Dear Ms. Cook,
The Board of Trustees is in receipt of your letter of January 27, 2005. The Trustees have
inspected your property and have determined that it is not fresh water wetlands. There are
no freshwater wetland indicator plant species on your property. The plan that you
describe in your letter to drain the area has been approved by Trustee Artie Foster.
Therefore, your property does not come under the jurisdiction of the Board of Trustees.
We will send a copy of this letter to the Planning Department, Building Department, and
Zoning Board of Appeals.

I am writing to voice our objections to the proposed division of the Cook property.
The current total area of the lot is 20,896 sq. fi. and is a grandfathered non-conforming
lot size. By waiving the merger and granting a variance for the lot line changes you
would now create two non-conforming lots in an already developed area.
The purpose of this application of Ms. Cook I presume would be to produce a lot on
which to build a home. This would entail putting in many cesspools in an already
environmentally sensitive area. With the water table high in this area the impact of the
new subdivided lot with a possible future home could result in our abutting property
becoming flooded and or contaminated.

Request for comments on Donna Cook Variance Application

The Planning Board has reviewed the variance application for the above-referenced properties
and offers the following comments and/or recommendations at this time: ',,
I. The subject properties were merged in accordance with the merger provision of
the Zoning Code of the Town of Southold (Section 100-25). The primary
objective of the merger law is to bring nonconforming lots into compliance with
the bulk schedule requirements of the Zoning Code.
2. The total area of the lot is 20,896 sq.ft., where 40,000 sq.ft, is the minimum
required in the R-40 Zoning District. If the ZBA approves the waiver of merger
and grants the variances for the lot line change, parcel 1 will be approximately
7,500 sq.ft, and parcel 2 will be approximately 13,500 sq.ft.
3. Planning staffconducted an inspection of the property to verify the presence of
wetlands on the southern lot. A copy of the aerial photograph is attached which
clearly shows a wetlands pocket covering a large portion of the southern lot.
Once appropriate setbacks are applied, it is clear there is little, if any, buildable
area on this property. Accordingly, the Planning Board finds that even if a
waiver of merger is approved by the ZBA, it may be difficult to obtain permits to
develop the lot. Construction of a single-family residence may require permits
and/or approvals from the Town Trustees, the Suffolk County Department of
Health Services and the New York State Department of Environmental
Conservation.
For the reasons stated above, the Planning Board recommends the ZBA coordinate review with
the To,am Trustees to determine xvhether or not they have jurisdiction over the proposed project.

Dear Ms. Cook,
A recent site inspection of your property revealed the recent clearing of vegetation ~vithin
the scrub-shrub xvetland on the rear of your property. This is to notify you that you are in
violation of Chapter 97 of the Tox~m Code regarding Wetlands on the above referenced
property.
According to Chapter 97 any activity within 100' of a wetland requires a permit fi.om this
office. Be advised, that there is to be no further clearing in or around the wetland/scrub-
shrub area on your property without first obtaining a permit for the action. Any further
activity within the wetland may result in a monetary fine up to $4000.00.

I am writing to you concerning my property at 425 Private Road 12.
I have an area in the rear of the property that now holds water when it rains or
snows. At least once in 2004, when the rain was severe, this wet area became
large enough to reach one neighbors house and extended over three
neighboring properties. It dries completely when the weather allows. It became
this severe about 2 years ago when a neighboring property was re-graded and a
new house was built on it. Also, my front property slopes down from Main
Bayview Road to this area in the rear. The highway department put a "lip" on
the edge of Main Bayview Road to help with runoff. The corner of Main Bayview
Road and Waterview Drive has had this same flooding problem for more than 10
years, when heavy rains cause standing water that covers most of the road.
My property has mostly clay and compacted soil. This area was covered in
poison ivy, evergreen trees, thorny wild rose bushes, apple trees, honeysuckle
vines, some other long thick vines that grow under and over the ground, a
couple of trees that I don't know the name of and some bushes that I also don't
know the name of. Some of this vegetation was dead or choking from the vines
and poison ivy. There is grass growing that gets cut during the summer. I have
family video pictures from as long ago as 1994 that shows what was growing
there before ! cleared it.
I called local landscape and drainage companies about fixing this problem.
They said I had to remove all the vines and vegetation to loosen up all the clay
and packed soil. They would bring in gravel and sand to fill in the Iow areas and
then come back to put top soil over everything. This will aerate the soil and give
the water somewhere to go. I also had other suggestions from some neighbors
about how to fix it. In March or so I started clearing out the property and finished
by the end of November. I left the apple trees, some bushes, some evergreen
trees and honeysuckle vines. I moved some of the exposed clay to another area
of the property, leaving some indents in the ground that holds the water. This is
where the gravel and sand will go. The top soil wilt level everything and bring
the elevation back up to where it was and where it's supposed to be.
In 2001 I applied for a building permit and in 2002 I applied for a variance.
During this process I contacted different Southold Town Departments
questioning whether there were any concerns with water that I would need to
address. There wasn't any water in my yard, but I thought t~
problem with how near I was to the creek and the canal.

Based on this information I have been doing work on my property without any
concern for wetlands. Now in the middle of eliminating this problem, I have been
told to stop or face large fines. I was notified that I may need a wetland permit
from your office, but this has never been considered wetlands before. I consider
this to be an annoying puddle that only recently became like this and needs to
be fixed. I am asking you to please consider it the same so I can continue with
what rve started.
If your office does consider this to be wetlands it will create more than one
hardship for me and it will continue to be a problem for some neighbors. Please
consider this information and notify me of your decision so I can find out how to
proceed with this.
