The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The work would involve dredging, by clamshell bucket, with ten years maintenance, material from the entrance to the marina and within the marina area itself to a depth of 4 feet below mean water, removing approximately 2,400 cubic yards of material. Two additional dredging events for the marina area and five additional dredging events for the entrance to the marina are anticipated during the ten year life of permit, removing an unspecified quantity of material dependent solely on the severity of storms especially during winter months, but not expected to exceed 2,400 cubic yards. Material from initial and subsequent dredging events would be used as backfill behind the existing bulkhead and/or placed no less than 10 feet above the mean high water line for dune stabilization. The applicant also proposes to repair and/or replace deteriorated floats and install two new 3 foot by 20 foot finger floats. During the dredging operation, the permittee and his contractor shall make every effort to restrict spillage of sediment during excavation and haulage. Dredging shall be accomplished with a clam shell or other closed "bucket" equipment. 3. ~o dredging will occur within 15' of the seaward edge of the intertidal marsh located in the northeast end of the basin, just south of the East Channel bulkhead . 4. There shall be no disturbance to vegetated tidal wetlands as a result of the permi[ted activity. 5. Dredging is specifically prohibited from June ~ through September 30 each year to protect spawning shellfish. 6. For maintenance dredging projects permittee shall yearly submit a Notice of Commencement specifying spoil (updated site plan) and Notice of Completion specifying amount of dredged material deposited on beach or approved spoil site. 7. All peripheral rip rap berms, cofferdams, rock revetment, gabions, bulkhead etc.., shall be completed prior to placement of any fill material behind such structures. 8. Ail repairs to existing structures shall be confined to replacement of existing structural elements with no change in design, dimension, or mateC~als, unless specifically authorized herein. 9. I Page 3 of 4 SUPPLEMENTARY SPECIAL CONDITIONS The following conditions apply to all permits: ae If any of the permit conditions are unclear,the permittee shall con- tact the Division of Regulatory Affairs at the address and telephone noted below. A copy of this permit with supplementary conditions and approved plans shall be available at.the project site whenever authorized work is in progress. The permit sign enclosed with the permit or a copy of letter of approval shall be protected from the weather and posted in a con- spicuous location at the work site until completion of authorized work. At least 48 hours prior to commencement of the project, the permittee shall complete and return the top portion of the enclosed receipt form certifying that he is fully aware of and understands all provisions and conditions of this permit. Within one week of completion of the permitted work, the bottom portion of that form shall also be com- pleted 6nd returned. For projects involving activities to be accomplished over a period of more than one year, the permittee shall notify the Regional Permit Administrator in writing at least 48 hours prior to the con~'encement of resumption of work each year. If project design modifications take place after permit iEs6ance, the permittee shall submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modi- fications. The applicant would replace, within 18 inches, 350 linear feet of timber bulkhead on the southern end of the project site, and would also repair, where necessary, 200 linear feet of timber bulkhead on the eastern end of the project stte. The applicant also proposes to maintenance dredge to 4 feet below the level of mean low water an irregular shaped area in front of the bulkheads. Approximately 300 cubic yards of dredged material would be removed Initially and used as backfill for the reconstructed bulkheads. Any surplus and all future dredged material, approximately 60 cubic yards every 2 years for the life of the 10 year dredging permit, would be placed above the spring high tide line for beach dune stabilization and reinforcement; these dunes erode every year due to winter storms.
