File No. R-6149 Dear Sue: With reference to the above matter and pursuant to my meeting with Henry Raynor on September 28 , 1982, I have enclosed herewith a copy of a portion of the Southold Town zoning map depicting the subject parcel of approximately 18 .7 acres lying to the west of Gull Pond Road. Inasmuchas Henry Raynor indicates that there have been several subdivision applications for this parcel in the past, all of which were apparently turned down, at least in part, because of the "un- buildable" area on the northerly portion of the property, I would appreciate it if you would please forward me copies of those appli- cations and the decision or other indication from the planning board as to the reason for the denial and/or the comments relating to the "unbuildable" area. If this requested material is too extensive it would be just as satisfactory if you could have it all together and I would come down to your office to go over it there. Thank you very much. I was distressed to learn that the bond had not been placed on the town board's calendar for May 8th and would not appear on that board' s calendar until May 22 , 1984, I do not know the purpose of waiting for the approval of the bond until the board votes on the resolution approving the subdivision. 2iay I suggest that conditional approval be given to this sub- division based upon the approval of the performance bond estimate by the Town Board and, further, the submission of the bond within thirty (30) days of that approval by the applicant, If in fact the Town Board does not approve the bond, which. is unlikely since it is the Town Engineer who prepares the esti- mate, then the Planning Board's approval of the subdivision would be of no effect and, likewise, failure to submit the performance bond within the time period set in the resolution would nullify the resolution, Thank you for your continuing consideration and cooperation. Dear Mr. Raynor: The Suffolk County Planning Commission at its regular meeting on February 1, 1984, reviewed the proposed subdivison plat entitled, "Minor Subdivision - Leon Marcus", referred to it pursuant to Section 1333 of the Suffolk County Charter. After due study and deliberation it resolved to disapprove said map for the follow- ing six reasons: 1. This subdivision constitutes a major subdivision as five lots are being created. The map title does not indicate that this subdivi- sion is Section 1 nor does the key map indicate the tract is to be filed with the County Clerk in sections. 1 -11 2.) No information was provided to show that the subdivider will, in , fact, offer the property indicated as "Section Two" to the Nature Conservancy and that that organization is willing to accept the parcel. Should The Nature Conservancy not accept the parcel the County of Suffolk could become the owner of the parcel through non- payment of taxes which will place the burden of paying the taxes on the County. Also, if the land is not transferred as proposed it may be built upon as a building lot again, the fifth lot of what is actually a major subdivision. (D3 The building envelope on Lot 2 is only setback 75 feet from the shoreline. The Commission's requirement, for many years, has been 100 feet from the upland edge of tidal wetlands on the property. J /(2 v-F A6>1s 4. The lot configuration of Lots 1 and 2 are considered to be poor and lacking in potential for enhancing residential amenities. 5. No attempt has been made to eliminate the landlocked adjacent lots that the subdivider also owns which could possibly be done at this time. Raynor, Jr. - 2 - February 3, 1984 Re: Minor Subdivision - Leon Marcus ----------------------------------------------------------------------------- 6. The subdivider owns three adjacent parcels, all of which may have been at one time part of the same tract. If these parcels were created since 1970 the creation of these lots may be procedurally defective as there is no record of the subdivision having been sub- mitted to the Commission in accordance with Suffolk County Charter requirements. Marcus Dear Mr. Gillispie: As per our meeting of November 30, 1982 relative to the above captioned property, a thorough review was made of the files and records within our office and that of the Zoning Board of Appeals . It appears that informal discussions were held con- cerning this property and apparently withdrawn before official submission to the Planning Board. Very truly yours, HENRY E.
