WHEREAS, Patricia C. Moore, Esq. on behalf of Glenn Behr applied to thc Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated February 25, 2003 WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on March 18th, 2003 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with thc premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code. 2 WHEREAS, the Board has determined that the project as proposed will not affect the health, Safety and general welfare of the people of the town. NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approved the application of Patricia C. Southold 1000-79-8-15.2 (formerly owned by Glenn Behr) Wetlands Permit # 5730 (dated March 18, 2003) Dear Trustges: The previous owner, Mr. Behr, obtained a wetlands permit for a proposed inground swimming pool at the address above. Mr. Behr recently sold the property to Mr. Chicco who wants to go ahead with the pool using the existing permit. I was recently informed by the real estate agent that Mr. Behr had previously started digging the pool, but because the pool was never completed prior to the house sale, the previous pool company filled in the hole. The problem now ~s we do not know to what extent the area has been disturbed, thereby making it risky to try and construot a pool in the same location. In addition, the ne~v homeowners want to move the pool further away from the house for safety concerns because of their V. vo small children. Thuz, we are asking permission to set the pool approximately 30 to 40 feet offthe house. We would strictly abide by the fifty-foot non-disturbance buffer from the wetlands line. Also, the homeowner would like to change the shape from a free form to a rectangle, so that fewer trees need to be removed and there would be less overall disturbance to the yard, as we would be decreasing the square footage from 918 square feet (27X34 free form, as permitted) to 720 square feet (18X40 rectangle requested). Again, all construction would remain well within the appropriate building envelope and away from the non- disturbance buffer. Thapk you for consideration in this matter.
