This will provide an adequate buffer to ensure that land use does not impact the wetlands. The following terms shall apply to the 100 foot wetland buffer: Clearing and cutting within this area shall be limited to that necessary for proper maintenance and removal of diseased, decayed or dead material and obnoxious plant species, Such clearing and cutting shall be subject to review by the Board of Trustees of the Town of Southold prior to clearing and cutting to insure proper maintenance and preservation of the natural buffer. 4- Construction and clearing on slopes greater that 10 percent shall incorporate the use of silt fencing or hay bales to minimize potential for storm water transport of soils. 5- Gutters, leaders and/or dry wells shall be provided for impervious surfaces on each of the lots. 6- The Declarant grants easements, defined in schedule B affecting Lots I, 2, 3 and 4 . As you know the health department required that all four wells be placed on the lots. The wells for lot 1 and lot 3 meet the requirements for depth and quality, however lots 2 and 4 have good water but do not meet the depth requirements. I am requesting that the Health Department grant approval for the road and lots 1 and 3 while the new wells are being drilled and tested during the next two weeks. The surveyer is in the process of drawing up the lot plans for health department review, I am requesting that an extension for the sketch approval be granted at this time. Except that a driveway may be constructed and Declarant or their assigns may use same as is necessary to travel to and from the building envelope areas depicted on the fina1 map 2- There shall be no further subdivision of any lot shown in the subdivision in perpetuity. 2.1 Development of lots contained in the minor subdivision shall be contingent on the availability of water and waste management approved by the Suffolk County Department of Health Services, 3- A 100 foot building set back from the wetland area shall be shown on the final map. This will provide an adequate buffer to ensure that land use does not impact the wetlands. The following terms shall apply to the 100 foot wetland buffer Clearing and cutting within this area shall be limited to that necessary for proper maintenance and removal of diseased, decayed or dead material and obnoxious plant species. Such clearing and cutting shall be subject to review by the Board of Trustees of the Town of Southold prior to clearing and cutting to insure proper maintenance and preservation of the natural buffer. 4- Construction and clearing on slopes greater that 10 percent shall incorporate the use of silt fencing or hay bales to minimize potential for storm water transport of soils. 5- Gutters, leaders and/or dry wells shall be provided for impervious surfaces on each of the lots. 6- The Declarant grants easements affecting Lots 1, 2, 3 and 4 . The easements hereinafter described shall be appurtenant to and shall pass with the title to every Lot to which the easement apply. Lots I, 2, 3 and 4 shall each have an easement, in common with others, 25 feet in width, extending from North Bayview Road to the Northern boundary of Lot 3 and extending ingress, egress, and installation, maintenance and inspection of utilities to the West boundary of Lot 4 as shown on the subdivision map as "ROAD" and flag Lot 4. The following is a list of my comments: 1. Drainage design. The proposed drainage design meets the minimum requirements ofthe Highway Code. The required storm drains should consist of eight (8') foot diameter x eight (8') foot deep leaching pools with concrete traffic bearing slabs that have cast iron grates & frames. The proposed leaching pools should be identical with the exception of solid concrete covers. All piping between storm drains and leaching pools shall be eighteen (18") diameter traffic bearing pipe. 2. The outside radius of stone blend pavement at the cul-de-sac should be a minimum of forty-four (44') feet. The inside radius should be twenty (20') feet. Tasks and completed activities are identified as follows: 1. Review Part I LEAF The parcel has been field inspected by CV A, and the LEAF has been reviewed and amended as necessary. A copy of same is attached. 2. Prepare Part II LEAF The Part II LEAF checklist has been comEleted and is also attached. Additional information concerning our findings is inc uded below. 3. Environmental and Planning Considerations The subject site has been inspected and environmental references concerning the site and area have been consulted. The site consists of 18.54 acres of land and is located on the south side of North Bar;ew Road in Bayview, Town of Southold, New York. The site is generally rectangu ar in shape and extends 1,695.39 feet south of North Bar1ew Road, Site width varies from 371.46 feet along North Bayview Road to 51 .33 feet along the southern property line. A freshwater wetlands occupies approximately 1 acre on the western-central portion of the site. The!eroposed action involves the subdivision of the land into 4 lots for single-family resi entlal use, Lot 1 of the proposed subdivision has been designed as an 11.3 acre lot and lots 2, 3, and 4 have each been desifed as 2.4 acre lots. Access to the lots will be gained via a proposed 25 foot wide y approximately 1,300 foot long roadway to be i~roved consistent with Town of Southold specifications, All of the proposed lots co orm to the minimum lot size and setback requirements under the existmg A- C zoning. The Southold T<lwn Planning Board adopted a resolution grant~ sketch site plan approval for the proposed project. As a condition of this aptfcrov , the building envelo~e of Lot 1 must be amended to be a similar size as t e building envelopes for lots 2, and 4 (48,000 to 55,000 square feet). Field inspection and reference review found the following with regard to site resources. The site was inspected and found to ~rimarily contain soils conducive to leaching -- Plymouth loamy sand, Carver and P ymouth sands and Riverhead sandy loam. Approximately 1 acre of the site is occupied by Muck (wetlands) which is poorly drained, The site has a to~ogr~hical relief of appr01omate118 feet, with a maximum he:et of a~proximate y 21 eet and a minimum height 0 apJroximately 3 feet. The su ace of t e site is gently rolling, with slopes between 5 an 15 percent adjacent to the freshwater wetlands area. An aerial photograph of the area taken around 1970 shows most of the site cleared and under agricultural use, with the exception of the western-central portion of the site adjacent to the wetlands which is wooded. At present, the western-central portion of the site is primarily occupied by oaks (scarlet, black, white, chestnut and post), with red maple near the wetlands bound~. The previously cleared portions of the site have become overgrown and are curren y occupied by oak species, black pine, red and white cedar, !cop-lar, and greenbriar. The site is anticipated to support various species of avian wi dhfe and small mammals. The elevation of groundwater beneath the site is about 4 feet above mean sea level (msl), resulting in a depth to water of between 0 and 17 feet. Sanitary ?,stems must be situated to ensure proper separation distance between the bottom 0 leaching pools and the water table. According to the North Fork Water Suppl~ Plan map, it appears that the site may be located within the Water Budget Area. imilarly, the Aldicarb Contamination Areas map, depicting areas havin& groundwater aldicarb concentrations over 7 uf,/l, appears to include the subject SIte, The site does not appear to be significant y impacted by nitrate contammation. If private wells are intended to be utilized by each of the lots for drinking water supply, adequate water source for each lot will have to be demonstrated to the satisfaction of the SCDHS. The lands to the east and west of the proposed lots are wooded and vacant. Lands to the north, west and east of the site are undevel~ed and are either wooded or occuried by freshwater wetland ve~etation. Akscin's ursery is located to the south 0 the SIte. A single-family dwe ling is located near the subject site's southeastern comer. The proposed project will not create an undue burden on environmental or community resources. It is recommended that the buildin~ envelope for Lot 1 be situated on the southern portion of the lot to ensure adequate se{laration distance between the bottom of sanitary leaching pools and the water table. Additionally, situating the building envelope as such would effectively concentrate development on the southern portion of the site. Pellicano: The following resolutions were duly adopted by the Southold Town Planning Board at a meeting held on Monday, January 29, 1996: BE IT RESOLVED that the Southold Town Planning Board start the lead agency coordination process on this unlisted action. BE IT RESOLVED that the Southold Town Planning Board grant sketch approval on the map dated November 13, 1995 with the following conditions: 1. The building envelope for Lot 1 shall be amended so that it is similar in size to the envelopes shown for Lots 2, 3 and 4. The area located outside of the building envelope for Lot 1 shall be contained in an Open Space Easement. The terms for the Open Space Easement Area shall be as follows: a. The said premises described as the Open Space Easement on the final map for Russell Pellicano will forever be kept open and free of all buildings and other structures, including any bill boards or other advertising premises. b. The natural resources and condition of the said premises shall remain undisturbed and in its natural state, and to this end no top soil, sand, gravel, rock or minerals shall be excavated or removed therefrom, no grading shall be conducted on the said premises and no planting or fill shall be placed upon the said premises, and nothing shall be permitted to occur on the said premises which would contribute to the erosion of the land, and no trees on the said premises shall be cut or removed and no other plants or vegetation on the said premises shall be destroyed or removed, except for the removal of such dead, dis- eased or decayed trees or vegetation which may be required for conservation or scenic purposes. Except that a driveway may be constructed and Declarants or their assigns may use same as is necessary to travel to and from the building envelope areas depicted on the final map. 2. There shall be no further subdivision of any lot shown in the subdivision in perpetuity. 3. A 100 foot building set back from the wetland area.shall be shown on the final map. This will provide an adequate buffer to ensure that land use does not impact the welands. The following terms shall apply to the 100 foot wetland buffer: Clearing and cutting within this area shall be limited to that necessary for proper maintenance and removal of diseased, decayed or dead material and obnoxious plant species. Such clearing and cutting shall be subject to review by the Board of Trustees of the Town of Southold prior to clearing and cutting to insure proper maintenance and preservation of the natural buffer, Sketch Plan approval is conditional upon submission of final maps within six months of the date of sketch approval, unless an extension of time is requested by the applicant, and granted by the Planning Board. The final maps, 2 mylars and five paper prints, must contain a current stamp of Health Department approval, and must be submitted before a final public hearing will be set. Road profiles and drainage plans must be submitted, prior to the final submission, for review by the Planning Board, Engineering Inspector and Suffolk County Planning Commission. The terms for the Open Space Easement and conditions 2 and 3 on the conditional sketch approval must be incorporated into a Declaration of Covenants and Restrictions in proper legal form. Once the document is approved, it must be filed in the office of the County Clerk prior to any endorsement of the map by the Chairman. The following items must be included in the Declaration of Covenants and Restrictions: 1. The Declaration must provide for access over the road to the interior lots and must address maintenance of the road, 2. The following paragraphs must be included in the Declaration: a, The Declarants reserve the right to the exclusive use of the said premises described as the Open Space Easement on the final map for Russell Pellicano insofar as such use is not inconsis- tent with the covenants and agreements hereinabove set forth, and the Declarants may exclude the general public or any person or persons from the use of the said premises described as the Open Space Easement on the final map for Russell Pellicano except that the Town of Southold shall have the right to inspect the said prem- ises described as the Open Space Easement on the final map for Russell Pellicano for the purpose of assuring itself that the covenants and agreements are not being violated, such inspection to be at reasonable times and by mutual arrangement, if possible. b. The Declarant grants the continuing right in perpetuity to the Town of South old or any of its designated representatives to inspect any areas designed as open space, common areas or any similar nomen- clature so as to insure continued compliance with the covenants, terms and provisions designated herein in regard to same and to insure that such covenants, terms and provisions have not been violated, c. Declarant grants the continuing right in perpetuity to the Town of Southold or any of its designated representatives to enforce the conditions and restrictions of the covenants as they relate to the open space, common area or nomenclature and to take any legal action it deems necessary to enforce the conditions and restric- tions of the covenants. These rights of inspection and enforcement shall be binding upon declarant, their heirs, executors, legal repre- sentatives, distributees, successors, assigns and transferees. L . . These covenants and restrictions can be modified only at the request of the then owner of the premises with the approval of a majority plus one of the Planning Board of the Town of Southold after a public hearing. Adjoining property owners shall be entitled to notice of such public hearing, but their consent to such modification shall not be required. The sketch plans will be referred to the Suffolk County Planning Commission (SCPC) upon submission of the road and drainage plans. The Planning Board may require additional covenants and restrictions upon review of the SCPC report and review of the final maps. Therefore, it is not necessary to prepare the draft Declaration of Covenants and Restrictions at this time. The sketch plans have also been referred to the Southold Fire District for their recommendation as to whether a firewell is necessary for fire protection. You will be notified under separate cover if the Planning Board will be requiring a firewell as part of any subdivision approval. The Planning Board has reviewed the property and has decided that it is inadequate in size for a reservation of land for park and playground use. Therefore a cash payment in lieu of land reservation will be required as per Section A106-38 (E) of the Town Code, The amount to be deposited with the Town Board shall be $8,000.00 (two thousand dollars per lot for each vacant lot in the subdivision.)
