BE IT ENACTED, by the Town Board of the Town of Southold as follows:
Section I. Legislative Intent.
In an effort to further the Town's goal of serving housing and business needs of the community, and to respond
to the assertions from the business community that there is an insufficient supply of Light Industrial (LI) zoned
property in the Town, the Town Board requested the Town Planner to prepare a Survey of the Light Industrial
Park/Planned Office Park(LIO) property within the Town to review its uses and requirements. Based on the
findings and recommendations of this Survey dated December 2003, the Town Board has determined that it is
necessary and desirable to change the zoning district designated for a certain parcel of Light Industrial
Park/Planned Office Park(L[O) to Light Industrial(LI), thereby creating more available locations for business
owners in the Town.
Section 2. Enactment.
Therefore, based upon the goals and identified needs of the Town, and upon our consideration of the
recommendations and comments of the Town Planning Board, the Suffolk County Planning Commission, the
environmental consultant retained by the Town and the public comment taken at the public heating and
otherwise, we hereby change the zoning district designation fbr part of parcel known as Suffolk County Tax
Map (SCTM) #1000-96-1-1 ¢rom the Light Industrial Park/Planned Office Park (LIO) Designation to the Light
Industrial(L I) Zoning District Designation. The property is approximately fifteen (l 5) acres, is located on the
northeast corner of Depot Lane and County Route 48, Cutchogne, and is more particularly described as follows:

NOTICE IS HEREBY FURTHER GIVEN that pursuant to Section 265 of the Town Law
requirements of the Code of the Town of Southold, Suffolk County, New York, the Town Board of the
Town of Southold will hold a public hearing on the aforesaid local law at the Southold Town Hall,
53095 Main Road, Southold~ New York at 8:05 p.m, Tuesday~ March 23rd~ 2004. The purpose of
this Local Law is to change the Zoning District Designation of p/o SCTM# 1000-96-01-01 fi.om Light
Industrial Park/Planned Office Park (LIO) to Light Industrial (LI). The petitioner for this request is the
Town Board of the Town of Southold. The property is approximately 15 acres and is located on the
northeast comer of Depot Lane and County Route 48, Cutchogne, New York.
I have several communications on this. One is a note from the Department of Planning of the County
of Suffolk, "Pursuant to requirements of Sections A 14-14 to 23 of the Administrative Code, this
application submitted to the Suffolk County Planning Commission is considered to be a matter for
local determination as there is no county-wide or inter-community impact." And incidentally, I have
also certification that this has appeared in the local newspaper as a public notice but as a legal and it

has also appeared on the Town Clerk's bulletin board outside. The Southold Town Planning Board has
responded in a memo dated March 19, 2004, "In December, 2003 a survey of Light Industrial Office
Zoning was conducted. The purpose of the survey was to identify property within the Toxvn that were
zoned Light Industrial Office (LIO) and to review the uses and requirements of the district. The survey
xvas intended to assist the Town Board in its effort to respond to assertions from the business
community that there was an insufficient supply of LI zoned property to meet the demand and to find
suitable properties to rezone to LI. The report found that the demand for LI zoned land presently was
greater than that for LIO zoned land and it provided a rationale for rezoning some of the LIO zoned
land to LI (as opposed to rezoning A-C Agricultural Conservation land to LI). The report found 16
parcels of land encompassing 190.8 acres in the LIO zoning category. The bulk of these lands were in
Cutchogue, just west of the capped landfill, recycling and transfer station. Within this area, one parcel
encompassing 28 acres was the subject of an application to be subdivided into an industrial park under
the LIO designation. In anticipation of final approval on this subdivision, the developer had received
permission to construct the internal access road. As a result, all the parcels within this yet-to-be
approved industrial park have the potential for good internal road access to CR 48 via Depot Lane.
Access to public water at this time can be made on a lo-by-lot basis for permits for private wells from
the Suffolk County Department of Health Services or failing that, by amending the water main map.
The land is flat and suitable for development in light industrial uses. The Planning Board supports the
rezoning of the southern part of the subject parcel as described in the heating notice." I believe that
that is the all the relevant information and communications that I have on this heating.
SUPERVISOR HORTON: Thank you, Councilman Wickham. Are there comments from the floor on
this public hearing?
HENRY RAYNOR: Good evening, Mr. Supervisor and members of the Board, my name is Henry
Raynor and I am one of the principals of the group of the parcel in question and obviously xve go on
record in favor of this, especially with the Town Board's initiation with the change of zone, it basically
allows a small business person in the Town the opportunity for equity and the fact that they can own
their own parcel here in the township. With regard to Mr. Wickham's comment about the private wells
being able to sustain and being approved, they are not all approvable under the Suffolk County
Department of Health Services, some are on the property, some are not and that is primarily the reason
our group has sought to connect to Suffolk County Water Authorities pipeline, which exists on our
southern perimeter at this point. And I guess that really brings up the crux of the situation with regard
to the change of zone. All of this would become rather academic should we not be able to tie into
public water and I just offer this for the Board's consideration and I appreciate the Board's
consideration and concern for everyone involved here, especially the small business person in the
Town of Southold.
SUPERVISOR HORTON: Thank you, Mr. Raynor.
MR. RAYNOR: If you have any questions, I would be happy to field them.
SUPERVISOR HORTON: I just want to note that the Board, xvho in recent weeks has actively
commenced discussion about the issue of water to the property and that is something that the Board is
going to address in the near future. Your point is well made about that. There is a water main in front
of the property and the records show that the Health Department wouldn't approve wells on the entire

property, so that is something that the Town Board is actively addressing in conjunction with the
Water Authority.
MR. RAYNOR: Good. If there is any way that we can expedite that with the town, we xvould be more
than happy to cooperate. Thank you.
SUPERVISOR HORTON: Thank you. Are there other conunents from the floor on this particular
public hearing? Yes, Mr. McCarthy.
TOM MCCARTHY: Good evening, Mr. Supervisor, members of the Board. Tom McCarthy,
Southold. I would just like to speak in favor of the change of zone from LIO to LI, I think it is a wise
decision on the Town Board's point of view. You are taking three acre minimum lot size, bringing it
down to one acre which means you are going to be multiplying the number of local residents that you
can take the same piece of land and give ownership back to the local people so, on the same piece of
land you are going to multiply or at least have the ability to multiply the number of owners by three
without any real impact to the land itself. I am certainly in favor of it as a local resident and hope that
you would move forward to doing whatever is necessary to extend public water and make that
available to the project to make it fly. Thank you.
SUPERVISOR HORTON: Thank you, Mr. McCarthy. Are there other comments from the floor?
Yes.
MELANIE NORDEN: Melanie Norden, Greenport. With respect to the water issue, if in fact wells
are going to be used opposed to extending public water, will there be any definition or re-definition of
use based on what is going to happen on the property? Obviously...
SUPERVISOR HORTON: No.
MS. NORDEN: What do you mean, no?
SUPERVISOR HORTON: If the Health Department approves wells, then they approve the wells.
MS. NORDEN: Right but if there are wells or if there is public water, it would make a difference in
terms of industrial uses.
SUPERVISOR HORTON: No, if the Health Department, if the property, if the Health Department,
again we don't have any jurisdiction over approval o f wells.
MS. NORDEN: I understand. I understand that.
SUPERVISOR HORTON: So if the Health Department says that these wells are, that the property is
suitable for xvells or the water is suitable for private wells ....
MS. NORDEN: Right.
SUPERVISOR HORTON: Then that ....

MS. NORDEN: And the Health Department, but I mean will they be taking into consideration not the
suitability of the property for private wells but the suitability of the property for industrial uses with the
use of private wells?
SUPERVISOR HORTON: I don't know how the Health Department gauges xvhether or not private
wells are suitable or not. I don't know the science behind that.
COUNCIl_MAN ROMANELLI: The Health Department is looking at the quality of the well for
potable drinking water. That is what they are looking at. They are not looking at industrial use that is
going to be used on that piece of land and if that water is good for that use. They are looking to say
that that land is going to be developed, there is going to be bathrooms, there are going to be sinks,
there is going to be potable water and that water needs to be clean and drinkable. If the wells don't
pass, then they need public water. And I will be quite honest with my intention to help this project be
facilitated with public water because the water main is in front of their property. We are talking
bordering the property there is a water main. We should stop playing games with the well situation
and deal with the water main.
MS. NORDEN: No, I understand that and probably ! think a number of people would support that but
the question that I have is, if we are talking about a major industrial use, then we are talking about
being able to look much more thoroughly than potable water. In other words, who looks at that, if the
Board of Health doesn't look at that ....
COUNCILMAN ROMANELLI: Our Planning Board and our site plan and our zoning code and the
uses allowed in those zoning codes.
MS. NORDEN: I understand that but how can you make this kind of a decision in terms of
appropriating land for industrial use if you really don't know what is going to happen to the water and
the land underneath it until you know what the uses are going to be?
COUNCILMAN ROMANELLI: Well that is what we have the zoning code for. With defined uses,
allowable uses and non-allowable uses, usable uses by special exception. That is what we have site
plan for, that is what all those processes are for.
MS. NORDEN: So basically you will approve the property based on the fact that wells could be used
or Suffolk County water will be used but xvith no knowledge of what that will do to the underground
aquifer system?
SUPERVISOR HORTON: That is xvhere the Health Department ....
MS. NORDEN: Yeah, but if the Health Department doesn't know the purposes. I mean, John has just
said that the Health Department is only going to address potability.
SUPERVISOR HORTON: The Health Department has standards for commercial properties. And the
water has to meet those standards for commercial properties.

COUNCILMAN ROMANELLI: And each industry is going to be regulated by xvhatever industry
regulates them. I myself am regulated by the Health Department. Farmers are regulated in large part
by DEC, depending on what goes on there. But we have specific uses allowed in our code for Light
Industrial purposes. When we create Light Industrial land, we are assuming that the uses that we have
in our code are going to be allowable in that Light Industrial parcel.
SUPERVISOR HORTON: Right.
MS. NORDEN: Thank you.
