type things. Number one, we as a Board have been
working very hard to try to beautify our beaches, and to beautify our community, and we have a
concern in this direction. It is kind of like going to Disney World. When something is neat and
tidy, and there aren't any papers on the ground you don't throw that piece of paper on the
ground, because you get a feeling of guilt, so it builds on itself when it is kept neat.
Superintendent of Highway, and the Highway Department is just constructing a new bathhouse
down at Klipp Park. Before it is even completed someone took cinder blocks and destroyed the
door. This cost money. It cost $50,000 to build a bathhouse at our beaches, and you have to have
them. It is mandated by the Health Department in order to be able to use the beach. So, I get a
little annoyed when my Highway Superintendent calls and says, Jean, I have had vandalism, not
over a weekend, a Monday and a Tuesday night. It was Klipp Park, and one of the other
beaches. We had vandalism at two of them. I would like to say, that if we catch the persons that
are doing this we will prosecute, you will end up in court, Mommy and Daddy is not going to
pay and bail you out, you will go before the Judge, and you will be given probably work
community work and service, and this isn't always a fun thing. So, I would like to say to these
people, and I am not saying young people purposely, because you don't know who did it, but I
would like to say that, please, we are trying very hard to improve your beaches, and your
community, and we would expect some cooperation. (tape change) You must display your
house numbers. This is for your benefit. It is not for ours. This was supposed to be in place by
January 1st, 2000. There are many homes out there that do not have house numbers. Southold
Fire Department alone answered over 500 calls this past year, ambulance, health, safety, and
welfare of people. We would appreciate putting your house numbers out, so that when the
emergency squad comes looking for you, or a loved one that has injured themselves or needs
medical attention immediately, that they can locate your house. Okay, it is not too much to ask.
Run down to the lumberyard, and buy some numbers. We would appreciate it. It will help your
Fire Department, and it will protect you. Okay? I am going to go real quickly with the Town
Board today. We were blessed with young people coming in, and representing the positions we
hold. My charge for the day was Kara Kramer. She served as Supervisor along with myself, and
each Board member can tell me who your charges were for the day. These are students from
Southold School, and we worked along with their government teacher, Dick Westgate, and the
students came in first thing this morning. They had their juice and bagels, and then we had pretty
good roundtable as to government how it functions, and then they sat through our Work Session
in relation to reports that we received on planning, and the water study that has just been
completed, and so forth, and then we did serve them lunch, and we did have the Baykeeper in
today, Kevin McAllister, and we gave them a full day of what is happening in the Town of
Southold. The other students, we had Bruce Volinski, who was the Town Assessor, and then we
had Steven Clacherty, Matt Sirlino, Melissa Surozenski, Greg Koller, Doug Kilfoil, Vanessa
Dayton, Amanda Dunne, and Danielle Masino, and these young people were Councilpeople for
the day, and they sat up here on the dais, and we sat down below on a Work Session, and I think
they gleaned a great deal out of it. We learned, and they learned, and in fact I have to go on the
air, WRIV, and do a safety message for the holiday coming up, so I asked them what they felt
would be part of the good message, and they gave me the don't drink and drive, and be smart,
and buckle up, and they gave me some pretty good things to say in a message, and one young
man says, finish it with, give a hoot, don't pollute Class of 2000. So we shall finish the ad on the
TV or the public announcement with give a hoot, don't pollute, class of 2000. So, all and all it
was a good day. I don't have anything else. Craig?
COUNCILMAN RICHTER: I just wanted to say I had Amanda and Danielle this morning, and
it was a pleasure to be with them, and visit the Police Station, and that was interesting, and I
would like to thank this gentleman for bringing that report.
