Box 1179 Southold, New York 11971 Fax (631) 765-6145 Telephone (631) 765-1800 southoldtown.northfork.net OFFICE OF THE TOWN CLERK TOWN OF SOUTHOLD THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 356 OF 2004 WAS ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON APRIL 20, 2004: WHEREAS, there was been presented to the Town Board of the Town of Southold, Suffolk County, New York, on the 23~ day of March 2004 a Local Law entitled "A Local Law in Relation to Exceptions to Site Plan Approval in the Hamlet Business (HB) District in Chapter 100 of the Zoning Code of the Town of Southold"; and WHEREAS the Town Board of the Toxvn of Southold will held a public hearing on the aforesaid Local Law at which time all interested persons were given the opportunity to be heard, noxv therefore be it RESOLVED that the Town Board of the Town of Southold hereby enacts the following Local Law: A Local Law entitled, "A Local Law in Relation to Exceptions to Site Plan Approval in the Hamlet Business {HB) District in Chapter 100 of the Zoning Code of the Town of Southold" LOCAL LAW NO. 11 OF 2004 BE IT ENACTED, by the Toxvn Board of the Town of Southold as follows: I. Purpose - Prior to the enactment of Local Law No 10 of 2003, buildings, structures and uses owned or operated by the Town of Southold, school districts, park districts and fire districts were permitted uses not subject to site plan approval by the Planning Board. This Local Law restores this exception to site plan approval, xvhich was inadvertently eliminated by the adoption of Local Law 10 of 2003. II. Chapter 100 of the Zoning Code of the Town of Southold is hereby amended as follows: § 100-91. Use regulations. In the HB District, no building or premises shall be used and no building or part of a building shall be erected or altered which is arranged, intended or designed to be used, in whole or in part, for any uses except the following: A. Permitted uses. The following are permitted uses and, except for those uses permitted under Subsection A(1), A(2), A(3) and A(20) hereof, are subject to site plan approval by the Planning Board: (3) Buildings, structures and uses owned or operated by the Town of Southold, school districts, park districts and fire districts. III. Severability. If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not effect the validity of this law as a whole or any part there of other than the part so decided to be tmconstitutional or invalid. IV. Effective Date. This Local Law shall take effect inm~ediately upon filing with the Secretary of State as provided by law. Strike-through represents deletion. Underline represents insertion. "Due to Lxpographical eh'or during a code amendment in 2003, buildings, structures and uses owned and operated by the Town of Southold. school districts, park districts and fire districts are now subject to site plan approval by the Plalming Board. The Planning Board agrees that these buildings, structures and uses should be exempt from the site plau approval process." And [ have a communication from the County of Suffolk, to whom this local law was referred and they essentially say that the Colnlnission considers this to be a matter of local determination as there is no apparent significant county-wide or inter-community impacts. I have a notice that it has appeared on the Town Clerk's bulletin board outside and it has appeared as a legal in the local papers. No further communications.
