The following resolution was adopted by the Southold Town Planning Board at a
meeting on Monday, June 9, 1997:
BE IT RESOLVED that the Southold Town Planning Board authorize the
Chairman to endorse the final surveys dated August 26, 1996, Conditional final
approval was granted on May 12, 1997. All conditions have been fulfilled,
Enclosed please find a copy of the map which was endorsed by the Chairman,
The mylar maps, which were also endorsed by the Chairman, must be picked up
at this office and filed in the office of the County Clerk. Any plat not so filed or
recorded within sixty (60) days of the date of final approval, shall become null
and void.

DECLARAT I ON
THIS DECLARATION, made the .:b~y of May, 1997, by Ann Marie
Nelson, residing at Cherry Lane Farm, Ninth Street, Greenport, New York, hereinafter
referred to as the party of the first part, said party of the first part hereinafter referred to
as Declarant.
WITNESSETH
WHEREAS, the party of the first part is the owner of certain real property situate
at Greenport, Town of Southold, County of Suffolk, State of New York, more
particularly described as set forth on Schedule A annexed hereto, and ..
WHEREAS, the party of the first part has made application to the Planning
Board of the Town of Southold for approval to subdivide said real property described
on Schedule A into four lots, as shown on the subdivision map entitled "Ann Marie
Nelson" which map is dated August 26, 1997, prepared by Roderick Van Tuyl, P,C.
and intended to be filed in the Suffolk County Clerk's Office herewith, and

WHEREAS, for and in consideration of granting of said approval, the Planning
Board of the Town of Southold has deemed it to be for the best interests of the Town of
Southold and the owners and prospective owners of said lost that the within
covenants and restrictions be imposed on said lots, and as a condition of said
approval, said Planning Board has required that the within declaration be recorded in
the Suffolk Count Clerk's Office, and
WHEREAS, the Declarant has considered the foregoing and has determined
that the same will be in the best interest of the Declarant and sUbsequent owners of
said lots,
NOW, THEREFORE, THIS DECLARATION WITNESSETH:
That the Declarant, for the purposes of carrying out the intentions above
expressed, does hereby make known, admit, publish, covenant and agree that the

said premises herein described shall hereafter be subject to the following covenants
which shall run with the land and shall be binding upon all purchasers and holder of
said premises, their heirs, executors, legal representatives, distributees, successors
and assigns, to wit:
1. Clearing and cutting within the hundred foot
wetland buffer shall be limited to that necessary
for proper maintenance and removal of diseased,
decayed or dead material and obnoxious plant species, .-
Such clearing and cutting shall be subject to review by
the Board of Trustees of the Town of Southold prior to
clearing and cutting to insure proper maintenance
and preservation of the natural buffer.
2. An further subdivision of Lot No, 4 shall be processed as

a major subdivision by the Planning Board.
3. There shall be no further subdivision of Lot 1, Lot 2 or
Lot 3,
4, No new residential structure or sanitary disposal facility shall be
constructed or otherwise located within 1 00 feet of the adjacent
wetlands or of the Peconic Bay.
S, No stormwater runoff resulting from the development an
improvement of the subdivision or any of its lots shall be
discharged into the adjoining bodies of water or wetlands in and
bordering the parcel.

State Environmental Quality Review
( FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manne" whether a project
or action may be significant. The question of whether an action may be significant is not always easy to anSWer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically expert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action.
.. Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information "bout a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 an,d 3.
. Part 2: Focuses on identifying the range of possib'e impacts that may occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-

9. Are there any comments while the hearing is still open?
Pat Nelson: I'm her grandson. I have the receipts where I notified my
neighbors and the affidavit that I posted the sign, that Melissa told me I was
supposed to hand over. One person didn't answer back.
Mr. Orlowski: OK, Any other comments on this from anyone?
Darlene Duffy: My husband owns the property that abuts where the
subdivision is going to be, My only concern is, I have other neighbors, who,
their septic systems are leaching into that meadow. So, my concern is
where their septic systems are iocated? Is there any way you can force
them to hook into the Greenport sewer system?
Mr. Orlowski: That would be the Health Department.
Ms. Duffy: That's what everybody says to me. I don't care if they build the
house, that's fine, but we have a real leaching problem going into the
wetlands there and I'm trying to address it with neighbors on the other side
of the meadow, so we're just a little concerned about that, because I know
it's a Clay bank there. It's been an ongoing problem. I'll address it with the
Heaith Department.
Mr. Orlowski: ...any application for a building permit.
Mr, Nelson: I believe I can add to that, if you like, We had a soil test done
and there isn't any clay, it's silty loam down to 17 feet. The Greenport sewer
system runs down to Linnet 5t. There is a village moratorium on present day
sewer hook up, We have letters from the viliage that says when that
moratorium is lifted the people who buy the property wili have to hook up
the sewer system. All we're doing is selling unapproved lots. You can get
the sketch plans from the Health Department in Riverhead. And they have
them here too which have the outline of the septic systems on,

Environmental Quality R iew Act, (Article 8), Part 617, declared itself lead
agency and Issued a Negat e Declaration on January 29, 1996; and
WHEREAS, the Town's Engineerl Inspector has reviewed the site, and in a
report dated February 7, 1996, w 'ch was adopted by the Planning
Board, noted that any work require within the Town right-of-way necessary
to provide suitable access for indlvidu driveways will be the responsibility of

WHEREAS, a final pUblic hearing was closed said subdivision application at

The following took place at a meeting of the Southold Town Planning
Board on Monday, May 12, 1997:
The final public hearing, which was originally held on March 31, 1997, but
was re-advertised for May 12, 1997 due to incomplete notification of the
March 31 st hearing, was closed.
The following resolution was adopted:
WHEREAS, Ann Marie Nelson is the owner of the property known and
designated as SCTM# 1000-45-6-9, located on the west side of Ninth St. in
Greenport; and
WHEREAS, this proposed minor subdivision is for 4 lots on 12.1 acres; and
WHEREAS, the South old Town Planning Board, pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617, declared itself lead
agency and issued a Negative Declaration on January 29,1996; and
WHEREAS, the Town's Engineering Inspector has reviewed the site, and in a
report dated February 7, 1996, which was adopted by the Planning

Board, noted that any work required within the Town right-of-way
necessary to provide suitable access for individual driveways will be the
responsibility of the individual lot owners; and
WHEREAS, a final public hearing was closed on said subdivision application
at the Town Hall, Southold, New York on May 12, 1997; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58,
Notice of Public Hearing, has received affidavits that the applicant has
complied with the notification provisions; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town
of Southold will be met upon fulfillment of the conditions; be it therefore
RESOLVED, that the Southold Town Planning Board grant conditional final
approval on the surveys dated August 26, 1996, and authorize the
Chairman to endorse the final surveys subject to fulfillment of the
following conditions. All conditions must be met within six (6) months of
the date of this resolution:
1. The draft Declaration of Covenants and Restrictions containing the
requirements of the Planning Board, has been approved by the
Planning Board. The Declaration must be filed in the County Clerk's
Office and a copy of the recorded Declaration must be submitted
to this office. The liber and page number of the recorded
document must be noted on the final surveys.
2. Five (5) paper prints and two (2) mylars of the final map, all
containing a valid stamp of Health Department approval and the
liber and page number of the recorded Declaration of Covenants
and Restrictions must be submitted.
3. The park and playground fee in the amount of $6,000.00 ($2000 per
vacant lot) must be submitted.

residing at Cherry Lane Farm. Ninth Street, Greenport. New York, for the purpose of
amending/modifYing certain Declaration of Covenants and Restrtction:; entf~red into by
the DECLARANT, or her predecessor-in-Interest, on the 27th day of June 1996, and
recorded on the 20th day of August. 1996. In the Office of the Clerk of tM County of
SuffolK at liber 11788. at page 285 Said Cecla'ratlon Of Covenants and Restrictions
burdened the PREMISES descrloed in Schedule "A" attached hereto; and.
WHEREAS, said Declarations of Covenants and Restrictions ~.et forth in
paragraph seven as followS:
"These covenants and restrictions shall run with the land
and shall be binding upon the DECLARANT, its successors
and assigns, and upon all persons or entities claiming under
them. and my be terminated. revoked or amended only

agree to amend/modify the above-mentioned restrictive covenants: and
WHEREAS, the DECLARANT represents and warrants that she has not offered
or given any gratuity to any official. employee, or agent of Suffolk County, New York
State, or of any political party, with the purpose or intent of securing: favorable
treatment with respect to the performance of an agreement, and that such person has
read and IS familiar with the provisions of Local Law #32- 1980
NOW. THEREFORE, it is mutually agreed as follows:
1. The PREMISES are hereby released from the restrictive
covenants contained In the agreements above referred to. and the parties hereto
release each of the other parties, their dlstributees, heirs, successors and assigns

Statemenl of Problem
A communiey-type water supply and sewage syslem is required when a realey subdivi:;ion or
development is located within or is reasonably accessible to an existing water/sewage districr
or service area in accordance wirh the requirements of Anicle 6. The applicant is reqllesring
relief from rhese requiremenrs.
Findinlls and Facts
1. Proposed development of a 12.1 acre parcel inro four lots of 7,2 acres wirh existing
dwellings; 74,000 $,f., 70,000 s.f. and 68.000 s.f.lols to be developed. Total project
area is 12,1 acres,
2, The variance request is to permit the use of lemporary on-site sanirary systems on the
three notthem subdivision 101S (#1, #2 and #3). Public warer will be provided 10 these
lors. In addilion the applicant is requesring a variance for the 7.2 acre lot (lil4) which
would not require hook-up to the sewer system and nOI require public water ex':ension to
all the associated building sttUcNres on the parcel. Presently public water is provided
to the main house. garage apartment and coltage,
3. A public water main is available on Ninth Street. TheIl! is also a sewer line on Ninth
Street which terminates at Linnell SUCCI.
4. The Village of Greenpon' s Wastewater Treaanem Plant is presently restricted from
a~~epting additional =tomers \lfui! it is upgraded 10 meet New York Slate Department of
Environmental Conservation requirements.

I reviewed the final maps you submitted this morning. Please note the
following outstanding items:
1. The Planning Board's ,December 11, 1995, sketch approval required
a) that the wetland area and upland area for each lot be
indicated on the final map; and
b) a 75 foot wetland buffer adjacent to all wetland areas.
At the conclusion of the environmental review, the Planning
Board expanded the 75 foot wetland buffer to 100 feet as noted
in the Board's letter of January 30, 1996.
Neither of the above conditions are shown on the final map.
2. During the subdivision review, the Planning Board required that
certain covenants and restrictions be contained in a Draft
Declaration of Covenants and Restrictions. The draft must be
submitted for Planning Board review.
3. The final maps must contain a notation that covenants and
restrictions, as required by the Planning Board, have been recorded
in the County Clerk's Office. Prior to any endorsement of the final
map by the Planning Board Chairman, the Iiber and page number of
the recorded document must be noted on the map. .-.-

After the final maps are revised as noted above, you must submit two
mylars and five paper prints of the final maps. All maps must contain a
valid stamp of approval from the Health Dep,artment.
The final public hearing will be scheduled upon receipt of the above

As per' your request, I have reviewed the Sketch Plan for the above referenced
minor subdivision. I have also reviewed the proposed subdivision with Mr. Jacobs. The
impact that this subdivision would have on' the existing drainage in the area and site
conditions along ninth street would be minimal.
A field inspection of the project location indicated that the adjacent pavement of
~nth street does not meet the minimum width requirements of the Highway Specifications.
ue to the fact that this is a minor subdivision, I would not recommend the applicant be
required to widen the road. But, any additional work required within the Town Right-of-Way
to provide suitable access for individual driveways should be made the responsibility of the
individual lot owners.
I would also suggest that the local fire commissioners be requested to verify the
q,uantity and locations of existing fire hydrants in the area. If an additional hydrant is
required, it could be connected to the existing water main on ninth street.

Reasons Supporting This Detennination:
An Environmental Assessment Form has been submitted and reviewed,
and it was determined that no significant adverse effects to the
environment were likely to occur should the project be implemented
as planned.
The Department of Health Services has reviewed the Planning Board's
lead agency coordination and has no objection to the Planning Board's
designation as lead agency. The applicant must comply with the
requirements of the Suffolk County Sanitary Code and relevant
construction standards for water supply and sewage disposal.
There has not been any correspondence received from the New York State
Department of Environmental Conservation in the allotted time.
Therefore, it is assumed that there are no comments or objections
from that agency.
The proposed project is consistent with land use in the surrounding area,
and lot sizes are significantly in excess of lots in the surrounding neighbor-
hood. The density of development is consistent with Suffolk County
Sanitary Code Article 6 for use of on-site sanitary systems. Subsoils are
conducive to sanitary and drainage leaching facilities as evidenced by an on
site test hole. Since the building sites are relatively flat, there are no
significant topographic impacts or erosion potential expected. Though there
are wetlands on site, the depth of lots provides more than adequate area for
location of dwellings consistent with wetland setbacks. A 1 00 foot setback
from wetlands will be provided to ensure that land use does not impact
wetlands.
The addition of three additional homes on Ninth Street is not expected to
overburden transportation systems, nor is the addition of three additional
residential units and families expected to cause a significant impact on
community services, character, local demography or other human re-
sources. The site use is consistent with the residential character of the
area, therefore, no significant visual impact is expected.

size, located to the west end of Ninth Street fronting Peconic Bay. The site includes an
existing house \vith a numb.:r of sheds and garages. There is a boat basin in the southwest
comer of the site, 'Mth wetlands adjacent to and within the subject property along the west
side of the site. The property extends north to the Long Island Railroad.

The main house and appurtenances are located at the southern end of the site.
This area is not proposed to be changed as a result of the proposed project. The northern
half of the site is proposed to be subdivided into lhree lots, for a total of [Clur lots
including the remaining 7.2 acres which would be associated with the exis;;jng home and
improvements. Proposed lots would be 74,000 sq. ft., 70,000 sq. ft. and 68,000 sq. ft.
from north to south. Each lot would have 155 feet of frontage and would be between 515
and 5ig feet in depth. Lots are proposed to be serviced by a public water main existing
along Ninth Street. Each lot is proposed to utilize an individual on site 5a!:utary system.

building envelop for each lot consistent with Town Zoning. A hypothetical house

Inspection of the parcel finds high marsh tidal wetlands on the west part of the site, These
wetlands exhibit man-rrwie influence in the foml of mosquito ditches to avoid stagnation
which promotes mosquito breeding. An active osprey nest was observedotfthe site along
the beach front to the west, and several species of wild ducks were observed in association
with wetlands west of the site. The man-made and bulkheaded basin on the sOuth part of
the s!te provides navigable water access to Peconic Bay from within the site. The upland
portion of the west side of the site is comprised of a low bank that is vegetated in
primlui1y briar understory, and primarily oak tree species. The area at the $lJuth part of
the site comprising Lot 4 is primarily landscaped and lawn area in and around the
buildings, with driveway access and paths between sheds, buildings, etc. North of this
area appears to have been primarily cleared area with fruit trees associated ,..nth the old
fann; At present this area is characteristic of overgrown field, 1uniper and ornamental
evergreen '/egetacion is present along the road and within the site, and there is a row of
old fruit trees running north-south, west of the street. There are also severnl north-south
running fences within this portion of the property. The nonh central part of the. site is old
fieldwith pioneer species of vegetation colonizing. Locust saplings, grasses and several
clusters of juniper dominate this area. The field opens to grassland further west. Between
the [ow bani, that descends to wetlands and the open grasslands is a north-!outh running
dirt j'oad, used to traverse the property. The east side of this road is lined v..;th oak trees.
Ther,e lS a small cinder block shed at the extreme north end of the property adjacent the
railroad.
The surrounding area consists of residential neighborhoods east of the site, Peconic Bay
south of the site, wetlands west of the site, and the LrRR tracks north oftbe site beyond
which is high density housing. .
The proposed project is consistent with land use in the surrounding area, _and lot sizes are
si~.ticantly in excess of lots in the surrounding neighborhood. The density of
development is consistent ,..nth Suffolk County Sanitary Code Article 6 for use of on-site
saniiary systems. Subsoils are conducive to sanitary and drainage leaching facilitieS as
evid~nced by an on site test hole. Since the building sites are relatively flat, there are no

Pursuant to Sections A14-24, Article XIV of Suffolk County Administrative Code
WHEREAS, pursuant to Sections A14-24, Article XIV of the Suffolk County Administrative
Code, a referral was received by the Suffolk County Planning Commission on
December 14, 1995, with respect to a proposed plat entitled, "Minor Subdivision -

RESOLVED, That the Suffolk County Planning Commission hereby approves and adopts
the report as modified of its staff as the report of the Commission, Be It Further
RESOLVED, That said proposed plat is approved subject to the following conditions:
1. Lots 1, 2 and 3 are considerably larger than that required by the zoning
classification of this property. Therefore, these lots shall be made subject to a
covenant that will prohibit future subdivision.
2. Since passing trains can result in noise levels of 70-75 dBA, or greater, within a
residential structure and since such noise levels can awaken adults, disturb babies,
and interrupt normal activity, "
a) The residential structure on lot 4 shall be setback from the railroad right-of-
way the maximum distance possible;
b) a buffer having a minimum width of 50 feet shall be established along the

above referenced project. Included with the correspondence is the Full EAF completed by the
project applicant, the subdivi::ion sketch plan and the Planning Board resolution dated December
II, 1995. At this time we have completed the following selVices with regard to this project.
1. Review of Full EAF
The Full EAF submitted by the project applicant has been reviewed. Please note
that the EAF was incomplete as submitted. We have reviewed the EAF against our office
literature, field inspection and the proposed project plan. Attached, please find the
"marked up" EAF providing appropriate information and corrections as necessary.
2. Field Inspection and Project Review
CV A inspected the subject site on January 18, 1996. There was light snow 'cover
on the ground at the time of inspection. The subject site is an existing estate, 12.1 acres in
size, located to the west end of Ninth Street fronting Peconic Bay. The site includes an

Pursuant to Sections AI4-24, Article XIV of Suffolk County Administrative Code
WHEREAS, pursuant to Sections AI4-24, Article XIV of the Suffolk County Administrative
Code, a referral was received by the Suffolk County Planning Commission on
December 14, 1995, with respect to a proposed plat entitled, "Minor Subdivision-
Ann Marie Nelson", submitted by the Town of Southold Planning Board affecting
premises located on the westerly side of 9th Street, opposite Brown Street,
Greenport, and
WHEREAS, said referral was considered by the Suffolk County Planning Commission at its
meeting on January 3,1996, and
WHEREAS, the Commission has voted to approve with certain changes said referral, Be It
Therefore
RESOLVED, That the Suffolk County Planning Commission hereby approves and adopts
the report as modified of its staff as the report of the Commission, Be It Further
RESOLVED, That said proposed plat is approved subject to the following conditions:
1. Lots 1, 2 and 3 are considerably larger than that required by the zoning
classification of this property. Therefore, these lots shall be made subject to a
covenant that will prohibit future subdivision.
2. Since passing trains can result in noise levels of 70-75 dBA, or greater, within a
residential structure and since such noise levels can awaken adults, disturb babies,
and interrupt normal activity,
a) The residential structure on lot 4 shall be setback from the railroad right-of-
way the maximum distance possible;
b) a buffer having a minimum width of 50 feet shall be established along the
railroad right-of-way and the natural vegetation within the buffer shall be
retained and supplemented with suitable indigenous plant materials where
necessary .
3. No new residential structure or sanitary disposal facility shall be constructed or
otherwise located within 100 feet of the adjacent wetlands or Peconic Bay.

4. No stormwater runoff resulting from the development and improvement of the
subdivision or any of its lots shall be discharged into the adjoining bodies of water
or wetlands in and bordering the parcel.
5. Conditional approval of this subdivision does not in any way imply approval of

The Suffolk County Department of Health Services (SCDHS; "Department") has received
your letter dated, 1995, concerning the above-referenced project. The Department has no
objection to your designation as lead agency.
Based on a review of the subject coordination, the Department offers the following
comments. These comments should not be construed as an implicit SCDHS approval or
rejection of the project. All applications are reviewed thoroughly with respect to Suffolk County
Sanitary Code (SCSe) concerns by appropriate departmental personnel when SCDHS
applications are completed.
Article 6 Application Status:
An application for this proposed four lot subdivision was deemed incomplete on 9/19195
pending submission of additional technical information, permits/revisions, including: test hole
data, neighboring well and septic locations, revised plans, NYSDEC tidal wetlands permit and a
SEQRA determination letter from the Town of Southold.
The applicant must comply with the requirements of the Suffolk County Sanitary Code and
relevant construction standards for water supply and sewage disposal. Design and flow

The following resolutions were duly adopted by the Southold Town Planning
Board at a meeting held on Monday, December 11, 1995:
BE IT RESOLVED that the Southold Town Planning Board start the lead
agency coordination process on this Type 1 action. The subject property is
classified as a Type 1 action since it is located within 500 feet of a Critical
Environmental Area (Peconic Bay).
BE IT RESOLVED that the Southold Town Planning Board grant sketch
approval on the map dated December 31, 1994 with the following conditions.
1. The following must be shown on the final map:
a) the wetland area and upland area for each lot;
b) a 75 foot wetland buffer adjacent to all wetland areas.
2. The following terms shall apply to the 75 foot wetland buffer: ~
Clearing and cutting within this area shall be limited to that necessary
for proper maintenance and removal of diseased, decayed or dead
material and obnoxious plant species. Such clearing and cutting shall
be subject to review by the Board of Trustees of the Town of Southold

prior to clearing and cutting to insure proper maintenance and preser-
vation of the natural buffer.
3. Pre-certificates of Occupancy will be required to certify the pre-existence
of all dwellings on proposed Lot NO.4. There shall be no more than one
year round dwelling unit allowed on Lot NO.4.
4. Any further subdivision of Lot No. 4 shall be processed as a major sub-
division by the Planning Board.
Conditions 2, 3 & 4 must be incorporated into a Dedication of Covenants and
Restrictions in proper legal form. A copy of the draft Declaration of Covenants
and Restrictions must be submitted to the Planning Board office for review by
the Planning Board and the Town Attorney. Once the document is approved, it
must be filed in the Office of the County Clerk prior to any endorsement of the
map by the Chairman.
Sketch plan approval is conditional upon submission of final maps within six
months of the date of sketch approval, unless an extension of time is requested
by the applicant, and granted by the Planning Board. The final maps, 2 mylars
and 5 paper prints, must contain a current stamp of Health Department
approval, and must be submitted before a final public hearing will be set.
The sketch plans have been referred to the Suffolk County Planning
Commission (SCPC) for review. The Planning Board may require additional
covenants and restrictions upon review of the SCPC report and review of the
final maps. Therefore, it is not necessary to prepare the draft Declaration of
Covenants and Restriction at this time.
The sketch plans have also been referred to the Greenport Fire District for their
recommendation as to whether a firewell is necessary for fire protection. You
will be notified under separate cover if the Planning Board will be requiring a
firewell as part of any subdivision approval.
The Long Environmental Assessment Form has been forwarded to the Board's
environmental consultant for review. There is a $400 fee for this review. This
must be paid in full before authorization can be given to the consultant to
proceed with the review. The check should be made payable to the Town of
Southold.

The Planning Board has reviewed the property and has decided that it is
inadequate in size for a reservation of land for park and playground use.
Therefore, a cash payment in lieu of land reservation will be required as per
Section A 106-38 (E) of the Town Code. The amount to be deposited with the
Town Board shall be $6,000.00 (two thousand dollars per lot for each vacant lot
in the subdivision.) Payment is required prior to any final endorsement of the
subdivision.

As per our telephone conversation of this morning, I have listed the fees
which will be required for your proposed subdivision below.
The application will remain incomplete until the application fee is
submitted. The application fee for minor subdivisions is calculated by the
number of lots in the total subdivision. Your proposed subdivision is for
a total of four (4) lots. Therefore a $3,000.00 application fee is
required ($1,000.00 plus $500.00 per lot),
Once the Planning Board receives a complete application. the environmental
review will be conducted. The Planning Board will be referring the Long
Environmental Assessment Form, which was submitted with your application
materials, to an environmental consultant for review, There is a $400.00
fee required for this review,
When land is subdivided, land for park and recreation purposes must be
designated within the subdivision. Where the Planning Board deems that a
reservation of land would be inadequate in size for park or playground
use (which is likely in your proposed subdivision), the Planning Board
may waive the requirement for such reservations, with the condition that
the applicant deposit with the Town Board a cash payment in lieu of land
reservation. The amount required is two thousand dollars ($2,000.00) per
lot for each vacant lot in the subdivision. Therefore, a payment of six
thousand dollars ($6,000.00) will be required prior to any final approval
of your proposed subdivision,

The fees mentioned above are those required by the Planning Board.
There are other costs associated with the subdivision process that are not
directly associated with the Planning Board. I have listed those that come
to mind below:
1. Surveyor's charge for making changes/additions to the survey.
2, Cost to prepare and record Declaration of Covenants and
Restrictions. if such is required by the Planning Board or the
Suffolk County Planning Commission.
3. Subdivision improvements (for example street trees or drainage
improvements) if such are required by the Planning Board during
subdivision review. The improvements must be completed prior to any
endorsement of the final subdivision or a performance guarantee for
the improvements must be submitted.
IJ. The Planning Board will be referring the proposal to the Suffolk
County Planning Commission (SCPC) for review. The SCPC will
contact you if a review fee is required.
5. All approved subdivisions must be recorded in the Suffolk County
Clerk's Office. There is a filing fee for recording subdivisions.
6. Fees associated with obtaining approvals from the Suffolk County
Health Department and the Village of Creenport for water supply and
sewage disposal.
