A change of zone for this parcel alone would result in a significant
imapct on the environment. As the Part III statement
reveals, the Town would put itself in a position of Vulnerability with
respect to other pre-existing non-conforming properties throughout the
Town. This proposal would also be in contradiction with the adopted
Master Plan and constitute spot zoning. If the Town wishes to further
consider this zoning change it should cause a generic EIS addressing
the above situations to be prepared by the applicant.

Impact on Growth and Character of Community or Neighborhood:
The proposed action will conflict with the officially adopted
Master Plan and the proposed zoning for the Town. It will also
cause a change in the possible density of land uses as well as
the permitted allowable uses. An important precedent will be
set for future change of zone requests similar nature where
pre-existing non-conforming buildings exist on site*. It would
lead to pressure from other landowners to request the same type
of spot zoning change. Clearly this is not the intent of the
existing or proposed zoning or of the Master Plan.
* This type of precendent would require a generic environmental
impact statement.
Impact on Transportation
A change in zone would permit a number of new uses to be
proposed that could be significantly more intense than the
existing uses and that could generate significantly more
traffic.

WHEREAS, George Kokkinos and Steven Tsokanos has heretofore applied to the
Southolct Town Board for a change of zone from "A" Residential and Agricultural
District to "B-l" General Business District on certain property located on the north
side of Route 25, east of Peconic Lane, Peconic, New York;
NOW, THEREFORE, BE IT RESOLVEO AS FOLLOWS:
1. That pursuant to the provisions of Article 8 of the Environmental Conserva-
tion Law; Part 617 of Title 6 of the New York State Codes, Rules and Regulations,
and Chapter 44 of the Southold Town Code, the Southold Town Board, as lead agency,
does hereby determine that the action proposed is unlisted and is likely to have a
significant effect on the environment.
2. That the Town Clerk shall file and circulate such determination as required
by the aforementioned law, rules and code.
3. That the Town Clerk immediately notify the applicant, George Kokkinos
and Steven Tsokanos, of this determination, and further request said applicant to
prepare aGeneric Environmental Impact Statement, all in accordance with said law,
rules and code.
4. In accordance with Chapter 44, Section 20 and Part 617 NYCRR, the
applicant is required to defray the cost of reviewing lheGeneric Environmental
Impact Statement, which includes a scoping session, therefore, the Town Board
determines that a deposit of $2,000.00 shall be paid to the Town Clerk prior to
the date of the scoping session.

Pursuant to the requirements of Sections A14-14 to 23 of the Suffolk County
Administrative Code, the Suffolk County Planning Commission on November 2, 1988,
reviewed the above captioned application and after due study and deliberation
Resolved to disapprove it because of the following reasons:
It is inconsistent with the pattern of zoning in the surrounding area
and therefore must be considered as "spot zoning";
It constitutes the unwarranted further perpetuation of strip business
zoning along Main Road (N.Y.S. Rte. 25);
It would tend to establish a precedent for further such downzonings in
the locale along Rte. 25;

It would tend to establish a precedent for the continuance of such a
practice for other nonconforming uses throughout the Town of Southold;
It contravenes policy objectives setforth in the recent Town of Southold
Master Plan update which calls for the discontinuance of strip business
zoning outside hamlet centers along the Towns major corridors; and,
It is inconsistent with the recent Town Master Plan update which
designates this area for agricultural/residence purposes.

Impact on Growth and Character of Community or Neighborhood:
The proposed action will conflict with the officially adopted
Master Plan and the proposed zoning for the Town. It will also
cause a change in the possible density of land uses as well as
the permitted allowable uses. An important precedent will be
set for future change of zone requests similar nature where
pre-existing non-conforming buildings exist on site*. It would
lead to pressure from other landowners to request the same type
of spot zoning change. Clearly this is not the intent of the
existing or proposed zoning or of the Master Plan.
* This type of precendent would require a generic environmental
impact statement.
Impact on Transportation
A change in zone would permit a number of new uses to be
proposed that could be significantly more intense than the
existing uses and that could generate significantly more
traffic.

Dear Ms. Terry:
I am in receipt of the Planning Board's letter of
October 18, 1988, wherein it recommends that the above-referenced
application be denied.
The basis of the Planning Boards recommendation is the
proposed Master Plan's zoning for this parcel. To base a re-
con~endation upon proposed ordinances which may never be adopted
is both erroneous and unlawful.
The realities of the situation are that this parcel is,
and has for a substantial period of time, been used for business
purposes. These uses include the rental of one of the buildings
to the Town of Southold.
The proposed change of zone merely validates that which
already exists. Any denial of this application based on the
proposed Master Plan is contrary to the law and will be treated
as such.
