Dear Dear Mr. Tommasini:
The Planning Board has discussed this proposed
major subdivision and requests the following changes:
1. There is no access to the Sound; the road
must extend to Sound 'bluff.
2. There is insufficient frontage on lots on
Sound bluff; must be 135 feet.
3. Park and playground area must be provided.
4. Profile and topographical maps must be
submitted.

Dear Mr. Price:
The following action was taken by the Southold Town Planning
Board, Monday, November 24, 1986.
RESOLVED that the Southold Town Planning Board accept
the profile submitted by Inspector John W. Davis for the access
road within the minor subdivision formally of Frank Stillo,
now owned by BLBD Enterprises located at Orient.
The Board also recommended that excavating be done between
the stockpiles to provide leaching areas.
Enclosed is a copy of the profile for your review.

Dear Mr. patouris:
In regard to your inquiry about the above mentioned
subdivision, I hope you find the following information helpful.
l. The map was endorsed by the Planning Board Chairman. on
November 29, 1972. A copy of this map is enclosed.
2. On June 23, 1986, the Planning Board approved an
amended survey which deleted the proposed strip
entitled "Reserved for Possible Highway Dedication." A
copy of the minutes from this meeting is enclosed.
3. At a meeting held on August 10, 1987, the Planning
Board accepted the final inspection report, approving
the access road. A copy of this resolution is also
enclosed.
The Planning Board can not guarantee that the particular
lot in question is buildable until an approval from the Health
Department and a permit from the Southold Building Department
are obtained.

of a subdivision plat entitled "Sunbow Associates" located
at Mattituck (tax map no. 1000-122-6-29) was submitted to the
PLanning Board on September 4, 1985 and, filing fee was paid
on September 4, 1985, and
WHEREAS, a public hearing was held on said subdivision appltcatiop
and plat at the Town Hall, Southold, New York, on Monday,
June 9, 1986 at 8:00p.m., and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said subdivision plat
and aplication,
NOW, therefore, be it RESOLVED that the application of "Sunbow
Associates" for approval of said subdivision plat prepared
by Rod Van Tuyl dated as amended February 21, 1986 be approv~d
and the Chairman be authorized to endorse approval on said
subdivision plat, subject to the following conditions which.
must be completed within 6 months from the date of this reso~ution:
1. No lot shall be subdivided or its lot lines changed
in any manner at any future dated unless authorized by the
Town of Southold Planning Board.

located at Orient.
Comments:
A. Foster called me on 10/31/86 to inquire about leaching basins
at the above project. At that time I founld that he had been
working on the access road - did not adviseffie when he had started.
On 11/1/86 I met R. Foster at his field office and gave him
copies of my reports Nos. 412 and 493 and also copy of Planning
Board letter to P.J. Cardinale (4/15/86) re: notification when
work is to be started. Foster said he would get a profile.
I inspected the site on 11/3/86. Topsoil has been stripped
and bankrun brought in and stockpiled in the R,O.W. Van Tuyl
has staked out the 30 ft. R.O.W. There were no grade stakes
as no profile was submitted as requested by the Planning Board.

Re: Access road in Minor Subdivisions at Orient - formerly owned
by Frank Stillo and Peter Sledjeski - now owned by Bennett Brokaw

Comments:
This subdivision will require remediable work. There was no notification
of starting road work, not enough topsoil was removed and no road pro-
file was submitted. Bankrun material was brought in and placed on the
partially stripped road area in stockpiles. The 30 ft. R.O.W. had been
staked out by Van Tuyl. Holes were excavated between the piles with
a backhoe and backfilled with bankrun to provide drainage under the road.
There was no inspection on this operation - no notice from the road
contractor when the work was to be done - information re holes and back-
fill from A, Foster.
Was contacted by J. Geideman who had prepared a road profile for the
access road and requested that I meet him on the site to go over same.
6/12/87: Meeting on the site, Present: B. Brokaw, A. Foster, J. Geideman
and J. Davis. The following was agreed upon:
I. Clear the R,O.W. and level the piles so that Geideman can stake or
restake the road profile which is approved. Stakes to be on a 15 ft.
offset.
2. The 2 L.B.'s shown at 0+05! on the profile were set at 0+40! according
to Foster due to interference with Lilco installations and the fence.
Provided the profile can be properly adjusted to a minus grade from
the State R.O,W. to the present location of the L,B.'s and meeting
the plus grade, the structures could remain. If not, they should
be removed and installed where shown on the profile stationing !.
Locations on sides of the R.O.W. would be acceptable.
L.B,'s at Sta 5+00 have not been installed.
The owner has received the State permit for the access road entrance
which includes an asphalt apron and concrete curb returns.

would be needed on the Sledjeski right-of-way. This
information would be required prior to beginning

It has come to our attention that Mr. Mohring also

I am one of the owners of the subject minor subdivision.
Most of the property is held in the name of BLBD Enterprises.
Noted only on the map in the Planning Board file is an area
designated "Reserved for possible future highway". That notation
appears to have been hand-written on the map. It cannot be as-
certained whether the notation was placed on the map before or
after the approval of the minor subdivision. I am enclosing a
copy of a portion of the approved map showing the area in ques-
tion. By this letter I am requesting that the Planning Board
adopt a resolution in respect to the subject minor subdivision
deleting the area designated as "Reserved for possible future
highway" as part of the approved map. My reason for the request
is economic but I believe that the Board should adopt the resolu-
tion based upon planning considerations.
It is my understanding that during 1972 when this map was
approved that an additional east/west highway was considered for
Orient to join developments in that hamlet. During this time pe-
riod Orient-By-The-Sea was either before the Board or had been
approved and development started. Other areas adjoining or in
the vicinity of Petty's Bight were being developed or were under
consideration for development. The joining of such developments
by the use of an east/west road in close proximity to the sound
bank is no longer a viable plan. The inadvisability of an addi-
tional east/west road in this vicinity is confirmed by its dele-
tion from the revised updated master plan. I have also received
information from an engineer and an official with DEC, in the
past before I had anything to do with this property, that the
reason Petty's Bight exists is because the soil and beach compo-
sition in that area is different than the rest of the shoreline

and is more susceptible to erosion from tidal action. Therefore,
a road in close proximity to the sound bank would not be a good
idea.
I also point out to the Board that there is a serious ques-
tion as to whether or not this reservation is valid. There were
no declarations, covenants or restrictions recorded with the Suf-
folk County Clerk in respect to this minor subdivision and the
map itself was not filed with the Suffolk County Clerk. As this
Board is aware without a recording or filing with the County
Clerk there is no record notice to the world of the reservation.
When we purchased the property we received vacant land certifi-
cates of occupancy for each of the lots but had no notice of the
reservation.
As I stated above, my reason for this request is economic.
We have been under contract to sell the property for approxi-
mately four months. The closing was scheduled for April 29,
1986. At the time of the closing the attorney for the purchaser
first brought up the issue of the reservation and his client has
refused to proceed with the transaction until the reservation is
deleted. While I believe the purchaser and purchaser's attorney
are wrong in assuming the unrecorded reservation renders title
unmarketable, expediency dictates that I make this request to the
Board as opposed to involving the parties to the transaction and
the Town in the Supreme Court in an action for a Declaratory
Judgment.
I would truly appreciate the Board's timely action on this
matter. Thank you for your courtesy and cooperation in this
matter.

of the Stillo property' in a straight line from Lot No.5 to the Sound.
'!he 30 ft. R.O.W. as shown appears to follow the farm road through Lots No. 5,h
and 3. '!he R.O.W. after a right and left turn ccntinues to the Sound in a
different location. '!he R.O.W. is in open farm land throughout. A test hole
by Van 'Illyl indicates 2 ft. of topsoil. A test hole by ~e1f in the R.O.W.
showed topsoil about 1 ft.~ . '!his report COVllrs the Stillo property' only. '!here is an adjacent subdiViSion

1. I do not see the necessity' of a road between Lots No. 1 and No.2. A road length

h. Replace topsoil excavation With a good grade of clean fill to bring the road up
to original grade.

The Planning Board discussed the proposed minor subdivision 1

3ide of Main (State) Road, Orient, N.Y. The Supt. of Highways ,
~as advised that Larry Tuthill has suggested that the connecting
:oads be built according to Town Specifications. The Supt. of
1ighways stated that he will recommend 50 ft. connecting roads
,ara1lel to the Sound, to be built to Town Specifications, and
set back to connect to other subdivisions in the area. Mr. Dean
CO send recommendation to the Planning Board to the foregoing
':lffect.

The Planning Board and the Superintendent of Highways
liscussed the proposed major subdivision of Richard Younq.
located at north side of Eugene's Road, Cutchogue, New York.
1r. Dean reported that Mr. Young was in to see him; Mr. Dean
3aid that Mr. Young told him that he plans tO,sell the east-
~rly parcel (outside of the subdivision) to the adjoining
)roperty owner, Mike Shepish. The Chairman stated that if he
LS going to sell this parcel to Mike Shepish, he must make a
leal with him for another access road either on Bay Avenue
,r Eugene's Road. After further discussion, it was decided
~hat the best location for another access road would be on
3ugene's Road, to be located between lots 14 & 15, and 21 &
22, immediately east of the little house outside the subdivision.
1r. Dean to send in his recommendations on this subdivision.

A lengthly discussion was held by the Planning Board
and the Supt. of Highways in regard to new highway speci-
fications. The Chairman read Mr. Dean's recommendations
as dated February 4th; and the Planning Board's letter of
February 8th containing their recommendations and additions
for revisions. Mr. Dean stated that he doesn't approve of
minor subdivisions. He said that developers should not be
allowed to run a dirt road through 4 or 5 lots, they should
be required to construct town roads. The Planning Board was
also of the opinion that town roads should be required in
minor subdivisions, except in real hardship cases. The
Chairman stated that he also feels that we are getting too
many minor subdivisions, but by the same token it is better
to have minor subdivisions, than to build on the road frontage
and leave the interior property vacant. The Chairman suggested
that we require any road in a minor subdivision which is 500 ft.

Dear Mr. Wickham:
We have received your letter of August 23, 1972, with the _p of the sub-
division for Frank Stillo, Orient, N.Y.
Since this _p contains 5 lots, we IIIllSt consider it as a regular subdivi-
sion under proviSions of the public health laws and our own sanitary code. We
therefore are returning the map and check to you as this does not represent a
full submission. To process this _p through our office, the applicant can
either reduce the _p to 4 lots, whereby we can then process the _p as a minor
subdivision and need nothing more than 6 copies of the map, 3 for our files and
3 to be returned to the applicant.
If the map is to be resubmitted, as a 5 lot subdivision, we will require
the following:
1. Applications in duplicate (blue fOl'lllll)
2. 3 proper prints tar our records
3. a check for $17.50
4. Test well results, water and well driller'S certificate
